<section id="HC16775A3E3A84EF191A4D4DA82334A11" section-type="section-one"><enum>1.</enum><header>Study on use of additional key factors in credit scoring models</header> 
<subsection id="H4694FD6E2C1F463FB1786642F0CAD177"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than December 31, 2025, the Director of the Bureau of Consumer Financial Protection and the Chairman of the Federal Trade Commission shall jointly submit to Congress a report on—</text> <paragraph id="H24961C7A1A0D4F8D96CB84873D1E0342"><enum>(1)</enum><text>the use of credit scoring models that include consideration of key factors described in subsection (b); and</text></paragraph> 
<paragraph id="H2A2413D1EE7A4D98A528979784EF97E0" commented="no"><enum>(2)</enum><text>how such models affect the ways in which a creditor evaluates the creditworthiness of a consumer.</text></paragraph></subsection> <subsection id="H032654CFF6734E8DB8AAC5621872D237"><enum>(b)</enum><header>Key factors</header><text>The key factors described in this subsection are as follows:</text> 
<paragraph id="H43CC51B3D5DE4461983AA4CA41870AB6"><enum>(1)</enum><text display-inline="yes-display-inline">Brokerage account statements.</text></paragraph> <paragraph id="HC6165D43DC324069AF48372BE0B80E79"><enum>(2)</enum><text>Payment history for installment contracts, such as <quote>Buy Now, Pay Later</quote> installment contracts.</text></paragraph> 
<paragraph id="H2FF93B89729E4787B756474125E6511C"><enum>(3)</enum><text display-inline="yes-display-inline">Electronic benefit transfer system (as defined in section 904(d)(2)(A)(i) of the Electronic Fund Transfer Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1693b">15 U.S.C. 1693b(d)(2)(A)(i)</external-xref>)) transaction records.</text></paragraph> <paragraph id="H61459334B1EF4A098EBD0DBF9FBBE189"><enum>(4)</enum><text display-inline="yes-display-inline">Rental payment history.</text></paragraph> 
<paragraph id="H95DDDC91A1E24BF48CC8E7A3987148AC"><enum>(5)</enum><text>Utility payment history.</text></paragraph> <paragraph id="HBC22EC7918214DFFBDDF7CE890BFAD04"><enum>(6)</enum><text>Telecom and subscription-service payment history.</text></paragraph> 
<paragraph id="H1FF78DE3F4CB4B9283026E2849CE6A02"><enum>(7)</enum><text>Transaction data from depository institution (as defined in section 3(a) of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813(a)</external-xref>)) and credit union accounts.</text> </paragraph> <paragraph id="H84B9A0D052A24E1F88FA0C7C3046C9BA"><enum>(8)</enum><text>Payroll deposit or data on the frequency with which an employee makes deposits to an account of a consumer.</text></paragraph> 
<paragraph id="HB3E82047100E4D029A4712671128B4BB"><enum>(9)</enum><text>Payment history for insurance.</text></paragraph> <paragraph id="H3AE8CA504DD14D9A920274CB619536E4"><enum>(10)</enum><text>Public record data relating to property ownership, business licenses, and court filings relating to assets or real property.</text></paragraph> 
<paragraph id="HD8CF2589CF63476498686AAEB39E747F"><enum>(11)</enum><text>Peer-to-peer financial transaction activity.</text></paragraph></subsection> <subsection id="H669203E35B4A48CF91F69D1C79B7C640"><enum>(c)</enum><header>Definitions</header><text>In this Act:</text> 
<paragraph id="HBACD1B56740146FAB047F928618ECDA8"><enum>(1)</enum><header>Credit scoring model</header><text display-inline="yes-display-inline">The term <term>credit scoring model</term> means a model for developing a credit score (as defined in section 609(f)(2)(A) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681g">15 U.S.C. 1681g(f)(2)(A)</external-xref>)).</text></paragraph> <paragraph id="H345AE2E6A84C4451A83583F829C652DF"><enum>(2)</enum><header>Key factor</header><text display-inline="yes-display-inline">The term <term>key factor</term> has the meaning given in section 609(f)(2)(B) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681g">15 U.S.C. 1681g(f)(2)(B)</external-xref>).</text> </paragraph></subsection></section>
