<section id="HB65088A5000C4FAB9FA56234C7CC3EE6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Coal Ash for American Infrastructure Act</short-title></quote>.</text></section> <section id="HDE8B95F8D0E149189EB28D421D39DB03"><enum>2.</enum><header>Beneficial use staging units</header><text display-inline="no-display-inline">Section 4005 of the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6945">42 U.S.C. 6945</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H5B40AFC941DD4CE58BD577EA0F28C01D"><enum>(e)</enum><header>Beneficial use staging units</header> 
<paragraph id="HF0A8FC35A199480A9B92827F19D2ED2F"><enum>(1)</enum><header>Application</header> 
<subparagraph id="HEC27DCA8234540E786140047EFDC487B"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An owner or operator of a coal combustion residuals unit may submit to a State operating a State permit program or other system of prior approval and conditions that is approved under subsection (d)(1)(B), or with respect to a coal combustion residuals unit in a nonparticipating State, to the Administrator, an application to designate the coal combustion residuals unit as a beneficial use staging unit under paragraph (2).</text></subparagraph> <subparagraph id="H251BF20FDE014B3180C6C0CA32D082EF"><enum>(B)</enum><header>Contents</header><text>An application under this paragraph shall include—</text> 
<clause id="H3C2CD3025CD641189F92242C3E991047" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">an attestation that the owner or operator of the coal combustion residuals unit will comply, with respect to such coal combustion residuals unit, with the applicable beneficial use requirement under paragraph (4);</text></clause> <clause id="H4DFCC065214B414FA7F2726375D1CFD7"><enum>(ii)</enum><text display-inline="yes-display-inline">a measurement in cubic yards of the volume of coal combustion residuals stored in the coal combustion residuals unit; and</text></clause> 
<clause id="HCCA74A86884146BE9272F79BCC7825A9"><enum>(iii)</enum><text display-inline="yes-display-inline">a beneficial use management plan detailing—</text> <subclause id="H0038B20DAE2E498784BB233FF710B1D5"><enum>(I)</enum><text display-inline="yes-display-inline">the volume of coal combustion residuals to be removed from the coal combustion residuals unit for beneficial use;</text></subclause> 
<subclause id="H3C2F98433CE348B9A8D0BC8997F6586D"><enum>(II)</enum><text>the schedule for such removal;</text></subclause> <subclause id="HC1664D411F4543BA90FB190AAA27328A"><enum>(III)</enum><text>any plan for the recovery from such coal combustion residuals of any critical mineral (as such term is defined in section 7002(a) of the Energy Act of 2020); and</text></subclause> 
<subclause id="H95814D5135994AA99C02BD9885E88BEA"><enum>(IV)</enum><text>beneficial use markets for such coal combustion residuals.</text></subclause></clause></subparagraph> </paragraph> <paragraph id="H16E53F493A3443D6A11F8A7016AC2D11"><enum>(2)</enum><header>Determination</header> <subparagraph id="H0F2913FBCE5F49A3A93E1CBACED51BE7"><enum>(A)</enum><header>Approval</header><text display-inline="yes-display-inline">A State operating a State permit program or other system of prior approval and conditions that is approved under subsection (d)(1)(B), or with respect to a coal combustion residuals unit in a nonparticipating State, the Administrator, may approve an application submitted under paragraph (1) and designate the coal combustion residuals unit as a beneficial use staging unit if such coal combustion residuals unit—</text> 
<clause id="H46738706245E4EE49D310036F4319C70" display-inline="no-display-inline"><enum>(i)</enum><text>is a surface impoundment or landfill;</text></clause> <clause id="H835EED438B244AB583F0A150290B1741"><enum>(ii)</enum><text display-inline="yes-display-inline">is lined in accordance with section 257.70, 257.71, or 257.72 of title 40, Code of Federal Regulations (or any successor regulations), or a State standard established pursuant to a State permit program or other system that is at least as protective as the criteria under any such section that applies to the surface impoundment or landfill;</text></clause> 
<clause id="HB5B9F29324C04B908C570C5B0149D205"><enum>(iii)</enum><text display-inline="yes-display-inline">satisfies the groundwater monitoring requirements under sections 257.90 through 257.98 of title 40, Code of Federal Regulations (or any successor regulations), or a State standard established pursuant to a State permit program or other system that is at least as protective as the criteria under such sections; and</text></clause> <clause id="H4E3DF9EEB8CD44DFB6F558DFBA5154C5"><enum>(iv)</enum><text display-inline="yes-display-inline">is in compliance with any Federal or State regulations that apply with respect to such coal combustion residuals unit.</text> </clause> </subparagraph> 
<subparagraph id="H31BE9849FED54EE495CA42A5E9B4E6D2" commented="no"><enum>(B)</enum><header>Denial</header><text display-inline="yes-display-inline">If a State operating a State permit program or other system of prior approval and conditions that is approved under subsection (d)(1)(B), or the Administrator, denies an application submitted under paragraph (1), such State or the Administrator, respectively, shall notify the applicant of the reason for such denial.</text></subparagraph></paragraph> <paragraph id="H9E7AACA9A6534A4391215891FC31B695"><enum>(3)</enum><header>Length of designation; multiple designations</header> <subparagraph id="H8AF63E1D692D4A79A810747A2EA1835C"><enum>(A)</enum><header>Length of designation</header><text display-inline="yes-display-inline">A designation under paragraph (2) shall expire on the date by which removal from the beneficial use staging unit of coal combustion residuals for beneficial use is required under paragraph (4).</text></subparagraph> 
<subparagraph id="HEB7E057A744A4483A6A3F042095D59DE"><enum>(B)</enum><header>Multiple designations</header> 
<clause id="H73563A1BD64D42679A541645357F8290"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">A coal combustion residuals unit may be designated as a beneficial use staging unit under paragraph (2) multiple times, except as provided in clause (ii).</text></clause> <clause id="HDC2AEE32DCD6461ABD028EE87048F464"><enum>(ii)</enum><header>Limitation</header><text display-inline="yes-display-inline">A coal combustion residuals unit that is designated as a beneficial use staging unit under paragraph (2) may not be subsequently so designated if the owner or operator of such unit fails, with respect to such unit, to comply with the applicable beneficial use requirement under paragraph (4).</text> </clause></subparagraph></paragraph> 
<paragraph id="H4791143CC61941F0AC443FF1FEDFFF28"><enum>(4)</enum><header>Beneficial use requirement</header><text display-inline="yes-display-inline">The owner or operator of a beneficial use staging unit shall remove from such unit for beneficial use, or enter into a contract for such removal—</text> <subparagraph id="HFBD1248FDB7E431188CFCE2D2127BF43"><enum>(A)</enum><text display-inline="yes-display-inline">for any such unit that stores fewer than 1.5 million cubic yards of coal combustion residuals, as specified in the application under paragraph (1), at least 25 percent of the coal combustion residuals stored in such unit, by not later than the earlier of—</text> 
<clause id="H1D3DBA2320A24AB98B249BEBB35D81D0"><enum>(i)</enum><text>the date that is 5 years after such removal begins; and</text></clause> <clause id="H8CBD97D4622A40F7BA3694A0B0423C51"><enum>(ii)</enum><text display-inline="yes-display-inline">the date that is 7 years after the applicable designation date; and</text></clause></subparagraph> 
<subparagraph id="H23B9A813BB0A4854A9497189D24C1AB5"><enum>(B)</enum><text display-inline="yes-display-inline">for any such unit that stores 1.5 million cubic yards or more of coal combustion residuals, as specified in the application under paragraph (1), at least 25 percent of the coal combustion residuals stored in such unit, by not later than the earlier of—</text> <clause id="HBC87B6F4DBDB4349886AF8D437F3DCC3"><enum>(i)</enum><text>the date that is 10 years after such removal begins; and</text></clause> 
<clause id="HE1635CD8C0134D42AAE0C8B7D404D603"><enum>(ii)</enum><text display-inline="yes-display-inline">the date that is 12 years after the applicable designation date.</text></clause></subparagraph> </paragraph> <paragraph id="HC47CE67CA49B4B4397569D6EE5B5B911"><enum>(5)</enum><header>Prohibition on addition of coal combustion residuals</header><text display-inline="yes-display-inline">A beneficial use staging unit may not receive coal combustion residuals.</text></paragraph> 
<paragraph id="HAC79A41F0A2843BC9604C0E17FEA146C"><enum>(6)</enum><header>Treatment of beneficial use staging units</header><text display-inline="yes-display-inline">A beneficial use staging unit—</text> <subparagraph id="H6CABD672CC1D4EA5917D7522DF474041"><enum>(A)</enum><text display-inline="yes-display-inline">shall be considered to be a sanitary landfill for purposes of this Act, including subsection (a), if the beneficial use staging unit is in compliance with the requirements of this subsection; and</text> </subparagraph> 
<subparagraph id="HA9C5461D4A704310B1E109910BCACE9C"><enum>(B)</enum><text display-inline="yes-display-inline">shall not be subject to section 257.102(e)(2) of title 40, Code of Federal Regulations (or any successor regulation), or any Federal or State requirement to close for failure of the owner or operator of such beneficial use staging unit to remove from such unit coal combustion residuals for beneficial use by a date that is earlier than the date by which removal from such unit of coal combustion residuals for beneficial use is required under paragraph (4).</text> </subparagraph></paragraph> <paragraph id="H23342B4C180442AAA14A810E6F5F399F"><enum>(7)</enum><header>Revocation of designation</header><text display-inline="yes-display-inline">The State that designated a beneficial use staging unit, or with respect to a beneficial use staging unit designated in a nonparticipating State, the Administrator, may issue a revocation of such designation for failure of the beneficial use staging unit to maintain compliance with the requirements of clauses (ii), (iii), and (iv) of paragraph (2)(A).</text> </paragraph> 
<paragraph id="H4F773AB7350A4C94A0C56E484B134485"><enum>(8)</enum><header>Reports</header> 
<subparagraph id="H2704A06B59064F118BCA13391D52F150"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than March 1, 2026, and annually thereafter, the Administrator shall publish a report, broken down by State and year, that includes—</text> <clause id="H067E41AD2AD24044B6A60FF84A4D70C3"><enum>(i)</enum><text display-inline="yes-display-inline">for each beneficial use staging unit, the volume of coal combustion residuals stored in such unit and the volume of coal combustion residuals removed from such unit for beneficial use; and</text></clause> 
<clause id="H47BC2C838AB64B7E9590407E0681D6A2"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of revocations issued under paragraph (7).</text></clause></subparagraph> <subparagraph id="H17BED11A71DD4C9F8E1EBA62BB8469A2"><enum>(B)</enum><header>State information</header><text>Each State shall provide to the Administrator any information necessary for the Administrator to publish the report under subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="HFDCCAD9E67654002B6DAD79747A492F4"><enum>(9)</enum><header>Federal preemption</header><text display-inline="yes-display-inline">A State, or political subdivision thereof, may not establish, maintain, or enforce any State law, regulation, or executive order that conflicts with this subsection, including any such law, regulation, or executive order that mandates the closure of a beneficial use staging unit that is in compliance with the requirements of this subsection.</text> </paragraph> <paragraph id="HF18423502D2142A6A47FBC50FDF9B875"><enum>(10)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text> 
<subparagraph id="HF01984EACD7D4E85995A9639825E87C6"><enum>(A)</enum><header>Beneficial use staging unit</header><text display-inline="yes-display-inline">The term <term>beneficial use staging unit</term> means a coal combustion residuals unit designated under paragraph (2), for which such designation has not expired under paragraph (4) or been revoked under paragraph (7).</text></subparagraph> <subparagraph id="H42E32B40706F493F8FE454B60A18EAC8"><enum>(B)</enum><header>Designation date</header><text display-inline="yes-display-inline">The term <term>designation date</term> means, with respect to a coal combustion residuals unit, the date that such unit is designated as a beneficial use staging unit under paragraph (2).</text></subparagraph> 
<subparagraph id="HEEB50835347845A88C7E877A51679D57"><enum>(C)</enum><header>Nonparticipating State</header><text>The term <term>nonparticipating State</term> has the meaning given such term in subsection (d)(2)(A).</text> </subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body></bill>
