<section id="H4591B66E4CB34E94BB4CBF8B0F601DF1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transit Funding Flexibility Act</short-title></quote>.</text></section> <section id="H67B5B9244EB04690A455295AE3B14F30"><enum>2.</enum><header>Use of urbanized area formula grant funds for public transportation operating costs</header><text display-inline="no-display-inline">Section 5307 of title 49, United States Code, is amended—</text> 
<paragraph id="H2771D519912C48938A84FECFE3356A91"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="H4E43E33C1A2D4D4A80C18AE3FB8F110E"><enum>(A)</enum><text>in paragraph (1)(D) by striking <quote>in an urbanized area with a population of fewer than 200,000 individuals, as determined by the Bureau of the Census</quote>; and</text></subparagraph> 
<subparagraph id="HA66AA1FE510B4C1583A49093CA51C6D0"><enum>(B)</enum><text>by striking paragraphs (2) and (3);</text></subparagraph></paragraph> <paragraph id="H469BDE9015DF4046B4C2934C5B42AA4F"><enum>(2)</enum><text>in subsection (c)—</text> 
<subparagraph id="HD2A9E0A46F6644109194F8EA76BE08D0"><enum>(A)</enum><text>in paragraph (1)(L) by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="H78A35D8343024035BC501934C41DFC92"><enum>(B)</enum><text>in paragraph (2) by striking <quote>the certification</quote> and inserting <quote>each certification</quote>;</text></subparagraph> 
<subparagraph id="H6EC217D658244654B21CAB82863147E2"><enum>(C)</enum><text>by redesignating paragraph (2) as paragraph (3); and</text></subparagraph> <subparagraph id="H0AF1E55468894DC1B9EA45876AAFBE49"><enum>(D)</enum><text>by inserting before paragraph (3), as so redesignated, the following new paragraph:</text>

<paragraph id="H60619F8E66364963A166832CAACC4263"><enum>(2)</enum><text display-inline="yes-display-inline">the recipient, not later than the 30th day of the first full fiscal year after a recipient first receives grant funds under this section and each fiscal year thereafter, shall submit to the Secretary a certification that, for the fiscal year, the recipient will maintain effort with respect to any operating costs of equipment and facilities for which grant funds are used; and</text></paragraph> <after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> </paragraph> <paragraph id="HF11EA4788CC044D1A5E14E529C0DDC28"><enum>(3)</enum><text>in subsection (f)(3)—</text> 
<subparagraph id="H8B7233001FB444EF86ADBD4D9CE72C67"><enum>(A)</enum><text>by striking <quote>The Secretary may</quote> and inserting <quote><header-in-text level="subparagraph" style="USC"><enum-in-header>(A)</enum-in-header> In general.—</header-in-text>Subject to subparagraph (B), the Secretary may</quote>; and</text></subparagraph> <subparagraph id="HA7F2D2EB40904278B04B4794116D19C3"><enum>(B)</enum><text>by adding at the end the following new subparagraph:</text>

<subparagraph id="HF309592BA0214C47AB662899F15C57B1"><enum>(B)</enum><header>Failure to maintain effort</header><text display-inline="yes-display-inline">If, in conducting a review, audit, and evaluation under this subsection, the Secretary finds that a recipient failed to maintain effort during a fiscal year as certified to under subsection (c)(2), the Secretary shall reduce by <fraction>1/3 </fraction>any amount such recipient is to receive under this section in the next fiscal year.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section> </legis-body></bill>
