which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Government Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the establishment of schedule F of the excepted service, and for other purposes.</official-title></form><legis-body id="H17B50C3469F747D3B9B95A2109024AAA" style="OLC"><section id="H8D207BD3EB2441E0AB3B13A49D0A3829" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Saving the Civil Service Act</short-title></quote>. </text></section><section id="HE01F2AA43A254F2E818E9592C43A724C" section-type="subsequent-section"><enum>2.</enum><header>Limitations on excepting positions from competitive service and transferring positions</header><subsection id="H19BED2220B8A4D1CB613D3D11178BF8D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A position in the competitive service may not be excepted from the competitive service unless such position is placed—</text><paragraph id="H0E16605BE33849AAADF6C84248B5D979"><enum>(1)</enum><text display-inline="yes-display-inline">in any of the schedules A through E as described in section 6.2 of title 5, Code of Federal Regulations, as in effect on September 30, 2020; and</text></paragraph><paragraph id="H55E8721E1D2F466A91175D286554C96F"><enum>(2)</enum><text display-inline="yes-display-inline">under the terms and conditions under part 6 of such title as in effect on such date.</text></paragraph></subsection><subsection id="H8E661FF0A4E34F61AF8978843D18791C"><enum>(b)</enum><header>Transfers</header><paragraph id="H1A4A375170064947B7340159E9C9D5EE"><enum>(1)</enum><header>Within excepted service</header><text display-inline="yes-display-inline">A position in the excepted service may not be transferred to any schedule other than a schedule described in subsection (a)(1).</text></paragraph><paragraph id="H7E1779B554BB43BB92FF4FC473913FF3" commented="no"><enum>(2)</enum><header>OPM consent required</header><text display-inline="yes-display-inline">An agency may not transfer any occupied position from the competitive service or excepted service into schedule C of subpart C of part 213 of title 5, Code of Federal Regulations, without the prior consent of the Director of the Office of Personnel Management.</text></paragraph><paragraph id="H8A8B916518434E1F9844006FA0976C76" commented="no"><enum>(3)</enum><header>Limit during presidential term</header><text>During any four-year presidential term, an agency may not transfer from the competitive service into the excepted service a total number of employees that is more than one percent of the total number of employees at such agency as of the first day of such term, or five employees, whichever is greater.</text></paragraph><paragraph id="HE7AB1C387BA341B2B385532EA232CE4A"><enum>(4)</enum><header>Employee consent required</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this section—</text><subparagraph id="HD944F8561A3B4B5F9E51742B8C146AC9"><enum>(A)</enum><text>an employee who occupies a position in the excepted service may not be transferred to an excepted service schedule other than the schedule such position is located without the prior written consent of the employee; and</text></subparagraph><subparagraph id="H6F140553DE304BEFBC3900165AB37175"><enum>(B)</enum><text>an employee who occupies a position in the competitive service may not be transferred to the excepted service without the employee’s prior written consent.</text></subparagraph></paragraph></subsection><subsection id="H6575F81B10DF4D6C82A3AC1E1FFE27EE"><enum>(c)</enum><header>Other matters</header><paragraph id="HE759CACBE0E4411CA9F9361D327D90F6"><enum>(1)</enum><header>Application</header><text>Notwithstanding section 7425(b) of title 38, United States Code, this section shall apply to positions under chapter 73 or 74 of such title.</text></paragraph><paragraph id="HD9C20A99CE8C4B1D82966DE747428BB9"><enum>(2)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Director shall issue regulations to implement this section.</text></paragraph></subsection><subsection id="H4F7910E9DFB04028B801BBC26001808A"><enum>(d)</enum><header>Definitions</header><text>In this section—</text><paragraph id="HC34F34543A61410A9B8E5CDDBC5C2541"><enum>(1)</enum><text>the term <term>agency</term> means any department, agency, or instrumentality of the Federal Government; </text></paragraph><paragraph id="H059D8777953443AF9179BE4F643E8CA0"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>competitive service</term> has the meaning given that term in section 2102 of title 5, United States Code;</text></paragraph><paragraph id="HB39C1CBA9FCA4C48915901B2F254D447"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>Director</term> means the Director of the Office of Personnel Management; and</text></paragraph><paragraph id="H2D5ABF719E3341E39FC5435356314AA9"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>excepted service</term> has the meaning given that term in section 2103 of title 5, United States Code.</text></paragraph></subsection></section></legis-body></bill>
