<section id="H4F5D0D5B8D964615A8E92DD202D51A6C" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hospitals As Naloxone Distribution Sites Act</short-title></quote> or the <quote><short-title>HANDS Act</short-title></quote>.</text></section> 
<section id="H7643B0BD3D2D470FB46698688C9BB8E0"><enum>2.</enum><header>No-cost coverage of preventive opioid overdose reversal drugs</header> 
<subsection id="HF4FCCB8B2D0045E9B116329441F45D61"><enum>(a)</enum><header>Coverage under Medicare</header> 
<paragraph id="HB48B0F0A07FE478880D51627AB90E65E"><enum>(1)</enum><header>Coverage</header><text display-inline="yes-display-inline">Section 1861(s)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(2)</external-xref>) is amended—</text> <subparagraph id="H22CC887B7E50418DB79FA7EC1D2B3AC6"><enum>(A)</enum><text>in subparagraph (JJ), by adding <quote>and</quote> after the semicolon at the end; and</text></subparagraph> 
<subparagraph id="H6A2BBD6146CF4DF1B5A84DBAEE750AD2"><enum>(B)</enum><text>by adding at the end the following new subparagraph:</text> <quoted-block style="OLC" id="H34513D2ACB2E4B1EA22E8F53E6189C24" display-inline="no-display-inline"> <subparagraph id="H61F58FC311BA4401AFDB5B15A411E659" indent="up1"><enum>(KK)</enum><text display-inline="yes-display-inline">a preventive opioid overdose reversal drug (as defined in subsection (nnn)) furnished on or after January 1, 2026;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H561C998A7D6947ED9A619445E19C5585"><enum>(2)</enum><header>Preventive opioid overdose reversal drug defined</header><text>Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended by adding at the end the following new subsection:</text> <quoted-block style="OLC" id="H74438E8EF5FC40B38DC1277505E5DAAE" display-inline="no-display-inline"> <subsection id="HF645602DB4694F7299A319B977ABAE25"><enum>(nnn)</enum><header>Preventive opioid overdose reversal drug</header><text display-inline="yes-display-inline">The term <term>preventive opioid overdose reversal drug</term> means an opioid overdose reversal drug, which may be either intranasal or intramuscular, that is furnished by a physician, nurse practitioner, physician assistant, or other attending clinical personnel (as determined by the Secretary by regulation) to an individual who is an inpatient of a hospital, critical access hospital, or rural emergency hospital, or is a patient of the emergency department of such a hospital or an ambulatory surgical center, but only if—</text> 
<paragraph id="H06EC5363FD844B168D1BF1A23EE05FCE"><enum>(1)</enum><text>such physician, nurse practitioner, physician assistant, or attending clinical professional determines that such individual is at risk for an opioid overdose; and</text></paragraph> <paragraph id="HE9996CFC9293473F8B31F67CFD6F7341"><enum>(2)</enum><text>such drug is furnished at the time such individual is discharged from the hospital or leaves the emergency department or ambulatory surgical center, as the case may be, together with instructions for the administration of such drug.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H72C14E179EDB4EA3BD38F49FCA4A845A" commented="no"><enum>(3)</enum><header>Prohibition of cost sharing</header><text>Section 1833 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l</external-xref>) is amended—</text> <subparagraph id="HF5BF398BEB934AF2A7AAB8E3B95E93CC" commented="no"><enum>(A)</enum><text>in subsection (a)(1)—</text> 
<clause id="H45D692C55C774B2DAD3BE9F4754915EC"><enum>(i)</enum><text>in subparagraph (S)(i), by striking <quote>subparagraph (EE),</quote> and inserting <quote>subparagraphs (EE) and (II),</quote>;</text></clause> <clause id="HACA385DA45E948178FD3425A4A05F296" display-inline="no-display-inline" commented="no"><enum>(ii)</enum><text>in subparagraph (GG), by striking <quote>and</quote> at the end; and</text></clause> 
<clause id="HC4BC2932C2EA4AD88F916DA264E968DF" commented="no"><enum>(iii)</enum><text>by inserting <quote>, and (II) with respect to a preventive opioid overdose reversal drug (as defined in section 1861(nnn)) furnished on or after January 1, 2026, the amounts paid shall be 100 percent of the lesser of the actual charges for such drug or the amount determined under section 1842(o)</quote> before the semicolon at the end; and</text></clause></subparagraph> <subparagraph id="H4B516FEE28B34889A1BA17A9D540713F" commented="no"><enum>(B)</enum><text>in subsection (b)—</text> 
<clause id="H144A493DFA9F41F9B3DEC4383852370A" commented="no"><enum>(i)</enum><text>by striking <quote>, and (13)</quote> and inserting <quote>(13)</quote>; and</text></clause> <clause id="H455FFEEE8196458CA32E7D084D0DA39D" commented="no"><enum>(ii)</enum><text>by striking <quote>section 1861(n)..</quote> and inserting <quote>section 1861(n), and (14) such deductible shall not apply with respect to a preventive opioid reversal drug (as defined in section 1861(nnn)) furnished on or after January 1, 2026.</quote>.</text></clause></subparagraph></paragraph> 
<paragraph id="HBA0CF01051444523A6F00508AF617899"><enum>(4)</enum><header>Prohibition of cost sharing for Medicare Advantage plans</header><text>Section 1852(a)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-22">42 U.S.C. 1395w–22(a)(1)(B)</external-xref>) is amended—</text> <subparagraph id="HF8C8D55E78DF4060A5FB63AC36BF1C23"><enum>(A)</enum><text>in clause (iv)—</text> 
<clause id="HD7925106196A429D99C61E91D1C195AD"><enum>(i)</enum><text>by redesignating subclause (VIII) as subclause (IX); and</text></clause> <clause id="H42288F0081D04362B40F1A267375CD18"><enum>(ii)</enum><text>by inserting after subclause (VII) the following new subclause:</text>

<subclause id="H88BACF5FA2304A5B8764DA12D1D3D7C4"><enum>(VIII)</enum><text display-inline="yes-display-inline">A preventive opioid reversal drug (as defined in section 1861(nnn)).</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> <subparagraph id="H7A4D9054E47B4CC5AAB0DEC5EC927E78"><enum>(B)</enum><text>in clause (v), by striking <quote>and (VI)</quote> and inserting <quote>(VI), and (VIII)</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H290C1AC340D040748B9199EF828F3D0A"><enum>(b)</enum><header>Coverage under Medicaid</header> 
<paragraph id="HB342CF2AAD454F718B0AFB5337B442E9"><enum>(1)</enum><header>Mandatory coverage</header> 
<subparagraph id="H8E2F6EAA50DC42DD9E5A444565E283F5"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1902(a)(10)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)(A)</external-xref>) is amended by striking <quote>and (30)</quote> and inserting <quote>(30), and (32)</quote>.</text></subparagraph> <subparagraph id="H49123B766C314F9B90E0F4D8C05C9C35"><enum>(B)</enum><header>Alternative benefit plans</header><text display-inline="yes-display-inline">Section 1937(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396u-7">42 U.S.C. 1396u–7(b)</external-xref>) is amended by adding at the end the following new paragraph:</text>

                                <header>Preventive opioid overdose reversal drugs</header>
 <text display-inline="yes-display-inline">Notwithstanding the previous provisions of this section, a State may not provide for medical assistance through enrollment of an individual with benchmark coverage or benchmark-equivalent coverage under this section unless, beginning on January 1, 2026, such coverage includes (and does not impose any deduction, cost sharing, or similar charge for) preventive opioid overdose reversal drugs described in section 1861(nnn).</text>
                            </paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H0B12ABFC30274F3B9C633A2814223199"><enum>(2)</enum><header>Inclusion in medical assistance</header> 
<subparagraph id="H14DE9123E6C342D09F15488C8DC99D56"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1905(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)</external-xref>) is amended—</text> <clause id="H6F32F0C2ECA247A3813837E740FADE97" display-inline="no-display-inline"><enum>(i)</enum><text>in paragraph (31), by striking <quote>and</quote> at the end;</text></clause> 
<clause id="H8616F4F2DD3D461FA9DAA0E6E3FAC531"><enum>(ii)</enum><text>by redesignating paragraph (32) as paragraph (33); and</text></clause> <clause id="H2C2426C28F714ED88597DA2CFF2710F9"><enum>(iii)</enum><text>by inserting after paragraph (31) the following new paragraph:</text>

<paragraph id="H7DF06E33E121423081783C6040482989"><enum>(32)</enum><text display-inline="yes-display-inline">beginning January 1, 2026, preventive opioid overdose reversal drugs described in section 1861(nnn); and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph> <paragraph id="H6732CA623E4249868B4D244849FB14EF" commented="no"><enum>(3)</enum><header>Application of rebate requirements</header><text>Section 1927 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-8">42 U.S.C. 1396r–8</external-xref>) is amended—</text> 
<subparagraph id="H0258EDB350684D55AA3D2E1E2BEAE08D" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (d)(7), by adding at the end the following new subparagraph:</text> <quoted-block style="OLC" id="H9998853AF0E44D23A97887A635289D4F" display-inline="no-display-inline"> <subparagraph id="H054658502DCD4C03B7A31D41F260C596" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">Preventive opioid overdose reversal drugs described in section 1861(nnn) that are furnished as medical assistance in accordance with section 1905(a)(32) and section 1902(a)(10)(A).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H081D1C9CF7A348169491315785A35505" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>in subsection (k)(4)—</text> <clause id="H340994D8E98347559EAA1B761A772BCD" commented="no"><enum>(i)</enum><text>by striking <quote>If a State plan</quote> and inserting:</text>

<subparagraph id="HAA442A95057647628A008387B6EA3A78" commented="no"><enum>(B)</enum><header>Preventive opioid overdose reversal drugs</header><text display-inline="yes-display-inline">Beginning January 1, 2026, in applying paragraph (2)(A) to a preventive opioid overdose reversal drug described in section 1861(nnn), such drug shall be deemed a prescribed drug for purposes of section 1905(a)(12).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph> <paragraph id="HD27EB9245A7D41DF81B84B243114D86E" commented="no"><enum>(4)</enum><header>Prohibition of cost sharing</header> <subparagraph id="H70C728DC55A84E38B761E0C183FDE119" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1916 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396o">42 U.S.C. 1396o</external-xref>) is amended—</text>

<subparagraph id="H9C6D9530A08D4AA195E51706B73C9FCD" commented="no"><enum>(B)</enum><header>Application to alternative cost sharing</header><text display-inline="yes-display-inline">Section 1916A(b)(3)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396o-1">42 U.S.C. 1396o–1(b)(3)(B)</external-xref>) is amended by adding at the end the following new clause:</text> <quoted-block style="OLC" id="H0C1F44C9468E4AC7B4FE6DC6E141D64A" display-inline="no-display-inline"> <clause id="H2ADA5CE1EB834C389B7EBA3DB7E9E0A4" commented="no"><enum>(xv)</enum><text display-inline="yes-display-inline">Beginning January 1, 2026, preventive opioid overdose reversal drugs described in section 1861(nnn).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> 
<subsection id="HFCF6E93D3F79453E9CAC4D54BD1ECE81" commented="no"><enum>(c)</enum><header>Coverage under TRICARE</header><text>Section 1074g of title 10, United States Code, is amended as follows:</text> <paragraph id="H34D669B1C2134EBC935CB263280D3910"><enum>(1)</enum><text>In subsection (a)(6), by adding at the end the following new subparagraph:</text> 
<quoted-block style="USC" id="H7FB9F9E4B4164D30B5FBE546301F6EB4" display-inline="no-display-inline"> 
<subparagraph id="H68F985D1E32D46159597B3CC7BB86FAC" indent="up2" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">Notwithstanding subparagraphs (A), (B), and (C), beginning on January 1, 2026, an eligible covered beneficiary shall not be required to pay a cost-sharing amount for a preventive opioid overdose reversal drug.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="HDE2B2EE85A1646D8A849577BF7F7E46E"><enum>(2)</enum><text>In subsection (i), by adding at the end the following new paragraph:</text> 
<quoted-block style="USC" id="H21F548495C4D44AAB9FE0070473390DA" display-inline="no-display-inline"> 
<paragraph id="HFB49512DF49A4F0DB0C22512D2D61854"><enum>(5)</enum><text display-inline="yes-display-inline">The term <term>preventive opioid overdose reversal drug</term> has the meaning given such term in section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H2CF786098AF44A70806A6D0C31C0F2C3" display-inline="no-display-inline"><enum>(d)</enum><header>Regulatory guidance</header> <paragraph id="HB18CD7C254554894A33541EF997CF5BF"><enum>(1)</enum><header>State boards</header><text>Not later than 1 year after the date of the enactment of this Act, the Commissioner of Food and Drugs shall issue guidance for State boards of pharmacy, nursing, and medicine with respect to—</text> 
<subparagraph id="H94F65FB01A8B4AC2A82C5AE7E0A01593"><enum>(A)</enum><text>enhancing safe and effective hospital-based dispensing and distribution of opioid overdose reversal drugs; and</text></subparagraph> <subparagraph id="H2509AF46A35741F7B8EBA8CDAC468396"><enum>(B)</enum><text display-inline="yes-display-inline">eliminating barriers to such dispensing and distribution.</text></subparagraph></paragraph> 
<paragraph id="H78A9431D4D0D403EB8312E9DD73CC414"><enum>(2)</enum><header>Hospital</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary of Health and Human Services shall issue guidance for hospitals with respect to billing for preventive opioid overdose reversal drugs described in section 1861(nnn) of the Social Security Act, as added by subsection (a)(2).</text></paragraph></subsection> <subsection id="H9BCF236E4009459AB7235087B7AD5D31"><enum>(e)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to require a provider of services or supplier to furnish a preventive opioid overdose reversal drug described in section 1861(nnn) of the Social Security Act, as added by subsection (a)(2), to an individual at risk of an opioid overdose.</text></subsection></section>
