<section id="H22DF7E3BEEEF40AEBFD71C0D2F9D7C64" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Advanced Chips for the CCP Act of 2025.</short-title></quote></text></section> 
<section id="HCCAF06ACB594440EBC0A40B397804C80"><enum>2.</enum><header>Congressional approval requirement for advanced AI chip exports to China</header> 
<subsection id="HC18E7FB966064419A3C37BFACDB18CF0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">No person may export, reexport, or transfer an advanced AI semiconductor to the People’s Republic of China unless—</text> <paragraph id="H0D46C09C55204DEA85759D6CAD9AD9C6"><enum>(1)</enum><text>the Secretary of Commerce has approved such export, reexport, or transfer pursuant to subsection (b); and</text></paragraph> 
<paragraph id="HBC016A34A60D43E58236264A8E2A26DA"><enum>(2)</enum><text>Congress has enacted a joint resolution approving such export, reexport, or transfer pursuant to subsection (c).</text></paragraph></subsection> <subsection id="HE51952E3F8C24DB281F6D26BE3C925A2"><enum>(b)</enum><header>Executive branch approval process</header> <paragraph id="H7ADC3309B0EC46CCBE379E203C7707EA"><enum>(1)</enum><header>Interagency review</header><text display-inline="yes-display-inline">Before approving any export, reexport, or transfer under subsection (a)(1), the Secretary of Commerce shall conduct an interagency review involving the Secretary of Defense, the Secretary of Energy, the Secretary of State, and the Director of National Intelligence in coordination with the appropriate elements of the intelligence community (as such term is defined in section 3 of the National Security Act of 1947).</text></paragraph> 
<paragraph id="H057076FACC1F486394DF900178F91281"><enum>(2)</enum><header>Factors for consideration</header><text>In conducting the review under paragraph (1), the Secretaries shall consider—</text> <subparagraph id="H79201B003497481B8384205A9303D051"><enum>(A)</enum><text>the potential impact on United States national security;</text></subparagraph> 
<subparagraph id="H897F14D89E1F4F75B073958BBD745087"><enum>(B)</enum><text>the potential impact on United States technological leadership;</text></subparagraph> <subparagraph id="H7EC1FD4F5C794877BD8FDEBF5F608644"><enum>(C)</enum><text>the risk of enabling military applications by the People’s Republic of China;</text></subparagraph> 
<subparagraph id="HB8EEB9BEF17340A4BB500064DB144005"><enum>(D)</enum><text>the risk of enabling the perpetration of human rights abuses in the People’s Republic of China;</text></subparagraph> <subparagraph id="H226B0EC6353A45ABB05BB1869121D586"><enum>(E)</enum><text>the availability of comparable technology at a comparable volume from other sources; and</text></subparagraph> 
<subparagraph id="H8954132378F84F32A5FAAAEF32610AA4"><enum>(F)</enum><text>the economic impact on United States companies and workers.</text></subparagraph></paragraph> <paragraph id="HF3D54E200E6243BA9C4B2C684D7E2154"><enum>(3)</enum><header>Determination</header><text>The Secretary of Commerce may approve an export, reexport, or transfer under this subsection only if the Secretary determines, in coordination with the other Secretaries described in paragraph (1), that such action is in the national security and foreign policy interests of the United States.</text></paragraph></subsection> 
<subsection id="HDC619716045A451F9560D61671A5F388"><enum>(c)</enum><header>Congressional approval process</header> 
<paragraph id="HA072DDCA669443F5B7F6F64C1C6A6D13"><enum>(1)</enum><header>Submission to Congress</header><text>Not later than 30 days after making a determination under subsection (b)(3), the Secretary of Commerce shall submit to Congress a report describing—</text> <subparagraph id="H502BBD2044BB4EEF8D20FF6B8E934AF7"><enum>(A)</enum><text>the specific advanced AI semiconductor that is the subject of the determination;</text></subparagraph> 
<subparagraph id="HCE9EEB0CFCFF40869819A06C7B7CD05B"><enum>(B)</enum><text>the intended recipient in the People’s Republic of China of such semiconductor;</text></subparagraph> <subparagraph id="H76CF2F44A60849B88B0901EFD214C315"><enum>(C)</enum><text>the intended use of such semiconductor;</text></subparagraph> 
<subparagraph id="HDD5D8F97E0784BE58E95C71C44782EAA"><enum>(D)</enum><text>the analysis conducted under subsection (b)(2); and</text></subparagraph> <subparagraph id="H7387783EEC87431F91E91D36F485A797"><enum>(E)</enum><text>the basis for the determination under subsection (b)(3).</text></subparagraph></paragraph> 
<paragraph id="H2F95D8B1C6B643D7821C694C7655AFE5"><enum>(2)</enum><header>Joint resolution required</header><text>An export, reexport, or transfer may proceed under subsection (a) only if Congress enacts a joint resolution specifically approving such action.</text></paragraph></subsection> <subsection id="HC17F32C254E6430EA795221532CC890E"><enum>(d)</enum><header>Exceptions</header><text>The requirements of this section shall not apply to—</text> 
<paragraph id="H06AE5B3FF05942659E6C23DA8890D55F"><enum>(1)</enum><text>exports, reexports, or transfers for humanitarian purposes, as determined by the Secretary of Commerce;</text></paragraph> <paragraph id="H22DCC93DB43247FAA0C64E26ED4A0231"><enum>(2)</enum><text>exports, reexports, or transfers necessary for the operation of United States diplomatic or consular facilities in the People’s Republic of China; or</text></paragraph> 
<paragraph id="H5B17BDA3097D46FDBBBE94E1BB263A3B"><enum>(3)</enum><text>exports, reexports, or transfers of advanced AI semiconductors that were lawfully exported to the People’s Republic of China before the effective date of this Act and are being returned for repair or replacement.</text></paragraph></subsection></section> <section id="H5F7DE2D068384A8799AF82ECB1EF3ED0"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H5880ADB725C34D068FD4CE3AA782385B"><enum>(1)</enum><text>The term <quote>advanced AI semiconductor</quote> means a semiconductor that exceeds any of the following thresholds:</text> <subparagraph id="H729AD3132FEE4457A4C9F60FA4AB4F1E"><enum>(A)</enum><text>A total processing performance of 2,400 or a performance density of 1.6 or more.</text></subparagraph> 
<subparagraph id="H29A907FB19744A57A5D88A79CC905B68"><enum>(B)</enum><text>A DRAM bandwidth exceeding 4,100 GB/s.</text></subparagraph> <subparagraph id="H3BB05B0FBAD2448E9FDF4EDD2E10C4AA"><enum>(C)</enum><text>An interconnect bandwidth exceeding 1,100 GB/s.</text></subparagraph> 
<subparagraph id="H7F27D23584C2493C9D3B9D4983C864FB"><enum>(D)</enum><text>A sum of DRAM bandwidth and interconnect bandwidth exceeding 5,100 GB/s.</text></subparagraph></paragraph> <paragraph id="H8B28F1EB29994F11AD92C2625D931844"> <enum>(2)</enum> <text>The term <quote>People’s Republic of China</quote> means—</text>
                <subparagraph id="H795B5124B7F441ADA518CA703DDAEECB">
                    <enum>(A)</enum>
 <text>the territory of the People’s Republic of China, including Hong Kong and Macau; or</text>
                </subparagraph>
                <subparagraph id="H35FE602DD2AF4C54B29E069A98451692">
                    <enum>(B)</enum>
 <text>any entity that is owned or controlled by, or acting on behalf of, the Government of the People’s Republic of China or the Chinese Communist Party.</text>
                </subparagraph>
            </paragraph> 
<paragraph id="HC314DDD149F14153AEEBFBD6450DCD2C">
                <enum>(3)</enum>
 <text>The term <quote>person</quote> means any individual, corporation, partnership, association, or other legal entity, wherever located.</text>
            </paragraph></section> 
<section id="H13AD4699941748E1B105AF30BA74413C"><enum>4.</enum><header>Sunset</header><text display-inline="no-display-inline">This Act shall cease to be effective beginning on the date that is three years after the date of the enactment of this Act.</text> </section> </legis-body></bill>
