which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To authorize the President of the United States to issue letters of marque and reprisal with respect to acts of aggression against the United States a member of a criminal enterprise or any conspirator associated with an enterprise involved in cybercrimes, and for other purposes.</official-title></form><legis-body id="H33B850D9667942D69F1CE4CCC8F7713D" style="OLC"><section id="HA0007081FEC845A1BFC5AD9AE9B09912" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Scam Farms Marque and Reprisal Authorization Act of 2025</short-title></quote>.</text></section><section id="HC2C43D96E7D4410B847C8CBA12C2E4D4"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text><paragraph id="H2BD95CCC73B545BE8B553A6BF7EF4912"><enum>(1)</enum><text display-inline="yes-display-inline">Article I, Section 8 of the Constitution grants the Congress the power to grant letters of marque and reprisal to punish, deter, and prevent the acts of aggression and depredations and other acts of war committed by scam centers.</text></paragraph><paragraph id="HEC6924793ED549ED829EB77274BFF0A7"><enum>(2)</enum><text>Criminal enterprises that employ cybercrimes and coerced labor present an unusual and extraordinary threat to the economic and national security of the United States.</text></paragraph></section><section id="H9453C47E1365405781F8F52DA9CDA036"><enum>3.</enum><header>Issuance of letters of marque and reprisal</header><subsection id="H0E2E3285953E4276914E69E725D72544"><enum>(a)</enum><header>Authority of President</header><text display-inline="yes-display-inline">The President of the United States is authorized and requested to commission, under officially issued letters of marque and reprisal, so many of privately armed and equipped persons and entities as, in the judgment of the President, the service may require, with suitable instructions to the leaders thereof, to employ all means reasonably necessary to seize outside the geographic boundaries of the United States and its territories the person and property of any individual or foreign government, as applicable, who the President determines is a member of a criminal enterprise or any conspirator associated with an enterprise involved in cybercrime who is responsible for an act of aggression against the United States.</text></subsection><subsection id="H1DBCE842C7E64F948F44FEAC6FD0151E"><enum>(b)</enum><header>Security bonds</header><text display-inline="yes-display-inline">No letter of marque and reprisal shall be issued by the President without requiring the posting of a security bond in such amount as the President shall determine is sufficient to ensure that the letter be executed according to the terms and conditions thereof.</text></subsection><subsection id="H03FECE010DF740809DAAD276082CA6AE"><enum>(c)</enum><header>Definitions</header><text>For the purposes of this section—</text><paragraph id="HA8F7386398B74C52AE07838768F53D85"><enum>(1)</enum><text>the term <quote>cybercrime</quote> includes—</text><subparagraph id="H23B7DEFC92814F31814CF92D1089474E"><enum>(A)</enum><text>an offense under section 1030 of title 18, United States Code;</text></subparagraph><subparagraph id="HACB322E48FF1416EB33692026FB51D13"><enum>(B)</enum><text>accessing a computer without authorization to obtain national security information, including sharing or retaining such information;</text></subparagraph><subparagraph id="HDC3F3281AA6D4063B2CB5380DB23F7E7"><enum>(C)</enum><text>accessing a computer without authorization to obtain personally identifiable information;</text></subparagraph><subparagraph id="HE3971D609B2C46B091A49150BC4481B8"><enum>(D)</enum><text>accessing a Government computer without authorization;</text></subparagraph><subparagraph id="H4985041DA5AC4BDAA6980F7EA5C4E5E1"><enum>(E)</enum><text>accessing a computer without authorization to engage in fraud;</text></subparagraph><subparagraph id="H7C39D821D12542A38279231E74BAD5CB"><enum>(F)</enum><text>causing damage to a computer by transmitting a program, information, code, or command;</text></subparagraph><subparagraph id="H685D2AA3F8D64CB4B37D57E40E3EB84F"><enum>(G)</enum><text>trafficking in passwords or other means of accessing a computer without authorization;</text></subparagraph><subparagraph id="H66703FF553F54D92B6EE255C985AC68B"><enum>(H)</enum><text display-inline="yes-display-inline">a pig butchering scam;</text></subparagraph><subparagraph id="H929E464869B94A57ACF9F5219075FA34"><enum>(I)</enum><text>a ransomware attack;</text></subparagraph><subparagraph id="HA7A1A3A2D23C4D16B96AC2491F5F3E5E"><enum>(J)</enum><text>cryptocurrency theft; or</text></subparagraph><subparagraph id="H313F6060AF784CE2A7795F73DC1C9293"><enum>(K)</enum><text>identity theft; and</text></subparagraph></paragraph><paragraph id="HE61988EA33084395B3161BD3F1D1A77A"><enum>(2)</enum><text>the term <quote>criminal enterprise</quote> includes a foreign government.</text></paragraph></subsection></section></legis-body></bill>
