<section id="HECA7C06994E84041BEBB00CE48B28B9C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rare Earth Solutions and Carbon Utilization Enhancement Act of 2025</short-title></quote> or the <quote><short-title>RESCUE Act of 2025</short-title></quote>.</text></section> <section id="H4D5A95A91594479EB332A3CD1685E4FA"><enum>2.</enum><header>Permit process for projects relating to extraction, recovery, or processing of certain materials</header> <text display-inline="no-display-inline">Section 41001(6)(A) of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m">42 U.S.C. 4370m(6)(A)</external-xref>) is amended—</text> 
<paragraph id="H28BB4A3C23CB4DEC8E39CF2ABD2587BE"><enum>(1)</enum><text>in clause (iii)(III), by striking <quote>or</quote> at the end;</text></paragraph> <paragraph id="HA1D97A168E084264AA163E5E643AF223"><enum>(2)</enum><text>in clause (iv)(II), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="HD4998EC1AE934951B1502F2385A115B3"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H1C625FC4841A40DAA90FAB9F7F135AA8" display-inline="no-display-inline"> <clause id="H2C3EDE1BEDC04177884D7A4D0EF0D183"><enum>(v)</enum><text>is related to the extraction, recovery, or processing from acid mine drainage, mine tailings, coal, coal waste, coal processing waste, or pre- or post-combustion coal byproducts of—</text> 
<subclause id="H3EA491FF4D734D448827CE20F42F43DF"><enum>(I)</enum><text display-inline="yes-display-inline">a mineral of a kind that is locatable under the Mining Law of 1872 (<external-xref legal-doc="usc" parsable-cite="usc/30/22">30 U.S.C. 22 et seq.</external-xref>), including such a mineral located on lands acquired by the United States (as that term is defined in section 2 of the Mineral Leasing Act for Acquired Lands (<external-xref legal-doc="usc" parsable-cite="usc/30/351">30 U.S.C. 351</external-xref>));</text></subclause> <subclause id="H0D9C16ECF03D4BE49DB4D623DBC12F3E"><enum>(II)</enum><text>a rare earth element; or</text></subclause> 
<subclause id="HDB48FB1C6A284FF0A5DE479DEB5D5CED"><enum>(III)</enum><text>microfine carbon or carbon from coal.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> </legis-body></bill>
