<section id="H3C4BC9794F424D0CB3F61ACB67DE03C8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Primacy Certainty Act of 2025</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="HAEECEDB9E1E9442D93699295F8FDA114"><enum>2.</enum><header>State primary enforcement responsibility for Class VI wells</header> <subsection commented="no" display-inline="no-display-inline" id="H09248C673EB14D11BB8D94E9A04853A4"><enum>(a)</enum><header>Amendments</header><text>Section 1422(b) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300h-1">42 U.S.C. 300h–1(b)</external-xref>) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H76A3A3F2DEF144A2BA8945E8D5B871C9"><enum>(1)</enum><text>in paragraph (2)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HFE38605EBE1F440D9138694F7F8CA40A"><enum>(A)</enum><text>by striking <quote>(2) Within ninety days</quote> and inserting the following:</text>

<paragraph id="HBFB72FBED84547D3A71540274CFE4753"><enum>(2)</enum><header>Required timeline</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H33F1F81C1FD34C48B88EB8837D75AB6F"><enum>(A)</enum><header display-inline="yes-display-inline">Definition of Class VI well</header><text>In this paragraph, the term <term>Class VI well</term> has the meaning given the term in section 40306(a) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300h-9">42 U.S.C. 300h–9(a)</external-xref>).</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H3328C59FB5324A49A6D6B2E45D829DB7"><enum>(B)</enum><header display-inline="yes-display-inline">General deadline for response</header><text>Within 90 days</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H6B0D2AEF0EE946D5AE9947BB2A5F99E3"><enum>(B)</enum><text>by adding at the end the following:</text> <quoted-block id="HE5F31609768A47BC98347059E8B7BD6A" style="OLC" act-name=""> <subparagraph id="H48E6885FD17146399DED5A9FBCAA4FE2"><enum>(C)</enum><header>Notice related to State primary enforcement responsibility for class VI wells</header> <clause commented="no" display-inline="no-display-inline" id="H97BBECC642A344A9BE1B41DADD2E76BA"><enum>(i)</enum><header>Notice to State</header><text display-inline="yes-display-inline">If the Administrator does not approve, disapprove, or approve in part and disapprove in part the State's underground injection control program for Class VI wells by not later than 180 days after the date on which the application of the State is submitted under paragraph (1)(A) or notice of the State is submitted under paragraph (1)(B), the Administrator shall transmit to the State, in writing, a detailed explanation that describes—</text>
<subclause commented="no" display-inline="no-display-inline" id="HBCFCF0BD852E4F8B8ACBE88F7DB3AE16"><enum>(I)</enum><text display-inline="yes-display-inline">the status of the review of the application or notice, as applicable;</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="H2E16C24C85D74DA8BCE807A196C364C4"><enum>(II)</enum><text display-inline="yes-display-inline">the reason for which a decision with respect to that application or notice has not yet been made; and</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="HFACC2EA7EF50412E94503DD19896DAA1"><enum>(III)</enum><text display-inline="yes-display-inline">an itemized list of specific deficiencies with the application or notice to be addressed to receive approval of that application or notice, in accordance with the requirements of this title.</text></subclause></clause> <clause commented="no" display-inline="no-display-inline" id="H92F304E7697A4E0BA0A42BD2CF38C38D"><enum>(ii)</enum><header>Automatic approval for Class VI wells</header> <subclause commented="no" display-inline="no-display-inline" id="HDD03D6ADF8AC4020B484E5A17224C59D"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text>If the Administrator has not approved, disapproved, or approved in part and disapproved in part a complete application submitted under paragraph (1)(A) or notice submitted under paragraph (1)(B) of a State's underground injection control program to regulate Class VI wells in writing by not later than the date that is 30 days after the end of the 180-day period described in clause (i), that application or notice shall be considered approved by the Administrator if the State has established and implemented a primary enforcement authority program for 1 or more other classes of underground injection control wells (including adequate recordkeeping and reporting) to prevent underground injection that endangers drinking water sources.</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H020F0D356861419F824C983413C2817E"><enum>(II)</enum><header>Determination of completeness</header>
<item commented="no" display-inline="no-display-inline" id="H887B17602ACF4D4C84FD4573EEAAE4B4"><enum>(aa)</enum><header display-inline="yes-display-inline">Deadline</header><text>The Administrator shall determine whether an application submitted under paragraph (1)(A) or notice submitted under paragraph (1)(B) is complete for purposes of subclause (I), and provide notice to the State of any deficiencies in that application or notice, by not later than 10 days after the date on which the State submits the application or notice.</text></item> <item commented="no" display-inline="no-display-inline" id="H2F115A9DC0FF49B5BDDC7575817BD778"><enum>(bb)</enum><header>Failure to make determination concerning completeness of Class VI primacy application or notice</header><text display-inline="yes-display-inline">If the Administrator has not made a determination under item (aa) by the end of the 10-day period described in that item, on request of the State that submitted the application or notice, the application or notice shall be considered administratively complete.</text></item></subclause></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HFABA5BCBA34445FEBAEDF5F276D61D89"><enum>(D)</enum><header>Pending permits and applications for Class VI wells</header><text display-inline="yes-display-inline">With respect to Class VI wells and the efforts of a State to obtain from the Administrator primary enforcement responsibility of Class VI wells, following the approval of an application under paragraph (1)(A) or notice under paragraph (1)(B) for a State, the Administrator shall, as expeditiously as possible—</text> <clause commented="no" display-inline="no-display-inline" id="H953F70BC539547FC8C69A6C04CE4A4DC"><enum>(i)</enum><text display-inline="yes-display-inline">render a decision on any pending permits or applications for the operation of Class VI wells in the State prior to that State assuming primary enforcement responsibility for Class VI wells; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H7DE61AE90D384C378C6FB23163088093"><enum>(ii)</enum><text display-inline="yes-display-inline">transfer to that State all pending permits, applications, and other information relevant to operating an underground injection control program to regulate Class VI wells not already in possession of the State following that State assuming primary enforcement responsibility for Class VI wells.</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HD74500339F9C43F595EEED5DF249276E"><enum>(E)</enum><header>Grounds for denial of class VI well applications</header><text display-inline="yes-display-inline">A denial or approval in part and disapproval in part with respect to an application under paragraph (1)(A) or notice under paragraph (1)(B) for a State to operate an underground injection control program to regulate Class VI wells shall be based solely on a finding by the Administrator that the State does not meet the criteria described in paragraph (1)(A).</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H46A253A0A9B0446CAA91538C48AA69EC"><enum>(F)</enum><header>No conditions for decisions</header><text display-inline="yes-display-inline">The Administrator shall not condition the approval of an application under paragraph (1)(A) or notice under paragraph (1)(B) for a State to operate an underground injection control program to regulate Class VI wells on the inclusion of—</text> <clause commented="no" display-inline="no-display-inline" id="H57309D96750C4ED88F96EE80CA6CEECD"><enum>(i)</enum><text display-inline="yes-display-inline">provisions not otherwise included in the application or notice on the date of submission; or</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HFCFB9DDD0C334B7A809F3EDC98B99CBA"><enum>(ii)</enum><text display-inline="yes-display-inline">any other provision not otherwise explicitly required by this title.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HDD69DA2A92FC4489A7FA0B74A6C748DF"><enum>(2)</enum><text>by adding at the end the following:</text>

<paragraph id="H8FE12AFC9AEE442091A7AB7257068B5D"><enum>(5)</enum><header>Preapplication activities for Class VI wells</header><text>With respect to Class VI wells (as defined in paragraph (2)(A)) and the efforts of a State to obtain from the Administrator primary enforcement responsibility of Class VI wells (as so defined), the Administrator, acting through the individual designated under paragraph (6), shall work as expeditiously as possible with States to complete any necessary activities prior to the submission of an application under paragraph (1)(A) or notice under paragraph (1)(B), taking into consideration the need for a thorough and detailed application or notice, as applicable.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HAFE1873D74BF4B239A329EAA56D13356"> <enum>(6)</enum> <header>Application coordination for Class VI wells</header> <text display-inline="yes-display-inline">With respect to underground injection control programs of States, or portions of underground injection control programs of States, that regulate Class VI wells (as defined in paragraph (2)(A)), the Administrator shall designate 1 individual to be responsible for coordinating for each State—</text>
                            <subparagraph commented="no" display-inline="no-display-inline" id="H5964F2F6A6AD4F01BDDC99DED6EBE8AF">
                                <enum>(A)</enum>
 <text display-inline="yes-display-inline">in accordance with paragraph (5), the completion of any necessary activities prior to the submission of an application submitted under paragraph (1)(A) or notice submitted under paragraph (1)(B);</text>
                            </subparagraph>
                            <subparagraph commented="no" display-inline="no-display-inline" id="H70E4BC8D0EF142A2B768C0C47915EAB6">
                                <enum>(B)</enum>
 <text display-inline="yes-display-inline">the review of an application submitted under paragraph (1)(A) or notice submitted under paragraph (1)(B); and</text>
                            </subparagraph>
                            <subparagraph commented="no" display-inline="no-display-inline" id="HC7CC9B6D670B4939B4B8E624EC851102">
                                <enum>(C)</enum>
 <text display-inline="yes-display-inline">the hiring of any additional staff necessary to carry out subparagraphs (A) and (B).</text>
                            </subparagraph>
                        </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H138FD5378C1843C986A81B9C8289DB31"><enum>(7)</enum><header>Evaluation of resources</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this paragraph, the Administrator, in consultation with the individual designated under paragraph (6), shall submit to the Committees on Environment and Public Works and Appropriations of the Senate and the Committees on Energy and Commerce and Appropriations of the House of Representatives a report that describes—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H2244EF3CD94C44408EB2E497A45E3D34"><enum>(A)</enum><text display-inline="yes-display-inline">the availability of staff and resources to promptly carry out the requirements of the amendments made by section 2(a) of the <short-title>Primacy Certainty Act of 2025</short-title>; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H4FFFFB6C419D445A973E117D4DDB69BA"><enum>(B)</enum><text display-inline="yes-display-inline">any funding necessary to promptly carry out the requirements of the amendments made by section 2(a) of the <short-title>Primacy Certainty Act of 2025</short-title>.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H17F50BCFE9F94213A5D204A3328EF5E3"><enum>(b)</enum><header>Use of IIJA funds</header> <paragraph commented="no" display-inline="no-display-inline" id="HE58EEF3F1D1449B3A1790FF1841FA8F7"><enum>(1)</enum><header>Use for report</header><text>Amounts made available to carry out section 40306(b) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300h-9">42 U.S.C. 300h–9(b)</external-xref>) may, beginning on the date of enactment of this Act, be used to carry out paragraph (7) of section 1422(b) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300h-1">42 U.S.C. 300h–1(b)</external-xref>).</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HDF8611E8B5D2409BA0D46B7F1AC2556F"><enum>(2)</enum><header>Conforming amendment</header><text>Section 40306(b) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300h-9">42 U.S.C. 300h–9(b)</external-xref>) is amended by inserting <quote>(including carrying out paragraph (7) of section 1422(b) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300h-1">42 U.S.C. 300h–1(b)</external-xref>) in accordance with section 2(b)(1) of the <short-title>Primacy Certainty Act of 2025</short-title>)</quote> after <quote>2010))</quote>.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H42429096C684446FB817541DCDD681E7"><enum>(c)</enum><header>Rules of construction</header> <paragraph commented="no" display-inline="no-display-inline" id="HFCBC2F8C47494BAF8393B1256EC0DDA6"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H521AA8FBF09F4A8694177663705A32AC"><enum>(A)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H10998FD33DFF41C19160F9CC7792C679"><enum>(B)</enum><header>Class VI well</header><text>The term <term>Class VI well</term> has the meaning given the term in section 40306(a) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300h-9">42 U.S.C. 300h–9(a)</external-xref>).</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HD73BC94B70A04FE8A0C15C5DED45C5AB"><enum>(2)</enum><header>Ability to deny or withdraw State primary enforcement responsibility</header><text>Nothing in the amendments made by this section limits the ability of the Administrator—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H0DC6FE9883964173983DF22A0C1BB86F"><enum>(A)</enum><text>to deny an application under paragraph (1)(A) of subsection (b) of section 1422 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300h-1">42 U.S.C. 300h–1</external-xref>) or notice under paragraph (1)(B) of that subsection of a State to operate an underground injection control program to regulate Class VI wells; or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H85C5D9D29E6441CE9A740C962D88A203"><enum>(B)</enum><text>to revoke primary enforcement responsibility in accordance with that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>).</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H1A90BE62AC9D491981A22520F97DA3AC"><enum>(3)</enum><header>Applicability to new submissions</header><text>The amendments made by this section shall apply to all applications under paragraph (1)(A) of subsection (b) of section 1422 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300h-1">42 U.S.C. 300h–1</external-xref>) and notices under paragraph (1)(B) of that subsection for underground injection control programs of States, or portions of underground injection control programs of States, that regulate Class VI wells submitted to the Administrator pursuant to that section on and after the date of enactment of this Act.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H4722C32C0FA84088AA69686C59D41572"><enum>(4)</enum><header>Applicability to prior submissions</header><text>With respect to applications under paragraph (1)(A) of subsection (b) of section 1422 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300h-1">42 U.S.C. 300h–1</external-xref>) and notices under paragraph (1)(B) of that subsection for underground injection control programs of States, or portions of underground injection control programs of States, that regulate Class VI wells that were submitted to the Administrator, but not approved, before the date of enactment of this Act—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H6B6ED8D25FF4479ABF357EF9795EE069"><enum>(A)</enum><text>the 180-day period described in paragraph (2)(C)(i) of that section shall begin on the date of enactment of this Act; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H0C45B5453EAE4524A559D5C0DDE8EBD2"><enum>(B)</enum><text>the Administrator shall process and make decisions, pursuant to the requirements of this Act and the amendments made by this Act, on those applications and notices in the order in which the applications and notices were submitted.</text></subparagraph></paragraph></subsection></section> </legis-body></bill>
