<section section-type="section-one" id="H0D48B77837BF4FEBA0AA31407819A54A"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing Infrastructure from Adversaries Act of 2025</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="H7A2F074DBDA04D1A8C6B39FFFF9DCDE9"><enum>2.</enum><header>Prohibition on use of, procurement of, and contracting related to certain foreign-made LiDAR technology</header> <subsection commented="no" display-inline="no-display-inline" id="H6A4D490961D24C13922BD929101A167E"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H23D43F34AC01414DA6A5C413514FF65E">
                    <enum>(1)</enum>
                    <header>Covered foreign country; covered <enum-in-header>LiDAR</enum-in-header>
                        company, covered LiDAR technology;
                        <enum-in-header>LiDAR</enum-in-header></header>
 <text>The terms <term>covered foreign country</term>, <term>covered LiDAR company</term>, <quote>covered LiDAR technology</quote>, and <term>LiDAR</term> have the meanings given those terms in section 164(e) of the Servicemember Quality of Life Improvement and National Defense Authorization Act for Fiscal Year 2025 (10 U.S.C. note prec. 4651; <external-xref legal-doc="public-law" parsable-cite="pl/118/159">Public Law 118–159</external-xref>).</text>
                </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H5EF68748594F4A3BA589690A1D8180E7"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph></subsection> <subsection id="H52A6D3E6F1F840019102B33055506036"><enum>(b)</enum><header>Prohibition on use or procurement of certain LiDAR</header> <paragraph id="HC5A35318E17D4CB2940949E4BA254EBE"><enum>(1)</enum><header>In general</header><text>The Secretary may not—</text> 
<subparagraph id="H9C20190A5B9145B28A9DF999E7BFCF91"><enum>(A)</enum><text>procure or obtain—</text> <clause id="H66127D7D423E4507AD88A40319392C41"><enum>(i)</enum><text>any covered LiDAR technology;</text></clause>
<clause id="H46A59EE0C23B48728C746650D6630960"><enum>(ii)</enum><text>any LiDAR technology otherwise produced or provided by a covered LiDAR company; or</text></clause> <clause id="HEEF09AE47A0E4C108C2ADD79A87D1FAB"><enum>(iii)</enum><text>any LiDAR technology produced in or provided by a covered foreign country; or</text></clause></subparagraph> 
<subparagraph id="H2E6F7B9F31B64AEFA677F427345FB4C0"><enum>(B)</enum><text>enter into, extend, or renew a contract with any entity unless the entity submits to the Secretary a certification that no covered LiDAR technology described in clause (ii) or (iii) of subparagraph (A) will be used in the performance of the contract.</text></subparagraph></paragraph> <paragraph id="H24400637B57B4CA88B4A7DE20DC23B64"><enum>(2)</enum><header>Waiver</header><text>The Secretary may waive the prohibition under paragraph (1) on a case-by-case basis by submitting to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives, not later than 15 days before the applicable activity is carried out, a written certification that the activity to which that prohibition applies and for which a waiver will be provided is in the national interest of the United States.</text></paragraph></subsection> 
<subsection id="HE1259BB48BF646D0B53A7464AB20B81F"><enum>(c)</enum><header>Prohibition on use of loan or grant funds for certain LiDAR</header><text>In entering into an agreement with an entity under which the Secretary provides loan or grant funds to that entity, the Secretary shall ensure that no such funds may be obligated or expended to procure, obtain, or use—</text> <paragraph commented="no" display-inline="no-display-inline" id="H3F14F264612C433A9A559DA680ABCD1B"><enum>(1)</enum><text display-inline="yes-display-inline">any covered LiDAR technology;</text></paragraph>
<paragraph id="HF27F6B2136A54A3AB10723A948296E58"><enum>(2)</enum><text>any LiDAR technology otherwise produced or provided by a covered LiDAR company; or</text></paragraph> <paragraph id="HB94A7F6ED9294348A0E22DD7E559D890"><enum>(3)</enum><text>any LiDAR technology produced in or provided by a covered foreign country.</text></paragraph> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HA481B265A77B45C48362C39D0B079674"><enum>(d)</enum><header>Applicability</header> 
<paragraph commented="no" display-inline="no-display-inline" id="HDF992200EA564F649EBC6F9072358E76"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), this section shall apply to any obligation or expenditure of funds, and any contract entered into, on or after June 30, 2026.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H8E13DCDAA3414025A93F3F66061C6064"><enum>(2)</enum><header>Limitation</header><text>This section shall not apply to—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H85EB9F08465A469BBC7AF498AD7C12E1"><enum>(A)</enum><text display-inline="yes-display-inline">any application for an exemption from a Federal motor vehicle safety standard prescribed under section 30111 of title 49, United States Code;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H72811A786185416FAEDF525631633C33"><enum>(B)</enum><text>any application for a waiver of, or an exemption from, a Federal motor carrier safety regulation prescribed under section 31136 of title 49, United States Code; or</text></subparagraph>
<subparagraph id="H40DD6D8D94A9492280C7F3898E75C7F2"><enum>(C)</enum><text display-inline="yes-display-inline">any grant, operation, procurement, or contracting action that is for the purposed of any testing, research, evaluation, analysis, or training related to vehicle safety.</text></subparagraph></paragraph></subsection></section> </legis-body></bill>
