<section id="HDDD8E2DDDCF1472DBE4C30E35EA8C783" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Widespread Information Management for the Welfare of Infrastructure and Government Act</short-title></quote>.</text></section> 
<section id="H09AAA32E59A14DF4940BE38D63AB2097"><enum>2.</enum><header>Reauthorization of Cybersecurity Act of 2015</header> 
<subsection id="HD3DF3E6DCA0B470A97EBEA744F2606C4" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Cybersecurity Act of 2015 (<external-xref legal-doc="usc" parsable-cite="usc/6/1501">6 U.S.C. 1501 et seq.</external-xref>; enacted as division N of the Consolidated Appropriations Act, 2016; <external-xref legal-doc="public-law" parsable-cite="pl/114/113">Public Law 114–113</external-xref>) is amended—</text> <paragraph id="H85D32FE10B634523942854EAC1C85CAC"><enum>(1)</enum><text>in section 102 (<external-xref legal-doc="usc" parsable-cite="usc/6/1501">6 U.S.C. 1501</external-xref>; relating to definitions)—</text> 
<subparagraph id="H7FCF1CD05A184B73942FF63BF8A39114"><enum>(A)</enum><text>by redesignating paragraphs (4), (5), (6), (7), (8), (9), (10), (11), (12), (13), (14), (15), (16), (17), and (18) as paragraphs (6), (7), (8), (9), (10), (11), (12), (13), (14), (15), (16), (17), (19), (20), and (21), respectively;</text></subparagraph> <subparagraph id="HA83108C2EE104FBCA30C400B309E58AF"><enum>(B)</enum><text>by inserting after paragraph (3) the following new paragraphs:</text>

<paragraph id="HC2D17D3BFB7742AF905043FF7F6146ED"><enum>(4)</enum><header>Artificial intelligence</header><text display-inline="yes-display-inline">The term <quote>artificial intelligence</quote> has the meaning given such term in section 5002 of the National Artificial Intelligence Initiative Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/15/9401">15 U.S.C. 9401</external-xref>).</text></paragraph> <paragraph id="H78B5A1792514462B9A034C9A2E8447B7"><enum>(5)</enum><header>Critical infrastructure</header><text display-inline="yes-display-inline">The term <quote>critical infrastructure</quote> has the meaning given such term in section 1016(e) of <external-xref legal-doc="public-law" parsable-cite="pl/107/56">Public Law 107–56</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/42/5195c">42 U.S.C. 5195c(e)</external-xref>).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HBC293DD4154341D9803425476C87BA69"><enum>(C)</enum><text>by inserting after paragraph (17), as so redesignated, the following new paragraph:</text> <quoted-block style="OLC" id="HC47B680DF6D9427C875212EAA6D7DDF2" display-inline="no-display-inline"> <paragraph id="HF40AB2B6A50145A6A738E5F217B6CA3A"><enum>(18)</enum><header>Sector Risk Management Agency</header><text display-inline="yes-display-inline">The term <quote>Sector Risk Management Agency</quote> has the meaning given such term in section 2200 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/650">6 U.S.C. 650</external-xref>).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H6D86F97C41B440C9A698B26E1219D767" commented="no"><enum>(2)</enum><text>in section 103 (<external-xref legal-doc="usc" parsable-cite="usc/6/1502">6 U.S.C. 1502</external-xref>; relating to sharing of information by the Federal Government)—</text> <subparagraph id="H3B55CFF0248D4838A87D0F740AAE2C01" commented="no"> <enum>(A)</enum> <text>in subsection (a), in the matter preceding paragraph (1), by striking <quote>develop and issue</quote> and inserting <quote>develop, issue, and, as appropriate, update</quote>;</text>
                    </subparagraph> 
<subparagraph id="H6402144C688F44B3A44B7E0177DE8CC9" commented="no"><enum>(B)</enum><text>in subsection (b)—</text> <clause id="H743C4AD72B9740C0848C41DC42F745AF" commented="no"><enum>(i)</enum><text>in paragraph (1)—</text>

<subparagraph id="H6C53BE70D9E54E48A92EB9858181F0A1" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">ensure the Federal Government maintains the capability to provide technical assistance, on a voluntary basis, to non-Federal entities in utilizing cyber threat indicators and defensive measures for cybersecurity purposes;</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause> <subclause id="H6C9AA7B82C8F4958BC6C4EDEBD43150C"><enum>(III)</enum><text>in subparagraph (E)(ii), by striking <quote>and</quote> after the semicolon;</text></subclause> 
<subclause id="H2C75253C80574D1FAF35CC2A626DE075"><enum>(IV)</enum><text>in subparagraph (F), by striking the period and inserting <quote>; and</quote>; and</text></subclause> <subclause id="H95DAC9B611964B0691BA470F5AA9B4F7"><enum>(V)</enum><text>by adding at the end the following new subparagraph:</text>

<subparagraph id="H4F3E821DAF7F4732A04DD5FB5637565A" commented="no"><enum>(G)</enum><text display-inline="yes-display-inline">pursuant to section 2212 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/662">6 U.S.C. 662</external-xref>), provide one-time read-ins, as appropriate, to select individuals identified by non-Federal entities that own or operate critical infrastructure; </text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subclause> </clause> <clause id="H2E08EE7CDFBE4861B868B3538D5DDEEA" commented="no"><enum>(ii)</enum><text>in paragraph (2)—</text> 
<subclause id="HA232C4AB5F6D413BB84CDE01F5A813BB"><enum>(I)</enum><text>by inserting <quote>and, as appropriate, updating,</quote> after <quote>developing</quote>; and</text></subclause> <subclause id="H9F5B518247D34C1FB1F374D52175A269"><enum>(II)</enum><text>by inserting <quote>and defensive measures</quote> after <quote>promote the sharing of cyber threat indicators</quote>; and</text></subclause></clause></subparagraph> 
<subparagraph id="H7100F9F0D42F4F3A9C3FCFE6714F1565" commented="no"><enum>(C)</enum><text>in subsection (c)—</text> <clause id="H38FCB8CE39A04D5289FFBD83332A90F7" commented="no"><enum>(i)</enum><text>by inserting <quote>and not later than 60 days after any update, as appropriate, of procedures required by subsection (a),</quote> after <quote>Act,</quote>; and</text></clause> 
<clause id="H6AA17DBFA9124126AF520621ADA1DB8D" commented="no"><enum>(ii)</enum><text>by inserting <quote>(or update, as appropriate)</quote> after <quote>procedures</quote>;</text> </clause></subparagraph></paragraph> <paragraph id="H91521203C17E4AD4B1F1C65E01C7791E"><enum>(3)</enum><text display-inline="yes-display-inline">in section 104 (<external-xref legal-doc="usc" parsable-cite="usc/6/1503">6 U.S.C. 1503</external-xref>; relating to authorizations for preventing, detecting, analyzing, and mitigating cybersecurity threats)—</text> 
<subparagraph id="H541C4EE6671848EDA8C88FA64BD16A12"><enum>(A)</enum><text>in subsection (c)—</text> <clause id="H07A4986F6693470FA6B011F32B3C30F9" commented="no"> <enum>(i)</enum> <text>in paragraph (1), by inserting <quote>, including Sector Risk Management Agencies that are agencies and the majority of the systems of which are not covered under subsection (d) or (e) of section 3553 of title 44, United States Code,</quote> after <quote>Federal Government</quote>;</text>
                        </clause> 
<clause id="HBDF47F7239F542B2A8FF4BC2C46CDF23"><enum>(ii)</enum><text>in paragraph (3)—</text> <subclause id="H21BA23A5E9A144F9872CB6F71360783C"><enum>(I)</enum><text>in the matter preceding subparagraph (A), by striking <quote>shall be</quote> and inserting <quote>may be</quote>;</text></subclause> 
<subclause id="H3EAC3306019A47709F8A597158CD9857"><enum>(II)</enum><text>in subparagraph (A), by striking <quote>or</quote> after the semicolon;</text></subclause> <subclause id="HE51772CCD7AC4F93A740E65AACFDD308"><enum>(III)</enum><text>in subparagraph (B), by striking the period and inserting <quote>; or</quote>; and</text></subclause> 
<subclause id="H45DAF909D45249E6ACB3450E123667C5"><enum>(IV)</enum><text>by adding at the end the following new subparagraph:</text> <quoted-block style="OLC" id="HA45AF47F9BCA47EA80FD51A6FF3D6267" display-inline="no-display-inline"> <subparagraph id="HF5451A319A7B4B07A72F7E8F452323B7"><enum>(C)</enum><text display-inline="yes-display-inline">to preclude the use of artificial intelligence that is developed or strictly deployed for cybersecurity purposes in carrying out the activities authorized under paragraph (1).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause> 
<clause id="HE5456D58B8C54D20A5E5DE4585CE56D4"><enum>(iii)</enum><text>in subparagraph (B) of subsection (d)(2), by inserting <quote>, which may utilize artificial intelligence that is developed or strictly deployed for cybersecurity purposes,</quote> after <quote>technical capability</quote>;</text> </clause></subparagraph></paragraph> <paragraph id="H5056CE059DB04E6E81BF822F0BE13C55" commented="no"> <enum>(4)</enum> <text>in section 105 (<external-xref legal-doc="usc" parsable-cite="usc/6/1504">6 U.S.C. 1504</external-xref>); relating to sharing of cyber threat indicators and defensive measures with the Federal Government—</text>
                    <subparagraph id="H88760E61154F4A8AAE08439D78A8F270" commented="no">
                        <enum>(A)</enum>
 <text>in subsection (a)—</text> <clause id="HA7ECF61F02B14013ABDCBF7CD4DC71BC" commented="no"> <enum>(i)</enum> <text>in paragraph (2), by adding at the end the following new sentences: <quote>As appropriate, the Attorney General and the Secretary of Homeland Security shall, in consultation with the heads of the appropriate Federal entities, jointly update such policies and procedures, and issue and make publicly available such updated policies and procedures. Such updates shall prioritize rapid dissemination to State, local, Tribal, and territorial governments and owners and operators of non-Federal critical infrastructure of relevant and actionable cyber threat indicators and defensive measures.</quote>;</text>
                        </clause>
                        <clause id="H02DD651D20C24B46B87607F3D95D47E6" commented="no">
                            <enum>(ii)</enum>
 <text>in paragraph (3), in the matter preceding subparagraph (A), by striking <quote>developed or issued</quote> and inserting <quote>developed, issued, or, as appropriate, updated,</quote>; and</text>

                                    <header>Outreach</header>
 <text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this subparagraph, the Secretary of Homeland Security shall develop and continuously implement an outreach plan, including targeted engagement, to ensure Federal and non-Federal entities, particularly small or rural owners or operators of critical infrastructure which often lack dedicated cybersecurity staff but remain vital to national security—</text>
                                    <clause id="HABFCD2BE9EE44DA188C9A17B6042204D" commented="no">
                                        <enum>(i)</enum>
 <text>are aware of the capability and process required by paragraph (1) to share cyber threat indicators and defensive measures, including the benefits real-time information sharing provides;</text>
                                    </clause>
                                    <clause id="H713983D8B92B4854BF45E99E457B3CAE" commented="no">
                                        <enum>(ii)</enum>
 <text>understand how to share cyber threat indicators and defensive measures;</text>
                                    </clause>
                                    <clause id="HA7F51DA9620A4CDF951D13937D316F0B" commented="no">
                                        <enum>(iii)</enum>
 <text display-inline="yes-display-inline">understand the obligation to remove certain personal information in accordance with section 104(d)(7) prior to sharing a cyber threat indicator;</text>
                                    </clause>
                                    <clause id="H2C568DA8574748AD8918DA93073F41FD" commented="no">
                                        <enum>(iv)</enum>
 <text>understand how cyber threat indicators and defensive measures are received, processed, used, and protected;</text>
                                    </clause>
                                    <clause id="H5E461335F3B14112A2363C3BE560B77E" commented="no">
                                        <enum>(v)</enum>
 <text>understand the protections they are afforded in sharing any cyber threat indicators and defensive measures; and</text>
                                    </clause>
                                    <clause id="H3CB6E99BA114452183F0DC4D9C854831" commented="no">
                                        <enum>(vi)</enum>
 <text>can provide feedback to the Secretary when policies, procedures, and guidelines that are unclear or unintentionally prohibitive to sharing cyber threat indicators and defensive measures.</text>
                                    </clause>
                                </subparagraph>

                            </quoted-block>
                        </clause>

                            <enum>(iii)</enum>
 <text>by adding at the end the following new subparagraph:</text> <quoted-block style="OLC" id="HA6E3FFEADAB74CB29250201170335071" display-inline="no-display-inline"> <subparagraph id="HC6CB3EC23F864138B4BFF37739D01AA5" commented="no"> <enum>(D)</enum> <header>Briefings on outreach</header> <text display-inline="yes-display-inline">The Secretary of Homeland Security shall annually provide to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a briefing on the implementation of outreach pursuant to subparagraph (B).</text>
                                </subparagraph>

                        <enum>(D)</enum>

                        </clause>

                </paragraph>
