<section id="H0229DA3A037346BBADCD69E8CF992509" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reinstating Orderly Access for Drivers Act</short-title></quote> or the <quote><short-title>ROAD Act</short-title></quote>.</text></section> <section id="HD8495846DEA84A2CA7C1E9D1E4B93302" section-type="subsequent-section"><enum>2.</enum><header>Affirmative defense in a criminal or civil action; party convicted of riot</header> <subsection id="H7419E2C81D884C1DAEA72D09D6F122CA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/2">Chapter 2</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>

<section id="HB5A97FD7BF6F43DA95798FAAF2D82060"><enum>40B.</enum><header>Affirmative defense in a criminal or civil action; party convicted of riot</header> 
<subsection id="H7C01AF84312B49A984BEB77679ED5552"><enum>(a)</enum><text display-inline="yes-display-inline">In a criminal or civil action for damages for personal injury, wrongful death, or property damage carried out using a motor vehicle, it is an affirmative defense that such action arose from an injury or damage sustained by a participant acting in furtherance of a riot. The affirmative defense authorized by this section shall be established by evidence that the participant has been convicted of violating section 2101, or by proof of the commission of such crime by a preponderance of the evidence.</text></subsection> <subsection id="H3941E01E7A124A5EBD0CE145D42AF884"><enum>(b)</enum><text>In a civil action in which a defendant raises an affirmative defense under this section, the court shall, on motion by the defendant, stay the action during the pendency of a criminal action that forms the basis for the defense, unless the court finds that a conviction in the criminal action would not form a valid defense under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H0C5D1056CE8E4252AC551CD586DAFA00"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/2">chapter 2</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> <quoted-block style="USC" id="H0CCFFD80CEF744DD87FDCB7228C00993" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">40B.
