<section id="H40E1473F6F624DB6879654E7AF0C1D07"><enum>101.</enum><header>Identification of regulatory barriers to affordable housing in HUD annual report</header><text display-inline="no-display-inline">Section 8 of the Department of Housing and Urban Development Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3536">42 U.S.C. 3536</external-xref>) is amended by adding at the end the following: <quote>Each such annual report shall include an identification of significant regulatory barriers to affordable housing, within the meaning of such term as provided in the first sentence of section 1203 of the Housing and Community Development Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/12705b">42 U.S.C. 12705b</external-xref>), and a discussion and analysis of how to reduce or remove such barriers.</quote>.</text></section> <section id="HCF2597DA192046DA919C4EC7EA91F3F8" section-type="subsequent-section"><enum>102.</enum><header>Qualifying ordinary income added to special rules for investments in opportunity zones</header> <subsection id="H3DFE24D853D94602BB6424AD6E53EA6B"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/1400Z">Section 1400Z–2</external-xref> of the Internal Revenue Code of 1986 is amended—</text> 
<paragraph id="HAE7C3ABFC6C3423BBC88772C2985FA80"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">capital gains invested</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">investments</header-in-text></quote>,</text></paragraph> <paragraph id="H28A79885B6964C95AB955E37577E1317"><enum>(2)</enum><text>in subsection (a)—</text> 
<subparagraph id="H19CA22AE12BC4C30B22E4F570A51A43C"><enum>(A)</enum><text>in paragraph (1)—</text> <clause id="HEF6DA423A2074A7182B48C12CF274B89"><enum>(i)</enum><text>in the heading, by inserting <quote><header-in-text level="paragraph" style="OLC">qualifying ordinary income and</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">of</header-in-text></quote>,</text></clause>

<subparagraph id="HAC5A9D91EB8A4AC5894A0D0C49804ADE"><enum>(A)</enum><text display-inline="yes-display-inline">gross income for the taxable year shall not include—</text> <clause id="HCD8C66E363114D6992674B6F2C4E75AF"><enum>(i)</enum><text display-inline="yes-display-inline">so much of such gain as does not exceed the aggregate amount invested by the taxpayer in a qualified opportunity fund during the 180-day period beginning on the date of such sale or exchange, and</text></clause> 
<clause id="H1CBDD7C8C92B4898AE5D2B6F8FB9DC70"><enum>(ii)</enum><text display-inline="yes-display-inline">so much of such qualifying ordinary income as does not exceed the aggregate amount invested by the taxpayer in a qualified opportunity fund during such taxable year,</text></clause></subparagraph><after-quoted-block>, and</after-quoted-block></quoted-block></clause> <clause id="HE967DE57E9B94176A4787194F5177084"><enum>(iv)</enum><text>in subparagraph (B), by inserting <quote>qualifying ordinary income and</quote> after <quote>amount of</quote>,</text></clause></subparagraph> 
<subparagraph id="H055844F7428E4ED4A5A6BFFEEACC94BD"><enum>(B)</enum><text>in paragraph (2)—</text> <clause id="H934D19B34CE74B15ABBE64055256AE4E"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>or</quote> at the end,</text></clause>

<paragraph id="HB6B827D4DF6B44768192E9C77E86EE5A"><enum>(3)</enum><header>Qualifying ordinary income defined</header><text display-inline="yes-display-inline">In this subsection, the term <quote>qualifying ordinary income</quote> means ordinary income other than income attributable to capital gains.</text></paragraph><after-quoted-block>,</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H3FB6D70B92114448BCF58980B439610C"><enum>(3)</enum><text>in subsection (b)—</text>

<subclause id="HD3CDD71BC9724B5EB9BBA32948AED9F1"><enum>(II)</enum><text>by striking <quote>the amount of gain</quote> each place it appears and inserting <quote>the amount</quote>, and</text></subclause></clause></subparagraph></paragraph> <paragraph id="H03307073653F4C3B99C5B13B58BC2580"><enum>(4)</enum><text>in subsection (e)(1), by inserting <quote>qualifying ordinary income and</quote> after <quote>investments of</quote>.</text></paragraph></subsection> 
<subsection id="H6915A05F00DB467BA15DB5405F823F05"><enum>(b)</enum><header>Effective Date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to amounts invested after the date of the enactment of this Act.</text></subsection></section> <section id="H0F4E698082C1461DB5A760900B1B2E15" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>103.</enum><header>Relieving strain from shortages of transformers</header><text display-inline="no-display-inline">Section 321(35) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6291">42 U.S.C. 6291(35)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HF2069FE8D9104D3BB7B1CDFD683E5E39"> 
<subparagraph id="HDF6451CBC1AF4BB8B9C683B3721B9570" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header>Efficiency level</header><text>The Secretary shall not finalize any rule under which the efficiency level of a liquid-immersed type, low voltage dry type, or medium voltage dry type distribution transformer is greater than trial standard level 2 (as described in table V.1 in the proposed rule entitled <quote>Energy Conservation Program: Energy Conservation Standards for Distribution Transformers</quote> (88 Fed. Reg. 1722 (January 11, 2023))).</text></subparagraph> <subparagraph id="H52BC303AB7BE4134A5A9649FAE585F9D" commented="no" display-inline="no-display-inline"><enum>(D)</enum><header>Effective date for certain rules</header><text display-inline="yes-display-inline">Any rule finalized by the Secretary under which the efficiency level of a liquid-immersed type, low voltage dry type, or medium voltage dry-type distribution transformer is trial standard level 1 or 2 (as described in table V.1 in the proposed rule entitled ‘Energy Conservation Program: Energy Conservation Standards for Distribution Transformers’ (88 Fed. Reg. 1722 (January 11, 2023))) shall not take effect until 10 years after the date on which the rule is finalized.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H0E3996C25B494CD4979FA89D4A14F8C4"><enum>104.</enum><header>Incentivizing zoning reform</header> 
<subsection id="HBCCC52F6B0754285B255ED61CF7EBC45"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to discourage the use of discriminatory land use policies and remove barriers to making housing more affordable in order to further the original intent of the Community Development Block Grant program.</text></subsection> <subsection id="H14E3FCF8C0404823B155401860E3A0C4"><enum>(b)</enum><header>Land use plan</header> <paragraph id="H6E2A6DB093DC4026882CBB5F5F10A262"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 104 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5304">42 U.S.C. 5304</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H62264EC6C874433B8DCA4F4610B78411"> 
<subsection id="H31113052D790423E9F752E3000AEC3AF"><enum>(n)</enum><header>Plan To track discriminatory land use policies</header> 
<paragraph id="H00CA9AB83073474384A22C7539CFCD5F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Prior to receipt in any fiscal year of a grant from the Secretary under subsection (b), (d)(1), or (d)(2)(B) of section 106, each recipient shall have prepared and submitted, not less frequently than once during the preceding 5-year period, in accordance with this subsection and in such standardized form as the Secretary shall, by regulation, prescribe, with respect to each land use policy described in paragraph (2) that is applicable to the jurisdiction served by the recipient, a description of—</text> <subparagraph id="HAC8DADB7DE0E48119E6B8376C95D5F5E"><enum>(A)</enum><text>whether the recipient has already adopted the policy in the jurisdiction served by the recipient;</text></subparagraph> 
<subparagraph id="H094E0F57F52B43C7AADD989E5BC17763"><enum>(B)</enum><text>the plan of the recipient to implement the policy in that jurisdiction; or</text></subparagraph> <subparagraph id="H847E25B4511543B78AD3D7CA7C2A4A9C"><enum>(C)</enum><text display-inline="yes-display-inline">the ways in which adopting the policy will benefit the jurisdiction.</text></subparagraph></paragraph> 
<paragraph id="H8F424BF7B01F4A77ABBB70B397AFEEA5"><enum>(2)</enum><header>Land use policies</header><text>The policies described in this paragraph are as follows:</text> <subparagraph id="H939B810718D54B4496ED63BF712AC2A4"><enum>(A)</enum><text>Enacting high-density single-family and multifamily zoning.</text></subparagraph> 
<subparagraph id="H27E771B728BD4BD9926E3419D45DDCB5"><enum>(B)</enum><text>Expanding by-right multifamily zoned areas.</text></subparagraph> <subparagraph id="H582823E679AC4374B00331A3367F00F3"><enum>(C)</enum><text>Allowing duplexes, triplexes, or fourplexes in areas zoned primarily for single-family residential homes.</text></subparagraph> 
<subparagraph id="H209120566BC24BF38FC4B9328C2FFCC0"><enum>(D)</enum><text>Allowing manufactured homes in areas zoned primarily for single-family residential homes.</text></subparagraph> <subparagraph id="H0F59355902954101BC318637DE115F4C"><enum>(E)</enum><text>Allowing multifamily development in retail, office, and light manufacturing zones.</text></subparagraph> 
<subparagraph id="H01F52852379B45AF98C4822296AAC274"><enum>(F)</enum><text>Allowing single-room occupancy development wherever multifamily housing is allowed.</text></subparagraph> <subparagraph id="H31223BDB285E4E43B1B3D65BF53ABF85"><enum>(G)</enum><text>Reducing minimum lot size.</text></subparagraph> 
<subparagraph id="H9ACA4D71E3114044B758E9DD51B04944"><enum>(H)</enum><text display-inline="yes-display-inline">Ensuring historic preservation requirements and other land use policies or requirements are coordinated to encourage creation of housing in historic buildings and historic districts.</text></subparagraph> <subparagraph id="HBBBD940599354DAE951354D8C582AF87"><enum>(I)</enum><text>Increasing the allowable floor area ratio in multifamily housing areas.</text></subparagraph> 
<subparagraph id="H70B1E9DB0A324008A92999B85CF07D9B"><enum>(J)</enum><text>Creating transit-oriented development zones.</text></subparagraph> <subparagraph id="H6FA8EA5FF19A43EEB81DD28054481AC8"><enum>(K)</enum><text>Streamlining or shortening permitting processes and timelines, including through one-stop and parallel-process permitting.</text></subparagraph>

<paragraph id="HE0CB78FE15834F5AB73291453CA80AFC"><enum>(4)</enum><header>Acceptance or nonacceptance of plan</header><text>The acceptance or nonacceptance of any plan submitted under this subsection in which the information required under this subsection is provided is not an endorsement or approval of the plan, policies, or methodologies, or lack thereof.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="HC99F45217BCE47F4BA0FB996D2559C41"><enum>(2)</enum><header>Effective date</header><text display-inline="yes-display-inline">The requirements under subsection (n) of section 104 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5304">42 U.S.C. 5304</external-xref>), as added by paragraph (1), shall—</text>

<section id="HC10094C359154E95A4910A7D3BB76261"><enum>105.</enum><header>Decreasing the equity penalty and incentivizing more long-term owners to sell homes</header> 
<subsection id="HCAC938B57D0949EB8AF05E0E90181EF7"><enum>(a)</enum><header>Increase of exclusion of gain from sale of principal residence</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/121">Section 121(b)</external-xref> of the Internal Revenue Code of 1986 is amended—</text> <paragraph id="H4F2B160E2B3F4943906B105518C110A5"><enum>(1)</enum><text>by striking <quote>$250,000</quote> and inserting <quote>$500,000</quote> each place it appears,</text></paragraph> 
<paragraph id="H564199D710AD47DAAE15F991D9778029"><enum>(2)</enum><text>by striking <quote>500,000</quote> and inserting <quote>$1,000,000</quote> each place it appears,</text></paragraph> <paragraph id="HE3DD2A09A69C41E69D8D81E4E55D4E88"><enum>(3)</enum><text>in paragraph (2)(A), in the heading, by striking <quote><header-in-text level="subparagraph" style="OLC">$500,000</header-in-text></quote> and inserting <quote><header-in-text level="subparagraph" style="OLC">$1,000,000</header-in-text></quote>, and</text></paragraph> 
<paragraph id="H749E6373C599461083C8B781B71EA26F"><enum>(4)</enum><text>by adding at the end the following new paragraph:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HAB14B2153C23489DAB8462A8D73466BF"> <paragraph id="H9F864DCA87D5464DA0B77A6C6161FAE5"><enum>(5)</enum><header>Adjustment for inflation</header><text display-inline="yes-display-inline">In the case of a taxable year beginning after 2024, the $500,000 and $1,000,000 amounts in paragraphs (1), (2), and (4) shall be increased by an amount equal to—</text> 
<subparagraph id="H71C7171493204F4793B373459454FCFE"><enum>(A)</enum><text>such dollar amount, multiplied by</text></subparagraph> <subparagraph id="H8D2572A296F14FD29B3681125EC90EDF"><enum>(B)</enum><text display-inline="yes-display-inline">the cost-of-living adjustment determined under section 1(f)(3) for the calendar year in which the taxable year begins, determined by substituting <quote>2023</quote> for <quote>2016</quote> in subparagraph (A)(ii) thereof.</text></subparagraph><continuation-text continuation-text-level="paragraph">If any increase under this clause is not a multiple of $100, such increase shall be rounded to the next lowest multiple of $100.</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HED79D0D1C01140B98B1388ADDF7334B9"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply to sales and exchanges after the date of the enactment of this Act.</text></subsection></section></title> <title id="HCD1EE63AE63A459E885DD0C18CDE25C6"><enum>II</enum><header>Increasing access to housing and addressing cost</header> <section id="H6CA3BB26802B453B8F5D3DF5732515B8"><enum>201.</enum><header>Expanding workforce and volunteer housing</header> <subsection id="H4BA4EEAE6CD14D789A85148D6919649D"><enum>(a)</enum><header>Congressional findings</header><text>The Congress finds that—</text> 
<paragraph id="H8A43F2AB51874089961B788652AB306C"><enum>(1)</enum><text>the lack of affordable housing in the United States is an issue impacting millions of middle-class, working American families;</text></paragraph> <paragraph id="H43BAEE83F8CA4F1EA31CD27AB39280CC"><enum>(2)</enum><text>many of these families earn more annually than the income limits for certain Federal housing financing and benefits; and</text></paragraph> 
<paragraph id="HB456B7B37BDC48BA9FEC4380C9559915"><enum>(3)</enum><text>these families are often excluded from living in neighborhoods near their places of work, schools, shopping, and healthcare due to a lack of affordability.</text></paragraph></subsection> <subsection id="HF9447C39399F425893E704713ABA2C56"><enum>(b)</enum><header>Report to Congress</header><text>Not later than 180 days after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the Congress a report that—</text> 
<paragraph id="H77EB4048EC494C69B25CBBCFDEF6C30D"><enum>(1)</enum><text>identifies issues with housing affordability for America’s middle-income homeowners and renters, including identifying geographically where housing is the most unaffordable for these populations;</text></paragraph> <paragraph id="H8CB7C2534F8248ABB97F84E36B975862"><enum>(2)</enum><text>identifies Federal housing programs, including Federal tax credits, grants, credit programs, and other programs that currently benefit lower-income households, which are not available to middle-income households;</text></paragraph> 
<paragraph id="H12CFC132BE9F447480F8A0839F34E403"><enum>(3)</enum><text>identifies any gaps in the inclusion of middle-income households in Federal housing programs designed to promote affordability;</text></paragraph> <paragraph id="HF31687AF0C9C4F1583D195A7BEE87EAB"><enum>(4)</enum><text display-inline="yes-display-inline">sets forth recommendations for a definition of <quote>workforce housing</quote> based on income parameters in order to assist Federal agencies in including middle-income households under existing Federal programs; and</text></paragraph> 
<paragraph id="H5F38BBB676904B808B26186BB1349644"><enum>(5)</enum><text>analyzes how such a definition could relate to incentives for workforce housing development through Federal programs, policies, and other initiatives.</text></paragraph></subsection></section> <section id="H182006662A474F508FC3AAAD203BDEDB"><enum>202.</enum><header>Supporting affordability and safety for public servants</header><text display-inline="no-display-inline">Section 3(a) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(a)</external-xref>) is amended—</text> 
<paragraph id="H7C6D9B5DAF67436D9108EDBE2029CF57"><enum>(1)</enum><text>in paragraph (1), by striking <quote>Except as provided in paragraph (2)</quote> and inserting <quote>Except as provided in paragraphs (2) and (4)</quote>; and</text></paragraph> <paragraph id="H487425DE6FCA4037A7EA808F9E1699A4"><enum>(2)</enum><text>in paragraph (4)—</text> 
<subparagraph id="H7F0F15FEA21449E88252E83F8A018C5F"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="paragraph" style="OLC">Occupancy by police officers</header-in-text></quote> and inserting, <quote><header-in-text level="paragraph" style="OLC">Occupancy by police officers, firefighters, and emergency medical technicians</header-in-text></quote>;</text></subparagraph> <subparagraph id="H22CBF2F3D16F460E8F7649848AC35453"><enum>(B)</enum><text>by redesignating subparagraph (C) as subparagraph (D);</text></subparagraph> 
<subparagraph id="H3EF23CF7FF5F420A965778CAFFC3B64D"><enum>(C)</enum><text>by inserting after subparagraph (B) the following:</text> <quoted-block style="OLC" id="H1ADA3837B8D743B09936C6178467C44C" display-inline="no-display-inline"> <subparagraph id="H84C66927B9DE426FBF66643325434BF3"><enum>(C)</enum><header>Rental payments</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), a family of which one or more members are a police officer, firefighter, or emergency medical technician shall pay as rent for a dwelling unit assisted under this Act the highest of the following amounts, rounded to the nearest dollar:</text> 
<clause id="H045B64CBAD5B41E8BB513386EF3D7C25"><enum>(i)</enum><text display-inline="yes-display-inline">15 per centum of the family's monthly adjusted income; or</text></clause> <clause id="H332607BC68AE478A8300F6BCD5AA0D87"><enum>(ii)</enum><text display-inline="yes-display-inline">5 per centum of the family's monthly income</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HF4E854DDB9104E209EA6ABDDD2B3D894"><enum>(D)</enum><text display-inline="yes-display-inline">by amending subparagraph (D), as so redesignated, to read as follows:</text> <quoted-block style="OLC" id="H2C75C9D8F9A346FD864A960E083DA6EC" display-inline="no-display-inline"> <subparagraph id="H32C0CFEAC91649FDAFA4594DD3447ADE"><enum>(D)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this paragraph:</text> 
<clause id="H4FCE48C96F5B413F88A126A0B76C5AD3"><enum>(i)</enum><header>Police officer</header><text display-inline="yes-display-inline">The term <quote>police officer</quote> means any person determined by a public housing agency to be, during the period of residence of that person in public housing, employed on a full-time basis as a duly licensed professional police officer by a Federal, State, or local government or by any agency thereof (including a public housing agency having an accredited police force).</text></clause> <clause id="HA8BD45F2D0674D13B4D226F79EA46511"><enum>(ii)</enum><header>Firefighter</header><text display-inline="yes-display-inline">The term <quote>firefighter</quote> means any person determined by a public housing agency to be, during the period of residence of that person in public housing, employed on a full-time basis as a firefighter by a fire department or emergency medical services responder unit of the Federal Government, a State, unit of general local government, or an Indian tribal government.</text></clause> 
<clause id="H4FFC4948736A4147977248B83C029601"><enum>(iii)</enum><header>Emergency medical technician</header><text display-inline="yes-display-inline">The term <quote>emergency medical technician</quote> means any person determined by a public housing agency to be, during the period of residence of that person in public housing, employed on a full-time basis as an emergency medical technician by a fire department or emergency medical services responder unit of the Federal Government, a State, unit of general local government, or an Indian tribal government.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section> <section id="H769B18B3731A4669B3BF5E2025C051ED"><enum>203.</enum><header>Expanding programs supporting homeownership for those serving the community</header> <subsection id="H5C6332C7031A4771BD0FA7DC16B6E864"><enum>(a)</enum><header>Eligibility for Good Neighbors Next Door Sales Program</header><text display-inline="yes-display-inline">Members of the Armed Forces, firefighters, and law enforcement officers shall be eligible to purchase eligible properties under the Good Neighbor Next Door Sales Program of the Secretary of Housing and Urban Development, as provided under subsection (b).</text></subsection> 
<subsection id="HB567B85EAC044AD2AC89F067DDE7EABD">
          <enum>(b)</enum>
          <header>Eligible properties</header>
 <text display-inline="yes-display-inline">Notwithstanding section 204 of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1710">12 U.S.C. 1710</external-xref>), part 291 of the regulations of the Secretary of Housing and Urban Development (24 C.F.R. part 291), or any other provision of law, regulation, guideline, order, or notice, in carrying out the Good Neighbor Next Door Sales Program for single-unit properties acquired by the Secretary, properties shall be made available for purchase under the Program by members of the Armed Forces, by firefighters, and by law enforcement officers without regard to whether or not they are located in a revitalization area.</text>
        </subsection> 
<subsection id="H7C9AA5B85D1442A8884E4173865B4716"><enum>(c)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary of Housing and Urban Development shall amend the regulations of the Secretary as necessary to carry out subsections (a) and (b).</text></subsection></section> <section id="H817ACEB81909459DA4ED52AB5F39F896"><enum>204.</enum><header>Improving volunteer first responder housing</header> <subsection id="HFF837F3523094B91933A7F64077C880F"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HCC5263D8CEAF4628900CC6042A9E09E0"><enum>(1)</enum><header>Bona fide volunteer; eligible employer; qualified services</header><text>The terms <term>bona fide volunteer</term>, <term>eligible employer</term>, and <term>qualified services</term> have the meanings given those terms in <external-xref legal-doc="usc" parsable-cite="usc/26/457">section 457(e)</external-xref> of the Internal Revenue Code of 1986.</text></paragraph> <paragraph id="H16B3517B0CC34227AD5746CD1FC6D283"><enum>(2)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term <term>Indian tribe</term> in section 501(b) of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1471">42 U.S.C. 1471(b)</external-xref>).</text></paragraph> 
<paragraph id="H7DF6214666FE4CF6B5CB03824707E4EF"><enum>(3)</enum><header>Qualified volunteer first responder</header><text display-inline="yes-display-inline">The term <term>qualified volunteer first responder</term> means any individual who—</text> <subparagraph id="HFE2A65A96A2349D3B7D5086B6FD8FB59"><enum>(A)</enum><text>is a bona fide volunteer performing qualified services for an eligible employer;</text></subparagraph> 
<subparagraph id="H7FEDA88BF87A4B51B3D99E724FB4E028"><enum>(B)</enum><text>continuously served as a volunteer for the eligible employer during the 2-year period preceding the date on which the individual submits a verification letter under section 3(b) or 4(b);</text></subparagraph> <subparagraph id="H86FB83AB7B514539B612AFD4417B3886" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>during each of the 2 years described in subparagraph (B)—</text> 
<clause id="H2197C1B6B644410A99CB314E74AC9948"><enum>(i)</enum><text>met the minimum requirements for active membership established by the eligible employer; or</text></clause> <clause id="H39D0FBE6663942039736FC1CC4186888" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>if the eligible employer did not establish minimum requirements, volunteered for not less than 200 hours; and</text></clause></subparagraph> 
<subparagraph id="HDFB047FADD8F4FF1B974C06C23C4351F"><enum>(D)</enum><text>is certified as a firefighter or other first responder in the State, political subdivision of a State, or jurisdiction of an Indian Tribe in which the individual is serving as volunteer.</text></subparagraph></paragraph></subsection> <subsection id="HB9DFC1BD53374B9887A972A89B00B368"><enum>(b)</enum><header>Department of Agriculture Single Family Housing Guaranteed Loan Program</header> <paragraph id="H51B7CCDE095A45C8B05FF1A2EE3345EF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A qualified volunteer first responder who submits to the Secretary of Agriculture (referred to in this subsection as the <quote>Secretary</quote>) a verification letter in accordance with paragraph (2) shall be eligible for a deduction in annual income under section 3555.152(c) of title 7, Code of Federal Regulations (or any successor regulation), in the amount of $18,000.</text></paragraph> 
<paragraph id="HBCBAC6A16E3143EE9C9E1126B47AD358"><enum>(2)</enum><header>Verification letter</header><text>To be eligible for a deduction under paragraph (1), a qualified volunteer first responder shall submit to the Secretary a verification letter from the head of the eligible employer for which the qualified volunteer first responder volunteers, which shall—</text> <subparagraph id="H46BA298357494A40851FA55924CB7AFC"><enum>(A)</enum><text>include the date on which the qualified volunteer first responder joined the eligible employer as a volunteer;</text></subparagraph> 
<subparagraph id="HF04859DD3B45459B8FFF32EA07FD2A58"><enum>(B)</enum><text>attest to the Secretary that the qualified volunteer first responder meets the requirements under subparagraphs (B) and (C) of subsection (a)(3); and</text></subparagraph> <subparagraph id="H5DA0852DF45548ECA975C57AC72F1D50"><enum>(C)</enum><text>include a copy of the certification described in subsection (a)(3)(D).</text></subparagraph></paragraph></subsection> 
<subsection id="H81580267CB5945508A30084DE7FDFB11"><enum>(c)</enum><header>Good Neighbor Next Door Sales Program and similar programs</header> 
<paragraph id="HCFFBE01EBF56429190C899B5804AF5AF"><enum>(1)</enum><header>Eligibility</header><text display-inline="yes-display-inline">A qualified volunteer first responder who submits to the Secretary of Housing and Urban Development (referred to in this section as the <quote>Secretary</quote>) a verification letter in accordance with paragraph (2) shall qualify as a firefighter or emergency medical technician for purposes of any single family property disposition program carried out by the Secretary by regulation under section 204(g) of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1710">12 U.S.C. 1710(g)</external-xref>) that offers discounted home prices to firefighters or emergency medical technicians.</text></paragraph> <paragraph id="HEB35751069A142FA93C1ADB97078A249"><enum>(2)</enum><header>Verification letter</header><text display-inline="yes-display-inline">To qualify to purchase a home under a single family property disposition program referred to in paragraph (1), a qualified first responder shall submit to the Secretary a verification letter from the head of the eligible employer for which the qualified volunteer first responder volunteers, which shall—</text> 
<subparagraph id="HC7DFBD548E684436BAC7D226A22CF52D"><enum>(A)</enum><text>include the date on which the qualified volunteer first responder joined the eligible employer as a volunteer;</text></subparagraph> <subparagraph id="HA6D68ACDDEBF468FB8D4ADCBB63B82F6"><enum>(B)</enum><text>attest to the Secretary that the qualified volunteer first responder meets the requirements under subparagraphs (B) and (C) of subsection (a)(3);</text></subparagraph> 
<subparagraph id="HB7AF07B17B3D4FCDA6EAFF4D802B0DBD" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>include a copy of the certification described in subsection (a)(3)(D); and</text></subparagraph> <subparagraph id="H7FD5FBF4D7484BC89AC5D08800A11361" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">include a certification from the qualified volunteer first responder of the responder’s good faith intention to continue serving as a volunteer for the eligible employer for not less than 1 year following the date of closing.</text></subparagraph></paragraph></subsection></section> 
<section id="HCF9EABD16D5C4631A9F579480FB12597"><enum>205.</enum><header>Improving access to housing for veterans</header> 
<subsection id="HB588AE1535F44860A84AE232B04164BC"><enum>(a)</enum><header>Service connected disability compensation</header><text>Section 102(a)(20) of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5302">42 U.S.C. 5302(a)(20)</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="H7811E507B30345F4961389B071602D73" display-inline="no-display-inline"> <subparagraph id="HB3DEA2130CFF4AE5A604C86A541ABBE0"><enum>(C)</enum><header>Service-connected disability compensation</header><text display-inline="yes-display-inline">When determining whether a person is of a person of low and moderate income, a person of low income, or a person of moderate income under this paragraph, a State, unit of general local government, or Indian tribe shall exclude any service-connected disability compensation received by such person from the Department of Veterans Affairs.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA5A6EC6F8D0C40CBB214DCDFE5794E2C"><enum>(b)</enum><header>Report</header><text>The Comptroller General of the United States shall, not later than 1 year after the date of the enactment of this Act, submit to the Congress a report that—</text> <paragraph id="HD063AC75F9D84788ADA953A75F2B452A"><enum>(1)</enum><text display-inline="yes-display-inline">examines how service-connected disability compensation is treated for the purposes of determining eligibility for all programs administered by the Secretary of Housing and Urban Development and identifies any cases where service-connected disability compensation is treated inconsistently across a program; and</text></paragraph> 
<paragraph id="H572A70607EA74165872C6E00D8828C74"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to each program administered by the Secretary of Housing and Urban Development, provides legislative recommendations relating to how such program could better serve veteran populations, and under-served communities.</text></paragraph></subsection></section> <section id="H3069786B44024BA18FD69F40BB4F59BF"><enum>206.</enum><header>Supporting veteran families in need</header><text display-inline="no-display-inline">Section 2044(e) of title 38, United States Code, is amended—</text> 
<paragraph id="HD93B22F504134430A2F03F66F6693D6D"><enum>(1)</enum><text>by redesignating subparagraphs (A) through (H) as paragraphs (1) through (8), respectively; and</text></paragraph> <paragraph id="HE5684284D23E44ABB8D8C1D487DBB790"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block id="H05EBDC3269EC41D1ABC50AD3493BDA5A" style="OLC"> 
<paragraph id="HEFCEAB3D073D4BBFB6E5602FBD657396" display-inline="no-display-inline"><enum>(9)</enum><text display-inline="yes-display-inline">The amounts that are appropriated to carry out such subsections for fiscal year 2026 and each fiscal year thereafter.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H101D5ED62042498A822949BBF9F26FE2"><enum>207.</enum><header>Attracting private investment to build and rehabilitate owner-occupied homes</header> <subsection id="HD8AE5AD0F3B64AEABBA5F76119632F55"><enum>(a)</enum><header>In general</header><text>Subpart D of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after section 42 the following new section:</text>

<section id="H6577075067844ACCAFEA1E5C14DCB4B4"><enum>42A.</enum><header>Neighborhood homes credit</header> 
<subsection id="HB0A3A67CC44F410798F36ECB7C00C0D8"><enum>(a)</enum><header>Allowance of credit</header><text>For purposes of section 38, the neighborhood homes credit determined under this section for the taxable year is, with respect to each qualified residence sold by the taxpayer during such taxable year in an affordable sale, the lesser of—</text> <paragraph id="H13D1A8FFA422430D8F9907BACACD70F5"><enum>(1)</enum><text>an amount equal to—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HE2EE887F8D29443EA29BB27D7180B43E"><enum>(A)</enum><text display-inline="yes-display-inline">the excess (if any) of—</text> <clause id="H3DFD7C93059046DD9F144DD2C2A335B2"><enum>(i)</enum><text>the reasonable development costs paid or incurred by the taxpayer with respect to such qualified residence, over</text></clause> 
<clause id="H8E62CF0C12C345BC951E06F26E66146A"><enum>(ii)</enum><text>the sale price of such qualified residence (reduced by any reasonable expenses paid or incurred by the taxpayer in connection with such sale), or</text></clause></subparagraph> <subparagraph id="H769C5E3C69AF48FAAEA0C4CB1DCF45EA"><enum>(B)</enum><text>if the neighborhood homes credit agency determines it is necessary to ensure financial feasibility, an amount not to exceed 120 percent of the amount under subparagraph (A),</text></subparagraph></paragraph> 
<paragraph id="H087DB57E98E449669E494F2D9F62A50B"><enum>(2)</enum><text>35 percent of the eligible development costs paid or incurred by the taxpayer with respect to such qualified residence, or</text></paragraph> <paragraph id="H2E115794D26641CC9D73DFC048897843"><enum>(3)</enum><text>28 percent of the national median sale price for new homes (as determined pursuant to the most recent census data available as of the date on which the neighborhood homes credit agency makes an allocation for the qualified project).</text></paragraph></subsection> 
<subsection id="HAABCC219EC5748D49928F76D840A3749"><enum>(b)</enum><header>Development costs</header><text display-inline="yes-display-inline">For purposes of this section—</text> <paragraph id="H30D6CC30B92041D8AA68C9A9AF70254B"><enum>(1)</enum><header>Reasonable development costs</header> <subparagraph id="H9A5947C6AB3447B1BC4390DFEF0A1E20"><enum>(A)</enum><header>In general</header><text>The term <term>reasonable development costs</term> means amounts paid or incurred for the acquisition of buildings and land, construction, substantial rehabilitation, demolition of structures, or environmental remediation, to the extent that the neighborhood homes credit agency determines that such amounts meet the standards specified pursuant to subsection (f)(1)(C) (as of the date on which construction or substantial rehabilitation is substantially complete, as determined by such agency) and are necessary to ensure the financial feasibility of such qualified residence.</text></subparagraph> 
<subparagraph id="HE626A739FC694E58AB49FE27C99BFFB0"><enum>(B)</enum><header>Considerations in making determination</header><text>In making the determination under subparagraph (A), the neighborhood homes credit agency shall consider—</text> <clause id="H8F66D7CFB9F74065AF4B128F11B13F05"><enum>(i)</enum><text>the sources and uses of funds and the total financing,</text></clause> 
<clause id="H8FB7906D78C84F188A2EA13685C3CAE8"><enum>(ii)</enum><text>any proceeds or receipts generated or expected to be generated by reason of tax benefits, and</text></clause> <clause id="H61C63678C0E14CB4A91448BC87535C7A"><enum>(iii)</enum><text>the reasonableness of the developmental costs and fees.</text></clause></subparagraph></paragraph> 
<paragraph id="HADDFCD3557B8464B8AE884C52680285D"><enum>(2)</enum><header>Eligible development costs</header><text display-inline="yes-display-inline">The term <quote>eligible development costs</quote> means the amount which would be reasonable development costs if the amounts taken into account as paid or incurred for the acquisition of buildings and land did not exceed 75 percent of such costs determined without regard to any amount paid or incurred for the acquisition of buildings and land.</text></paragraph> <paragraph id="H7481CC2CE7704B0A9E524376698AF2AB"><enum>(3)</enum><header>Substantial rehabilitation</header><text>The term <term>substantial rehabilitation</term> means amounts paid or incurred for rehabilitation of a qualified residence if such amounts exceed the greater of—</text> 
<subparagraph id="HDFB2159CAF8C421899789081696CE019"><enum>(A)</enum><text>$20,000, or</text></subparagraph> <subparagraph id="H4EEEDEE8992C4B40997B06C949713244" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">20 percent of the amounts paid or incurred by the taxpayer for the acquisition of buildings and land with respect to such qualified residence.</text></subparagraph></paragraph> 
<paragraph id="H16170AB46E2A4F85A246E94178B55390"><enum>(4)</enum><header>Construction and rehabilitation only after allocation taken into account</header> 
<subparagraph id="HABED693846C34778AC7C5E3E9841955B"><enum>(A)</enum><header>In general</header><text>The terms <quote>reasonable development costs</quote> and <quote>eligible development costs</quote> shall not include any amount paid or incurred before the date on which an allocation is made to the taxpayer under subsection (e) with respect to the qualified project of which the qualified residence is part unless such amount is paid or incurred for the acquisition of buildings or land.</text></subparagraph> <subparagraph id="H873D54808F2C4DDCA1A793118055C775"><enum>(B)</enum><header>Land and building acquisition costs</header><text display-inline="yes-display-inline">Amounts paid or incurred for the acquisition of buildings or land shall be included under paragraph (A) only if paid or incurred not more than 3 years before the date on which the allocation referred to in subparagraph (A) is made. If the taxpayer acquired any building or land from an entity (or any related party to such entity) that holds an ownership interest in the taxpayer, then such entity must also have acquired such property within such 3-year period, and the acquisition cost included under subparagraph (A) with respect to the taxpayer shall not exceed the amount such entity paid or incurred to acquire such property.</text></subparagraph></paragraph></subsection> 
<subsection id="H392EB45C0FE54716BAFD7D33498B4579"><enum>(c)</enum><header>Qualified residence</header><text>For purposes of this section—</text> <paragraph id="H93A37F03D2AB4352B19D98AD9EE135FA"><enum>(1)</enum><header>In general</header><text>The term <term>qualified residence</term> means a residence that—</text> 
<subparagraph id="H97A96588A9294E84BF98B8D5481F95A1"><enum>(A)</enum><text>is real property affixed on a permanent foundation,</text></subparagraph> <subparagraph id="H596D0E52ACD04072BF913055305285FE"><enum>(B)</enum><text>is—</text> 
<clause id="HCC6782911CBB44F4A6DAD76CFCC91E20" display-inline="no-display-inline"><enum>(i)</enum><text>a house which is comprised of 4 or fewer residential units,</text></clause> <clause id="H72ED5711DE414FDFAE6DDBF80D601F4A"><enum>(ii)</enum><text>a condominium unit, or</text></clause> 
<clause id="H4BA5035D79E940E7895D7E8AAAAC78C0"><enum>(iii)</enum><text>a house or an apartment owned by a cooperative housing corporation (as defined in section 216(b)),</text></clause></subparagraph> <subparagraph id="H778E948767CE493DA3438C16B38CD7E4"><enum>(C)</enum><text>is part of a qualified project with respect to which the neighborhood homes credit agency has made an allocation under subsection (e), and</text></subparagraph> 
<subparagraph id="H990CD629AAE14A8EA6E88F07C3AC1152"><enum>(D)</enum><text>is located in a qualified census tract (determined as of the date of such allocation).</text></subparagraph></paragraph> <paragraph id="H29752F0445DF49788E2E32F3A0B08688"><enum>(2)</enum><header>Qualified census tract</header> <subparagraph id="H2DD30C46686E4C8F840B5E922C0E076F"><enum>(A)</enum><header>In general</header><text>The term <term>qualified census tract</term> means a census tract—</text> 
<clause id="H3082901B03F64CCEBA8D4902ED14584A"><enum>(i)</enum><text>which—</text> <subclause id="H458CBAA155D44D34BF61DEBD2C52DBDF"><enum>(I)</enum><text>has a median family income which does not exceed 80 percent of the median family income for the applicable area,</text></subclause> 
<subclause id="H58309B649609420B94486472125107D8"><enum>(II)</enum><text>has a poverty rate that is not less than 130 percent of the poverty rate of the applicable area, and</text></subclause> <subclause id="HCB8D54E8CEA048E29D91AA1F7EEEDDFD"><enum>(III)</enum><text display-inline="yes-display-inline">has a median value for owner-occupied homes that does not exceed the median value for owner-occupied homes in the applicable area,</text></subclause></clause> 
<clause id="H42AE172C501D422087E75A7D895BBE6A"><enum>(ii)</enum><text display-inline="yes-display-inline">which—</text> <subclause id="H0271F4BA5F9543D99378E41B44449B28"><enum>(I)</enum><text>is located in a city which has a population of not less than 50,000 and such city has a poverty rate that is not less than 150 percent of the poverty rate of the applicable area,</text></subclause> 
<subclause id="H3E820502FA4B442B934B669C5A07CEBE"><enum>(II)</enum><text display-inline="yes-display-inline">has a median family income which does not exceed the median family income for the applicable area, and</text></subclause> <subclause id="HD184C05F899B454B9C57B8B854D369AB"><enum>(III)</enum><text>has a median value for owner-occupied homes that does not exceed 80 percent of the median value for owner-occupied homes in the applicable area,</text></subclause></clause> 
<clause id="H6D707CBE1E1044BC82614215B41AF35A"><enum>(iii)</enum><text display-inline="yes-display-inline">which—</text> <subclause id="H0B414D3FA1704989834D16D1A5DC2181"><enum>(I)</enum><text>is located in a nonmetropolitan county,</text></subclause> 
<subclause id="H8F9FB680F059463B8F52E0FEEB4520E3"><enum>(II)</enum><text>has a median family income which does not exceed the median family income for the applicable area, and</text></subclause> <subclause id="HF1E672FE98E1423D9338A803CA603FDA"><enum>(III)</enum><text>has been designated by a neighborhood homes credit agency under this clause, or</text></subclause></clause> 
<clause id="H0AB227E80CAB4CBCA26553044CC21044"><enum>(iv)</enum><text display-inline="yes-display-inline">which is not otherwise a qualified census tract and is located in a disaster area (as defined in section 7508A(d)(3)), but only with respect to credits allocated in any period during which the President of the United States has determined that such area warrants individual or individual and public assistance by the Federal Government under the Robert T. Stafford Disaster Relief and Emergency Assistance Act.</text></clause></subparagraph> <subparagraph id="H156D7EF6137A47E8AF319A30C5A84D44" display-inline="no-display-inline"><enum>(B)</enum><header>Applicable area</header><text>The term <term>applicable area</term> means—</text> 
<clause id="HA6222892B238442EBA8B6B87FFF3E039"><enum>(i)</enum><text>in the case of a metropolitan census tract, the metropolitan area in which such census tract is located, and</text></clause> <clause id="HF9BCF744DA3A407ABA2EC6B073EA76DD"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of a census tract other than a census tract described in clause (i), the State.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HA12089E4432F4342858AB1CA27FE9601"><enum>(d)</enum><header>Affordable sale</header><text>For purposes of this section—</text> <paragraph id="HC10259BCFF564EE988E999E3A94AE458" commented="no"><enum>(1)</enum><header>In general</header><text>The term <term>affordable sale</term> means a sale to a qualified homeowner of a qualified residence that the neighborhood homes credit agency certifies as meeting the standards promulgated under subsection (f)(1)(D) for a price that does not exceed—</text> 
<subparagraph id="H2F0963E12AE146168E283599867EE04B" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of any qualified residence not described in subparagraph (B), (C), or (D), the amount equal to the product of 4 multiplied by the median family income for the applicable area (as determined pursuant to the most recent census data available as of the date of the contract for such sale),</text></subparagraph> <subparagraph id="HE5F4A1CF83D044889922A04B6B5D9F68" commented="no"><enum>(B)</enum><text>in the case of a house comprised of 2 residential units, 125 percent of the amount described in subparagraph (A),</text></subparagraph> 
<subparagraph id="HC27FC31A71CF4FA298B148AA6B2E0D98" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of a house comprised of 3 residential units, 150 percent of the amount described in subparagraph (A), or</text></subparagraph> <subparagraph id="H230EB63AAF2741A394039AA1C5A5221F" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">in the case of a house comprised of 4 residential units, 175 percent of the amount described in subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="HEFE19249A79342A3A53BBCE4AA0C0602"><enum>(2)</enum><header>Qualified homeowner</header><text>The term <term>qualified homeowner</term> means, with respect to a qualified residence, an individual—</text> <subparagraph id="HE5939648FA344238868E0CC56AC8BA1E"><enum>(A)</enum><text>who owns and uses such qualified residence as the principal residence of such individual, and</text></subparagraph> 
<subparagraph id="H2B7949B72318417C9CE03AA702ABA76A"><enum>(B)</enum><text display-inline="yes-display-inline">whose family income (determined as of the date that a binding contract for the affordable sale of such residence is entered into) is 140 percent or less of the median family income for the applicable area in which the qualified residence is located.</text></subparagraph></paragraph></subsection> <subsection id="H53BA03413B414E849326E5334B7328B6"><enum>(e)</enum><header>Credit ceiling and allocations</header> <paragraph id="H35FC0637535D4C2F90C21C704ECB89B3" commented="no"><enum>(1)</enum><header>Credit limited based on allocations to qualified projects</header> <subparagraph id="H04AFFC0A91CF4E3AB066A172F5F69B06"><enum>(A)</enum><header>In general</header><text>The credit allowed under subsection (a) to any taxpayer for any taxable year with respect to one or more qualified residences which are part of the same qualified project shall not exceed the excess (if any) of—</text> 
<clause id="H1BC61E9F779C4BC29619E2F845DEEAAF"><enum>(i)</enum><text>the amount allocated by the neighborhood homes credit agency under this paragraph to such taxpayer with respect to such qualified project, over</text></clause> <clause id="H9047C4FBDC2C4EAEA0653A2D09885E47"><enum>(ii)</enum><text>the aggregate amount of credit allowed under subsection (a) to such taxpayer with respect to qualified residences which are a part of such qualified project for all prior taxable years.</text></clause></subparagraph> 
<subparagraph id="H0085D1FED9374A5A8973E31250E79FD2"><enum>(B)</enum><header>Deadline for completion</header><text>No credit shall be allowed under subsection (a) with respect to any qualified residence unless the affordable sale of such residence is during the 5-year period beginning on the date of the allocation to the qualified project of which such residence is a part (or, in the case of a qualified residence to which subsection (i) applies, the rehabilitation of such residence is completed during such 5-year period).</text></subparagraph></paragraph> <paragraph id="H952E6E41D2764193A0789CC235A2A8EF"><enum>(2)</enum><header>Limitations on allocations to qualified projects</header> <subparagraph id="HCD45034FCEEB4FD88C41C0AEBD2778A7"><enum>(A)</enum><header>Allocations limited by State neighborhood homes credit ceiling</header><text>The aggregate amount allocated to taxpayers with respect to qualified projects by the neighborhood homes credit agency of any State for any calendar year shall not exceed the State neighborhood homes credit amount of such State for such calendar year.</text></subparagraph> 
<subparagraph id="HE1223198AFD94A108773B6C4B999144D" commented="no"><enum>(B)</enum><header>Set-aside for certain projects involving qualified nonprofit organizations</header><text display-inline="yes-display-inline">Rules similar to the rules of section 42(h)(5) shall apply for purposes of this section.</text></subparagraph></paragraph> <paragraph id="H09144DC1B0CD44D8941541E442906E2B"><enum>(3)</enum><header>Determination of State neighborhood homes credit ceiling</header> <subparagraph id="H2A18B35759794E1F9F0258B058893073"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The State neighborhood homes credit amount for a State for a calendar year is an amount equal to the sum of—</text> 
<clause id="H78398F9AD51C4AE986A87B6605107D4E"><enum>(i)</enum><text>the greater of—</text> <subclause id="H310DFD27F6094834B813E5196437B03F"><enum>(I)</enum><text display-inline="yes-display-inline">the product of $7, multiplied by the State population (determined in accordance with section 146(j)), or</text></subclause> 
<subclause id="HB4E1EBDDAD7F4359AA51923CFC1D3ECE"><enum>(II)</enum><text display-inline="yes-display-inline">$9,000,000, and</text></subclause></clause> <clause id="H369EBF9432B04432973DF3F126ED1AE3"><enum>(ii)</enum><text>any amount previously allocated to any taxpayer with respect to any qualified project by the neighborhood homes credit agency of such State which can no longer be allocated to any qualified residence because the 5-year period described in paragraph (1)(B) expires during calendar year.</text></clause></subparagraph> 
<subparagraph id="HE6818040115642C99715BE075C4A0516"><enum>(B)</enum><header>3-year carryforward of unused limitation</header><text display-inline="yes-display-inline">The State neighborhood homes credit amount for a State for a calendar year shall be increased by the excess (if any) of the State neighborhood homes credit amount for such State for the preceding calendar year over the aggregate amount allocated by the neighborhood homes credit agency of such State during such preceding calendar year. Any amount carried forward under the preceding sentence shall not be carried past the third calendar year after the calendar year in which such credit amount originally arose, determined on a first-in, first-out basis.</text></subparagraph></paragraph></subsection> <subsection commented="no" id="HD95462CD398342ACB709E446105BEB0A"><enum>(f)</enum><header>Responsibilities of neighborhood homes credit agencies</header> <paragraph commented="no" id="H75C7B23E9DDA41C18EA6476D2CBB52DE"><enum>(1)</enum><header>In general</header><text>Notwithstanding subsection (e), the State neighborhood homes credit dollar amount shall be zero for a calendar year unless the neighborhood homes credit agency of the State—</text> 
<subparagraph commented="no" id="H15F16538895F4C7D87EC089E0463EA73"><enum>(A)</enum><text display-inline="yes-display-inline">allocates such amount pursuant to a qualified allocation plan of the neighborhood homes credit agency,</text></subparagraph> <subparagraph id="H7914B646E2D64449A43317D66DDD18DC" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">allocates not more than 20 percent of amounts allocated in the previous year (or for allocations made in 2025, not more than 20 percent of the neighborhood homes credit ceiling for such year) to projects with respect to qualified residences which—</text> 
<clause id="H2CD45FC9DEC24C948A0D7FBFF38D094B" commented="no"><enum>(i)</enum><text>are located in census tracts described in subsection (c)(2)(A)(iii), (c)(2)(A)(iv), (i)(5), or</text></clause> <clause id="H9E79946487834E1BACD026381A0F9E27" commented="no"><enum>(ii)</enum><text>are not located in a qualified census tract but meet the requirements of subsection (i)(8),</text></clause></subparagraph> 
<subparagraph commented="no" id="H48371F8EE48B4268848E6EF1F1EBBB79"><enum>(C)</enum><text>promulgates standards with respect to reasonable qualified development costs and fees,</text></subparagraph> <subparagraph id="HACCEA5D9CD834E1FB883F58961B68088"><enum>(D)</enum><text>promulgates standards with respect to construction quality,</text></subparagraph> 
<subparagraph id="H67295EC5CD16469ABE5545499DCE50B2"><enum>(E)</enum><text display-inline="yes-display-inline">in the case of any neighborhood homes credit agency which makes an allocation to a qualified project which includes any qualified residence to which subsection (i) applies, promulgates standards with respect to protecting the owners of such residences, including the capacity of such owners to pay rehabilitation costs not covered by the credit provided by this section and providing for the disclosure to such owners of their rights and responsibilities with respect to the rehabilitation of such residences,</text></subparagraph> <subparagraph commented="no" id="HEFB1425E0E4248CB8E6803E1D21C69A5"><enum>(F)</enum><text>submits to the Secretary (at such time and in such manner as the Secretary may prescribe) an annual report specifying—</text> 
<clause commented="no" id="HB3ABE95653714F4BBB7936636E994D8A"><enum>(i)</enum><text>the amount of the neighborhood homes credits allocated to each qualified project for the previous year,</text></clause> <clause commented="no" id="H535F70B4E62B40C2B1DD32C18E2AE55C"><enum>(ii)</enum><text>with respect to each qualified residence completed in the preceding calendar year—</text> 
<subclause commented="no" id="H86310DEC4F234827BEBC0FB9B751579D"><enum>(I)</enum><text>the census tract in which such qualified residence is located,</text></subclause> <subclause commented="no" id="HB57B9FF60612448FB8D986535CE78899"><enum>(II)</enum><text>with respect to the qualified project that includes such qualified residence, the year in which such project received an allocation under this section,</text></subclause> 
<subclause commented="no" id="H1E74559CA979473492ED9C9FE8187C69"><enum>(III)</enum><text>whether such qualified residence was new, substantially rehabilitated and sold to a qualified homeowner, or substantially rehabilitated pursuant to subsection (i),</text></subclause> <subclause commented="no" id="H9E002C3DD4CF45B299A6A810FB2DDD14"><enum>(IV)</enum><text>the eligible development costs of such qualified residence,</text></subclause> 
<subclause commented="no" id="H141C919B650D4A868766FA98A80B0EED"><enum>(V)</enum><text>the amount of the neighborhood homes credit with respect to such qualified residence,</text></subclause> <subclause commented="no" id="HAF1B13B27792444DB8EFC1780FDB0D94"><enum>(VI)</enum><text>the sales price of such qualified residence, if applicable, and</text></subclause> 
<subclause commented="no" id="H1CE11061642446F4970677D30AB7B962"><enum>(VII)</enum><text>the family income of the qualified homeowner (expressed as a percentage of the applicable area median family income for the location of the qualified residence), and</text></subclause></clause> <clause commented="no" id="H684915F777BF4C29B2C0090A4E530623"><enum>(iii)</enum><text>such other information as the Secretary may require, and</text></clause></subparagraph> 
<subparagraph commented="no" id="HB29E07E4D0DA4F73B766741EB6468FC3"><enum>(G)</enum><text>makes available to the general public a written explanation for any allocation of a neighborhood homes credit dollar amount which is not made in accordance with established priorities and selection criteria of the neighborhood homes credit agency.</text></subparagraph><continuation-text continuation-text-level="paragraph">Subparagraph (B) shall be applied by substituting <quote>40 percent</quote> for <quote>20 percent</quote> each place it appears in the case of any State in which at least 45 percent of the State population resides outside metropolitan statistical areas (within the meaning of section 143(k)(2)(B)) and less than 20 percent of the census tracts located in the State are described in subsection (c)(2)(A)(i).</continuation-text></paragraph> <paragraph commented="no" id="HB06B03D26A6E4FFB9CBE31445E265DE7"><enum>(2)</enum><header>Qualified allocation plan</header><text>For purposes of this subsection, the term <term>qualified allocation plan</term> means any plan which—</text> 
<subparagraph commented="no" id="H66046DB032C440F5874CBB4F1A50CBD4"><enum>(A)</enum><text display-inline="yes-display-inline">sets forth the selection criteria to be used to prioritize qualified projects for allocations of State neighborhood homes credit dollar amounts, including—</text> <clause commented="no" id="H81D2E16F7038478A9706936E6CF3B47B"><enum>(i)</enum><text>the need for new or substantially rehabilitated owner-occupied homes in the area addressed by the project,</text></clause> 
<clause commented="no" id="H5C7793FA2C104AE691F9408EFC3BDE61"><enum>(ii)</enum><text display-inline="yes-display-inline">the expected contribution of the project to neighborhood stability and revitalization, including the impact on neighborhood residents,</text></clause> <clause commented="no" id="HAE61CA1620574320B343296213118B42"><enum>(iii)</enum><text>the capability and prior performance of the project sponsor, and</text></clause> 
<clause commented="no" id="HE3C5FF8768464E488D538E01A39C14A0"><enum>(iv)</enum><text>the likelihood the project will result in long-term homeownership,</text></clause></subparagraph> <subparagraph commented="no" id="HC3D371C5444545D4852B349488BA100C"><enum>(B)</enum><text>has been made available for public comment, and</text></subparagraph> 
<subparagraph commented="no" id="HD6576A89432944CE8BC4B1FDD723E390"><enum>(C)</enum><text>provides a procedure that the neighborhood homes credit agency (or any agent or contractor of such agency) shall follow for purposes of—</text> <clause commented="no" id="HEE4CEFD2436840C0B5016C27B3BCA96D"><enum>(i)</enum><text>identifying noncompliance with any provisions of this section, and</text></clause> 
<clause commented="no" id="H77A3E5E7DF9B49DFAB6BF335218CCB72"><enum>(ii)</enum><text>notifying the Internal Revenue Service of any such noncompliance of which the agency becomes aware.</text></clause></subparagraph></paragraph></subsection> <subsection id="HD7D1EAC5587E43F9AE05EE2D4FA24457"><enum>(g)</enum><header>Repayment</header> <paragraph commented="no" id="H441340CD71E9468CA46F1AFB83624515"><enum>(1)</enum><header>In general</header> <subparagraph commented="no" id="H9D237BF50C624563BF712AF1D1F6FE13"><enum>(A)</enum><header>Sold during 5-year period</header><text display-inline="yes-display-inline">If a qualified residence is sold during the 5-year period beginning immediately after the affordable sale of such qualified residence referred to in subsection (a), the seller shall transfer an amount equal to the repayment amount to the relevant neighborhood homes credit agency.</text></subparagraph> 
<subparagraph commented="no" id="H5374030E80E44AE3B23B741BCA532552"><enum>(B)</enum><header>Use of repayments</header><text>A neighborhood homes credit agency shall use any amount received pursuant to subparagraph (A) only for purposes of qualified projects.</text></subparagraph></paragraph> <paragraph id="HF63F178B7A914316B307B09874E5B731" commented="no"><enum>(2)</enum><header>Repayment amount</header><text>For purposes of paragraph (1)(A)—</text> 
<subparagraph commented="no" id="HB5E5EFF3CB3C49F4947BCB5AD056CFA2"><enum>(A)</enum><header>In general</header><text>The repayment amount is an amount equal to the applicable percentage of the gain from the sale to which the repayment relates.</text></subparagraph> <subparagraph commented="no" id="HAB4332B8C3684BD2B0FE5F8C9FCF75C9"><enum>(B)</enum><header>Applicable percentage</header><text>For purposes of subparagraph (A), the applicable percentage is 50 percent, reduced by 10 percentage points for each year of the 5-year period referred to in paragraph (1)(A) which ends before the date of such sale.</text></subparagraph></paragraph> 
<paragraph id="H1B17E8751E7B4257A762422745EC739B"><enum>(3)</enum><header>Lien for repayment amount</header><text>A neighborhood homes credit agency receiving an allocation under this section shall place a lien on each qualified residence that is built or rehabilitated as part of a qualified project for an amount such agency deems necessary to ensure potential repayment pursuant to paragraph (1)(A).</text></paragraph> <paragraph commented="no" id="HDA61F0C1034F433FB561973101F8B55E"><enum>(4)</enum><header>Waiver</header> <subparagraph commented="no" display-inline="no-display-inline" id="HB9BF5702ECFA4FBDA5967ACFC1A9929C"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The neighborhood homes credit agency may waive the repayment required under paragraph (1)(A) if the agency determines that making a repayment would constitute a hardship to the seller.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H9260036E0C2A401089FC66D15956C479"><enum>(B)</enum><header>Hardship</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), with respect to the seller, a hardship may include—</text> <clause commented="no" display-inline="no-display-inline" id="H2210C1E0A21746FA829641A72092D49D"><enum>(i)</enum><text display-inline="yes-display-inline">divorce,</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H28D389A7896741F4BB8F018965BF29F6"><enum>(ii)</enum><text>disability,</text></clause> <clause commented="no" display-inline="no-display-inline" id="HD08FF94644E744F2B6AF0B9F814D7EE7"><enum>(iii)</enum><text>illness, or</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H0933EA57722249D8AFAEA538F9B06E5E"><enum>(iv)</enum><text>any other hardship identified by the neighborhood homes credit agency for purposes of this paragraph.</text></clause></subparagraph></paragraph></subsection> <subsection id="HCB68BE94C33B4DB5835F9B2A16E5A44D"><enum>(h)</enum><header>Other definitions and special rules</header><text>For purposes of this section—</text> 
<paragraph id="HED288AF2AC3B4FF987DB36637EF3AF9C" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header>Neighborhood homes credit agency</header><text display-inline="yes-display-inline">The term <term>neighborhood homes credit agency</term> means the agency designated by the governor of a State as the neighborhood homes credit agency of the State.</text></paragraph> <paragraph id="H457E85231C744E8BB6E95E9EF74D2BB5"><enum>(2)</enum><header>Qualified project</header><text display-inline="yes-display-inline">The term <term>qualified project</term> means a project that a neighborhood homes credit agency certifies will build or substantially rehabilitate one or more qualified residences.</text></paragraph> 
<paragraph id="HC54FC4D5EEC342EEB3101B102E01FEC6"><enum>(3)</enum><header>Determinations of family income</header><text>Rules similar to the rules of section 143(f)(2) shall apply for purposes of this section.</text></paragraph> <paragraph id="HB7947FA647CF4324A08B69121CCFAA62"><enum>(4)</enum><header>Possessions treated as states</header><text>The term <term>State</term> includes the District of Columbia and the possessions of the United States.</text></paragraph> 
<paragraph id="H0E8BE7EBF1B34D30AC8C0A368675A4DB"><enum>(5)</enum><header>Special rules related to condominiums and cooperative housing corporations</header> 
<subparagraph id="H4C32AC319FE749FC9E3FE7645A66EB20"><enum>(A)</enum><header>Determination of development costs</header><text>In the case of a qualified residence described in clause (ii) or (iii) of subsection (c)(1)(A), the reasonable development costs and eligible development costs of such qualified residence shall be an amount equal to such costs, respectively, of the entire condominium or cooperative housing property in which such qualified residence is located, multiplied by a fraction—</text> <clause id="H682CDAB869094878962939E3D3C25924"><enum>(i)</enum><text>the numerator of which is the total floor space of such qualified residence, and</text></clause> 
<clause id="HFE5E1B46165B4075B96B0EA8E2D8FBA8"><enum>(ii)</enum><text>the denominator of which is the total floor space of all residences within such property.</text></clause></subparagraph> <subparagraph commented="no" id="HB8251C48FD5F45E1955BDD9FB918D345"><enum>(B)</enum><header>Tenant-stockholders of cooperative housing corporations treated as owners</header><text display-inline="yes-display-inline">In the case of a cooperative housing corporation (as such term is defined in section 216(b)), a tenant-stockholder shall be treated as owning the house or apartment which such person is entitled to occupy.</text></subparagraph></paragraph> 
<paragraph id="HFB951FBA73564D7CABFAAF385A566260" display-inline="no-display-inline"><enum>(6)</enum><header>Related party sales not treated as affordable sales</header> 
<subparagraph id="HC6F1A126B304404BAFFA6394433198D4"><enum>(A)</enum><header>In general</header><text>A sale between related persons shall not be treated as an affordable sale.</text></subparagraph> <subparagraph id="H93DE1CD14A5C4A9B9BE2691C5ED9AA6B"><enum>(B)</enum><header>Related persons</header><text>For purposes of this paragraph, a person (in this subparagraph referred to as the <quote>related person</quote>) is related to any person if the related person bears a relationship to such person specified in section 267(b) or 707(b)(1), or the related person and such person are engaged in trades or businesses under common control (within the meaning of subsections (a) and (b) of section 52). For purposes of the preceding sentence, in applying section 267(b) or 707(b)(1), <quote>10 percent</quote> shall be substituted for <quote>50 percent</quote>.</text></subparagraph></paragraph> 
<paragraph id="H18F8FE00C8EC4173823B0279FF9CBF01"><enum>(7)</enum><header>Inflation adjustment</header> 
<subparagraph id="H14A8A9EFD0564BCE9B55C51F2AE2CA51"><enum>(A)</enum><header>In general</header><text>In the case of a calendar year after 2025, the dollar amounts in subsections (b)(3)(A), (e)(3)(A)(i)(I), (e)(3)(A)(i)(II), and (i)(2)(C) shall each be increased by an amount equal to—</text> <clause id="H4CA6F6CF8C454E8C85A1D26F27E0429C" display-inline="no-display-inline"><enum>(i)</enum><text>such dollar amount, multiplied by</text></clause> 
<clause id="H6242636F23A44AF0B67D472BCBB2962E"><enum>(ii)</enum><text>the cost-of-living adjustment determined under section 1(f)(3) for such calendar year by substituting <quote>calendar year 2022</quote> for <quote>calendar year 2016</quote> in subparagraph (A)(ii) thereof.</text></clause></subparagraph> <subparagraph id="H9A844333556A412F8209FA625A720065"><enum>(B)</enum><header>Rounding</header> <clause id="H7D94365647274163BC04E6EFDF72406C"><enum>(i)</enum><text>In the case of the dollar amounts in subsections (b)(3)(A) and (i)(2)(C), any increase under paragraph (1) which is not a multiple of $1,000 shall be rounded to the nearest multiple of $1,000.</text></clause> 
<clause id="H28BABE3D074E4BC482D839D6E470CACE"><enum>(ii)</enum><text>In the case of the dollar amount in subsection (e)(3)(A)(i)(I), any increase under paragraph (1) which is not a multiple of $0.01 shall be rounded to the nearest multiple of $0.01.</text></clause> <clause id="H325DBC035A4440878A8C07E9DB623661"><enum>(iii)</enum><text>In the case of the dollar amount in subsection (e)(3)(A)(i)(II), any increase under paragraph (1) which is not a multiple of $100,000 shall be rounded to the nearest multiple of $100,000.</text></clause></subparagraph></paragraph> 
<paragraph id="HBEE0078B7BD94E5BB9C5E4B4EFE98584"><enum>(8)</enum><header>Report</header> 
<subparagraph id="HC971A742F1DA429298C73AC4E96746CB"><enum>(A)</enum><header>In general</header><text>The Secretary shall annually issue a report, to be made available to the public, which contains the information submitted pursuant to subsection (f)(1)(F).</text></subparagraph> <subparagraph id="H3CC4B87A62FD42D7B1D7256668CC22DF"><enum>(B)</enum><header>De-identification</header><text>The Secretary shall ensure that any information made public pursuant to subparagraph (A) excludes any information that would allow for the identification of qualified homeowners.</text></subparagraph></paragraph> 
<paragraph id="H5030B44C3E9C4FEE8C0D37AC50A0DD20"><enum>(9)</enum><header>List of qualified census tracts</header><text display-inline="yes-display-inline">The Secretary of Housing and Urban Development shall, for each year, make publicly available a list of qualified census tracts under—</text> <subparagraph id="HA5A988B1BD6542BEBBFC41CE48156A52"><enum>(A)</enum><text display-inline="yes-display-inline">on a combined basis, clauses (i) and (ii) of subsection (c)(2)(A),</text></subparagraph> 
<subparagraph id="HA2C53F616E5F433689E6300B52F7D38A"><enum>(B)</enum><text display-inline="yes-display-inline">clause (iii) of such subsection, and</text></subparagraph> <subparagraph id="HBFF7201FE7F94989861018EFDB91C5B6"><enum>(C)</enum><text display-inline="yes-display-inline">subsection (i)(5)(A).</text></subparagraph></paragraph> 
<paragraph id="HC902017F5666452C93281319BCF628EE"><enum>(10)</enum><header>Denial of deductions if converted to rental housing</header><text display-inline="yes-display-inline">If, during the 5-year period beginning immediately after the affordable sale of a qualified residence referred to in subsection (a), an individual who owns a qualified residence (whether or not such individual was the purchaser in such affordable sale) fails to use such qualified residence as such individual’s principal residence for any period of time, no deduction shall be allowed for expenses paid or incurred by such individual with respect to renting, during such period of time, such qualified residence.</text></paragraph></subsection> <subsection id="HC9B6C2B22ECC4F3E964BEFA2D3419319"><enum>(i)</enum><header>Application of credit with respect to owner-Occupied rehabilitations</header> <paragraph id="H31D4DF4BCDBA46D882AF777C5F5CE00A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of a qualified rehabilitation by the taxpayer of any qualified residence which is owned (as of the date that the written binding contract referred to in paragraph (3) is entered into) by a specified homeowner, the rules of paragraphs (2) through (7) shall apply.</text></paragraph> 
<paragraph id="H81C5395E95FB4414AF7B7F65FA1D3370"><enum>(2)</enum><header>Alternative credit determination</header><text display-inline="yes-display-inline">In the case of any qualified residence described in paragraph (1), the neighborhood homes credit determined under subsection (a) with respect to such residence shall (in lieu of any credit otherwise determined under subsection (a) with respect to such residence) be allowed in the taxable year during which the qualified rehabilitation is completed (as determined by the neighborhood homes credit agency) and shall be equal to the least of—</text> <subparagraph id="H8BD10D6D3BCF473DA3D605BABD839761"><enum>(A)</enum><text>the excess (if any) of—</text> 
<clause id="H2B8704B353874E338AAA523AB94FEEDB"><enum>(i)</enum><text display-inline="yes-display-inline">the amounts paid or incurred by the taxpayer for the qualified rehabilitation of the qualified residence to the extent that such amounts are certified by the neighborhood homes credit agency (at the time of the completion of such rehabilitation) as meeting the standards specified pursuant to subsection (f)(1)(C), over</text></clause> <clause id="HC22E323AA3144079B821E1CF209EDB0A"><enum>(ii)</enum><text>any amounts paid to such taxpayer for such rehabilitation,</text></clause></subparagraph> 
<subparagraph id="H30560F0CD1A34A9CAB4ECEF0B325B61A"><enum>(B)</enum><text>50 percent of the amounts described in subparagraph (A)(i), or</text></subparagraph> <subparagraph id="H9399918C8F37478FA9F9CEED1D87AE85"><enum>(C)</enum><text>$50,000.</text></subparagraph></paragraph> 
<paragraph id="H61FD72F66B04404A889FFCE38B9A75E7"><enum>(3)</enum><header>Qualified rehabilitation</header> 
<subparagraph id="H7EE4DECD352D4CB994EE84E20ACBD67E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <quote>qualified rehabilitation</quote> means a rehabilitation or reconstruction performed pursuant to a written binding contract between the taxpayer and the specified homeowner if the amount paid or incurred by the taxpayer in the performance of such rehabilitation or reconstruction exceeds the dollar amount in effect under subsection (b)(3)(A).</text></subparagraph> <subparagraph id="HEC3400888DCE4365B7A07860FFE640A5"><enum>(B)</enum><header>Application of limitation to expenses paid or incurred after allocation</header><text>A rule similar to the rule of section (b)(4) shall apply for purposes of this subsection.</text></subparagraph></paragraph> 
<paragraph id="HB5229C51509A4F51B91142447038B4E4"><enum>(4)</enum><header>Specified homeowner</header><text>For purposes of this subsection, the term <term>qualified homeowner</term> means, with respect to a qualified residence, an individual—</text> <subparagraph id="HF3890E88FF044187B95C533548DAD56F"><enum>(A)</enum><text>who owns and uses such qualified residence as the principal residence of such individual as of the date that the written binding contract referred to in paragraph (3) is entered into, and</text></subparagraph> 
<subparagraph id="H3C6AAC41156B40A99892D0FC3062BCCA"><enum>(B)</enum><text display-inline="yes-display-inline">whose family income (determined as of such date) does not exceed the median family income for the applicable area (with respect to the census tract in which the qualified residence is located).</text></subparagraph></paragraph> <paragraph id="HA91BE738D01B475B898882BF1933395C"><enum>(5)</enum><header>Additional census tracts in which owner-occupied residences may be located</header><text>In the case of any qualified residence described in paragraph (1), the term <quote>qualified census tract</quote> includes any census tract which—</text> 
<subparagraph id="HBF853A8B19CE42D9A031929674E32345"><enum>(A)</enum><text>meets the requirements of subsection (c)(2)(A)(i) without regard to subclause (III) thereof, and</text></subparagraph> <subparagraph id="H2856EAD5EF97401F890A3112E4BC7281"><enum>(B)</enum><text>is designated by the neighborhood homes credit agency for purposes of this paragraph.</text></subparagraph></paragraph> 
<paragraph id="HDF50BF76D44744A6915BC571022EE9AD"><enum>(6)</enum><header>Modification of repayment requirement</header><text display-inline="yes-display-inline">In the case of any qualified residence described in paragraph (1), subsection (g) shall be applied by beginning the 5-year period otherwise described therein on the date on which the qualified homeowner acquired such residence.</text></paragraph> <paragraph id="H74268CBEE2E443EA95491AA37A5CD4A4"><enum>(7)</enum><header>Related parties</header><text>Paragraph (1) shall not apply if the taxpayer is the owner of the qualified residence described in paragraph (1) or is related (within the meaning of subsection (h)(6)(B)) to such owner.</text></paragraph> 
<paragraph id="H4AD81073C5C0410E970DDA8DC733C96D"><enum>(8)</enum><header>Pyrrhotite remediation</header><text display-inline="yes-display-inline">The requirement of subsection (c)(1)(C) shall not apply to a qualified rehabilitation under this subsection of a qualified residence that is documented by an engineer’s report and core testing to have a foundation that is adversely impacted by pyrrhotite or other iron sulfide minerals.</text></paragraph></subsection> <subsection id="H13CDA7A07E2E4CE2AE8F8DCF5FE8A992"><enum>(j)</enum><header>Regulations</header><text>The Secretary shall prescribe such regulations as may be necessary or appropriate to carry out the purposes of this section, including regulations that prevent avoidance of the rules, and abuse of the purposes, of this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H6C53CEDC8652430F871C3880308D078C"><enum>(b)</enum><header>Credit allowed as part of general business credit</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/38">Section 38(b)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>plus</quote> at the end of paragraph (37), by striking the period at the end of paragraph (38) and inserting <quote>, plus</quote>, and by adding at the end the following new paragraph:</text> <quoted-block style="OLC" id="HE4E44415B2AB4582B01EE4F786AAA9E1"> <paragraph id="H23D59E5C7D2E476E91375D022D635C16"><enum>(39)</enum><text>the neighborhood homes credit determined under section 42A(a).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HE4D3893CEC93430DAD623262881BE266"><enum>(c)</enum><header>Credit allowed against alternative minimum tax</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/38">Section 38(c)(4)(B)</external-xref> of the Internal Revenue Code of 1986 is amended by redesignating clauses (iv) through (xii) as clauses (v) through (xiii), respectively, and by inserting after clause (iii) the following new clause:</text> <quoted-block style="OLC" id="H0C4148A9D8314EA8A5B5F7D9E5460FE6" display-inline="no-display-inline"> <clause id="H33BA10959459400B9113026C5619D318"><enum>(iv)</enum><text display-inline="yes-display-inline">the credit determined under section 42A,</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H6282E7CCFFCB45859D498B58647A8B21"><enum>(d)</enum><header>Basis adjustments</header> 
<paragraph commented="no" display-inline="no-display-inline" id="HCF60FD75CE3D4BA1923A075DDAD7A2F2"><enum>(1)</enum><header display-inline="yes-display-inline">Energy efficient home improvement credit</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/25C">Section 25C(g)</external-xref> of the Internal Revenue Code of 1986 is amended by adding after the first sentence the following new sentence: <quote>This subsection shall not apply for purposes of determining the eligible development costs or adjusted basis of any building under section 42A.</quote>.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H0FB722AD96634608B2A69B6DD44F921A"><enum>(2)</enum><header display-inline="yes-display-inline">Residential clean energy credit</header><text>Section 25D(f) of such Code is amended by adding after the first sentence the following new sentence: <quote>This subsection shall not apply for purposes of determining the eligible development costs or adjusted basis of any building under section 42A.</quote>.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H3489B981A45E438FAE84F5D567FE4EE4"><enum>(3)</enum><header display-inline="yes-display-inline">New energy efficient home credit</header><text>Section 45L(e) of such Code is amended by inserting <quote>or for purposes of determining the eligible development costs or adjusted basis of any building under section 42A</quote> after <quote>section 42</quote>.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H88170C4D45E0449BB7375FA97B2C96FF"><enum>(e)</enum><header display-inline="yes-display-inline">Exclusion from gross income</header><text display-inline="yes-display-inline">Part III of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting before section 140 the following new section:</text>

<subsection commented="no" id="H4DBE27AD5745407598A6803AF85309B4"><enum>(a)</enum><header>Exclusion from gross income</header><text display-inline="yes-display-inline">Gross income shall not include the value of any subsidy provided to a taxpayer (whether directly or indirectly) by any State energy office (as defined in section 124(a) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15821">42 U.S.C. 15821(a)</external-xref>)) for purposes of any energy improvements made to a qualified residence (as defined in section 42A(c)(1)).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection commented="no" display-inline="no-display-inline" id="H32E6868F7CD44F9F9E65D28698ED62E7"><enum>(f)</enum><header display-inline="yes-display-inline">Conforming amendments</header> <paragraph id="H3B2A8C48A0CD45359AA90455E678036A"> <enum>(1)</enum> <text>Subsections (i)(3)(C), (i)(6)(B)(i), and (k)(1) of <external-xref legal-doc="usc" parsable-cite="usc/26/469">section 469</external-xref> of the Internal Revenue Code of 1986 are each amended by inserting <quote>or 42A</quote> after <quote>section 42</quote>.</text>
                    </paragraph>

<subsection id="HBF1534A0430744B5B3F01B0141683142"><enum>(b)</enum><header>Submission to PBRB</header><text display-inline="yes-display-inline">Any Federal agency that receives a petition under subsection (a) shall submit a copy of such petition to the Public Buildings Reform Board.</text></subsection> <subsection id="H556AA6E6867A43C4AC5F20DA8C221C02"><enum>(c)</enum><header>Determination</header><text>A Federal agency that receives a petition under subsection (a) shall, not less that 60 days after receiving such petition determine whether the property is excess.</text></subsection> 
<subsection id="HD5E586A9DE774CE49AF7CA4953018D19"><enum>(d)</enum><header>Justification required</header><text>If a Federal agency determines under subsection (c) that a property is not excess such Federal agency shall submit to the Office of Management and Budget a statement that justifies why such property is not excess.</text></subsection> <subsection id="H316E317D898E429CA150E7A0DB1A1399"><enum>(e)</enum><header>Donation by GSA</header><text>If a Federal agency determines a property to be excess under subsection (b), the General Services Administration may donate such property to the State or unit of local government that submitted the petition under subsection (a).</text></subsection></section> 
<section id="HEAF59391852E45A9B0864D5786896AC1"><enum>209.</enum><header>Energy conservation standards for manufactured housing</header><text display-inline="no-display-inline">The Secretary of Energy may not, by rule or otherwise, establish energy conservation standards for manufactured housing.</text></section> <section id="H09ED6EC9827A4B68A2D58CFC11C88279" commented="no" display-inline="no-display-inline"><enum>210.</enum><header>Rental assistance demonstration program</header><text display-inline="no-display-inline">The matter under the heading <quote>Rental Assistance Demonstration</quote> in the Department of Housing and Urban Development Appropriations Act, 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/55">Public Law 112–55</external-xref>), is amended—</text>

<section id="H281D4770D3184A7FB15A4197198C25B8" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>211.</enum><header>Creating incentives for small dollar loan originators</header> 
<subsection id="HD34CB8A572F54DCCBFAD7AAFBDEBA9C9" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Small dollar mortgage defined</header><text display-inline="yes-display-inline">In this section, the term <term>small dollar mortgage</term> means a mortgage loan that—</text> <paragraph id="HFE39F1461BC140DC93448D40C437C896"><enum>(1)</enum><text>has an original principal obligation of not more than $70,000;</text></paragraph> 
<paragraph id="H53C15FD3568643F7A1E1741CB0700C30"><enum>(2)</enum><text>is secured by real property designed for the occupancy of 1 to 4 families; and</text></paragraph> <paragraph id="HFF03C642B2814CD79ADFCC58977F0A87"><enum>(3)</enum><text>is—</text> 
<subparagraph id="H08257CBA68EE470D8CDEA22E0F22DE71"><enum>(A)</enum><text>insured by the Federal Housing Administration under title II of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1707">12 U.S.C. 1707 et seq.</external-xref>);</text></subparagraph> <subparagraph id="H35A0C4E01A9E47C59F6D032E90DBCA9B"><enum>(B)</enum><text>made, guaranteed, or insured by the Department of Veterans Affairs;</text></subparagraph> 
<subparagraph id="H478F5FF39CA542AC9656C885A7E7D04D"><enum>(C)</enum><text>made, guaranteed, or insured by the Department of Agriculture; or</text></subparagraph> <subparagraph id="HF511A0BD00784E8183AF37B55199EB6B"><enum>(D)</enum><text>eligible to be purchased or securitized by the Federal Home Loan Mortgage Corporation or the Federal National Mortgage Association.</text></subparagraph></paragraph></subsection> 
<subsection id="HD8A524377367429981431738A2CCD26F" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Requirement To update regulations</header><text display-inline="yes-display-inline">Not later than 270 days after the date of enactment of this Act, the Director of the Bureau of Consumer Financial Protection shall issue regulations to update part 1026 of title 12, Code of Federal Regulations (commonly referred to as <quote>Regulation Z</quote>) to allow for salaried originators of residential mortgage loans that only originate small dollar mortgages.</text></subsection></section> <section id="HAAF940CE96DC4D1BAB64EB3A0716BFE2" display-inline="no-display-inline" section-type="subsequent-section"><enum>212.</enum><header>Small dollar mortgage points and fees</header> <subsection id="HD9EA45AB5DC24DBFA0F98DEA7C64AFEB" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>small dollar mortgage</term> means a mortgage with an original principal obligation of less than $70,000.</text></subsection> 
<subsection id="H273F07715382476C8DF8E6994F1C3DE7" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Amendments required</header><text>Not later than 180 days after the date of enactment of this Act, the Director of the Bureau of Consumer Financial Protection, in consultation with the Secretary of Housing and Urban Development and the Director of the Federal Housing Finance Agency, shall amend the limitations with respect to points and fees under section 1026.32 of title 12, Code of Federal Regulations, or any successor regulation, to encourage additional lending for small dollar mortgages.</text></subsection></section> <section id="HFC8164094C774B4CABF396F03865DEE8" display-inline="no-display-inline" section-type="subsequent-section"><enum>213.</enum><header>Removing Outdated Regulation for Manufactured Housing</header> <subsection id="H935ADFB6F09F4B3C822DC649E8D512DC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 603(6) of the National Manufactured Housing Construction and Safety Standards Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5402">42 U.S.C. 5402(6)</external-xref>) is amended by striking <quote>built on a permanent chassis and</quote>.</text></subsection> 
<subsection id="H87B7AF1F8F9A4E7A941692D6E8FDF7AE"><enum>(b)</enum><header>Implementation</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the consensus committee established under section 604(a)(3) of the National Manufactured Housing Construction and Safety Standards Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5403">42 U.S.C. 5403(a)(3)</external-xref>) shall meet to develop and recommend to the Secretary of Housing and Urban Development such revisions to the Federal manufactured home construction and safety standards, and related regulations, as are necessary to implement the amendment made by subsection (a) of this section. Such revised standards shall be considered by the Secretary for adoption pursuant to the process set forth in section 604 of such Act.</text></subsection></section></title> <title id="HEA59D8945C2F42E4B9DFD98CBD10627B"><enum>III</enum><header>Serving the most vulnerable; health and safety</header> <section id="H907BA568A9C543918CB5DFE803D0215E"><enum>301.</enum><header>GAO study to determine proximity of housing to Superfund sites</header> <subsection id="H1647F5C51D7B46BDB445135FE8E54E47"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall carry out a study to identify how many residential dwelling units, and how many dwelling units in public housing (as such term is defined in section 3(b) of the United States Housing Act of 1937 (42 U.S.C. 1437a(B))), are located within one mile of a site that is included on the National Priorities List pursuant to section 105 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9605">42 U.S.C. 9605</external-xref>).</text></subsection> 
<subsection id="H5347A17F7B6A41C2B41B31CB40CFD20F"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than the expiration of the 6-month period beginning on the date of the enactment of this Act, the Comptroller General shall submit a report to the Congress identifying, for each site referred to in subsection (a), how many residential dwelling units, and how many dwelling units in public housing, are located within one mile of such site.</text></subsection></section> <section id="H0DA0C81B09A34C86A56F379F21521424"><enum>302.</enum><header>Ensuring public housing agencies inspect each dwelling unit each year</header><text display-inline="no-display-inline">The Secretary of Housing and Urban Development and the Comptroller General of the United States shall, not later than 1 year after the date of the enactment of this section, conduct a study and submit a report to the Congress that identifies:</text> 
<paragraph id="HB437A3E56085474780DBC072B1D6A1A0"><enum>(1)</enum><text display-inline="yes-display-inline">how many inspections required to be conducted by the Secretary of Housing and Urban Development in the 1-year period are incomplete; and</text></paragraph> <paragraph id="H492F89AF7520498C8698AF95B03495D4"><enum>(2)</enum><text display-inline="yes-display-inline">how many inspectors are needed to ensure that all inspections required to be conducted by the Secretary of Housing and Urban Development can be completed each year.</text></paragraph></section> 
<section id="H8D1EE731C9C34C9480E2FAEFB1757E76"><enum>303.</enum><header>Incentivizing local solutions to homelessness</header> 
<subsection commented="no" display-inline="no-display-inline" id="HFB7D485D0A2545F4A9BB14C5A020BB04"><enum>(a)</enum><header display-inline="yes-display-inline">Continuum of care program</header><text display-inline="yes-display-inline">Section 428 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1186b">42 U.S.C. 1186b</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H6874A1D2D7F8465A95A446625B84A3C9"> <subsection id="H403FBFB07E6E4BC085F15DC6F12F91B9"><enum>(f)</enum><header>Incentives for reducing homelesness</header> <paragraph commented="no" display-inline="no-display-inline" id="H652CB85809314228A710238FEFA94134"><enum>(1)</enum><header>In general</header><text>From the amounts made available to carry out this subtitle for a fiscal year, the Secretary may use not more than 10 percent of the amounts made available to carry out this subtitle for incentives described in paragraph (2).</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H3A1CFB8FE33C41E28E2D6C06DF21AFFB"><enum>(2)</enum><header display-inline="yes-display-inline">Incentives</header><text display-inline="yes-display-inline">The Secretary may provide bonuses or other incentives to a geographic area under this subtitle if, during a fiscal year, the Secretary determines that an entity receiving funds under this subtitle has demonstrably and measurably improved housing outcomes for homeless individuals in the geographic area.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H2AE86036F9824EEE9887F2D5CB887B4B"><enum>(b)</enum><header>Emergency solutions grants program</header><text display-inline="yes-display-inline">Section 413 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11372a">42 U.S.C. 11372a</external-xref>) is amended by adding at the end the following:</text>

<section id="H13D447F84EF04ADBA223A4B932A6E212"><enum>304.</enum><header>Improving mold and health standards</header> 
<subsection id="H1B1F6475246F4382A758B3A78C59CAB9"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H327DF097EBFF461697AA9137BB27B6F6"><enum>(1)</enum><header>Indoor residential mold</header><text display-inline="yes-display-inline">The term <term>indoor residential mold</term> means any form of multicellular fungi in indoor environments, including cladosporium, penicillium, alternaria, aspergillus, fusarium, trichoderma, memnoniella, mucor, stachybotrys chartarum, streptomyces, and epicoccumoften found in water-damaged indoor environments and building materials.</text></paragraph> 
<paragraph id="H012F011121904369AE86A6B3AB68763E" display-inline="no-display-inline"><enum>(2)</enum><header>Residential mold inspection</header><text display-inline="yes-display-inline">The term <term>residential mold inspection</term> means an inspection, by a certified or licensed mold inspector or other indoor environmental professional, including through the Real Estate Assessment Center, of real property that is designed to discover—</text> <subparagraph id="HAE81A56921554B228E08622A2CAA57E6"><enum>(A)</enum><text display-inline="yes-display-inline">indoor mold growth in residential properties;</text></subparagraph> 
<subparagraph id="HDB67227756754822B203E057650E60DB"><enum>(B)</enum><text display-inline="yes-display-inline">conditions that facilitate indoor residential mold growth; or</text></subparagraph> <subparagraph id="HD6B386AF67F9466A9E1AF497794E44A2"><enum>(C)</enum><text display-inline="yes-display-inline">indicia of conditions that are likely to facilitate indoor residential mold growth.</text></subparagraph></paragraph> 
<paragraph id="HF9507AC3DADF461CA53F7BDB3B0569C0"><enum>(3)</enum><header>Toxigenic mold</header><text display-inline="yes-display-inline">The term <term>toxigenic mold</term> means any indoor mold growth that may be capable of producing a toxin or toxic compound, including mycotoxins and mVOCs, that can cause pulmonary, respiratory, neurological, gastrointestinal, or dermatological illnesses, or other major adverse health impacts, as jointly determined by the Director of the National Institutes of Health, the Secretary of Housing and Urban Development, the Administrator of the Environmental Protection Agency, and the Director of the Centers for Disease Control and Prevention.</text></paragraph></subsection> <subsection id="HCDD4DD2C222C4540831CAC6E37E3DE85" display-inline="no-display-inline"><enum>(b)</enum><header>Interagency research on health impacts of indoor residential mold</header> <paragraph id="HBBEE5B3E164A463790635D24731D4414"><enum>(1)</enum><header>Research</header> <subparagraph id="H21844BD92A0C49CD9727786A061A823D"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">As soon as practicable after the date of enactment of this Act, the Director of the National Institute of Environmental Health Sciences at the National Institutes of Health, in conjunction with the Secretary of Housing and Urban Development, the Director of the Centers for Disease Control and Prevention, the Administrator of the Environmental Protection Agency, the Secretary of Energy, the Secretary of Health and Human Services, the President of the National Academy of Sciences, and the Chair of the board of directors of the National Institute of Building Sciences shall jointly conduct a comprehensive study of the health effects of indoor residential mold growth, using the most up-to-date scientific peer-reviewed medical literature.</text></subparagraph> 
<subparagraph id="HC96456BFDD7B4E74979ED6308F52FF0A"><enum>(B)</enum><header>Contents</header><text display-inline="yes-display-inline">The study conducted under subparagraph (A) shall ascertain, among other things—</text> <clause id="H281E89CFC830448CBA2FBDE5B96CF70A"><enum>(i)</enum><text display-inline="yes-display-inline">detailed information about harmful or toxigenic mold, as well as any toxin or toxic compound such mold can produce;</text></clause> 
<clause id="H47EDC598B12E4E78B9604F1782FDF5DA"><enum>(ii)</enum><text display-inline="yes-display-inline">the most accurate research-based methods of detecting harmful or toxigenic mold;</text></clause> <clause id="HF9202A9B2B194F2B96CA4C5AA2A4212B"><enum>(iii)</enum><text>potential dangers of prolonged or chronic exposure to indoor residential mold growth;</text></clause> 
<clause id="HFEAA7475DA4245DEAAF07A5B28C30E6A"><enum>(iv)</enum><text display-inline="yes-display-inline">the hazards involved with inadequate residential mold inspections and improper indoor residential mold remediation;</text></clause> <clause id="H33D36D629187447D933FF12D1FE39637"><enum>(v)</enum><text display-inline="yes-display-inline">the estimated current public health burden of new or exacerbated physical illness resulting from exposure to indoor residential mold, including its disproportionate impact on vulnerable communities, including children and seniors;</text></clause> 
<clause id="H0FC7155E309E4166BF1C6FDE2243A886"><enum>(vi)</enum><text display-inline="yes-display-inline">improved understanding of the different health symptomology that can result from exposure to mold in indoor residential environments;</text></clause> <clause id="H67E6A6E074CD49C5A732A2E9F50DC2FC"><enum>(vii)</enum><text display-inline="yes-display-inline">ongoing surveillance of the prevalence of idiopathic pulmonary hemorrhage (AIPH) in infants; and</text></clause> 
<clause id="HB0F12EFC44844D7C937EE401570435A9"><enum>(viii)</enum><text>longitudinal studies on the effects of indoor old exposure in early childhood on the development of asthma and other respiratory illnesses.</text></clause></subparagraph> <subparagraph id="H1D41657CFCF84AB4980226891F1B6C69"><enum>(C)</enum><header>Availability</header><text display-inline="yes-display-inline">Not later than the expiration of the 3-year period beginning on the date of the enactment of this Act, the results of the study conducted under subparagraph (A) shall be submitted to Congress and the President and made available to the general public.</text></subparagraph></paragraph></subsection> 
<subsection id="H014F717202864515B3D2AEAC7011D1C8" display-inline="no-display-inline"><enum>(c)</enum><header>Mapping</header> 
<paragraph id="H2040ADCE4E3A47A089DA72D5BED41D57"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary of Housing and Urban Development shall, using the previous two years of inspection data, establish a geographic information system mapping tool that identifies areas which are impacted by a known presence of indoor residential mold.</text></paragraph> <paragraph id="H5846070E00F448B0BE84CB43A36E694A"><enum>(2)</enum><header>Required inclusions</header><text display-inline="yes-display-inline">The Secretary shall include, as part of the mapping tool—</text> 
<subparagraph id="H32FDC5AD358048FBA9634FCA37C09A9E"><enum>(A)</enum><text>inspection documentation;</text></subparagraph> <subparagraph id="HBECA36161760427E807F13780897F9A3"><enum>(B)</enum><text>management and occupancy reviews;</text></subparagraph> 
<subparagraph id="H4FCF5BAB00E046DBAD03C351C88617F8"><enum>(C)</enum><text>transfers of budget authority for contracts under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>); and</text></subparagraph> <subparagraph id="HA66AC723CD844157A39213F6F1E6571F"><enum>(D)</enum><text>any additional information, as required by the Secretary.</text></subparagraph></paragraph> 
<paragraph id="HB359A5F3868E42C5A4B78F0BDBD48ECF"><enum>(3)</enum><header>Updates</header><text>The Secretary shall update the mapping tool with the latest inspection data not less often than once per year.</text></paragraph></subsection> <subsection id="H64FAF9B9422D4A31B008B5A07BF0AACD" display-inline="no-display-inline"><enum>(d)</enum><header>Public information and education campaign</header> <paragraph id="H1CD8929A96674894AD9E33250A9568A2"><enum>(1)</enum><header>Requirement</header><text display-inline="yes-display-inline">The Administrator of the Environmental Protection Agency, the Secretary of Housing and Urban Development, and the heads of any other relevant Federal agencies, as determined by such Administrator and Secretary, shall jointly develop and carry out a public information and education campaign regarding indoor air quality and related issues that provides information required under this section on a recurring and annual basis through public outreach. The campaign shall commence within 1 year after the date of the enactment of this Act.</text></paragraph> 
<paragraph id="H98D7171A12294695A4F3F76115E7D682"><enum>(2)</enum><header>Topics</header><text display-inline="yes-display-inline">The information and education campaign shall include information on the dangers and prevention of indoor residential moisture and mold, volatile organic compounds, dust, smoking, pollution, indoor origins of smoke, including cooking, and any other health risks, as determined by such Administrator and Secretary.</text></paragraph> <paragraph id="HA0FA9591F8334212B553DC001906B7E1"><enum>(3)</enum><header>Indoor residential mold information</header><text display-inline="yes-display-inline">The information and education campaign shall include, at minimum, the following information regarding indoor residential mold:</text> 
<subparagraph id="H81D3A94D76DE49C482A100B6E2999E39"><enum>(A)</enum><text display-inline="yes-display-inline">The conditions that facilitate indoor residential moisture and mold growth.</text></subparagraph> <subparagraph id="HB485ED839E934B3FBC33997351A132CF"><enum>(B)</enum><text display-inline="yes-display-inline">Guidelines for inspecting indoor residential mold growth.</text></subparagraph>

<paragraph id="H8C8B896744524D70BB45AF14D3458F28"><enum>(4)</enum><header>Modes of communication</header> 
<subparagraph id="HFC707C7A71F1431EA6F9FA459E7186F4"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The public information and education campaign shall provide education and information through modes of communication that are commonly utilized and able to be easily consumed by relevant individuals or organizations, which shall include communication through advertisements on public transit in all 50 States and in territories and possessions of the United States, and distribution of the pamphlet developed pursuant to paragraph (9) as required under such paragraph.</text></subparagraph> <subparagraph id="H345E40B3FBF243AEA7259F2D792810CE"><enum>(B)</enum><header>Availability</header><text display-inline="yes-display-inline">All education and information that is part of the information and education campaign shall be made publicly available on the websites of the Environmental Protection Agency, the Department of Housing and Urban Development, and any other applicable Federal agencies.</text></subparagraph></paragraph> 
<paragraph id="H19E35A1B2D114B0499E7EB6A5FEFA5E9">
            <enum>(5)</enum>
            <header>Targeted groups</header>
 <text display-inline="yes-display-inline">The public information and education campaign shall be designed to reach tenants, tenant organizations working directly with tenants in project-based rental assistance and other types of federally-assisted housing, resident groups, landlords, health professionals, the general public, homeowners, prospective homeowners, the real estate industry, the home construction and renovation industries, the health, property and casualty, and life insurance industries, technical and vocational schools and colleges, and other academic institutions.</text>
          </paragraph> 
<paragraph id="H82ECD0033D1446E9A93D3B36AD36F349"><enum>(6)</enum><header>Information Specific to Health Professions</header><text display-inline="yes-display-inline">The public information and education campaign shall include information about warning signs of mold and other indoor air exposure pollutants and shall include education for health professions on mold-related illness, including for health professions who work with vulnerable populations and children in school or daycare settings.</text></paragraph> <paragraph id="H41787F755C4E45B5BBF866833FA05506"><enum>(7)</enum><header>Coordination</header><text display-inline="yes-display-inline">In developing and carrying out the public information and education campaign, the heads of the agencies referred to in paragraph (1) may coordinate with the Ad Council.</text></paragraph> 
<paragraph id="H16EFD9F678984FEDA13537EAC4EE3907"><enum>(8)</enum><header>Language</header><text display-inline="yes-display-inline">All information provided under the public information and education campaign—</text> <subparagraph id="H7B03848200C8444882DA5F5EA64C8639"><enum>(A)</enum><text display-inline="yes-display-inline">shall be provided in at least two languages, as determined by the Secretary, based on the most common languages spoken in the neighborhood, tribe, municipality, State, or region, and may be provided in additional languages based on the most common languages spoken in the neighborhood, tribe, municipality, State, or region, as determined by the Secretary; and</text></subparagraph> 
<subparagraph id="H1C1B8EE0A3BE4D2F9E1E28BD98D2F676"><enum>(B)</enum><text display-inline="yes-display-inline">shall be provided in language that is at a sixth grade reading level and is easy to understand.</text></subparagraph></paragraph> <paragraph id="H0D140EBE41624D4CB23ADAFE304EC6C1"><enum>(9)</enum><header>Pamphlet</header> <subparagraph id="HD8128D2AE97243E1907B6BD3DA224F3E"><enum>(A)</enum><header>Requirement</header><text display-inline="yes-display-inline">The Secretary of Housing and Urban Development, in consultation with the Director of the National Institutes of Health, the Administrator of the Environmental Protection Agency, and the heads of any other agencies the Secretary considers appropriate, shall develop, publish, and revise, not less frequently than every 5 years, a pamphlet regarding indoor residential mold hazards.</text></subparagraph> 
<subparagraph id="H6C4F134D4BDF446F88477DF13B180DD4"><enum>(B)</enum><header>Content</header><text>The pamphlet required under this subsection shall—</text> <clause id="H4CB8313B4B8F4826957D4B8BCC31E3AA"><enum>(i)</enum><text display-inline="yes-display-inline">contain information regarding the health risks associated with exposure to indoor residential mold growth;</text></clause> 
<clause id="HF1137B1CC9A54706A9A4F33E4A628B21">
                <enum>(ii)</enum>
 <text display-inline="yes-display-inline">provide information on the hazards of indoor residential mold growth in federally-assisted and federally-owned housing;</text>
              </clause> 
<clause id="HDEBD93AA8C55458FB7453AC56384F4BC"><enum>(iii)</enum><text display-inline="yes-display-inline">describe the risks of indoor residential mold exposure for persons residing in a dwelling with toxigenic mold;</text></clause> <clause id="HE7E3C05AB6A24D4CAF58391C40F8D9AB"><enum>(iv)</enum><text display-inline="yes-display-inline">provide information on approved methods for evaluating and reducing indoor residential mold growth and their effectiveness in identifying, reducing, eliminating, or preventing indoor residential mold growth;</text></clause> 
<clause id="H4885C7E30E714166950476A856DC8532"><enum>(v)</enum><text display-inline="yes-display-inline">provide advice on how to obtain a list of persons certified to inspect or remediate indoor residential mold growth in the area in which the pamphlet is to be used;</text></clause> <clause id="HF7F30F5AF2684245BE8A4FCADAB46364"><enum>(vi)</enum><text display-inline="yes-display-inline">include a statement that a risk assessment or inspection for indoor residential mold growth is recommended prior to the purchase, lease, or renovation of target housing;</text></clause> 
<clause id="HA8BE2D04F0754A60A7B0CE333FFDAEBB"><enum>(vii)</enum><text display-inline="yes-display-inline">include a statement that certain State and local laws impose additional requirements related to indoor residential mold growth in housing and provide a listing of Federal, State, and local agencies in each State, including address, telephone number, and electronic mail address, if available, that can provide information about applicable laws and available governmental and private assistance and financing;</text></clause> <clause id="HED7E1E490F1E42C5A128570D97B63F93"><enum>(viii)</enum><text display-inline="yes-display-inline">provide information considered by the Administrator of the Environmental Protection Agency to be appropriate or necessary to promote awareness of the hazards posed by indoor residential mold;</text></clause> 
<clause id="H47B629E71DC74B8F9847D97944D3DE3F"><enum>(ix)</enum><text>include information on indoor air quality safety generally, including best practices when cooking, taking a shower or bath, and smoking cessation;</text></clause> <clause id="H8CE41A7405B04BA59F61828A08AD0870"><enum>(x)</enum><text display-inline="yes-display-inline">be publicly available on the websites of the Department of Housing and Urban Development, the Environmental Protection Agency, and other applicable Federal agencies; and</text></clause> 
<clause id="HB077D6D0CDA445C3A49649BCA991AF20"><enum>(xi)</enum><text display-inline="yes-display-inline">include any other information considered by the Administrator of the Environmental Protection Agency to be appropriate or necessary.</text></clause></subparagraph></paragraph> <paragraph id="HE3B896223F434B089CD05DCAA4F4D991"><enum>(10)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated such sums as may be necessary to carry out this subsection.</text></paragraph></subsection> 
<subsection id="H678321A31EDE43B3B5050E73D4259F44" display-inline="no-display-inline"><enum>(e)</enum><header>GAO study on health and safety concerns in federally-Assisted housing</header><text>Not later than the expiration of the 3-year period beginning on the date of the enactment of this Act, the Comptroller General of the United States shall submit a report to the Congress analyzing and assessing the communication, as applicable, between public housing agencies, landlords, and tenants over resolving problems with the health, safety, or other issues of dwelling units that are federally subsidized and inspected through subpart G of part 5 of title 24, Code of Federal Regulations, landlord responsiveness regarding such issues, opportunities for improvement in such communications, and how tenants understand their rights and how they are responded to when issues arise, including protocols for responding to tenant complaints and tenant understanding of such processes. The report shall include recommendations for how to improve such communications and the physical quality of the housing stock for which such assistance is provided.</text></subsection></section> <section id="HCF162BFEABFF42C6B58E74477F49EE73"><enum>305.</enum><header>Improving Protection from Lead Hazards</header> <subsection id="H38548F1C62ED4E03BDBE94601FFD2340"><enum>(a)</enum><header>Definitions</header><text>In this section—</text> 
<paragraph id="H1700307430A9426291FF5217AEBB9605"><enum>(1)</enum><text>the term <term>covered housing</term> means a dwelling unit receiving project-based rental assistance or tenant-based rental assistance under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>); and</text></paragraph> <paragraph id="H63F26B954C624B758ABDC71C3C22B84B"><enum>(2)</enum><text>the term <term>Department</term> means the Department of Housing and Urban Development.</text></paragraph></subsection> 
<subsection id="HC6375521482A480E8C90A514DAB9BB2E"><enum>(b)</enum><header>Annual risk assessment and report</header><text>Not later than 1 year after the date of enactment of this Act, and every year thereafter, the Deputy Assistant Secretary for the Office of Multifamily Housing Programs of the Department, in collaboration with the Office of Lead Hazard Control and Healthy Homes of the Department, shall—</text> <paragraph id="H67E10C186C0C4FE6B9EFDA4B839004E1"><enum>(1)</enum><text>conduct a risk assessment of covered housing to identify properties with the greatest risk of exposing children under the age of 6 years old to lead hazards, including lead-based paint and lead service lines;</text></paragraph> 
<paragraph id="H6745A6F9463B478D8EBECE330894585E"><enum>(2)</enum><text>develop an action plan relating to remediation, control, and safeguards to address lead hazards, including lead-based paint and lead-service lines, in covered housing identified in the risk assessment conducted under paragraph (1), with priority given to those properties with children under the age of 6 years old; and</text></paragraph> <paragraph id="H2700FAFBF91B426888ECB973EB6783FA"><enum>(3)</enum><text>submit to Congress a report on properties with covered housing that have lead-based paint or lead service lines, including the number of children under the age of 6 years old living at these properties.</text></paragraph></subsection> 
<subsection id="HF3933E83A3764A46A0A06F9F51DBB29D"><enum>(c)</enum><header>Uniform physical condition standard inspections</header><text>In conducting uniform physical condition inspections in accordance with part 5 of title 24, Code of Federal Regulations, or any successor regulation, the Secretary shall include lead-based paint and lead service lines in the graded scoring as an exigent health and safety deficiency to ensure that—</text> <paragraph id="H8B910D4C800F4AEDB5D4821900D0250C"><enum>(1)</enum><text>lead-based paint and lead service lines are tracked at each applicable property; and</text></paragraph> 
<paragraph id="H03577BB312CA4DA28FE14CA445D26781"><enum>(2)</enum><text>the owners of those properties are held accountable for remediating deficiencies.</text></paragraph></subsection></section> <section id="HFD967959819148FBBFEEAF81881CF991"><enum>306.</enum><header>Improving housing for the elderly and disabled</header><text display-inline="no-display-inline">The Comptroller General of the United States shall, not later than 1 year after the date of the enactment of this section, conduct a study that identifies options to remove barriers and improve housing for persons who are elderly or disabled, including any potential impacts of providing capital advances for—</text> 
<paragraph id="HC37F2E8807004F03B434520710917407"><enum>(1)</enum><text display-inline="yes-display-inline">the program for supportive housing for the elderly under section 202 of the Housing Act of 1959; and</text></paragraph> <paragraph id="H25582BE8284241F692E409BAA5C1D2CE"><enum>(2)</enum><text display-inline="yes-display-inline">the program for supportive housing for persons with disabilities under section 811 of the Cranston-Gonzalez National Affordable Housing Act.</text></paragraph></section></title> 
<title id="H1E190258975A456A9B33B71548F4071F"><enum>IV</enum><header>Good Governance</header> 
<section id="HB2833250E1614FF7858837012537B2CF"><enum>401.</enum><header>Requiring annual testimony and oversight from housing regulators</header> 
<subsection id="H325F5D01113B465D86B72FDA487A4535"><enum>(a)</enum><header>Testimony by Secretary</header><text>Section 7 of the Department of Housing and Urban Development Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3535">42 U.S.C. 3535</external-xref>) is amended by adding at the end the following new subsection:</text> <quoted-block style="OLC" id="HBBBD841291A24BB68AF576DC27E401C2" display-inline="no-display-inline"> <subsection id="H4F2F18C8ED194EBBBA7020144042E7B8"><enum>(u)</enum><header>Annual testimony</header><text display-inline="yes-display-inline">The Secretary shall appear before the Committee on Financial Services of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate at an annual hearing and present testimony regarding the operations of the Department during the preceding year, including regarding the following topics:</text> 
<paragraph id="HD986835F90DC482A86D5BE6E31A3ACD3"><enum>(1)</enum><text>The physical condition of all public housing and other housing assisted by the Department.</text></paragraph> <paragraph id="H13407CD01F064E8DAC8E874162645CB9"><enum>(2)</enum><text display-inline="yes-display-inline">The financial health of the mortgage insurance funds of the FHA.</text></paragraph> 
<paragraph id="HE45A5A8F26AB4717AF9FC8EB9749382B"><enum>(3)</enum><text>Oversight by the Department of grantees and sub-grantees engaging in waste, fraud, and abuse.</text></paragraph> <paragraph id="HBFFC5B70A8294238B3FD865B251E289B"><enum>(4)</enum><text>Ongoing activities of the Department, as appropriate.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H50D6A56D60094909AF47E0EC3AF36AF0"><enum>(b)</enum><header>Testimony by Inspector General</header><text>Not later than October 1 of each year, the Inspector General of the Department of Housing and Urban Development shall appear before the Committee on Financial Services of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate and present testimony on the Office of Inspector General’s—</text> <paragraph id="H7BD22D9A545D434988D879680DC715CE"><enum>(1)</enum><text>efforts to detect and prevent fraud, waste, and abuse;</text></paragraph> 
<paragraph id="H22E2614F09EF4B6B970B1B80DC8C0123"><enum>(2)</enum><text>ability to conduct and supervise audits, investigations, and reviews;</text></paragraph> <paragraph id="H3AC37694262C4F5DB35DB2A9027EE351"><enum>(3)</enum><text>actions to identify opportunities for the programs of the Department of Housing and Urban Development to progress and succeed; and</text></paragraph> 
<paragraph id="H0620B5AB365D4BEC9D8F9B7BEAAD6B73"><enum>(4)</enum><text>ongoing activities regarding any such additional work, as appropriate.</text></paragraph></subsection></section> <section commented="no" display-inline="no-display-inline" id="H26A11818E04D4720B5FDF0F7CFE56631"><enum>402.</enum><header>Requiring annual testimony and oversight for government guaranteed or insured mortgage programs</header><text display-inline="no-display-inline">On an annual basis, the following individuals shall testify before the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives on mortgage loans guaranteed or insured by the Federal Government:</text>

<paragraph id="H753A631AF4934A9F9AF5E1093E5CFC60"><enum>(1)</enum><text display-inline="yes-display-inline">the New York City Housing Authority (in this section referred to as the <quote>Authority</quote>) is the largest housing authority in the United States, providing housing for over 520,000 residents in over 177,000 apartments in the City of New York (in this section referred to as the <quote>City</quote>);</text></paragraph> <paragraph id="HEDC34647914C474EAF84B8DB88320AD5"><enum>(2)</enum><text display-inline="yes-display-inline">the Authority is a public housing agency that receives Federal financial assistance from the Department of Housing and Urban Development (in this section referred to as the <quote>Department</quote>) to administer its public housing program;</text></paragraph> 
<paragraph id="HA6B7A36ED3F148ED838D7994B49724DC"><enum>(3)</enum><text>the Authority is required to, among other things, provide decent, safe, and sanitary housing for the public housing residents of the City and comply with Federal law protecting children from the hazards of lead poisoning;</text></paragraph> <paragraph id="H9EB6CAF57CBF4CD1AB9E482025BC0685"><enum>(4)</enum><text display-inline="yes-display-inline">on June 11, 2018, the United States filed a complaint in the United States District Court for the Southern District of New York (in this section referred to as the <quote>Complaint</quote>); which set forth the findings of the United States investigation, alleging, among other things, that the Authority had—</text> 
<subparagraph id="H1A59F299B8E749679D4305F56DD62ABE"><enum>(A)</enum><text>routinely failed to comply with lead-based paint safety regulations;</text></subparagraph> <subparagraph id="HB0D7AFBB277D4298866C41A050A7DE34"><enum>(B)</enum><text>failed to provide decent, safe, and sanitary housing, including with respect to the provision of heat and elevators and the control and treatment of mold and pests; and</text></subparagraph> 
<subparagraph id="HB67CFD0B9DB84B6B85A5EB7C801BA7DE"><enum>(C)</enum><text>repeatedly misled the Department through false statements and deceptive practices;</text></subparagraph></paragraph> <paragraph id="H93AEA96F02FB42929EFF8B5B68251AEF"><enum>(5)</enum><text>in a Consent Decree executed June 11, 2018, the Authority made admissions regarding, among other things, deficiencies in physical conditions with respect to lead, mold, heating, elevators and pests and made untrue statements to the Department regarding the conditions of the Authority’s properties and practices with regard to Public Housing Assessment System inspections;</text></paragraph> 
<paragraph id="H8DCD5EB6512E47AC9725508DC47CBBD8"><enum>(6)</enum><text display-inline="yes-display-inline">based on the Authority’s misconduct as detailed in the Complaint, on January 31, 2019, the Secretary of Housing and Urban Development (in this section referred to as the <quote>Secretary</quote>) declared that the Authority is in substantial default within the meaning of section 6(j)(3)(A) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437d">42 U.S.C. 1437d(j)(3)(A)</external-xref>);</text></paragraph> <paragraph id="HA231B73198AB439596908E09A370F2D7"><enum>(7)</enum><text>the Department did not take possession of the Authority or appoint a receiver, but instead entered into a voluntary agreement between the Authority, the Department, and the City on January 31, 2019, under which the Authority agreed to remedy noted deficiencies subject to the oversight of a Monitor appointed by the City;</text></paragraph> 
<paragraph id="HCBEE2A170E4C4F7DB23FC3957A4B885A"><enum>(8)</enum><text>as of the date of the enactment of this Act, the Authority has still fully not complied with the agreement, including the remedying of deficiencies or compliance with its obligations under Federal law;</text></paragraph> <paragraph id="H7802AF4AC7754B83BF9355E602CEB1DF"><enum>(9)</enum><text>the Department and the United States Attorney’s Office for the Southern District of New York have sought to extend the term of a Monitor over the Authority for an additional five years beginning in 2024;</text></paragraph> 
<paragraph id="H24A3A5E660C741CDB1F3B866F52C2D05"><enum>(10)</enum><text>the residents of housing provided by the Authority should not be required to wait five additional years for the Authority to provide decent, safe, and sanitary housing conditions, as is the Authority’s most basic and necessary function under the law; and</text></paragraph> <paragraph id="HE2F78E4111BC45428B54BB61801F747F"><enum>(11)</enum><text>the Congress believes that it must provide additional oversight over the Authority, the Department, the City, and the Monitor in order to compel the Authority to fix the appalling conditions and other issues that lead to a declaration of substantial default under section 6(j)(3)(A) of the United States Housing Act of 1937.</text></paragraph></subsection> 
<subsection id="H4F84F01646E34CA2BF7FEE4B483EACCD"><enum>(b)</enum><header>Investigation and report to Congress</header> 
<paragraph id="HDA2D730F21AF42C2B7DD0F101BAC1CDA"><enum>(1)</enum><header>Investigation</header><text display-inline="yes-display-inline">The Inspector General of the Department of Housing and Urban Development shall conduct an investigation of the Authority, which shall include at a minimum—</text> <subparagraph id="H93AE31414B484D78B55A8C43D260CC5A"><enum>(A)</enum><text>determining the status of the New York City Housing Authority’s compliance with the agreement entered into between the Authority, the Department, and the City on January 31, 2019, including specific areas of deficiency and progress towards compliance;</text></subparagraph> 
<subparagraph id="HD5A63E5822F64367953B2F50A3692C80"><enum>(B)</enum><text>conducting a review of actions taken by the Monitor over the Authority pursuant to such Agreement, including any gaps in oversight by the Monitor;</text></subparagraph> <subparagraph id="H4B79D37D8FD14A6E84DA48EDA507DF02"><enum>(C)</enum><text>conducting a survey of the physical conditions of housing provided by the Authority for the City’s residents;</text></subparagraph> 
<subparagraph id="H8AE656D1A08147DAAC7747D5718F3DF3"><enum>(D)</enum><text>conducting an examination of any waste, fraud, abuse and violations of Federal law committed by employees or contractors of the Authority; and</text></subparagraph> <subparagraph id="H6F3496715C0C459F9F586063167957FB"><enum>(E)</enum><text>identifying other priority issues and areas, as deemed necessary and appropriate by the Inspector General.</text></subparagraph></paragraph> 
<paragraph id="H9132F78F349B46EF8ABD137BF5706AAB"><enum>(2)</enum><header>Report</header><text>Not later than the expiration of the 180-day period beginning on the date of the enactment of this Act, the Inspector General shall provide to the Committee on Financial Services of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate a report setting forth the findings of its investigation, a summary of actions the Department may take to compel the Authority to remedy deficiencies, and any other recommendations of the Inspector General.</text></paragraph></subsection></section> <section id="H51510E239AD84391A68049E8DFC62081"><enum>405.</enum><header>FHA reporting requirements on safety and soundness</header> <subsection commented="no" display-inline="no-display-inline" id="H5A9D7E4BCA824495998E6580901D2BAB"><enum>(a)</enum><header>Monthly reporting on Mutual Mortgage Insurance Fund capital ratio</header><text display-inline="yes-display-inline">Section 202(a) of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1708">12 U.S.C. 1708(a)</external-xref>) is amended by adding at the end the following:</text>

<paragraph commented="no" display-inline="no-display-inline" id="H75E2BE2603FA4E1F8C502DFAF091D458"><enum>(8)</enum><header>Other required reporting</header><text>The Secretary shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HC42DD4048ADF4D04B48995921BB16710"><enum>(A)</enum><text display-inline="yes-display-inline">submit to Congress monthly reports on the capital ratio required under section 205(f)(2); and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HB8CFE4AB5C1E4EF48856D60954AB3157"><enum>(B)</enum><text>notify Congress as soon as practicable after the Fund falls below the capital ratio required under section 205(f)(2).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection commented="no" display-inline="no-display-inline" id="H17C795011D714B46A0C5FB7E820F14B8"><enum>(b)</enum><header>First-Time homebuyers</header> <paragraph commented="no" display-inline="no-display-inline" id="H02C82DF72DE54D7CA73F8BC15DD8283A"><enum>(1)</enum><header>Definitions</header><text>In this section—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HFB167C6B2803485EA283CC01CE0EB5FD"><enum>(A)</enum><text display-inline="yes-display-inline">the terms <term>consumer report</term> has the meaning given the term in section 603 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681a">15 U.S.C. 1681a</external-xref>); and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H328491A9199F48D58A46E219D1CD195B"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>Federally backed mortgage loan</term> has the meaning given the term in section 4022 of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9056">15 U.S.C. 9056</external-xref>).</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HD98D9F1A50694A7AAF2B417811F9D9FB"><enum>(2)</enum><header>Definition of first-time homebuyer</header><text>For purposes of qualifying for a Federally backed mortgage loan for which a consumer report is furnished to a creditor by a consumer reporting agency described in section 603(p) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681a">15 U.S.C. 1681a(p)</external-xref>), a first-time homebuyer shall be defined as a borrower whose consumer report does not indicate that the borrower has or had a loan with a consumer purpose that is secured by a 1- to 4-unit residential real property.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="HF8A09D0BA90740FDA6B6A6AD070FCE49"><enum>(c)</enum><header>GAO study on sustainable homeownership</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Comptroller General of the United States shall conduct a study and submit to Congress a report on—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H63584F02829D4CD091B1B4C99222D9D9"><enum>(1)</enum><text display-inline="yes-display-inline">the value for the Federal Housing Administration of defining what is sustainable homeownership in way that considers borrower default, refinancing to a non-insured mortgage product, paying off a mortgage loan and transitioning back to renting, and other factors that demonstrate whether insurance provided under title II of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1707">12 U.S.C. 1707 et seq.</external-xref>) has successfully served a borrower, including for first-time homebuyers as defined in subsection (b)(2); and</text></paragraph> <paragraph id="HCD2E1822886A4887B6C8230808A1C0F9" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>the feasibility of the Federal Housing Administration developing a scorecard using the metrics described in paragraph (1) to measure borrower performance and reporting the scorecard data to Congress.</text></paragraph></subsection></section> 
<section id="HD0B92BCD603B4028ACE14DC70095FF41"><enum>406.</enum><header>Combatting squatting</header> 
<subsection id="H1B7D1ACB7D8344E8973CFC7816BEB6E6"><enum>(a)</enum><header>Congressional findings</header><text>The Congress finds that—</text> <paragraph id="H5084336530E44A368E0628506ADF212F"><enum>(1)</enum><text>unlawfully entering a property without the permission of the property owner and residing in that property for consecutive days without the permission of the property owner and without the payment of rent or a rental contract agreed to by the property owner can be defined as <quote>squatting</quote> and should not confer any special status as a tenant or lawful occupant of the property;</text></paragraph> 
<paragraph id="HBBA8A19980A54A09AF96C8BF3A6A4B06"><enum>(2)</enum><text display-inline="yes-display-inline">local law enforcement should take actions to expeditiously remove from a property any persons or persons engaging in squatting and should prosecute such actions as prescribed by local law;</text></paragraph> <paragraph id="H51CD60108A0F441FAD11F70A774A647B"><enum>(3)</enum><text>Federal Government benefits, including loans, loan guarantees, subsidies, and tax credits, should not be used to reinforce, condone, or otherwise incentivize squatting; and</text></paragraph> 
<paragraph id="HB4F974F40EA14AAA9EB577EF14B13736"><enum>(4)</enum><text>real estate collateral securing a government or government-sponsored enterprise loan, or subject to a loan guarantee, mortgage insurance or other Federal mortgage support program must be protected from persons engaging in squatting as it creates undue risks for the value of such property.</text></paragraph></subsection> <subsection id="H3D0A91FDCD904FB3A7AFDF5E1B4598B2"><enum>(b)</enum><header>Prohibition on CDBG funding</header><text>Section 104 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5304">42 U.S.C. 5304</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H8FEB783DEB9B455F9DD68E4D79D9EEA2" display-inline="no-display-inline"> 
<subsection id="HAF05F4F878C54226B2A05721DE53C243"><enum>(n)</enum><header>Withholding of funds for jurisdictions that permit squatting</header> 
<paragraph id="H6A463126748148DE86FBD887DB73F8C0"><enum>(1)</enum><header>Prohibition</header><text display-inline="yes-display-inline">The Secretary shall, by regulation—</text> <subparagraph id="HF445010A462843FAA97289FE9D5C5E45"><enum>(A)</enum><text>prohibit the allocation and provision of funds under this title for any unit of general local government that permits squatting or confers special status for rights of tenancy for a person or persons engaging in the practice of squatting; and</text></subparagraph> 
<subparagraph id="H7C52FE9237A74D0E8BFD1F0208A76D88"><enum>(B)</enum><text display-inline="yes-display-inline">provide for—</text> <clause id="H89F73F2BCB0445C499210CD8E472AEEA"><enum>(i)</enum><text>units of general local government to take corrective actions to remedy the applicability of the prohibition under subparagraph (A) to such unit of general local government; and</text></clause> 
<clause id="HC491A1ADF78948A6B600ABC7B57A1E1F"><enum>(ii)</enum><text>certification by the Secretary upon a determination that such actions taken by a unit of general local government are sufficient for the unit of general local government to receive funds under this title.</text></clause></subparagraph></paragraph> <paragraph id="H4BBF80F7C90545EFA90A3D0BF1E28974"><enum>(2)</enum><header>Public notice</header><text>The Secretary shall make publicly available for each fiscal year a list of all units of general local government that are prohibited by paragraph (1) from receiving funds under this title and the justification for inclusion in the list of each such unit of general local government.</text></paragraph> 
<paragraph id="HAEFEC7C26E42485BB63042CBD20E1689"><enum>(3)</enum><header>Squatting</header><text>For purposes of this subsection, the term <quote>squatting</quote> means the practice of entering a property without the permission of the property owner and residing in that property for 14 or more consecutive days without the permission of the property owner and without the payment of rent or a rental contract agreed to by the property owner.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H2D3984E00F9944E0A3B0AF2DC830FEF3"><enum>(c)</enum><header>Prohibition on Federal mortgage support</header> <paragraph id="H0F4355E01DB5483281E7C132004262FE"><enum>(1)</enum><header>Prohibition</header><text display-inline="yes-display-inline">No Federal support may be provided for any loan that is secured by a first or subordinate lien on residential real property (including individual units of condominiums and cooperatives) and designed principally for the occupancy of from 1- to 4-families if the property securing such loan is located in a unit of general local government that is, at such time, prohibited from receiving funds under title I of the Housing and Community Development Act of 1974 by section 104(n)(1)(A) of such Act.</text></paragraph> 
<paragraph id="H723E8B821D414CD08B3E44F671C075CB"><enum>(2)</enum><header>Regulations</header><text display-inline="yes-display-inline">The heads of the covered agencies shall jointly develop, by regulations issued not later than 90 days after the date of the enactment of this Act, guidelines for such covered agencies to carry out this subsection.</text></paragraph> <paragraph id="H174462EB615546FC98F7713121AA1066"><enum>(3)</enum><header>Definitions</header><text>For purposes of this subsection, the following definitions shall apply:</text> 
<subparagraph id="H8F20D3D7F06647858DAF3AD7C45BA338"><enum>(A)</enum><header>Covered agency</header><text display-inline="yes-display-inline">The term <quote>covered agency</quote> means—</text> <clause id="HD6879A6E7CCB46AF90098B1B9655BC6D"><enum>(i)</enum><text>the Department of Housing and Urban Development;</text></clause> 
<clause id="HD0B287B5B7904ECC9AE935D82F29D591"><enum>(ii)</enum><text>the Federal Housing Finance Agency;</text></clause> <clause id="H9C0A277E98C7495087CED0F10D81EC70"><enum>(iii)</enum><text>the Department of Veterans Affairs; and</text></clause> 
<clause id="HD73387DB9FCC4BD595C6184A55E89D99"><enum>(iv)</enum><text>the Department of Agriculture.</text></clause></subparagraph> <subparagraph id="HD70DBD06364645E184C118B5BAE2AC46"><enum>(B)</enum><header>Federal support</header><text>The term <quote>Federal support</quote> means, with respect to a loan—</text> 
<clause id="H924A40F326AB41308097BFCD7BD5BADA"><enum>(i)</enum><text>insurance of the loan by the Federal Housing Administration under title II of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1707">12 U.S.C. 1707 et seq.</external-xref>);</text></clause> <clause id="H3535E2B4757740A69AC7B725CB543365"><enum>(ii)</enum><text display-inline="yes-display-inline">insurance of the loan under section 255 of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1715z-20">12 U.S.C. 1715z–20</external-xref>);</text></clause> 
<clause id="H72639B05593A4DC39FC18451EADBAC79"><enum>(iii)</enum><text display-inline="yes-display-inline">guarantee of the loan under section 184 or 184A of the Housing and Community Development Act of 1992 (12 U.S.C. 1715z–13a, 1715z–13b);</text></clause> <clause id="H6002718BDC8D40FA935781A756577369"><enum>(iv)</enum><text>guarantee or insurance of the loan by the Department of Veterans Affairs;</text></clause> 
<clause id="H599E0630910A48C6B517A372432284AC"><enum>(v)</enum><text display-inline="yes-display-inline">guarantee or insurance of the loan by the Department of Agriculture;</text></clause> <clause id="H312E392864E448AEA8C737753C3065DA"><enum>(vi)</enum><text display-inline="yes-display-inline">making of the loan by the Department of Agriculture; or</text></clause> 
<clause id="H2C394873A5E14AFF96EDFAC90676974F"><enum>(vii)</enum><text display-inline="yes-display-inline">purchase or securitization of the loan by the Federal Home Loan Mortgage Corporation or the Federal National Mortgage Association.</text></clause></subparagraph> <subparagraph id="HA8A22FE724ED47C89EB7904FDF7AED96"><enum>(C)</enum><header>Squatting</header><text>The term <quote>squatting</quote> means the practice of entering a property without the permission of the property owner and residing in that property for 14 or more consecutive days without the permission of the property owner and without the payment of rent or a rental contract agreed to by the property owner.</text></subparagraph></paragraph></subsection></section> 
<section id="H02C0503FA8794FFC8443A859D3DECB05"><enum>407.</enum><header>Reallocation of voucher funding</header><text display-inline="no-display-inline">Section 8(o) of the United States Housing Act of 1937 is amended by adding at the end the following:</text> <quoted-block style="OLC" id="HE2DFFF1ED0724DCCA14F364E7A8D76DC" display-inline="no-display-inline"> <paragraph id="H6457AB57F8C64D94A3281CB019F3F326"><enum>(24)</enum><header>Reallocation of amounts</header><text display-inline="yes-display-inline">The Secretary shall, at the end of each fiscal year—</text> 
<subparagraph id="H3C15FEF55BAB43EDB793E2BFC779D297"><enum>(A)</enum><text>recapture from each public housing agency any amounts provided to such public housing agency for tenant-based assistance under paragraph (1)(A) that such public housing agency did not obligate during such fiscal year; and</text></subparagraph> <subparagraph id="H47E89FE265F1401DAB6F677104AD1371"><enum>(B)</enum><text display-inline="yes-display-inline">provide amounts recaptured under subparagrah (A) to public housing agencies that used all of the amounts provided to them for tenant-based assistance under paragraph (1)(A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></title> 
<title id="H208BF9D6C4E94BE7B30F5DB4C5301F2B"><enum>V</enum><header>Regulatory flexibility</header> 
<section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="HF3C98343B56041238C8E73846A073822"><enum>501.</enum><header display-inline="yes-display-inline">Authorization of Moving to Work Program</header> 
<subsection id="HBB3B9EA5947643E6835E2FAEF0F08DF9"><enum>(a)</enum><header>Program reforms</header><text display-inline="yes-display-inline">Section 204 of the Departments of Veterans Affairs and Housing and Urban Development, and Independent Agencies Appropriations Act, 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note) is amended—</text> <paragraph id="HE4008F67A69F48BCB89FA20BA8C5D0D1"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="traditional">demonstration</header-in-text></quote> and inserting <quote><header-in-text level="section" style="traditional">program</header-in-text></quote>;</text></paragraph>

<paragraph id="H5ABC30F249314913903A0CFD194A246A"><enum>(1)</enum><header>Economic independence</header><text display-inline="yes-display-inline">To develop measures to promote economic independence for families with children whose head of household is working, seeking work, or preparing for work, for able-bodied individuals, and for persons with disabilities who are able to work on a limited basis, to obtain employment and become economically independent, by participating in job training, educational programs, or other supportive services and programs that assist in meeting such goal.</text></paragraph> <paragraph id="H96B7E98571AE45AEBBAD46A3647F3498"><enum>(2)</enum><header>Flexibility and cost-effectiveness</header><text display-inline="yes-display-inline">To give public housing agencies and the Secretary of Housing and Urban Development the flexibility to design and implement various approaches for providing and administering housing assistance that reduce cost and achieve greater cost effectiveness in Federal expenditures.</text></paragraph> 
<paragraph id="HADC22FE6A8E14D3ABDB404E540A5FDC5"><enum>(3)</enum><header>Housing choice</header><text display-inline="yes-display-inline">To increase housing choices for low-income families.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="H6B3924135A264BD6902D3CBABC736A22"><enum>(3)</enum><text>in subsection (b)—</text>

<subclause id="HA3DB677E2B254F769AA6A320A17B9DE9"><enum>(II)</enum><text>by striking <quote>purpose of this demonstration</quote> and inserting <quote>purpose of the program under subsection (a)(1)</quote>;</text></subclause></clause> <clause id="H916D67C851A14AEB910E861CB94F0C7A"><enum>(iii)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking <quote>demonstration</quote> and inserting <quote>program under this section;</quote>;</text></clause> 
<clause id="HB3AE9EF490A94121AEE7E7144A34967D"><enum>(iv)</enum><text display-inline="yes-display-inline">in subparagraph (E), by striking <quote>demonstration program</quote> and inserting <quote>program under this section</quote>;</text></clause> <clause display-inline="no-display-inline" id="H8F939EF4EB1A4F04AAD23C0B8D00B28F"><enum>(v)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (A), (B), (C), (D), and (E) as subparagraphs (B), (C), (D), (G), and (H), respectively;</text></clause> 
<clause id="HD2085F26F0F041B2837B6D7C8B53FA48"><enum>(vi)</enum><text>by inserting before subparagraph (B), as so redesignated, the following:</text> <quoted-block display-inline="no-display-inline" id="H7D8D6A4EFE4E44018AE5DEF48F96C9AD" style="OLC"> <subparagraph id="HCA376F30E7AC4DEE968987D9891BD12C"><enum>(A)</enum><text display-inline="yes-display-inline">actions to be taken under the proposed program to achieve the purposes of the program under paragraphs (1), (2), and (3) of subsection (a);</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause> 
<clause id="HF72650A1985943A7B05F018B85266B1B"><enum>(vii)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (D), as so redesignated, the following:</text> <quoted-block display-inline="no-display-inline" id="HAA101035498041E99E7D975844EE600A" style="OLC"> <subparagraph id="HACD3E89A8FED4F898D5C5EACD5ED357D"><enum>(E)</enum><text display-inline="yes-display-inline">hardship exceptions consistent with the purposes under subsection (a) under which tenants may be temporarily exempted from compliance with the program operated by the agency in the event of extenuating circumstances preventing such compliance and a process that provides tenants with recourse to a speedy determination regarding such an exception and makes available the contents and results of such a determination available to the public and the board of directors or other governing body on request of the tenant concerned or the director or other head official of the agency;</text></subparagraph> 
<subparagraph id="HB1033EBFF7D748AC930B9DEEEF6779FF"><enum>(F)</enum><text display-inline="yes-display-inline">providing assisted families and participants in the program operated by the agency with an informal administrative hearing or grievance process, prior to any eviction or termination of assistance, which process shall make the content and determination of the hearing available to the public and the board of directors or other governing body on request of the tenant concerned or the director or other head official of the agency;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> <subparagraph id="H25ABDDA5F5ED4228B284BD8AA4ABC41C"><enum>(D)</enum><text>in paragraph (4), by striking <quote>demonstration</quote> and inserting <quote>proposed program</quote>;</text></subparagraph></paragraph> 
<paragraph id="H0FAC6E5769A9471E873BFAF994B17BEE"><enum>(5)</enum><text>in subsection (d)—</text> <subparagraph id="H3A0D440B764044B7A673ECAE5739748A"><enum>(A)</enum><text>by striking <quote>(d) <header-in-text level="subsection" style="OLC">Selection</header-in-text>.—In selecting among applications, the Secretary shall take into account the</quote> and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="H605D6D3AE51D48B7860079F79FB87D4C" style="OLC"> 
<subsection id="H6FA4ED7BA9CB4FB7944E831D9C4B58A6"><enum>(d)</enum><header>Applications for participation</header> 
<paragraph id="H86B9970AE5AB42568B3F2A04BE41223C"><enum>(1)</enum><header>Submission; standards for participation</header><text display-inline="yes-display-inline">The Secretary shall provide for public housing agencies to submit applications for participation in the program under this section and shall establish, and make public, standards and requirements for participation that further the purposes of this program set forth in subsection (a), which shall—</text> <subparagraph id="H2368FA7599EF480D8428CD619865D10A"><enum>(A)</enum><text>provide that all public housing agencies not designated as troubled pursuant to part 902 or subpart B of part 985, Code of Federal Regulations, at any time during the most recent 2 fiscal years are invited to submit applications for consideration;</text></subparagraph> 
<subparagraph id="H445D1B6A02244601A7493C2593691361"><enum>(B)</enum><text display-inline="yes-display-inline">provide that participation of a public housing agency, upon approval, shall be for a period not shorter than 10 years;</text></subparagraph> <subparagraph id="H7EB5441E9A684F3B92AED7A6133EBDEF"><enum>(C)</enum><text>include a common set of budget metrics for use under the program that allow for comparison of the performance of different public housing agencies under the program;</text></subparagraph> 
<subparagraph id="HB3BA046EA68D4BE0ABE9BA43C72F6D69"><enum>(D)</enum><text>require that each public housing agency include in its application—</text> <clause id="HF4CC73B3E5014E119949C466809A639F"><enum>(i)</enum><text>a list of innovative proposals to be carried out under the program that are designed to reduce the cost of, and increase the cost-efficiency of, housing provided in connection with the program and metrics to assess the progress of the agency toward such goals; and</text></clause> 
<clause id="H4AA4CAB1C37D4F84981F3CA02E1FDE7C"><enum>(ii)</enum><text>a list of innovative manners in which the public housing agency will use the authorities under the program to assist families, goals regarding such activities to accomplish on an annual basis, and metrics to assess the progress of the agency toward such goals; and</text></clause></subparagraph> <subparagraph id="H2A19437D832948C4A6E64D3BEC61C1E6"><enum>(E)</enum><text>include a plan for using, to the greatest extent feasible, electronic data-matching for income verification services.</text></subparagraph></paragraph> 
<paragraph id="HA5A21D73FA7A4AE3BBF921CDBBAC7DB6"><enum>(2)</enum><header>Determination and notification</header> 
<subparagraph id="H5A15F6D796234C88AA578968E11083B4"><enum>(A)</enum><header>Review and determination</header><text display-inline="yes-display-inline">Upon receipt of an application for participation in the program under this section, the Secretary shall provide for review such application by a selection panel comprised of Federal officials and employees and established by the Secretary for such purpose. Based on such review, such selection panel shall make a determination of whether to approve such agency for participation in the program under this section, based on the criteria under paragraph (4).</text></subparagraph> <subparagraph id="H965CABFAFA6747549BB922CA26D48179"><enum>(B)</enum><header>Notification</header><text>Upon making a determination pursuant to subparagraph (A), the selection panel shall notify the public housing agency, the Secretary, and the governments for any counties and municipalities in which the jurisdiction of the public housing agency is located of such determination. In the case of disapproval of an application, such notice shall include a statement specifying the reasons for such disapproval.</text></subparagraph></paragraph> 
<paragraph id="HAA83616730B146AEBC5785B550821F22"><enum>(3)</enum><header>Transition</header> 
<subparagraph id="H56F90A800F8549A4A9D0795EBF0C5E84"><enum>(A)</enum><header>Numerical limitation</header> 
<clause id="HEBA0833A1C554E04AF7945F60420D103"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall review and process such applications as to enable the transition of not less than 25 public housing agencies per year to the program under this section (subject to approvable applications), until such time as there are not 25 public housing agencies whose applications merit approval.</text></clause> <clause id="H847F32F23E8944CAA9E1850F615D5989"><enum>(ii)</enum><header>Reserved spots for small and rural PHAs</header><text>Of the applications of public housing agencies approved in each year pursuant to clause (i), not less than 10 shall be applications of public housing agencies that administer, in the aggregate, fewer than 6,000 vouchers for rental assistance under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>) and public housing dwelling units, except that if for any year the Secretary receives fewer than 10 applications by public housing agencies described in this clause that merit approval, the requirement under this clause shall apply for such year only to the extent of the number of such approvable applications received.</text></clause> 
<clause id="H9358521DEEEB4ADA906594348F1C98FB"><enum>(iii)</enum><header>Treatment of new MTW agencies</header><text display-inline="yes-display-inline">Any agency that is newly transitioned under this subparagraph to participation in the program as in effect pursuant to the amendments made by this Act shall count toward fulfillment of the numerical limitation in clause (i), notwithstanding the authority under section 239 of the Transportation, Housing and Urban Development, and Related Agencies Appropriations Act, 2016 (division L of <external-xref legal-doc="public-law" parsable-cite="pl/114/113">Public Law 114–113</external-xref>) or any other provision of law other than this section authorizing participation of new agencies.</text></clause></subparagraph> <subparagraph id="H38475DB647454975A4305ACBE366B384"><enum>(B)</enum><header>Contract revisions</header><text>The Secretary shall, from time to time and in consultation with public housing agencies, amend contracts for participation by agencies in the program under this section as may be necessary, based on experiences of agencies that have participated in the program, to correct mistakes and better achieve the goals of this program set forth in subsection (a).</text></subparagraph> 
<subparagraph id="HF1AB2350F55F42FE819D74530F30CC24"><enum>(C)</enum><header>Renewal of certification</header> 
<clause id="H3022831DA99F4E779A1EAB05C4D5C492"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall provide that upon expiration of a contract for participation by a public housing agency in the program under this section, to continue participating in the program the agency shall be required to recertify with the Secretary for such renewed participation. The standards and requirements applicable to applications for initial participation in the program shall also apply to applications for renewed participation in the program.</text></clause> <clause id="HC8A2E0B6543E4BA88DCC03E12D5D06D0"><enum>(ii)</enum><header>Treatment of numerical limitation</header><text display-inline="yes-display-inline">An agency approved for continued participation in the program pursuant to recertification under this subparagraph shall not count toward fulfillment of the numerical limitation in subparagraph (A)(i).</text></clause></subparagraph></paragraph> 
<paragraph id="HE3C3B65342E240DDAAE434BDCA9C3AAB"><enum>(4)</enum><header>Criteria</header><text>The Secretary shall establish criteria for approval of applications of public housing agencies for participation in the program under this section, which shall provide for approval of applications that are reasonably designed to carry out the purposes of the program under subsection (a). Such criteria shall take into consideration the capacity and</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph id="HA1F7772116B342FB81FB2CEF1E63EF3A"><enum>(B)</enum><text>by striking <quote>each</quote> and inserting <quote>the</quote>;</text></subparagraph> 
<subparagraph id="HE3E03E016B384FC8AD2037D0B94A5185"><enum>(C)</enum><text>by striking <quote>a program under the demonstration</quote> and inserting <quote>the proposed program in the application</quote>; and</text></subparagraph> <subparagraph id="H1DA45AFC47844A4EB57D7DC9423BD680"><enum>(D)</enum><text>by striking <quote>an agency</quote> and inserting <quote>the agency</quote>;</text></subparagraph></paragraph> 
<paragraph id="HB6528427BDC14CA485190A32FBB0F357"><enum>(6)</enum><text>in subsection (e)—</text> <subparagraph id="H99A76740A3B44061A01310F8F9774A52"><enum>(A)</enum><text>in paragraph (1), by striking <quote>this demonstration</quote> and inserting <quote>the program under this section</quote>; and</text></subparagraph> 
<subparagraph id="H54306C3D0A934F4BA209513FC68F8909"><enum>(B)</enum><text>in paragraph (2), by striking <quote>demonstration</quote> and inserting <quote>program under this section</quote>;</text></subparagraph></paragraph> <paragraph id="H08166C6024D14133A3CF974176280054"><enum>(7)</enum><text>in subsection (f), by striking <quote>section 9, or pursuant to section 14 by a public housing agency participating in the demonstration under this part</quote> and inserting <quote>of the United States Housing Act of 1937, or provided from the Operating Fund under section 9(e) or from the Capital Fund under section 9(d) of such Act, by a public housing agency participating in the program under this section</quote>;</text></paragraph> 
<paragraph id="H3650ABC9EC45439792BEACCA12A5EABA"><enum>(8)</enum><text>in subsection (g)—</text> <subparagraph id="H9D79A72814B44AA1B230EA35B6A0D8E0"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>, including performance in achieving each of the purposes of the program specified in subsection (a)</quote>;</text></subparagraph> 
<subparagraph id="HC0334889E2524B2B83C3731C111158C4"><enum>(B)</enum><text>in paragraph (2)—</text> <clause id="HCCC42AF317C74C7082FF3DB51B7725B6"><enum>(i)</enum><text>in the first sentence—</text> 
<subclause id="H9354E9DEEC4F4E1C94004F21BA547CC5"><enum>(I)</enum><text>by inserting <quote>, and including such content, as shall be</quote> before <quote>specified by the Secretary</quote>; and</text></subclause> <subclause id="HF33AEECD1DEE4CF6842970C13AE5A3EE"><enum>(II)</enum><text>by inserting <quote>, but not less often than annually</quote> before the period at the end; and</text></subclause></clause> 
<clause id="HF4C350B2F967472E9F5D8A50BA7B8392"><enum>(ii)</enum><text>by striking subparagraph (C) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="H253839CB35E142FA9009A6A1474E4B1C" style="OLC"> <subparagraph id="HEFC35CC31DBA4D3C89045508C5AB68C3"><enum>(C)</enum><text display-inline="yes-display-inline">describe and analyze the effects of the program of the agency and the assisted activities under such program in addressing and achieving the objectives of the program under this section and each of the purposes specified in subsection (a), including the effects of the program on—</text> 
<clause id="HCB95007CD06345E7AAB1FD50BE1B897E"><enum>(i)</enum><text display-inline="yes-display-inline">the number of new families the agency has been able to assist from the waiting lists for housing assistance that is administered by the agency, including vouchers for rental assistance under section 8(o) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)</external-xref>) and dwelling units in public housing and in housing assisted with project-based section 8 assistance, as a result of the flexibility of funds and achievement of economic independence;</text></clause> <clause id="H33D91C52BF834CACAA23FDA57BEE0953"><enum>(ii)</enum><text>the cost and annual change, per family participating in the program, of providing housing assistance referred to in clause (i) that is administered by the agency;</text></clause> 
<clause id="H33D9487767904FCF80C51CD8DB240F57"><enum>(iii)</enum><text>any cost savings and additional housing resulting from the program; </text></clause> <clause id="H9BFCB19E37534157A9F885AD46E4D143"><enum>(iv)</enum><text>the household incomes, and changes in such incomes, of members of families participating in the program who are not exempt from work requirements; and</text></clause> 
<clause id="H89E98F52725F44CEB7AF06F9786DADE7"><enum>(v)</enum><text>such other factors as the Secretary considers appropriate.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph> <subparagraph id="H3F192E69FE9947AEB507FAD5CC553D6B"><enum>(C)</enum><text>by redesignating paragraphs (3) and (4) as paragraphs (5) and (6); and</text></subparagraph> 
<subparagraph id="H12AA854A4DF7459281A4609AA626A08D"><enum>(D)</enum><text>by inserting after paragraph (2) the following new paragraphs:</text> <quoted-block display-inline="no-display-inline" id="H15DA51C948434022A0E5311F204F577B" style="OLC"> <paragraph id="HFB08BA4CAE9B441FBF433EE08262FE40"><enum>(3)</enum><header>Annual budget plan</header> <subparagraph id="H5EF11A5878104D2C89884528224C451E"><enum>(A)</enum><header>Requirement</header><text display-inline="yes-display-inline">Each agency shall submit annually to the Secretary, together with the report under paragraph (2), a budget plan for the program of the agency for the upcoming year and shall make such budget plan publicly available.</text></subparagraph> 
<subparagraph id="H44A8D08261C741C08C0CE0C31A50415B"><enum>(B)</enum><header>Form and metrics</header><text>Each annual budget plan shall be set forth in a standard form, prescribed by the Secretary and shall utilize a common budget metric that allows for comparison of the budget plans of all public housing agencies participating in the program.</text></subparagraph> <subparagraph id="HBCD25D9BF22346AD8CBD8701177E4A6F"><enum>(C)</enum><header>Content</header><text>Each annual budget plan shall include such content as the Secretary shall specify, which shall include—</text> 
<clause id="HEDEEE8DC52604AD0AB07A41F6D4B1B46"><enum>(i)</enum><text display-inline="yes-display-inline">a description and explanation of all new rules and policy changes adopted by the agency in accordance with this section and the program under this section and, with respect to such new rules and policy changes—</text> <subclause id="HDDED86B8505741FFB9D5AE9E3855AFEF"><enum>(I)</enum><text>a description of the effect such rules and changes will have on the operation of the agency as compared to the preceding year and as compared to the operations of the agency other than under the program under this section;</text></subclause> 
<subclause id="HC769CB03B501497CA5503CBAB84AE325"><enum>(II)</enum><text>a description of the extent to which such rules and changes helped to achieve the annual goals identified in the public housing agency’s application pursuant to subsection (d)(1)(E) and, in the case of any such goals not achieved, a description of the extent to which such goals were not achieved and the reasons for such failure; and</text></subclause> <subclause id="H4A0B301E54F346F894063760812E3929"><enum>(III)</enum><text display-inline="yes-display-inline">whether the adoption of such new rules and policy changes required an adjustment in the annual goals identified in the public housing agency’s application pursuant to subsection (d)(1);</text></subclause></clause> 
<clause id="H0FA90EEB6B5944F68C50318998DA219C"><enum>(ii)</enum><text>a plan for all capital assets and anticipated construction and rehabilitation activities of the public housing agency in the upcoming year and a description of whether and how such activities are authorized and assisted under the program under this section; and</text></clause> <clause id="HA1FA11D7BB7541D6812E2E7C34A7580B"><enum>(iii)</enum><text>assurances satisfactory to the Secretary that such plan will conform with all applicable provisions of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>), the Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3601">42 U.S.C. 3601 et seq.</external-xref>), the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/701">29 U.S.C. 701 et seq.</external-xref>), and the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101 et seq.</external-xref>).</text></clause></subparagraph></paragraph> 
<paragraph id="HE10018AF1502413C8B4857F8111EE7F8"><enum>(4)</enum><header>Public and resident participation</header> 
<subparagraph id="HAC74EE3EF0A7497DA89C247C1648E93D"><enum>(A)</enum><header>Notification of residents</header><text display-inline="yes-display-inline">Each public housing agency shall annually hold a meeting to notify all assisted families participating in the program of the public housing agency of the contents of the report under paragraph (2) for such year and budget plan under paragraph (3) for such year and impacts on such assisted families. Any public housing agency that assists, in the aggregate, more than 50,000 families or assists families in multiple counties shall hold as many meetings as necessary to provide each assisted family a good-faith opportunity to attend such a meeting.</text></subparagraph> <subparagraph id="H1F2EC2816B864729B50F0AA00BF18361"><enum>(B)</enum><header>Public comment</header><text display-inline="yes-display-inline">Each annual report under paragraph (2) and annual plan under paragraph (3) shall—</text> 
<clause id="H9CD55DBDBE4842E2972BFA0ADF0AB423"><enum>(i)</enum><text>be made available for inspection and public comment 30 days before the meeting required by subparagraph (A) regarding such plan or report; and</text></clause> <clause id="HC7388EB03CC64B5F90BC0EDE19B75DB9"><enum>(ii)</enum><text>be approved in a public meeting of the board of directors or other governing body of the public housing agency before submission to the Secretary.</text></clause></subparagraph> 
<subparagraph id="H0805157894FF49F799279816B7F4E048"><enum>(C)</enum><header>Public availability</header><text display-inline="yes-display-inline">Each annual report under paragraph (2) and annual plan under paragraph (3) shall, upon submission to the Secretary, be made publicly available and shall include all comments provided pursuant to subparagraph (B).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H86EAE528DD4040F98904C503559F2766"><enum>(9)</enum><text>in subsection (h)—</text> 
<subparagraph id="HC005D3F1288C49E2AF592EF21F8324FF"><enum>(A)</enum><text>in paragraph (1), by striking <quote>demonstration</quote> and inserting <quote>program under this section</quote>; and</text></subparagraph> <subparagraph id="H40419A54FF274954BD936D05C794E890"><enum>(B)</enum><text>by striking paragraph (2) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="H74C796697C074A68BE17407E762EA11A" style="OLC"> 
<paragraph id="H68612B0AF8F140B8AF6AF59FF4B4F046"><enum>(2)</enum><header>Review</header><text display-inline="yes-display-inline">The Secretary shall annually review the activities of each public housing agency participating in the program under this section and, based on such review and the information submitted by the agency pursuant to subsection (g), determine—</text> <subparagraph id="HE4956A0135134598ADB6CC39CD450D13"><enum>(A)</enum><text>the impact and effectiveness of the public housing agency’s program and activities in achieving each of the purposes of the program specified in subsection (a), including an assessment of such impact and effectiveness using the common set of budget metrics established pursuant to subsection (d)(1)(D);</text></subparagraph> 
<subparagraph id="H6A1A70A1789F4688B3C351BE1A829E26"><enum>(B)</enum><text>the progress of the public housing agency toward meeting the goals identified in the public housing agency’s application pursuant to subsection (d)(1)(E), using the metrics identified in the public housing agency’s application pursuant to such subsection; and</text></subparagraph> <subparagraph id="HB4786A09EDCF44588560FE7EBE4C8E09"><enum>(C)</enum><text>the extent of compliance by the public housing agency with the requirements of the program under this section and, in determining such extent of compliance, shall take into consideration the unique characteristics of the public housing agency.</text></subparagraph></paragraph> 
<paragraph id="HC4BE9B51B74F44548BDECBD54629E785"><enum>(3)</enum><header>Verification of accuracy</header><text display-inline="yes-display-inline">In assessing information submitted by public housing agencies pursuant to subsection (g) and in reviewing such information and making determinations pursuant to paragraph (2) of this subsection, the Secretary shall carry out control activities and procedures designed to verify the accuracy of such information, which shall include auditing a representative sample of such information using standard statistical methods.</text></paragraph> <paragraph id="HD825D6E9A52F4E3F9E916C8F6386EA0A"><enum>(4)</enum><header>Continued participation</header><text>The Secretary shall not terminate the participation of any public housing agency in the program under this section unless the Secretary finds that the agency—</text> 
<subparagraph id="H26A571C2AF034DB4A8789C7B1C3E545B"><enum>(A)</enum><text>is in material default of the conditions and obligations under the agreement entered into between the agency and the Secretary providing for such participation;</text></subparagraph> <subparagraph id="H837ED4022B69426C9841A734EC881E67"><enum>(B)</enum><text display-inline="yes-display-inline">as demonstrated in its reports under subsection (g)(2) and its annual budget plans under subsection (g)(3), has persistently failed to meet the goals identified in its application, and the reasons or circumstances specified in the public housing agency’s reports and plans for such failure are not sufficient to justify the continued failure;</text></subparagraph> 
<subparagraph id="H580DACB926BB44FA9EC011D1B6340FA2"><enum>(C)</enum><text>has misused or misappropriated funds;</text></subparagraph> <subparagraph id="HAE6B3DCB0E474F21AFC40BB68C7F5BE4"><enum>(D)</enum><text>has failed to make a good faith effort to carry out the purposes of the program specified in subsection (a); or</text></subparagraph> 
<subparagraph id="H65E1009B4A0E4AEC87C7477A3F4FEDB1"><enum>(E)</enum><text>has failed to cure a material deficiency in performance after notice and an opportunity to correct the deficiency.</text></subparagraph></paragraph> <paragraph id="HAB6AE84671914EA795F5EC4214792C49"><enum>(5)</enum><header>Corrective action program</header><text>The Secretary shall carry out a program—</text> 
<subparagraph id="H039957B95D3544F7AE7876DBB4FB1AE1"><enum>(A)</enum><text>to identify public housing agencies participating in the program under this section that are at risk of termination of such participation pursuant to paragraph (6);</text></subparagraph> <subparagraph id="HE33B0F0536BF40FE80A5EB2526D95ECC"><enum>(B)</enum><text>to consult with such public housing agencies regarding actions that may be taken to avoid such termination;</text></subparagraph> 
<subparagraph id="HE4E0779933294FDA90013D906B82A652"><enum>(C)</enum><text>to establish goals and timelines for such corrective actions; and</text></subparagraph> <subparagraph id="HED752E557654440B999BD15EE2326DC8"><enum>(D)</enum><text>to provide appropriate technical assistance designed to facilitate such actions and avoid such termination.</text></subparagraph></paragraph> 
<paragraph id="H991575F0A3844983BFBCEE9ED116ACC1"><enum>(6)</enum><header>Termination of participation</header><text>Any public housing agency whose participation in the program under this section is terminated shall be subject to the provisions of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437">42 U.S.C. 1437 et seq.</external-xref>) and all other provisions of law applicable to public housing agencies not participating in the program, except that the Secretary shall provide a transition period, that begins upon such termination and is not shorter than 18 months, for such public housing agencies to come into compliance with such laws.</text></paragraph> <paragraph id="HEC61601C7D4A465A9E40D9F4058A73E9"><enum>(7)</enum><header>Reports to Congress</header><text display-inline="yes-display-inline">Not later than the expiration of the 5-year period beginning on the date of the enactment of this Act, and not later than the expiration of each successive 5-year period thereafter, the Secretary shall submit a report to the Congress regarding the program under this section and the results of the reviews conducted under paragraph (2), which shall—</text> 
<subparagraph id="HC2031EA5586747698C23D544DFC08133"><enum>(A)</enum><text>evaluate the programs carried out by public housing agencies participating in the program, including with respect to each of the purposes specified in subsection (a); and</text></subparagraph> <subparagraph id="H7DA8FCE9CCCE4FE5B48AAF2841EA7232"><enum>(B)</enum><text>include findings and recommendations for appropriate legislative changes to the program.</text></subparagraph></paragraph> 
<paragraph id="H55BFDA67B90445F3BE7FBF08AFD29983"><enum>(8)</enum><header>GAO reviews and reports</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, and not less frequently than every 8 years thereafter, the Comptroller General of the United States shall—</text> <subparagraph id="H44226DA3C16F4A51873BCC1D46610D20"><enum>(A)</enum><text>conduct and complete a review of the program under this section, which shall include examination and analysis of the implementation of the program and identification of any shortcomings and any means for improving the program; and</text></subparagraph> 
<subparagraph id="H83456127884C43E8B209A05BA3B5EBEF"><enum>(B)</enum><text>submit to the Congress a report regarding the review, which shall set forth a detailed description of such implementation, any shortcomings of the program identified, and recommendations for improving the program.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H89CF20E1B080466A83665D89B27BC96C"><enum>(10)</enum><text>in subsection (i)—</text> 
<subparagraph id="H58D455CE80574486BC39CAE287A91B37"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>section 14 of the United States Housing Act of 1937 for fiscal years 1996, 1997, and 1998</quote> and inserting <quote>the Capital Fund under section 9(d) of the United States Housing Act of 1937 in each fiscal year</quote>; and</text></subparagraph> <subparagraph commented="no" id="HA8447F8BDFFB48BAA6C82F0C8BB0F16D"><enum>(B)</enum><text>in paragraph (1)(B), by striking <quote>up to 10</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H371C1FA87A7343ABBCD55D2582B89745"><enum>(11)</enum><text>by striking subsection (j).</text></paragraph></subsection> <subsection id="H9CDCB5B9FBCA4B0E874E36B36A18F9CC"><enum>(b)</enum><header>Treatment of participating agencies</header> <paragraph id="HC0806147F28947C78ECB44202339BC1B"><enum>(1)</enum><header>Continuation of participation</header><text display-inline="yes-display-inline">This section and the amendments made by this section shall not affect the status of any public housing agency that, as of the date of the enactment of this Act, is participating in the Moving to Work Program under section 204 of the Departments of Veterans Affairs and Housing and Urban Development, and Independent Agencies Appropriations Act, 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note), as such a participating agency.</text></paragraph> 
<paragraph id="H64C7B453139A48BD82544CC9C57DD13E"><enum>(2)</enum><header>Election</header><text display-inline="yes-display-inline">Any public housing agency referred to in paragraph (1) may elect—</text> <subparagraph id="H2E6C1E2B58494AA6904CC3C6E2163C25"><enum>(A)</enum><text display-inline="yes-display-inline">to continue participation in the Program under section 204 of the Departments of Veterans Affairs and Housing and Urban Development, and Independent Agencies Appropriations Act, 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note) under the terms of the agreement entered into between the agency and the Secretary providing for such participation until the date of the expiration of such agreement; or</text></subparagraph> 
<subparagraph id="H3CED630BFA844F308C8DF590B4EFBE23"><enum>(B)</enum><text display-inline="yes-display-inline">at any time before date of the expiration of such agreement, to transition to participation under the program under such section 204, as amended by this Act.</text></subparagraph></paragraph> <paragraph id="HD05E1676D49E4000A9B6BE08D4F93977"><enum>(3)</enum><header>Conversion to reformed program</header> <subparagraph id="H7B7A5266AF224F21971DE35A5183C018"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B) of this paragraph, any public housing agency that elects pursuant to paragraph (2)(A) of this subsection to continue participation in the Program under section 204 of the Departments of Veterans Affairs and Housing and Urban Development, and Independent Agencies Appropriations Act, 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note) shall, upon the expiration of the agreement referred to in such paragraph, be considered to have been approved for participation in the Program under such section 204, as amended by this Act, and the Secretary of Housing and Urban Development shall provide for the transition of the agency to participation under the Program under such section as so amended.</text></subparagraph> 
<subparagraph id="H520E0B52B1894118BCBBF5E6820579FB"><enum>(B)</enum><header>Inapplicability</header><text display-inline="yes-display-inline">Subparagraph (A) shall not apply to any public housing agency that is determined by the Secretary to be in material default, upon the expiration of the agreement referred to in paragraph (2)(A), of the conditions and obligations under such agreement.</text></subparagraph></paragraph> <paragraph id="H88D9499659734B938E8B549B2185B0BC" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Inapplicability of numerical limitation</header><text display-inline="yes-display-inline">Any public housing agency transitioned pursuant to paragraph (2)(B) or (3)(A) of this subsection to participation under the program under section 204 of the Departments of Veterans Affairs and Housing and Urban Development, and Independent Agencies Appropriations Act, 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note), as amended by this section, shall not count toward fulfillment of the numerical limitation under section 204(d)(3)(A) of the Departments of Veterans Affairs and Housing and Urban Development, and Independent Agencies Appropriations Act, 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note), as added by the amendment made by this section.</text></paragraph></subsection></section> 
<section id="HB27A0851BC64451D931B956CDA502099"><enum>502.</enum><header>Rescission of Public and Indian Housing Notice 2021–18</header><text display-inline="no-display-inline">The Public and Indian Housing Notice 2021–18 of the Department of Housing and Urban Development is hereby rescinded.</text></section></title> <title id="H2F1EA7CBF58F4BB0844AB6A044EB1C0C"><enum>VI</enum><header>Improving financial literacy regarding housing</header> <section commented="no" display-inline="no-display-inline" id="H45860B851435465B925B72BBBDFB64D2"><enum>601.</enum><header>Reforms to housing counseling and financial literacy programs</header> <subsection commented="no" display-inline="no-display-inline" id="HFF6350FC96B948D0B1CBF241756C1F62"><enum>(a)</enum><header>In general</header><text>Section 106(a)(4) of the Housing and Urban Development Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701x">12 U.S.C. 1701x(a)(4)</external-xref>) is amended—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HF2126EA0A80A4E748B966F4526094686"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HE23D9BFBDF8949CDA10819DFCCCC20C5"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>The Secretary</quote> and inserting the following:</text>

<clause commented="no" display-inline="no-display-inline" id="HB4A44DC22CCB40109BAAEF24D0111471"><enum>(ii)</enum><header>Requirement</header><text>The Secretary shall require each organization receiving assistance under this paragraph to employ individuals providing housing counseling who—</text> <subclause commented="no" display-inline="no-display-inline" id="H0DF17FEC84ED4802959AC6B07DBE1036"><enum>(I)</enum><text display-inline="yes-display-inline">are certified to understand sustainable homeownership; and</text></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="H1AC4C4836DA346398A141208193190B9"><enum>(II)</enum><text>pass required examinations that determine the ability of the individual to counsel borrowers on responsible homeownership.</text></subclause></clause> <clause commented="no" display-inline="no-display-inline" id="H1B09D7A6C99C46DB9ADE78F8E43E5AD2"><enum>(iii)</enum><header>Suspension of certification</header><text>If an individual employed by an organization that receives assistance under this paragraph provides counseling services to borrowers who, after receiving those services, have default rates that exceed the average default rates for borrowers counseled by individuals in the area served by the organization, the Secretary—</text> 
<subclause commented="no" display-inline="no-display-inline" id="H6796F2BC644041DDA0D1F932D86E1910"><enum>(I)</enum><text display-inline="yes-display-inline">shall suspend the certification from the individual; and</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="H7BA4B9CD84AB4B0283B06B3F86DEAD33"><enum>(II)</enum><text>may deny future assistance under this paragraph to that organization.</text></subclause></clause> 
<clause commented="no" display-inline="no-display-inline" id="HDECC0C8E2678422BBDCF5554C3036D8A"><enum>(iv)</enum><header>Prohibition on lobbying activities</header><text display-inline="yes-display-inline">An organization that applies for or receives assistance under this paragraph shall not engage in political activities, advocacy, or lobbying, whether directly or through other parties.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H939E68605F3242FB8EC4F4018221B4AA"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HABEBEE469029432E8160EC83CF949BF9"> 
<subparagraph commented="no" display-inline="no-display-inline" id="H7FCDB4561BDD4435845D3FE769CB7AB2"><enum>(F)</enum><header>Set asides</header><text>The Secretary shall set aside 40 percent of amounts authorized to carry out this paragraph for organizations that provide rental counseling or pre-foreclosure counseling.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H5F807A32E23C4862B156F554B37A5B9C"><enum>(G)</enum><header>Geographic diversity</header><text display-inline="yes-display-inline">In making grants under this paragraph, the Secretary shall ensure that the recipients are geographically diverse and include organizations that serve urban and rural areas.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HA8D87FB6BCA142CD9583B38CBD078380"><enum>(b)</enum><header>Requiring prepurchase and foreclosure mitigation counseling</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H54CDF02578684BA4AEC1B5D0E9787158"><enum>(1)</enum><header display-inline="yes-display-inline">Covered mortgage loan defined</header><text>In this subsection, the term <term>covered mortgage loan</term> means any loan which is secured by a first or subordinate lien on residential real property (including individual units of condominiums and cooperatives) designed principally for the occupancy of from 1- to 4-families that is—</text> <subparagraph id="HE7892389DB2343DCB74000C07820D561"><enum>(A)</enum><text>insured by the Federal Housing Administration under title II of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1707">12 U.S.C. 1707 et seq.</external-xref>);</text></subparagraph> 
<subparagraph id="HC0BD73160438453582F0CA72EC0BAF40"><enum>(B)</enum><text>insured under section 255 of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1715z-20">12 U.S.C. 1715z–20</external-xref>);</text></subparagraph> <subparagraph id="H2B82EBBBCE934F4A9E5EB8A781E3ACCC"><enum>(C)</enum><text>guaranteed under section 184 or 184A of the Housing and Community Development 3 Act of 1992 (12 U.S.C. 1715z–13a, 1715z–4 13b);</text></subparagraph> 
<subparagraph id="HC1E517C31BFE4FC8A2876872163648C5"><enum>(D)</enum><text>guaranteed or insured by the Department of Agriculture; or</text></subparagraph> <subparagraph id="H27FD4DCBEBC548909CF9C7D9C808D73C"><enum>(E)</enum><text>made by the Department of Agriculture.</text></subparagraph></paragraph> 
<paragraph id="H9A5D76BAF8E34EA88A1650DF172C54A1" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Requirement for purchasers</header><text>Before purchasing residential real property that secures a covered mortgage loan, the purchaser shall participate in prepurchase housing counseling.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H544FD73C29904AF48ABA67B713D0DC7C"><enum>(3)</enum><header>Requirement for borrowers</header><text display-inline="yes-display-inline">A borrower with respect to a covered mortgage loan who is 30 days or more delinquent on payments for the covered mortgage loan shall participate in foreclosure mitigation counseling.</text></paragraph></subsection></section></title>
