<section id="H999220B97D5547358A19835D99CB97E8" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Quantum Encryption Readiness and Resilience Act</short-title></quote>.</text></section> 
<section id="HD645B68C59634A1ABE9A5BF654891B27"><enum>2.</enum><header>Reports on mitigating the cybersecurity and national security risks posed by certain quantum computers</header> 
<subsection id="HF1457EF1340E4A419F9D890225C42616"><enum>(a)</enum><header>Initial report</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Subcommittee on the Economic and Security Implications of Quantum Information Science established under section 105 of the National Quantum Initiative Act (<external-xref legal-doc="usc" parsable-cite="usc/15/8814a">15 U.S.C. 8814a</external-xref>) shall carry out the following:</text> <paragraph id="H9199C43F828542A0BA152D6BEAD0911B"><enum>(1)</enum><text display-inline="yes-display-inline">Conduct an assessment of each of the following:</text> 
<subparagraph id="H3BE5BBC1690B44AABB62FDC8E8FDF018"><enum>(A)</enum><text display-inline="yes-display-inline">The capabilities and progress of the United States, relative to other countries, with respect to the following:</text> <clause id="H6E747AF7CFE64E008AB23FFC3EA921D0"> <enum>(i)</enum> <text display-inline="yes-display-inline">Developing a cryptographically-relevant quantum computer.</text>
            </clause> 
<clause id="H31CE68E9B3444E6BA09D31E3C67F6C3B"><enum>(ii)</enum><text>Adopting security and preparedness measures, including post-quantum cryptography, to mitigate the cybersecurity and national security risks posed by such computer.</text></clause></subparagraph> <subparagraph id="HF1C4523FF8624BC28CFA595411211085"><enum>(B)</enum><text>The progress of private sector entities and public sector entities in the United States toward adopting such measures, including the progress toward implementing the guidance under section 4 of the Quantum Computing Cybersecurity Preparedness Act (<external-xref legal-doc="usc" parsable-cite="usc/6/1526">6 U.S.C. 1526</external-xref>).</text></subparagraph></paragraph> 
<paragraph id="HEF7AF8B4854C44ADAA3007BB719E4768"><enum>(2)</enum><text>Identify the sectors of the economy most vulnerable to such risks.</text></paragraph> <paragraph id="H8A4F9CE74863463F8A9E7E5A3EEA30E2"><enum>(3)</enum><text>Based upon such assessments and such identification, develop a plan to mitigate such risks, including by carrying out the following:</text> 
<subparagraph id="H7497A13E49314E57B5806C09D6803B77"><enum>(A)</enum><text>Facilitating collaboration between agencies and departments of the Federal Government.</text></subparagraph> <subparagraph id="H0BF35C08D3664DE495EC59DD382DA81E"><enum>(B)</enum><text>Facilitating the exchange of information between such private sector entities and public sector entities.</text></subparagraph> 
<subparagraph id="H6F12CB62943D45F0B9651511F732DC17"><enum>(C)</enum><text>Forming partnerships between the Federal Government and such private sector entities.</text></subparagraph> <subparagraph id="H37686281BAC249E2BC2155E097D994C1"><enum>(D)</enum><text>Identifying such measures that such private sector entities and public sector entities may adopt.</text></subparagraph> 
<subparagraph id="H7AED57D2BA734324A43C8C7A61794FD1"><enum>(E)</enum><text>Supporting such exchange and the adoption of such measures, including by identifying actions, including piloting projects, providing technical assistance, and publishing cyber hygiene guidance for such private sector entities, that such agencies and departments may carry out to support such exchange and adoption.</text></subparagraph> </paragraph> <paragraph id="H908E5B19EE6D4F0A84CC610C0600F576" commented="no"> <enum>(4)</enum> <text>Develop guidelines for determining whether a quantum computer is a cryptographically-relevant quantum computer.</text>
        </paragraph> 
<paragraph id="H1B1089247FAC4EBD9C9BCA2AF2FEC0AC"><enum>(5)</enum><text display-inline="yes-display-inline">Submit to the appropriate committees of Congress a report in classified or unclassified form, as appropriate, that includes information relating to the following:</text> <subparagraph id="H2CB0A235BB9444BE8A040B95BA068F1E"><enum>(A)</enum><text>The assessments conducted under paragraph (1).</text></subparagraph> 
<subparagraph id="H123E2D0AD88F4CCEB64F78F989F3B672"><enum>(B)</enum><text>The sectors identified under paragraph (2).</text></subparagraph> <subparagraph id="HE9DACE4026B14776BDBA47757D75FFD2"><enum>(C)</enum><text>The plan developed under paragraph (3).</text></subparagraph> 
<subparagraph id="HF35AC604233F4C12811676F1FF7D72A1"><enum>(D)</enum><text>The guidelines developed under paragraph (4).</text></subparagraph> <subparagraph id="HC45286F0CB6D4132A5989ACF2C5D3027"><enum>(E)</enum><text>Recommendations for the following:</text> 
<clause id="H052CCF617F134BA9B2F3D6F495E7F112"><enum>(i)</enum><text>A timetable to implement such plan.</text></clause> <clause id="H217DFB75E96F4BC0BC06437CDD099CA0"><enum>(ii)</enum><text>Policies to implement such plan that require legislation.</text></clause> 
<clause id="H7F36963A3B5348888D7463ACFBE34A2D"><enum>(iii)</enum><text>Policies to implement such plan that do not require legislation.</text></clause></subparagraph></paragraph></subsection> <subsection id="HA16957C282AB4D2BA6E737F1DDC06BC9"><enum>(b)</enum><header>Subsequent reports</header><text display-inline="yes-display-inline">Not later than one year after the report under subsection (a) is submitted and annually thereafter for four years, the Subcommittee referred to in such subsection shall submit to Congress a report in classified or unclassified form, as appropriate, that includes information relating to the progress of private sector entities and public sector entities in the United States toward adopting the measures described in such subsection.</text></subsection> 
<subsection id="H9492CE64506745EDAC03D2DA36CC7C70"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H42015C47E7004BD1BCCCBB91E300B47D"><enum>(1)</enum><header>Appropriate committees of Congress</header><text display-inline="yes-display-inline">The term <term>appropriate committees of Congress</term> has the meaning given such term in section 2 of the National Quantum Initiative Act (<external-xref legal-doc="usc" parsable-cite="usc/15/8801">15 U.S.C. 8801</external-xref>).</text></paragraph> 
<paragraph id="H5877B2644C874925A0473EEF956536C6"><enum>(2)</enum><header>Classical computer; post-quantum cryptography; quantum computer</header><text>The terms <term>classical computer</term>, <term>post-quantum cryptography</term>, and <term>quantum computer</term> have the meanings given such terms in section 3 of the Quantum Computing Cybersecurity Preparedness Act (<external-xref legal-doc="usc" parsable-cite="usc/6/1526">6 U.S.C. 1526</external-xref> note).</text></paragraph> <paragraph id="H67DF16B0818A4A41A921E8724B82A113"><enum>(3)</enum><header>Cryptographically-relevant quantum computer</header><text display-inline="yes-display-inline">The term <term>cryptographically-relevant quantum computer</term> means a quantum computer with the ability to compromise a cryptographic system that a classical computer is unable to compromise.</text></paragraph></subsection></section>
