<section id="HC3065744F25C4EDCA9A7CAD6CCB3F09C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>AUKUS Improvement Act of 2025</short-title></quote>.</text></section> <section id="H647DCB685C464E8DA41506819AE153B0"><enum>2.</enum><header>Flexibility with respect to certain Arms Export control Act and other arms transfer requirements</header><text display-inline="no-display-inline">Section 38(l) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2778">22 U.S.C. 2778(l)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H842371C2141343FEA618DBD64247FEDD"><enum>(8)</enum><header>Exemption from certain requirements</header>
<subparagraph commented="no" display-inline="no-display-inline" id="HABA9D46F790D46A0844A37058C970365">
                        <enum>(A)</enum>
                        <header display-inline="yes-display-inline">In general</header>
 <text>Defense articles sold by the United States under this Act may be reexported, retransferred or temporarily imported exclusively between the Government of Australia, the Government of the United Kingdom, or entities eligible under section 126.7(b)(2) of title 22 of the Code of Federal Regulations, or successor regulations. Such transfers shall not require the consent of the President under section 3(a)(2) of this Act, or under section 505(a)(1) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2314">22 U.S.C. 2314(a)(1)(B)</external-xref>).</text>
                    </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HF1CF376FBFB44B0A9E0564F4A75BB3BE"><enum>(B)</enum><header>Intra-company, intra-organizational, and intra-governmental transfers</header><text display-inline="yes-display-inline">Intra-company, intra-organization, and intra-governmental transfers related to defense articles and defense services described under subparagraph (A) are authorized between officers, employees, and agents who satisfy section 120.64 of title 22 of the Code of Federal Regulations, or successor regulations, including dual or third country nationals who satisfy section 126.18 of title 22 of the Code of Federal Regulations, or successor regulations.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HC7747B36E8C14D77A6DF8D61228D007D"><enum>3.</enum><header>Elimination of certification requirement for commercial technical assistance or manufacturing license agreements involving Australia and the United Kingdom</header><text display-inline="no-display-inline">Section 36(d)(2) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2776">22 U.S.C. 2776(d)(2)</external-xref>) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="HA01CB03B49994C898F40E7450B2925F0"><enum>(1)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H99BE6253CA3347B3A6C7E8EE99CA7608"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>A certification</quote> and inserting <quote>(A) A certification</quote>;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HCBACB808136C45D7A39BCA76D98557ED"><enum>(3)</enum><text display-inline="yes-display-inline">in clause (i), as redesignated by paragraph (1), by striking <quote>North Atlantic Treaty Organization or Australia, Japan</quote> and inserting <quote>North Atlantic Treaty Organization (excluding the United Kingdom) or Japan</quote>; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H33A27FCA30C44399A7BE64D57AD23035"><enum>(4)</enum><text>by adding at the end the following new subparagraph:</text>

<subparagraph indent="up1" id="HB4E7EB9DDE9E4644B8107C1B8F42F59B"><enum>(B)</enum><text>A certification under this subsection shall not be required in the case of an agreement for or in Australia or the United Kingdom.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> </legis-body></bill>
