R. 5016</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250822">August 22, 2025</action-date><action-desc><sponsor name-id="B001302">Mr. Biggs of Arizona</sponsor> (for himself, <cosponsor name-id="H001077">Mr. Higgins of Louisiana</cosponsor>, <cosponsor name-id="N000026">Mr. Nehls</cosponsor>, and <cosponsor name-id="H001052">Mr. Harris of Maryland</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Government Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit in the District of Columbia an individual charged with an offense from being released pending trial without executing an secured appearance bond.</official-title></form><legis-body id="HACBDD68AF6BB4B4186654E5988356E41"><section id="HAB8CEC9D3DC0402F9020DC3C97F89435" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keep Offenders Off Our Streets Act.</short-title></quote>.</text></section><section id="HD05B40F521E748228DC362970250BC72"><enum>2.</enum><header>Prohibition in district of columbia on release of individual charged with offense pending trial without executing a secured appearance bond</header><subsection id="HC55FEA68873F485A8DB82918D10F7D1C"><enum>(a)</enum><header>In general</header><text>The Council of the District of Columbia may not enact, and the Mayor of the District of Columbia may not enforce, any act, resolution, regulation, or other requirement which permits an individual charged with an offense in the District of Columbia who appears before a judicial officer, as defined in section 23–1331(1), District of Columbia Official Code, to be released, pending trial, without such person executing a bail bond with solvent sureties in whatever amount is reasonably necessary to assure the appearance of the individual as required.</text></subsection><subsection id="H499E8373796E4889A1D79F0CB24C56E0"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="H51682015CE034074B9715A24FB9C6EB1"><enum>(1)</enum><header>Repeal of release on personal recognizance</header><text>Section 23–1321 District of Columbia 11 Official Code, is amended—</text><subparagraph id="H66F98C5D9E3D41199F1673733B683DC4"><enum>(A)</enum><text>in subsection (a)—</text><clause id="HEE32A98690BA4292B6CCE0129BAB9E3E"><enum>(i)</enum><text>by striking subsection (1); and</text></clause><clause id="H448812FC36304DC4B563A58274A60200"><enum>(ii)</enum><text>redesignating subsections (2), (3), and (4) as subsections (1), (2), and (3), respectively;</text></clause></subparagraph><subparagraph id="H7EDAB1BC3BE64897949F1A3C750ED210"><enum>(B)</enum><text>by striking subsection (b);</text></subparagraph><subparagraph id="H386BAD3F0A6545CC805FCDB412CE2C5E"><enum>(C)</enum><text>by redesignating subsections (c), (d), and (e) as subsections (b), (c), and (d), respectively; and</text></subparagraph><subparagraph id="H2B85FD8168E149B1A6B13D6ADD89CB53"><enum>(D)</enum><text>in subsection (b), as so redesignated—</text><clause id="HFA0E37F884164C6386A8243D4D17E088"><enum>(i)</enum><text>in subsection (1), by striking everything before <quote>the judicial officer</quote>;</text></clause><clause id="H313943EF2E714F3F8D39B67C03D4EFF9"><enum>(ii)</enum><text>in subsection (A), by striking <quote>and</quote> after the semicolon;</text></clause><clause id="H00D647DF9463474FAC07A158A520480B"><enum>(iii)</enum><text>redesignating subsection (B) as subsection (C);</text></clause><clause id="H9D654AFE42BE43668BCA70B6195BE7B0"><enum>(iv)</enum><text>after subsection (A), insert the following:</text><quoted-block id="HD97BFA0954F9425EB0CC48F7D9C6551A" style="OLC"><subparagraph id="HC214BD3281974AEA9D02FAFAA1DDA929"><enum>(B)</enum><text>Execution of a bail bond with solvent sureties in whatever amount is reasonably necessary to assure the appearance of the person as required; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="H3EF161B7536D4B24AECA32FDE2BDB392"><enum>(v)</enum><text>in subsection (C), as so redesignated, strike subsection (xii), and redesignate subsection (xiv) as subsection (xiii).</text></clause></subparagraph></paragraph><paragraph id="HBA2F7C2616FF44D59CFCF5C8A0DA8F2B"><enum>(2)</enum><header>Inclusion of prohibition in home rule act</header><text>Section 602(a) of the District of Columbia Home Rule Act (sec. 1–206.02(a), D.C. Official Code) is amended—</text><subparagraph id="HBFC27785038B48A399760633DF5E0156"><enum>(A)</enum><text>in paragraph (9), by striking <quote>office; or</quote> and inserting a <quote>office;</quote>;</text></subparagraph><subparagraph id="H33514E11D41D4AC0B9F3293515721116"><enum>(B)</enum><text>in paragraph (10), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="H0E52F1815BBF432CBD284808AC839B57"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text><quoted-block id="HB8D487BC24894A43ADC03D47BE81355C" style="OLC"><paragraph id="H9586C241361142299E65EAC07265CC38"><enum>(11)</enum><text>enact any act, resolution, regulation or other requirement which permits a person charged with an offense in the District of Columbia to be released, pending trial, without such person executing an bail bond with solvent sureties in whatever amount is reasonably necessary to assure the appearance of the person as required.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HDDFC54BE3C1245E9AA22FA2C322C95F9"><enum>(c)</enum><header>Applicability</header><text>This Act, and the amendments made by this Act, shall apply with respect to an individual charged with an offense in the District of Columbia who appears before a judicial officer, as defined in section 23– 1331(1), District of Columbia Official Code, before, on, or after the date of the enactment of this Act.</text></subsection><subsection id="HCF83A2D75DE640FAA511C7998E132597"><enum>(d)</enum><header>Severability</header><text>If, for any reason, any provision of this Act, or an amendment made by this Act, is held invalid, such invalidity shall not affect the validity of the remaining provisions of this Act.</text></subsection></section></legis-body></bill>
