<official-title display="yes">To limit youth offender status in the District of Columbia to individuals 18 years of age or younger, to direct the Attorney General of the District of Columbia to establish and operate a publicly accessible website containing updated statistics on juvenile crime in the District of Columbia, to amend the District of Columbia Home Rule Act to prohibit the Council of the District of Columbia from enacting changes to existing criminal liability sentences, and for other purposes.</official-title>

<section id="H5DCD373ADF4D44F698BEFFBBC0C133E4" section-type="section-one"><enum>1.</enum><header>Short title</header> <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>DC Criminal Reforms to Immediately Make Everyone Safe Act</short-title></quote> or the <quote><short-title>DC CRIMES Act</short-title></quote>.</text></section> <section id="H6EF471EBF9824ACE823A0BD93B3E306E"><enum>2.</enum><header>Youth offenders</header> <subsection id="H1123F109F9084038810DE789C8468DEF"><enum>(a)</enum><header>Limiting youth offender status in District of Columbia to individuals 18 years of age or younger</header> <paragraph id="H3C7FF87F006C4ACDA04A41E598243B6A"> <enum>(1)</enum> <header>Limitation</header> <text display-inline="yes-display-inline">Section 2(6) of the Youth Rehabilitation Act of 1985 (sec. 24–901(6), D.C. Official Code) is amended by striking <quote>24 years of age or younger</quote> and inserting <quote>18 years of age or younger</quote>.</text> </paragraph> 
<paragraph id="H7CDC6709A9DB4A678528369EADCFB940"><enum>(2)</enum><header>Conforming amendments</header> 
<subparagraph id="HBA70BAA0169D4696820A341D864A30E5"> <enum>(A)</enum> <header>Repeal consideration of individuals 18 through 24 years of age in strategic plan for facilities, treatment, and services</header> <text display-inline="yes-display-inline">Section 3(a–1) of such Act (sec. 24–902(a–1), D.C. Official Code) is amended by striking paragraph (3).</text> </subparagraph> <subparagraph id="H68279DC5C49A40C59C7336731174D9C0"> <enum>(B)</enum> <header>Community service for individuals under order of probation</header> <text>Section 4(a)(2) of such Act (sec. 24–903(a)(2), D.C. Official Code) is amended by striking <quote>15 to 24 years of age</quote> and inserting <quote>15 to 18 years of age</quote>.</text> </subparagraph></paragraph></subsection> 
<subsection id="H4BD693092070440EADCC7D99EC0C9F99"> <enum>(b)</enum> <header>Prohibiting issuance of sentence less than mandatory-Minimum term</header> <text>Section 4(b) of such Act (sec. 24–903(b), D.C. Official Code) is amended—</text> <paragraph id="HF5F8774CA11E47E3B129798BA964A701"> <enum>(1)</enum> <text>by striking <quote>(b)(1)</quote> and inserting <quote>(b)</quote>;</text> </paragraph> 
<paragraph id="HE6BAE924AE5E4FB3A4073E309AD0E817"> <enum>(2)</enum> <text>by striking paragraph (2); and</text> </paragraph> <paragraph id="H4E5E665A279C444D975E9359FF04A9CD"> <enum>(3)</enum> <text>by redesignating paragraph (3) as paragraph (2).</text> </paragraph> </subsection></section> 
<section id="H991ADF2B35474760A9806A7DCDC134D0"><enum>3.</enum><header>Establishment and operation of website on District of Columbia juvenile crime statistics</header> 
<subsection id="H66C9CA9D8BB54D5F998995416D01B858"><enum>(a)</enum><header>Establishment and operation</header><text>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/16/23">chapter 23</external-xref> of title 16, District of Columbia Official Code, is amended by adding at the end the following new section:</text> <quoted-block style="USC" id="HF2A9DB750D2F4156AA52EB3B90B98BD1" display-inline="no-display-inline"> <section id="H8C740042290E4A25AC3C5C705F33F799"><enum>16–2340a.</enum><header>Website of updated statistics on juvenile crime</header> <subsection id="H74A7BB466E194FD7A61C6E33F6EB69C4"><enum>(a)</enum><header>Establishment and operation of website</header><text display-inline="yes-display-inline">The Attorney General of the District of Columbia shall establish and operate a publicly accessible website which contains data on juvenile crime in the District of Columbia, including each of the following statistical measures:</text> 
<paragraph id="HADD53D046E294F91B668F32B558376C7"><enum>(1)</enum><text display-inline="yes-display-inline">The total number of juveniles arrested each year.</text></paragraph> <paragraph id="H40EECC0CA4924A11BCBFB2B973BF25CF"><enum>(2)</enum><text>The total number and percentage of juveniles arrested each year, broken down by age, race, and sex.</text></paragraph> 
<paragraph id="H5C028601DD4542C789703C238245D885"><enum>(3)</enum><text>Of the total number of juveniles arrested each year, the total number and percentage arrested for petty crime, including the following crimes:</text> <subparagraph id="H796603474FE54453A009E3F41E55D575"><enum>(A)</enum><text>Vandalism.</text></subparagraph> 
<subparagraph id="H16C90EFBFF79461A8C56BE648E91EDCC"><enum>(B)</enum><text>Theft.</text></subparagraph> <subparagraph id="H31EE1B30F0A249B3A21110CD93E5175A"><enum>(C)</enum><text>Shoplifting.</text></subparagraph></paragraph> 
<paragraph id="H19B870F3905B408CB72D58FBAB7419D7"><enum>(4)</enum><text>Of the total number of juveniles arrested each year, the total number and percentage arrested for crime of violence (as defined in section 23–1331(4)).</text></paragraph> <paragraph id="H5913F89FC442496D9AC0A8F1F7201175"><enum>(5)</enum><text>Of the total number of juveniles arrested each year, the total number and percentage who were arrested for their first offense.</text></paragraph> 
<paragraph id="HDD830AB8078A43A7ACC6070B55D0BD9F"><enum>(6)</enum><text>Of the total number of juveniles arrested each year, the total number and percentage who had been arrested previously.</text></paragraph> <paragraph id="H46444172A11441CFBD4746B6716CA7F7"><enum>(7)</enum><text>Of the total number of juveniles arrested each year who had been arrested previously, the total number and percentage of the number of arrests.</text></paragraph> 
<paragraph id="H8FFE4BF217094E8FA2629104863D865B"><enum>(8)</enum><text>Of the total number of juveniles arrested each year, the declination rate for prosecutions by the Office of the Attorney General for the District of Columbia.</text></paragraph> <paragraph id="H936A5209F7384FF0A83B48A28ED11DDB"><enum>(9)</enum><text>Of the total number of juveniles sentenced each year, the number and percentage who were tried as adults.</text></paragraph> 
<paragraph id="HD684AFF89F8949DEA574AE5A2D6B5630"><enum>(10)</enum><text>Of the total number of juveniles prosecuted each year, the number and percentage who were not sentenced, who were sentenced to a misdemeanor, and who were sentenced to a felony.</text></paragraph> <paragraph id="H2F085C2C26774886BB847A836DC286CD"><enum>(11)</enum><text>Of the total number of juveniles sentenced each year, the number and percentage of the length of time that will be served in a correctional facility as provided by the sentence.</text></paragraph></subsection> 
<subsection id="H448622F2174E488C9460EA1600BFEDB2"><enum>(b)</enum><header>Updates</header><text>The Attorney General shall update the information contained on the website on a monthly basis.</text></subsection> <subsection id="HDDFF5ECDEDC246D08FACF2132982FB26"><enum>(c)</enum><header>Maintaining archive of information</header><text display-inline="yes-display-inline">The Attorney General shall ensure that the information contained on the website is archived appropriately to provide indefinite public access to historical data of juvenile arrests and prosecutions.</text></subsection> 
<subsection id="H557B7904CB9B4B5582301FE869981CAE"><enum>(d)</enum><header>Format</header><text>The Attorney General shall ensure that the information contained in the website, including historical data described in subsection (c), is available in a machine-readable format available for bulk download.</text></subsection> <subsection id="HCB9138F95A6C4322927B0EB61414FD0F"><enum>(e)</enum><header>Prohibiting disclosure of personally identifiable information</header><text>In carrying out this section, the Attorney General shall ensure that the website does not include any juvenile’s personally identifiable information.</text></subsection> 
<subsection id="H855DAC1CE59E434E918182185DECDE5D"><enum>(f)</enum><header>Definitions</header><text>In this section—</text> <paragraph id="H9AF168A724ED456EB98BCF833F38A3B8"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>crime</term> has the meaning given the term <term>offense</term> in section 23–1331(2); and</text></paragraph> 
<paragraph id="H9FB3DD1B8E3D45BD9CAC374C320FAAD2"> <enum>(2)</enum> <text display-inline="yes-display-inline">the term <term>juvenile</term> has the meaning given the term <term>youth offender</term> in section 2(6) of the Youth Rehabilitation Act of 1985 (sec. 24–901(6), D.C. Official Code).</text> </paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H02D76F765AEA4BA68D6706D55C76AEA4"><enum>(b)</enum><header>Conforming amendments relating to authorized release of information</header> <paragraph id="HE705120F65F248DFA8E421975664C035"><enum>(1)</enum><header>Juvenile case records of Family Court</header><text display-inline="yes-display-inline">Section 16–2331, District of Columbia Official Code, is amended—</text> 
<subparagraph id="H51912F820312480CABB71449A7032568"><enum>(A)</enum><text>by redesignating subsection (i) as subsection (j); and</text></subparagraph> <subparagraph id="HC72C0D5D081048FA89FBA57841BF42FC"><enum>(B)</enum><text>by inserting after subsection (h–2) the following new subsection:</text> 
<quoted-block style="USC" id="HE5BF60341FE64611B8523EA5B78C9AB1" display-inline="no-display-inline"> 
<subsection id="HD6DBD021380F4ED596875050A0C18DA1"><enum>(i)</enum><text display-inline="yes-display-inline">Notwithstanding subsection (b) of this section, a person shall provide information contained in juvenile case records to the Attorney General for purposes of the website established and operated under section 16–2340a.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H05A0B33763E848C9B3100BE94664D8B6"><enum>(2)</enum><header>Juvenile social records of Family Court</header><text>Section 16–2332, District of Columbia Official Code, is amended—</text> 
<subparagraph id="H3C96AA9C0B194AFCB48434B3D3A0E83E"><enum>(A)</enum><text>by redesignating subsection (h) as subsection (i); and</text></subparagraph> <subparagraph id="H3B2A6C1500E6451EBD7C441C0694D78B"><enum>(B)</enum><text>by inserting after subsection (g) the following new subsection:</text>

<subsection id="HFA1FCF0D5C804D71B94DCB6E7ED9D38A"><enum>(h)</enum><text display-inline="yes-display-inline">Notwithstanding subsection (b) of this section, a person shall provide information contained in juvenile social records to the Attorney General for purposes of the website established and operated under section 16–2340a.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="HCBF744456F374CDF93EC1062268CE6B3"><enum>(3)</enum><header>Police and other law enforcement records</header><text>Section 16–2333, District of Columbia Official Code, is amended—</text> 
<subparagraph id="HF64BBF8364A548379B49E7CACB86026B"><enum>(A)</enum><text>by redesignating subsection (g) as subsection (h); and</text></subparagraph> <subparagraph id="H85AC6B21020C4A1A8EB0AD35EC97921D"><enum>(B)</enum><text>by inserting after subsection (f) the following new subsection:</text> 
<quoted-block style="USC" id="H52D030E1175D459783661D6ED073913B" display-inline="no-display-inline"> 
<subsection id="HB31C9C8BA0EA45B3B271859722E53172"><enum>(g)</enum><text display-inline="yes-display-inline">Notwithstanding subsection (a) of this section, a person shall provide information contained in law enforcement records and files concerning a child to the Attorney General for purposes of the website established and operated under section 16–2340a.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> <subsection id="HAA81AD9A6568403B8FC17742AD757F54"><enum>(c)</enum><header>Effective date</header><text>The Attorney General of the District of Columbia shall establish the website under section 16–2341, District of Columbia Official Code, as added by subsection (a), not later than 180 days after the date of the enactment of this Act.</text></subsection></section> 
<section id="HB522FE5E3577439FACCD58349472DF53"><enum>4.</enum><header>Prohibiting Council from enacting changes to existing criminal liability sentences</header><text display-inline="no-display-inline">Section 602(a) of the District of Columbia Home Rule Act (sec. 1–206.02(a), D.C. Official Code) is amended—</text> <paragraph id="HE03FF8FAFB0A4CB1A4B953B19F569325"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of paragraph (9);</text></paragraph> 
<paragraph id="H6A13ECF233D349F1BEF39650173E61C0"><enum>(2)</enum><text>by striking the period at the end of paragraph (10) and inserting <quote>; or</quote>; and</text></paragraph> <paragraph id="HA0807C9F339242999E0B0A2AD97D146C"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="H191E70CE5BA44283BBE2A297B0496634"><enum>(11)</enum><text>enact any act, resolution, or rule to change any criminal liability sentence in effect on the date of the enactment of the DC CRIMES Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> </legis-body> </bill>
