which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Food and Nutrition Act of 2008 to require the Secretary to designate food and food products to be made available under the supplemental nutrition assistance program, and for other purposes.</official-title></form><legis-body id="H45E87E6677E149449CB6A859CED3C059" style="OLC"><section id="HE01D8381509C4FD68F34FAC527433AAC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Healthy SNAP Act of 2025</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="H02B6D7B04DC34A68B9A615840B7BB23D" section-type="subsequent-section"><enum>2.</enum><header>Food under supplemental nutrition assistance program</header><subsection commented="no" display-inline="no-display-inline" id="HE735315D066A46A7A0446F04F9527763"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of food</header><text display-inline="yes-display-inline">Section 3(k)(1) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012(k)(1)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H7729F609B9D143C39E1982787D3DDB49"><enum>(1)</enum><text>by striking <quote>except alcoholic beverages, tobacco</quote> and inserting the following <quote>designated by the Secretary under section 4(d), except any alcoholic beverages, tobacco, soft drinks, candy, ice cream, prepared desserts such as cakes, pies, cookies, or similar products</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1E80D39DC2064D5BA858A3EF7FF64281"><enum>(2)</enum><text>by striking <quote>clauses</quote> and inserting <quote>paragraphs</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H54717ED363984F98AF87247432B44AA5"><enum>(b)</enum><header>Designated food</header><text>Section 4 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2013">7 U.S.C. 2013</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB2E9098C11B5430294252FFB70281E26"><subsection commented="no" display-inline="no-display-inline" id="H41418989B3114884801789D6B9335539"><enum>(d)</enum><header>Designated food</header><paragraph id="HF95E9CD3F404406BA3F97EF5B5D4D0AF"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this subsection, the Secretary shall designate by regulation the foods and food products that shall be included in the definition of the term <quote>food</quote> under section 3(k)(1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H499FE7F6992A4EDE9F556689847493EA"><enum>(2)</enum><header>Considerations</header><text>In carrying out paragraph (1), the Secretary shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="HE5B7B2EA25814F96B27ED0148B468DEE"><enum>(A)</enum><text display-inline="yes-display-inline">take into consideration food and food products that—</text><clause commented="no" display-inline="no-display-inline" id="H633965FAEAA646EAA912BE1619A71988"><enum>(i)</enum><text display-inline="yes-display-inline">based on nutrition research, contain nutrients lacking in the diets of people in the United States; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H6384E221481240FFB561058693A5F87D"><enum>(ii)</enum><text display-inline="yes-display-inline">promote the health of the population served by the supplemental nutrition assistance program, based on relevant nutrition science, public health concerns, and cultural eating patterns; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H56B820A43F514B99898D481144B1C76A"><enum>(B)</enum><text>to the maximum extent practicable, ensure that the fat, sugar, and salt content of the food and food products is appropriate.</text></subparagraph></paragraph><paragraph id="H7A3D1ED100BD4970A78692C84A2E015A"><enum>(3)</enum><header>Review of available foods</header><text>As frequently as determined by the Secretary to be necessary to reflect the most recent scientific knowledge, but not less frequently than once every 5 years, the Secretary shall—</text><subparagraph id="H5912536B74B244BC8EE8B8CC4409A16E"><enum>(A)</enum><text>conduct a scientific review of the food and food products designated under paragraph (1); and</text></subparagraph><subparagraph id="H6D490552AAAD4D4BA61C916C204D9BA2"><enum>(B)</enum><text>amend those foods and food products, as necessary, to reflect nutrition science, public health concerns, and cultural eating patterns.</text></subparagraph></paragraph><paragraph id="HF21FFFFF0AF64C2CB297290BDAB74CA3"><enum>(4)</enum><header>Prepared meals</header><text>Prepared meals described in section 3(k) shall have nutritional values consistent with regulations developed by the Secretary under this subsection.</text></paragraph><paragraph id="H8FA354BF5A014344916BDF13FEB4A49F"><enum>(5)</enum><header>Cultural Cuisines</header><text>To allow for different cultural eating patterns, State agencies may, with the approval of the Secretary, substitute different food for food designated under paragraph (1) subject to the condition that the different food is nutritionally equivalent to the substituted food.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
