<section id="HFCBBA7A96E2746EEB76F826B49236555" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Enhancing Necessary Federal Offenses Regarding Child Exploitation Act</short-title></quote> or the <quote><short-title>ENFORCE Act</short-title></quote>.</text></section> <section id="HA4ACFF62F973493A962CE8DB0FE13C35"><enum>2.</enum><header>Clarifying production with respect to material constituting or containing child pornography</header><text display-inline="no-display-inline">Section 2252A of title 18, United States Code, is amended—</text> 
<paragraph id="H8A3DF433F23A417B8A994423979675D8"><enum>(1)</enum><text>in subsection (a), by striking paragraph (7) and inserting the following:</text> <quoted-block style="USC" display-inline="no-display-inline" id="H938ACE0091734A35A21B70F5D06931BE"> <paragraph id="H896CF8985D814FDD89F3B47707CF6422"><enum>(7)</enum><text>knowingly produces child pornography, as defined in section 2256(8)(C), that—</text> 
<subparagraph id="HE19EFAA1A2714799A691143845F4E54F"><enum>(A)</enum><text>the person knows, or has reason to know, will be mailed, shipped, or transported using any means or facility of interstate or foreign commerce or in or affecting interstate or foreign commerce;</text></subparagraph> <subparagraph id="H51B9CA9F91CA488FA9822864D3A7CC61"><enum>(B)</enum><text>was produced using materials that have been mailed, shipped, or transported in or affecting interstate or foreign commerce; or</text></subparagraph> 
<subparagraph id="HFAE25195C6A040D0965EC233DDE0C32B"><enum>(C)</enum><text>has been mailed, shipped, or transported using any means or facility of interstate or foreign commerce or in or affecting interstate or foreign commerce,</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H913CCA821DEE4821B5F28E88340E32E0"><enum>(2)</enum><text>in subsection (b)—</text> 
<subparagraph id="HCA920FF5EB014F9FB550C284B5FEBD4B"><enum>(A)</enum><text>in paragraph (1), by striking <quote>or (6)</quote> and inserting <quote>(6), or (7)</quote>; and</text></subparagraph> <subparagraph id="HA0D201D9F1EA4E1FA29D754AF5A94ADB"><enum>(B)</enum><text>by striking paragraph (3).</text></subparagraph></paragraph></section> 
<section id="HA8E6CE73A4FD4A16A04B83BD24519CF5"><enum>3.</enum><header>Enhancing enforcement with respect to obscene visual representations of child sexual abuse</header> 
<subsection id="H8607CC43C0F74F08ADEBF6782EBC5FEB"><enum>(a)</enum><header>Removing the statute of limitations for obscene visual representations of child sexual abuse</header><text>Section 3299 of title 18, United States Code, is amended by inserting <quote>1466A or</quote> before <quote>1591</quote>.</text></subsection> <subsection id="H2E11F76DECF944B29E87802037D9ABCD" commented="no"><enum>(b)</enum><header>Including crimes of obscene visual representations of child sexual abuse in sex offender registration</header><text>Section 111(5)(A)(iii) of the Adam Walsh Child Protection and Safety Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/34/20911">34 U.S.C. 20911(5)(A)(iii)</external-xref>) is amended by inserting <quote>1466A or</quote> before <quote>1591</quote>.</text></subsection> 
<subsection id="H9A9EA793F8814B67A80E52D9E8EE256D" commented="no"><enum>(c)</enum><header>Prohibition on reproduction of obscene visual representations of child sexual abuse in discovery</header><text>Section 1466A of title 18, United States Code, is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="H176C538D7F094BEA83FF33754088E05B"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (f) as subsection (g); and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H82A3FCC5E57E4BCEA6BE63BEAC1492B7"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (e) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HD3ECA0893CED48ED8C47BA8B32013B4F"> <subsection id="HD3F209F98F9A428682097D76E3A0BB15" commented="no"><enum>(f)</enum><header>Prohibition on reproduction of obscene visual depictions of child sexual abuse</header><text>In any criminal proceeding brought under this section—</text> 
<paragraph id="H16F862B0426944B28A160EEA1FB968FD" commented="no"><enum>(1)</enum><text>any visual depiction involved in a violation of this section shall remain in the care, custody, and control of either the Government or the court in the same manner specified for child pornography in paragraphs (1) and (2) of section 3509(m); and</text></paragraph> <paragraph id="HB65871797FBA4A4A87438BB499DA09DA" commented="no"><enum>(2)</enum><text>any identifiable minor, as that term is defined in section 2256(9), depicted in any visual depiction involved in a violation of this section may have access to such depiction in the same manner specified for a victim, with respect to child pornography depicting the victim, in section 3509(m)(3).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H9432CC2EA3CA4F22A4EC807928433A73"><enum>(d)</enum><header>Presumption of detention for violations of section 1466A pending trial</header><text>Section 3142 of title 18, United States Code, is amended—</text> <paragraph id="H7ADDD5E5E5EF41409387852DA6ADC4ED"><enum>(1)</enum><text>in subsection (c)(1)(B), in the undesignated matter following clause (xiv), by striking <quote>that involves</quote> and all that follows through <quote>2425 of this title</quote> and inserting <quote>that involves an offense described in subsection (e)(3)(E)</quote>; and</text></paragraph> 
<paragraph id="HD4C409997D4D46419C80ECD1F5E89637"><enum>(2)</enum><text>in subsection (e)(3), by striking subparagraph (E) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H23BFA53242734208BFDF7E5CCC497108"> <subparagraph id="HA705988C63404F2695DF967E38F9AC9F"><enum>(E)</enum><text>an offense—</text> 
<clause id="HC1289587F3B44F279AD8D2AEFDD195AC"><enum>(i)</enum><text>involving a minor victim under section 1201, 1591, 2241(a), 2241(b), 2242, 2244(a)(1), 2245, 2421, or 2422(a) of this title; or</text></clause> <clause id="HD78DEFD477804024A4768C08A9B9D4E3"><enum>(ii)</enum><text>under section 1466A(a), 2241(c), 2251A, 2252(a)(1), 2252(a)(2), 2252(a)(3), 2252A(a)(1), 2252A(a)(2), 2252A(a)(3), 2252A(a)(4), 2260, 2422(b), 2423, or 2425 of this title.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H7473CCA4405A4194A4691AAD6FF38DB7" commented="no"><enum>(e)</enum><header>Supervised release for violations of section 1466A after imprisonment</header><text>Section 3583(k) of title 18, United States Code, is amended, in the first sentence, by inserting <quote>1466A,</quote> before <quote>1591,</quote>.</text></subsection></section> </legis-body></bill>
