<section commented="no" display-inline="no-display-inline" id="H824C771534974B8DB1402D6321218E5E" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>District of Columbia Policing Protection Act</short-title></quote>.</text></section> 
<section id="H0572AC6A45E14FF78752D9AFF4E5671E"><enum>2.</enum><header>Vehicular pursuits by law enforcement officers in District of Columbia</header> 
<subsection commented="no" display-inline="no-display-inline" id="HC8CCB262D16F470D888144898F8B61EB"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline">The Comprehensive Policing and Justice Reform Amendment Act of 2022 (D.C. Law 24–345) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="HEEDE5E2A8A134A9997CB2E91B175F20B"><enum>(1)</enum><text display-inline="yes-display-inline">in subtitle S of title I—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H6DFBCB9FA098444BB989727AD9D7B7BA"><enum>(A)</enum><text display-inline="yes-display-inline">in the heading, by striking <quote><header-in-text level="subtitle" style="OLC">LIMITATIONS ON THE</header-in-text></quote>;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H40D80EC69EC64E35B2D5E0DD941A491A"> <enum>(B)</enum> <text display-inline="yes-display-inline">in section 127(a) (sec. 5–365.01(a), D.C. Official Code)—</text>
            <clause commented="no" display-inline="no-display-inline"

              <enum>(i)</enum>
 <text display-inline="yes-display-inline">by striking paragraphs (1) through (5);</text>
            </clause>
            <clause commented="no" display-inline="no-display-inline"

              <enum>(ii)</enum>
 <text>by redesignating paragraphs (6) and (7) as paragraphs (1) and (2), respectively;</text>
            </clause>

              <enum>(iii)</enum>
 <text>by striking paragraphs (8) through (11); and</text> </clause> <clause commented="no" display-inline="no-display-inline" id="HA1AF506078DA4A97AE7334AC539C7EB1"> <enum>(iv)</enum> <text>by redesignating paragraph (12) as paragraph (3); and</text>
            </clause>
          </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline"

            <enum>(C)</enum>
 <text>in section 128 (sec. 5–365.02, D.C. Official Code), by striking subsections (a), (b), and (c) and inserting the following:</text>

 <text display-inline="no-display-inline">If a law enforcement officer encounters a suspect fleeing in a motor vehicle, the officer shall engage in a vehicular pursuit of the suspect unless the officer, or a higher-ranking official with supervisory authority over the officer, reasonably believes that—</text>

                  <enum>(1)</enum>
 <text>vehicular pursuit would—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HC39B2CC65A254114866E1DD288DA175C"> <enum>(A)</enum> <text display-inline="yes-display-inline">entail an unacceptable risk of harm to a person other than the suspect; or</text>
                  </subparagraph>
                  <subparagraph id="H69C28421B5CF42C09FF3B64736662FAE">
                    <enum>(B)</enum>
 <text>be futile; or</text> </subparagraph> </paragraph> <paragraph id="HC8F31DDB66D54ECD8F989D2C925E3705"> <enum>(2)</enum> <text>the suspect can be apprehended more effectively or expeditiously by a means other than vehicular pursuit.</text>
                </paragraph>
              </section>

          </subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H5E3E277BB6484E7FA915B3F0A852F7E0"><enum>(2)</enum><text>in the table of contents, by striking the item relating to subtitle S of title I and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H77DDAC2D60A94CF0B6FEA94C98A3E0D8"> <toc> <multi-column-toc-entry level="subtitle" bold="on"><toc-enum>SUBTITLE S.</toc-enum><level-header level="subtitle">USE OF VEHICULAR PURSUITS BY LAW ENFORCEMENT OFFICERS</level-header><target>33</target></multi-column-toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection display-inline="no-display-inline" commented="no" id="HCF1FDB0E6ECE461DAECD7389219EB282"><enum>(b)</enum><header>Department of Justice report on PursuitAlert</header><text>Not later than 3 years after the date of enactment of this Act, the Attorney General shall—</text> 
<paragraph display-inline="no-display-inline" commented="no" id="H57759F762A1643C4AFC89F63E4F4D735"><enum>(1)</enum><text>evaluate the costs and benefits of the Metropolitan Police Department of the District of Columbia adopting PursuitAlert or another similar technology capable of alerting members of the public to the presence of a police pursuit in their immediate vicinity; and</text></paragraph> <paragraph display-inline="no-display-inline" commented="no" id="HC7EA74ADC17C4633A7C5D8CC981DDBDC"><enum>(2)</enum><text>publish a report on the evaluation conducted under paragraph (1) and submit the report to—</text> 
<subparagraph display-inline="no-display-inline" commented="no" id="H516BF8CCCC8748EAB63C384CC2110D20"><enum>(A)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate;</text></subparagraph> <subparagraph display-inline="no-display-inline" commented="no" id="H0F869A9DC9EE47D0BF21004E9A7097ED"><enum>(B)</enum><text>the Committee on the Judiciary of the Senate;</text></subparagraph> 
<subparagraph display-inline="no-display-inline" commented="no" id="HB04BCBDCA7914457A25BA0544E2512B1"><enum>(C)</enum><text>the Committee on Oversight of the House of Representatives; and</text></subparagraph> <subparagraph display-inline="no-display-inline" commented="no" id="H4C9EDDE7900B45A9B689704936D04832"><enum>(D)</enum><text>the Committee on the Judiciary of the House of Representatives.</text></subparagraph></paragraph></subsection></section>
