<section id="HD070F907393247DE9BBDE5596B1595BD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Plastic Health Research Act</short-title></quote>.</text></section> <section id="HFC8AF4AA95204B41AAD5074CC663B502"><enum>2.</enum><header>Plastic exposure health research</header> <subsection id="H28F5E7A494FF4A719727FF884BA6BD99"><enum>(a)</enum><header>Expansion and coordination; research grants</header><text display-inline="yes-display-inline">The Public Health Service Act is amended by inserting after section 399V–7 (<external-xref legal-doc="usc" parsable-cite="usc/42/280g-18">42 U.S.C. 280g–18</external-xref>) the following:</text>

<section id="H9F59F4E5A928481C8996BF6FE759673E"><enum>399V–8.</enum><header>Plastic exposure health research</header> 
<subsection id="HA88DA811B07D436B809DB3EB22E70F5D" commented="no"><enum>(a)</enum><header>Expansion and coordination of research activities</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Administrator of the Environmental Protection Agency, the Commissioner of Food and Drugs, the Administrator of the National Oceanic and Atmospheric Administration, the Director of the National Institute of Standards and Technology, and the Director of the National Institute of Environmental Health Sciences, shall carry out, expand, and coordinate programs for the conduct and support of research with respect to understanding plastic exposures and the potential health effects stemming from plastic exposure. The Secretary shall prioritize such research that—</text> <paragraph id="HCA2473A3839E4F2BA53CF7AD4DDB81E2"><enum>(1)</enum><text>promotes the improvement of scientific quality through the development of vetted research methods that are reproducible, improve comparability of results among research studies, and develop standards definitions for microplastics and nanoplastics materials;</text></paragraph> 
<paragraph id="H96E66537F1114F17B2CF83DB30BA4366"><enum>(2)</enum><text>develops validated testing methodologies and reference materials for microplastics and nanoplastics in different media that are reproducible and improve comparability of results among research studies; or</text></paragraph> <paragraph id="H4C661DDDA1C9454389A4C67A7594BD63"><enum>(3)</enum><text display-inline="yes-display-inline">fills gaps in the field of potential health effects research through the use of methods that improve the quality and comparability of scientific results.</text></paragraph></subsection> 
<subsection id="HDA4C4AE39E5D413DB2B015AAB7401C15"><enum>(b)</enum><header>Plastic exposure health research grants</header> 
<paragraph id="H850489DD8648403DB41AADE7C0F0E0D5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Administrator of the Environmental Protection Agency, the Commissioner of Food and Drugs, the Administrator of the National Oceanic and Atmospheric Administration, the Director of the National Institute of Standards and Technology, and the Director of the National Institute of Environmental Health Sciences, may award grants or contracts to public entities, nonprofit entities, academic research institutions, or consortia of such entities (including such consortia that collaborate with private entities) to conduct scientific research on plastic exposure and the potential health effects stemming from such exposure. In awarding such grants and contracts, the Secretary shall prioritize research that—</text> <subparagraph id="HC0C6525B002749DD855B9EB9E55212F5"><enum>(A)</enum><text>improves the quality of scientific information through the development of vetted research methods that are reproducible, improve comparability of results among research studies, and develop standard definitions for microplastic and nanoplastic materials;</text></subparagraph> 
<subparagraph id="H1B2B75963F0C489A8CED0C122C55FF77"><enum>(B)</enum><text>develops validated testing methodologies and reference materials for microplastics and nanoplastics in different media that are reproducible and improve comparability of results among research studies; or</text></subparagraph> <subparagraph id="H3C1D44352FCB4AA69AF04C0CEC9704A8"><enum>(C)</enum><text display-inline="yes-display-inline">fills gaps in the field of potential health effects research through the use of methods that improve the quality and comparability of scientific results.</text></subparagraph></paragraph> 
<paragraph id="H73B1AE1FF50947A1A8031DA507E2D22E"><enum>(2)</enum><header>Applications</header><text display-inline="yes-display-inline">To be eligible for a grant or contract under this subsection, an entity shall submit to the Secretary an application in such form, in such manner, and containing such agreements, assurances, and information as the Secretary determines necessary.</text></paragraph> <paragraph id="H9EED5A7809CA4B77871B2A01CF78A49C"><enum>(3)</enum><header>Reports</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this section, and annually thereafter for each of the following 4 years, the Secretary shall submit to Congress, and make publicly available, a report that provides an overview of the research conducted or supported under this section, together with any relevant findings.</text></paragraph> 
<paragraph id="HBDDF76C09ED147009E4D7A5D2FF85FD5"><enum>(4)</enum><header>Information sharing</header><text display-inline="yes-display-inline">The Secretary shall share the findings of the research supported by grants and contracts under this subsection with—</text> <subparagraph id="HC1AA00B8D96149B18078AC1139CBB105"><enum>(A)</enum><text>the heads of relevant institutes and agencies of the Department of Health and Human Services (including the Director of the National Institute of Environmental Health Sciences and the Commissioner of Food and Drugs);</text></subparagraph> 
<subparagraph id="HB4A0B79BBE5047DDAE6E0F6427F23ABC"><enum>(B)</enum><text>the Administrator of the Environmental Protection Agency;</text></subparagraph> <subparagraph id="HABA682C7ABDD4CD1B31406BF6071B5EE"><enum>(C)</enum><text display-inline="yes-display-inline">the Director of the National Institute of Standards and Technology;</text></subparagraph> 
<subparagraph id="H78B79B5148D64A11B79DF27D31D80C93"><enum>(D)</enum><text>the Administrator of the National Oceanic and Atmospheric Administration; and</text></subparagraph> <subparagraph id="HF890ADD6B0D94D18A8E9B2D41075522E"><enum>(E)</enum><text>the centers of excellence for plastic exposure health research described in section 463C.</text></subparagraph></paragraph> 
<paragraph id="H0A6E54DDF2D147B2B7E58BB2A93BF06C"><enum>(5)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $10,000,000 for each of fiscal years 2026 through 2030.</text></paragraph></subsection> <subsection id="H71EB6EC7511D42799E6F42F11C5B3E8E" display-inline="no-display-inline"><enum>(c)</enum><header>Plastic exposure defined</header><text display-inline="yes-display-inline">In this section, the term <term>plastic exposure</term> means exposure to macroplastics, microplastics, and nanoplastics, including through plastic production and manufacturing, occupational exposure, environmental exposure, end-user interaction (such as handling and use of food packaging, manufactured goods, and textiles), plastic recycling, plastic degradation through natural or human-made processes, and plastic waste and disposal.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF7B75E0FD64D4F13BB0A240C32C726BA"><enum>(b)</enum><header>Centers of excellence for plastic exposure health research</header><text display-inline="yes-display-inline">The Public Health Service Act is amended by inserting after section 463B (<external-xref legal-doc="usc" parsable-cite="usc/42/285l-6">42 U.S.C. 285l–6</external-xref>) the following:</text> <quoted-block style="OLC" id="HF1DA3ECDD4AD46079178848D146F6C1D" display-inline="no-display-inline"> <section id="HFE4DB138F32A4DD1A6A33B11DB89BA6C"><enum>463C.</enum><header>Centers of excellence for plastic exposure health research</header> <subsection id="H191C16239A584D79AB8BBCDAD614029C"> <enum>(a)</enum> <header>In general</header> <text display-inline="yes-display-inline">The Secretary, acting through the Director of the Institute (in this section referred to as the <quote>Secretary</quote>) may award grants to, or enter into appropriate funding agreements with, public entities, nonprofit entities, academic research institutions, or consortia of such entities (including such consortia that collaborate with private entities) to pay all or part of the cost of planning, establishing, or strengthening, and providing basic operating support for, centers of excellence to conduct and improve the quality of scientific research to inform public health determinations and increase public awareness (where scientifically warranted) with respect to the potential health effects caused by plastic exposure. Such centers shall prioritize research that—</text>

                <enum>(1)</enum>
 <text>develops standard material definitions;</text> </paragraph> <paragraph id="H253EFFAC9823489F933CF648EE320FAC"> <enum>(2)</enum> <text>improves the quality of scientific results to fill gaps in the field of research;</text>
              </paragraph>
              <paragraph id="H9A5BE789F94A4CECA7E1098A52EF0F99">
                <enum>(3)</enum>
 <text display-inline="yes-display-inline">fills gaps in the field of health research through the use of methods that improve the quality and comparability of scientific results; or</text>
              </paragraph>
              <paragraph id="HC33F6721A7FF4513A6247E0A381DA6C5">
                <enum>(4)</enum>
 <text>develops vetted testing methodologies for microplastics and nanoplastics that can be replicated and can be compared to other testing methodologies.</text>
              </paragraph>
            </subsection> 
<subsection id="HB61EAAAC24164B70A9564EA6B8722190"><enum>(b)</enum><header>Purposes of centers</header><text>The purposes of the centers of excellence referred to in subsection (a) are—</text> <paragraph id="HACEA6D40390F4D6D86C3F7BB79DC7498"><enum>(1)</enum><text display-inline="yes-display-inline">to improve the quality of scientific results while researching the potential health effects stemming from plastic exposure, including identifying potential links between plastic exposure and such potential health effects;</text></paragraph> 
<paragraph id="H2C2684B67C9F4EC7BEBEA1966C19AC6F"><enum>(2)</enum><text display-inline="yes-display-inline">to identify potential exposures to plastic and conduct hazard assessments and risk assessments; and</text></paragraph> <paragraph id="HFBCF0C17D82C45C7B05ED545115895D0"><enum>(3)</enum><text>to increase public awareness (where scientifically warranted) of—</text> 
<subparagraph id="H8C7B7E9B00974627BA1BB8557B247B30"><enum>(A)</enum><text>the potential health effects of plastic exposure, sources of such exposure, outcomes of hazard assessments, and the results of risk assessments relating to such exposure; and</text></subparagraph> <subparagraph id="H3449E971FB8147588204DF4B3B38F876"><enum>(B)</enum><text>the research referred to in—</text> 
<clause id="H686623B38DB54FBBA434E1001036E653"><enum>(i)</enum><text>paragraph (1); or</text></clause> <clause id="H1B634C89FEF0456DB67358C38D46BAD8"><enum>(ii)</enum><text>section 399V–8(a).</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H533F8578721449FFA0109F224E3C8253"><enum>(c)</enum><header>Use of funds</header><text>Funds made available under this section may be used for—</text> <paragraph id="H37106329D4044917A094D4C20B85C1D4"><enum>(1)</enum><text display-inline="yes-display-inline">the development of plastic hazard, exposure, or risk assessment methodologies that can be replicated and compared to other methodologies, which shall include—</text> 
<subparagraph id="HE8C4F0BED36447E791C69C3959796970"><enum>(A)</enum><text>the comprehensive characterization and methods for characterization of the chemical and physical properties of microplastics, nanoplastics, macroplastics, and other plastics;</text></subparagraph> <subparagraph id="HF48B3DA4CAD149659B0CFB1C1DA725B4"><enum>(B)</enum><text>the development of validated testing methodologies for microplastics and nanoplastics in different media that can be replicated and compared to other testing methodologies; and</text></subparagraph> 
<subparagraph id="H68CAEFDC63A64BE4818227B054679764"><enum>(C)</enum><text>detailing the quality assurance and quality control measures taken to improve the scientific results;</text></subparagraph></paragraph> <paragraph id="HCB93D838FBAE40D49B922FE5E1AB2FF8"><enum>(2)</enum><text>the application of exposure methodologies (including both new and existing methodologies), if appropriately validated and controlled, to assess the potential burden of plastic exposures;</text></paragraph> 
<paragraph id="H88915513F2C64925BE04E8E87BA09A37"><enum>(3)</enum><text>the support of research to assess potential health impacts of plastic exposure; and</text></paragraph> <paragraph id="HF03DE3A3ED874C61A8561CD21B6FCBE5"><enum>(4)</enum><text>increasing public awareness of research results, as scientifically warranted.</text></paragraph></subsection> 
<subsection id="H22AA3738DED046F58544D5F00DC13AC7"><enum>(d)</enum><header>Policies</header><text display-inline="yes-display-inline">A grant or agreement under this section shall be entered into in accordance with policies established by the Secretary.</text></subsection> <subsection id="H7794F2E93BFF4741A5E2FF86E52AE7D3"><enum>(e)</enum><header>Duration of grant or agreement</header><text>A grant or agreement under this section shall be for a period of 5 years, and may be renewed by the Secretary for subsequent 5-year periods in the case of a center of excellence for which an appropriate technical and scientific peer review group established by the Secretary has—</text> 
<paragraph id="H7DCFE89737F84CAF80839C5A9F2115E8"><enum>(1)</enum><text>reviewed the operations of such center; and</text></paragraph> <paragraph id="H490332A1DDE4465AB84BD6876AEC71D8"><enum>(2)</enum><text>submitted to the Secretary a recommendation that such grant or agreement be renewed.</text></paragraph></subsection> 
<subsection id="H3322247FF14D40ADA785F83BC5AE7C4E"><enum>(f)</enum><header>Coordination and information sharing with other institutes and agencies</header> 
<paragraph id="H923BA1F68AB24EB9AB4C61F5E59AF89F"><enum>(1)</enum><header>Coordination</header><text display-inline="yes-display-inline">The Secretary shall coordinate the activities under this section with related activities of other institutes and agencies of the Department of Health and Human Services (including the National Institute of Environmental Health Sciences and the Food and Drug Administration), the Environmental Protection Agency, the National Institute of Standards and Technology, and the National Oceanic and Atmospheric Administration.</text></paragraph> <paragraph id="HE3A8223AE4DA42FCBFA4E5D4CD00093B"><enum>(2)</enum><header>Information sharing</header><text display-inline="yes-display-inline">The Secretary shall share research findings of the centers of excellence referred to in subsection (a) with other institutes and agencies of the Department of Health and Human Services (including the National Institute of Environmental Health Sciences and the Food and Drug Administration), the Environmental Protection Agency, the National Institute of Standards and Technology, and the National Oceanic and Atmospheric Administration.</text></paragraph>
