R. 4905</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250805">August 5, 2025</action-date><action-desc><sponsor name-id="V000136">Mr. Vasquez</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Workforce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish the Energy Workers Compensation Fund to compensate energy workers for certain medical expenses.</official-title></form><legis-body id="H49CF35C0A7DD423C9FC94AB1779A0819" style="OLC"><section id="H6D2A67ECBA3F41A78183E18BFD3EF100" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Energy Workers Health Improvement and Compensation Fund Act</short-title></quote>.</text></section><section id="HCDE9A6E8C6E842A3974BDF6934DBA1B2"><enum>2.</enum><header>Energy Workers Compensation Fund</header><subsection id="H61D1F6BB014340C3A54932FB2C6CE32F"><enum>(a)</enum><header>Creation of trust fund</header><text display-inline="yes-display-inline">There is established in the Treasury of the United States a trust fund to be known as the <quote>Energy Workers Health Compensation Fund</quote>.</text></subsection><subsection id="HA0A4289425E1481B823F769C996806B6"><enum>(b)</enum><header>Deposits</header><paragraph id="HA05F4B1680FC4F78B5BF7002F05FEBCB"><enum>(1)</enum><header>In general</header><text>Each oil company shall pay with respect to each calendar year (not later than March 31 of the calendar year immediately following such calendar year) an amount equal to the aggregate amounts paid as compensation (including the fair market value of any deferred compensation) to the 10 most highly paid (taking into account all compensation taken into account under this subsection) employees of such company during such calendar year. Such amounts shall be deposited into the Energy Workers Health Compensation Fund.</text></paragraph><paragraph id="H5EEF8D33B7EF494193DBC5D972108C8F"><enum>(2)</enum><header>Penalties for underpayments</header><text>If the Secretary of Labor determines that the amount paid by any oil company with respect to any calendar year is less than 98 percent of the amount properly determined under paragraph (1), such oil company shall pay an additional amount equal to 10 percent of such difference. Such amount shall be deposited into the Energy Workers Health Compensation Fund.</text></paragraph><paragraph id="H92C2FE3132264E6A915CEF0041BF12CF"><enum>(3)</enum><header>Elective contributions</header><text>An oil company may contribute, in addition to any amount required to be paid under paragraph (1) or (2), an additional amount to the Energy Workers Health Compensation Fund not in excess of the amount required to be paid under paragraph (1).</text></paragraph><paragraph id="H3820A673117F4151BD5E75A4F84DC1D1"><enum>(4)</enum><header>Tax treatment of contributions</header><text>No deduction shall be allowed under section 162 (or any other provision) of the Internal Revenue Code of 1986 for any amount required to be paid under paragraph (1) or (2) or any amount contributed to the Energy Workers Health Compensation Fund which is in excess of the amount permitted under paragraph (3).</text></paragraph></subsection><subsection id="HB0392D9B471849B99F5EC4308706E845"><enum>(c)</enum><header>Expenditures</header><text display-inline="yes-display-inline">Amounts in the compensation fund shall be available to the Secretary of Labor, without need of further appropriation, for the purposes of section 3.</text></subsection></section><section id="HC2957117DA69415DAD0EE17E8386E850"><enum>3.</enum><header>Compensation for medical expenses</header><subsection id="H7E06B6DBCCF74703897F0762A3C52B99"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible worker, or family member thereof, shall be entitled to compensation in order to reimburse such eligible worker (or family member thereof) for medical expenses, including copayments and costs not covered by private insurance, Medicare, or Medicaid, associated with—</text><paragraph id="H968DCFC987FE4BF18BEF8648DFB0588F"><enum>(1)</enum><text>asthma;</text></paragraph><paragraph id="HC5A9E9BA4D064BEF821884AE63222154"><enum>(2)</enum><text>heat-related illness; and</text></paragraph><paragraph id="H8EB6C245C0594A43849721D7361F3C9F"><enum>(3)</enum><text display-inline="yes-display-inline">other respiratory or cardiovascular diseases determined by the Secretary, in consultation with the Assistant Secretary of Labor for Occupational Safety and Health, to be associated with methane emissions, high levels of smog, and exposure to particulate matter and volatile organic compounds.</text></paragraph></subsection><subsection id="H35B050A0A57E4FB08C16F6E819A0FF6D"><enum>(b)</enum><header>Payment from trust fund</header><text>The compensation under this section shall be paid from the compensation fund established under section 2.</text></subsection><subsection id="H3E2D525B3FF645F8AC824D54EB7EF730"><enum>(c)</enum><header>Processing of claims</header><text display-inline="yes-display-inline">The Secretary shall provide the compensation to which an individual is entitled under subparagraph (a) in the order in which claims for compensation are received.</text></subsection></section><section id="HBB3ECFF00FDE4002A83BB636EF0DDBFC"><enum>4.</enum><header>Improving health outcomes</header><subsection id="H10B0CE5CF4F546ACBADC508E504374D0"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Secretary shall establish and appoint all members of a commission on health outcomes of oil and gas workers.</text></subsection><subsection id="HA17711878860431794B36C8DB6331820"><enum>(b)</enum><header>Membership</header><paragraph id="H66A8C0432FEE4EC283EF9A1AABA12439"><enum>(1)</enum><header>In general</header><text>The Commission shall be composed of members who represent diverse experiences and backgrounds that provide balanced points of view with regard to the duties of the Commission.</text></paragraph><paragraph id="H9785D240F2E44C4AB848743B868110F1"><enum>(2)</enum><header>Appointment</header><text>The Secretary shall appoint the members to the Commission, including representatives—</text><subparagraph id="H54E676319ABB4B1F9F3AE4A9149054C4"><enum>(A)</enum><text>from—</text><clause id="H73E9FCF7EB0B4F8DB834D720AB4D7111"><enum>(i)</enum><text display-inline="yes-display-inline">the Department of Health and Human Services;</text></clause><clause id="HF38949DA3D3F45738FC4A69C29348C84"><enum>(ii)</enum><text>the Department of Labor;</text></clause><clause id="H13A8672D44734BAF86E5FFE214DF7209"><enum>(iii)</enum><text>the National Institutes of Health, who shall be a doctor who does research into the subject matter of the Commission;</text></clause><clause id="H1A86B76EB304488E9DECAD65CEB10A35"><enum>(iv)</enum><text>the Occupation Safety and Health Administration;</text></clause><clause id="H25AC4ACBDEED462392D8FBB4938BE6DA"><enum>(v)</enum><text>an immigration advocacy group; and</text></clause><clause id="HAB69BDE0076A4AA8ABD446A7FCD75B77"><enum>(vi)</enum><text>a labor advocacy group; and</text></clause></subparagraph><subparagraph id="H23C40D6FFA2B407693AB15C70891E0ED"><enum>(B)</enum><text display-inline="yes-display-inline">who are eligible workers employed by oil companies, including one such representative from each of the following States:</text><clause id="H935214560C0E4CC581E1231E7BB547DD"><enum>(i)</enum><text display-inline="yes-display-inline">Alaska.</text></clause><clause id="H27317B3D8D3241CFB4DE8C1C8334C08D"><enum>(ii)</enum><text>Colorado.</text></clause><clause id="H1E4DE0FEFC7E41599E4F122118B8FFFA"><enum>(iii)</enum><text>Louisiana.</text></clause><clause id="HB3EB9BB3A5B546879138108D37520C6D"><enum>(iv)</enum><text>New Mexico.</text></clause><clause id="H3B94E44066704BEF97DB85B53762CE66"><enum>(v)</enum><text>North Dakota.</text></clause><clause id="HD32273AD052B413A9B58F1FED47C45D6"><enum>(vi)</enum><text>Texas.</text></clause></subparagraph></paragraph><paragraph id="HFE50AD4BE02A4045A0D5FC1367BABCD0"><enum>(3)</enum><header>Periods of appointment</header><text>Members shall be appointed for the duration of the Commission.</text></paragraph><paragraph id="H3CD1F66EFEC744E2927B807FA84E6BC4"><enum>(4)</enum><header>Vacancies</header><text>A vacancy in the Commission shall be filled in the manner in which the original appointment was made and shall not affect the powers or duties of the Commission.</text></paragraph><paragraph id="HD878E42772404CE691E6616E873C86DE"><enum>(5)</enum><header>Compensation</header><text>Commission members shall serve without compensation.</text></paragraph><paragraph id="H0D7EB4FDBB9B4200B384C6AB9C007476"><enum>(6)</enum><header>Travel expenses</header><text>The Secretary shall consider the provision of travel expenses, including per diem, to Commission members when appropriate.</text></paragraph></subsection><subsection id="HD09FBE5089F1426D9391762976AD378C"><enum>(c)</enum><header>Duties</header><paragraph id="H6FACF828A43B45578AD4003D0E207EFF"><enum>(1)</enum><header>In general</header><text>The Commission may hold such hearings, meet and act at times and places, take such testimony, and receive such evidence as the Commission considers to be advisable to carry out the duties of the Commission under this section.</text></paragraph><paragraph id="HF7B3E124E8394225A95035A0C3931185"><enum>(2)</enum><header>Recommendations for the Department of Labor</header><subparagraph id="H47E89A2D91B94E62B2ADA7115AA28419"><enum>(A)</enum><header>In general</header><text>The Commission shall develop recommendations to the Secretary on actions the Federal Government can take to study and improve health outcomes of oil and gas workers.</text></subparagraph><subparagraph id="H1DA0751CE49248329036BE91A34DAF46"><enum>(B)</enum><header>Submission</header><text>Not later than 18 months after the enactment of this Act, the Commission shall make publicly available and submit all recommendations developed under this paragraph to—</text><clause id="H59CDB7B8870346E0BBA3DA081F98BD12"><enum>(i)</enum><text>the Secretary;</text></clause><clause id="H1F5115DDAA4444A58747D65BE1B24571"><enum>(ii)</enum><text>the Committee on Energy and Natural Resources of the Senate;</text></clause><clause id="H2EE049A76D6E46B8BBA079E3092F380D"><enum>(iii)</enum><text>the Committee on Health, Education, Labor, and Pensions of the Senate;</text></clause><clause id="H052B1B4B9706408186A8ED9AE2D3165C"><enum>(iv)</enum><text>the Committee on Energy and Commerce of the House of Representatives; and</text></clause><clause id="HFF8B74E6E75D489BA680C1BABF98B249"><enum>(v)</enum><text>the Committee on Natural Resources of the House of Representatives.</text></clause></subparagraph><subparagraph id="H082FD9984CAC45DA82BBD5EA558B5342"><enum>(C)</enum><header>Secretarial response</header><text>Not later than 90 days after the date on which the Secretary receives the recommendations under paragraph (2), the Secretary shall make publicly available and submit a written response to the recommendations to—</text><clause id="HF76E01C8F066487F8BB1F25CB30A0048"><enum>(i)</enum><text>the Commission;</text></clause><clause id="H273E275B22E24945996B8480D669D0D0"><enum>(ii)</enum><text>the Committee on Energy and Natural Resources of the Senate;</text></clause><clause id="HE627FAB08E0F48B6906D7111CEC5601D"><enum>(iii)</enum><text>the Committee on Health, Education, Labor, and Pensions of the Senate;</text></clause><clause id="H3946E560CCDC40C0BEBCFC9467C946ED"><enum>(iv)</enum><text>the Committee on Energy and Commerce of the House of Representatives; and</text></clause><clause id="H3355FED266284A94AC420C164664FE4A"><enum>(v)</enum><text>the Committee on Natural Resources of the House of Representatives.</text></clause></subparagraph></paragraph></subsection></section><section id="H4CD3313B726F44899AFA326D81EC232A"><enum>5.</enum><header>Report to Commission</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Secretary of Labor shall report to the Commission established under section 4(a) on the compensation fund, including—</text><paragraph id="HB26D15AE3C864A03A76DE0905BC28EB9"><enum>(1)</enum><text>deposits required under section 2(b); and</text></paragraph><paragraph id="H9E55ADA165A74E5186F0137088416097"><enum>(2)</enum><text display-inline="yes-display-inline">compensation paid under section 3.</text></paragraph></section><section id="H6CFB3C6BB6754496B418A9F79BEBF5C4"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H7C2E7ED45F864A5EB1ADD693AB32404E"><enum>(1)</enum><header>Eligible worker</header><text display-inline="yes-display-inline">The term <term>eligible worker</term> means any individual who—</text><subparagraph id="HA1A684B3CDDA4E0E9890CA685D840399"><enum>(A)</enum><text>either—</text><clause id="HD9055B4A806F4C328C49C7BF4D678D9B"><enum>(i)</enum><text>works or has worked within or around a oil and gas extraction or exploration site for not less than 1 year; or</text></clause><clause id="HF8C3D83F7353450F9181AC7C01B11C6C"><enum>(ii)</enum><text>lives or has lived within 20 miles of such a site for not less than 1 year; and</text></clause></subparagraph><subparagraph id="H0E47BCA8FE77492296D02E32FA76671E"><enum>(B)</enum><text>works or has worked for an oil company engaged in oil and gas extraction or exploration or for a company contracted to perform those duties.</text></subparagraph></paragraph><paragraph id="HAF2AFAB8A59F4A6B9B5B4AABB1E0034C"><enum>(2)</enum><header>Family member</header><text display-inline="yes-display-inline">The term <term>family member</term> means the spouse, son, daughter, or parent of an eligible worker, if such spouse, son, daughter, or parent lives or has lived within 20 miles of an oil and gas extraction or exploration site for not less than 1 year.</text></paragraph><paragraph id="H26517BBD6AE348EDAB73D8448EF451F5" commented="no"><enum>(3)</enum><header>Oil company</header><text display-inline="yes-display-inline">The term <term>oil company</term> means a company engaged in oil or natural gas exploration or extraction with annual revenue greater than $50,000,000.</text></paragraph><paragraph id="H3FFE5B37F5804FB69AF86BA7E1E8E1C2"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Labor.</text></paragraph><paragraph id="HD648D8BB2E5B4F4881D814EC10D0FE77"><enum>(5)</enum><header>Compensation fund</header><text>The term <term>compensation fund</term> means the Energy Workers Health Compensation Fund established under section 2.</text></paragraph></section></legis-body></bill>
