<section id="HC49251CC6DD9415E88B001972B0EF469" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sanctuary Penalty and Public Protection Act of 2025</short-title></quote>.</text></section> 
<section id="H904EFA5255874018908869855CA94468"><enum>2.</enum><header>Database and funding prohibition for sanctuary jurisdictions</header> 
<subsection id="H10EB90DCFDB549FDA21DC318D0318287"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Illegal Immigration Reform and Immigrant Responsibility Act of 1996 is amended by inserting after section 642 (<external-xref legal-doc="usc" parsable-cite="usc/8/1373">8 U.S.C. 1373</external-xref>) the following new section:</text> <quoted-block style="OLC" id="H695AFFE50AD540D58CC1EC59D9B6B229" display-inline="no-display-inline"> <section id="HD74867178D63449592DB631A4AA87EAC"><enum>642A.</enum><header>Database and funding prohibition for sanctuary jurisdictions</header> <subsection id="H378BF2A53A7B4A28A9EF5BA2D57C841E"><enum>(a)</enum><header>Database</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this section, the Secretary of Homeland Security, acting through the Director of U.S. Immigration and Customs Enforcement, and the Attorney General shall jointly develop, update not less frequently than quarterly, and make publicly available a database of each State or local government entity the Secretary and Attorney General jointly determine to have a law, regulation, policy, or practice that—</text> 
<paragraph id="H00FE8CFB88B9468F9F58EB29CD0476F9"><enum>(1)</enum><text>is in conflict with, or in violation of, as the case may be—</text> <subparagraph id="H167B01CBA0D44D638B11646248D2C0A0"><enum>(A)</enum><text>subsection (a) or (b) of section 642;</text></subparagraph> 
<subparagraph id="HD910669E2E8449D78DCA4A328F1DE270"><enum>(B)</enum><text>section 274(a)(1)(A)(iii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324">8 U.S.C. 1324(a)(1)(A)(iii)</external-xref>); or</text></subparagraph> <subparagraph id="H1E61CAC54217491D82F329262005CACF"><enum>(C)</enum><text>section 277 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1327">8 U.S.C. 1327</external-xref>);</text></subparagraph></paragraph> 
<paragraph id="H77A01A4F0B8248B696EC0510F5A015A1"><enum>(2)</enum><text display-inline="yes-display-inline">prohibits or restricts—</text> <subparagraph id="HBC2917E2DB0C4D73A2274167A866F48A"><enum>(A)</enum><text>State or local law enforcement agencies from complying with a detainer issued by the Secretary under section 236(c)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1226">8 U.S.C. 1226(c)(3)</external-xref>), with respect to an alien in the custody of such a law enforcement agency; or</text></subparagraph> 
<subparagraph id="H60410582259B4BBF93637A54DA6EE1F8"><enum>(B)</enum><text display-inline="yes-display-inline">State or local law enforcement officials from arresting or detaining individuals described in section 439 of the Antiterrorism and Effective Death Penalty Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1252c">8 U.S.C. 1252c</external-xref>), as authorized under such section; or</text></subparagraph></paragraph> <paragraph id="HEA65599FD92C4513A134D37EA18B000F"><enum>(3)</enum><text>prohibits the Secretary or the Attorney General, as the case may be, from interviewing an incarcerated individual to determine whether the individual is—</text> 
<subparagraph id="H9018F7F11E9F4C3A8A8C416CC54D85D5"><enum>(A)</enum><text>an alien and, if so, whether the individual is lawfully present in the United States; or</text></subparagraph> <subparagraph id="HB5E5024DD6974A6A9E6FAF7187DB4A29"><enum>(B)</enum><text>suspected of being involved in a crime.</text></subparagraph></paragraph></subsection> 
<subsection id="HAC6E33C6D8A94897B0226D6035A206C1"><enum>(b)</enum><header>Sanctuary jurisdiction</header><text display-inline="yes-display-inline">A State or local government entity included in the database under subsection (a) shall be referred to as a <quote>sanctuary jurisdiction</quote>.</text></subsection> <subsection id="H4752752D199A43B8B1CFD82C1416D5FD"><enum>(c)</enum><header>Prohibition</header><text>Federal funds made available after the date of the enactment of this section may not be obligated or expended with respect to a sanctuary jurisdiction.</text></subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H24DB50CD6881498C8A4F98E1546D7266"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents in section 1(d) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 is amended by inserting after the item relating to section 642 the following new item:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H12BFBB1F51E04F69AECEC9534D3BD265"> <toc regeneration="no-regeneration"> <toc-entry level="section">Sec. 642A. Database and funding prohibition for sanctuary jurisdictions.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> </section> </legis-body></bill>
