<section id="HAC4CAF7E3BF94F0BB28C4ECAA03A0436" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Standardizing Permitting and Expediting Economic Development Act</short-title></quote> or the <quote><short-title>SPEED Act</short-title></quote>.</text></section> <section id="H8952BB1F5D4E4150AEF862590968C4CE"><enum>2.</enum><header>NEPA reform</header> <subsection id="H7D3599DA2AEA43C38101CC568ED21CF5"><enum>(a)</enum><header>Purpose</header><text>Section 2 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref>) is amended—</text> 
<paragraph id="H5AF395927EEA4793994B56E9C720D77F"><enum>(1)</enum><text>by striking <quote>The purposes</quote> and inserting the following:</text> <quoted-block id="HD4B693B8D1AC49ECAF496DA2B023B867" style="OLC"> <subsection id="H7B85760CAAAC4AD4B39004FE5AF28FDD"><enum>(a)</enum><text>The purposes</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H41B24BA042074B8BB84CF03BAC8375D1"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block id="HE7CC2BEF9E954D12A89A0F984A8CAAA6" style="OLC"> <subsection id="HDBBFD5BA446748979C7D75A66ECC1054"><enum>(b)</enum><text>This Act is a purely procedural statute intended to ensure Federal agencies consider the environmental impacts of their actions during the decisionmaking process. This Act does not mandate particular results, and only prescribes a process. Nothing in this Act shall be construed to mandate any specific environmental outcome or result, nor shall this Act be interpreted to confer substantive rights or impose substantive duties beyond procedural requirements.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H2E251CCB312A4D9AA400E23F0844E65A"><enum>(b)</enum><header>Procedure for determination of level of review</header><text>Section 106 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4336">42 U.S.C. 4336</external-xref>) is amended—</text> <paragraph id="H4A207D4CFEE04BB3B2A7FF6BF20336E5"><enum>(1)</enum><text>in the heading, by inserting <quote><header-in-text level="section" style="OLC">; </header-in-text><header-in-text level="section" style="OLC">scope of review</header-in-text></quote> after <quote><header-in-text level="section" style="OLC">level of review</header-in-text></quote>;</text></paragraph> 
<paragraph id="H0ED50BF07C624DB8A92A9263B8B01C6C"><enum>(2)</enum><text>in subsection (a)—</text> <subparagraph id="H2D01DF7869B14434B2422D8EBEF6F85B"><enum>(A)</enum><text>in paragraph (3), by striking <quote>or</quote>;</text></subparagraph> 
<subparagraph id="H2805C38EB7D949629B17934691CF3B32"><enum>(B)</enum><text>in paragraph (4), by striking <quote>action.</quote> and inserting <quote>action;</quote>; and</text></subparagraph> <subparagraph id="HFBD49981B96B4D278BE9DBBECE192E53"><enum>(C)</enum><text>by adding at the end the following:</text>

<paragraph id="H3F7E7C83B77843928AE0C53126BBB6B7"><enum>(5)</enum><text>the proposed agency action is an action for which such agency’s compliance with another statute’s requirements serve a similar function as the requirements of this Act with respect to such action; or</text></paragraph> <paragraph id="H965123DD57B04F4C8855A08CA083D5B2" commented="no"><enum>(6)</enum><text>the proposed agency action—</text> 
<subparagraph id="H6142B961442140C182372DB7AD07B278"><enum>(A)</enum><text>relates to a project or action that has already been reviewed pursuant to a State or Tribal environmental review statute; and</text></subparagraph> <subparagraph id="HA4D2FEC2F1634F90A3E82CF1966AE870"><enum>(B)</enum><text>the lead agency determines such review meets the requirements of this Act.</text> </subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H849DF9CA3FB34F10BF79871A3F1ECE5F"><enum>(3)</enum><text>in subsection (b)—</text> <subparagraph id="HF8FCA425960A4D4CB33FA41F57A6C180"><enum>(A)</enum><text>in paragraph (2), by striking <quote>does not</quote> and inserting <quote>is not likely to</quote>; and</text></subparagraph> 
<subparagraph id="HAF1FB16B31084347A8E1B125F53EA919"><enum>(B)</enum><text>in paragraph (3), by amending subparagraph (B) to read as follows:</text> <quoted-block id="HE9EB2743863047B08695C6C1CEB01EAF" style="OLC"> <subparagraph id="H472D44E581AB4716A6292D1F8F829738"><enum>(B)</enum><text>is not required to—</text> 
<clause id="HE635E4DEEDA4404E96CC2F0D23D28188"><enum>(i)</enum><text>undertake new scientific or technical research unless the new scientific or technical research is essential to a reasoned choice among alternatives, and the overall costs and time frame of obtaining it are not unreasonable; or</text></clause> <clause id="HA22EDB30C22E4B718DF33145E8D092BA"><enum>(ii)</enum><text>undertake new scientific and technical research after the receipt of an application, as applicable, with respect to such proposed agency action.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H29ACE63FC51B489DB846C4487FE36336"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block id="HA8059227AFB641FC9EBDACE1323D202E" style="OLC"> <subsection id="HEFFCA8938C00416E8A6E520183DBFE71"><enum>(c)</enum><header>Scope of review</header><text>In developing an environmental document for a proposed agency action, a Federal agency—</text> 
<paragraph id="HCBE995C2CC8041B39346ABCD1A413287"><enum>(1)</enum><text display-inline="yes-display-inline">may only consider effects that share a reasonably close causal relationship to, and are proximately caused by, the immediate project or action under consideration; and</text></paragraph> <paragraph id="H8B27751E1F4D4964AE0B8837FD71C1BD"><enum>(2)</enum><text>may not consider effects that are speculative, attenuated from the project or action, separate in time or place from the project or action, or in relation to separate existing or potential future projects or actions.</text> </paragraph></subsection> 
<subsection id="HB8F8D0435BD74CA985A58E6949C99240" commented="no"><enum>(d)</enum><header>Certainty</header><text>A Federal agency may not rescind, withdraw, amend, alter, or otherwise render ineffective any environmental document completed under this Act unless the Federal agency has been so ordered by a court.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H43EE7BBD56EA41EEBBFE5A3A8E0FA67B"> <enum>(c)</enum> <header>Timely and unified Federal reviews</header> <text>Section 107 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4336a">42 U.S.C. 4336a</external-xref>) is amended—</text>
        <paragraph id="HA32ECBE99E104D39BA71912DFBE6B1F5">
          <enum>(1)</enum>
 <text>in subsection (a)(3), by adding at the end <quote>Such comments shall be limited to matters relating to the proposed agency action with respect to which such cooperating agency has jurisdiction by law. If a lead agency determines an environmental document is not required to be prepared with respect to a proposed agency action under section 106(a), another agency may not prepare an environmental document with respect to such proposed agency action.</quote>;</text>
        </paragraph>
        <paragraph id="HD3FF12C4BAE84393A18D74A0900886C3">
          <enum>(2)</enum>
 <text>in subsection (b)—</text> <subparagraph id="H4E7A096A73274FBEAC22FDC0ACDFCB50"> <enum>(A)</enum> <text>by striking <quote>To the extent practicable,</quote> and inserting the following:</text>

                <header>Consideration timing</header>
                <subparagraph id="HDC2A5E12C06048FD897A17D89CDE1197">
                  <enum>(A)</enum>
                  <header>In general</header>
 <text>In developing an environmental document for a proposed agency action, no Federal agency shall be required to consider any scientific or technical research that becomes publicly available after the sooner of, as applicable—</text>
                  <clause id="HAF77FB8AFF6C4D4997EFA221FA63BA90">
                    <enum>(i)</enum>
 <text>the date of receipt of an application with respect to such proposed agency action; and</text>
                  </clause>
                  <clause id="H38EE9ED61E3A410385064168B7186A78">
                    <enum>(ii)</enum>
 <text>the date of publication of a notice of intent or decision to prepare such environmental document for such proposed agency action.</text>
                  </clause>
                </subparagraph>
                <subparagraph id="HF0C95FEF27F54372A6A6BCC580AA6093">
                  <enum>(B)</enum>
                  <header>Applicability to other law</header>
 <text>This paragraph does not affect any review of information required under subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code, with respect to comments received during the public comment period as applicable.</text>
                </subparagraph>
                <subparagraph id="H219820520BCA48E7A384A35DE4847FE8">
                  <enum>(C)</enum>
                  <header>Unnecessary delay</header>
 <text>A Federal agency may not delay the issuance of an environmental document or a final agency action, including any decision or determination, on the basis of awaiting new scientific or technical research or information that was not available as of the deadlines specified in subparagraph (A).</text>
                </subparagraph>
              </paragraph>
              <after-quoted-block>;</after-quoted-block>
            </quoted-block>
          </subparagraph>
        </paragraph>
        <paragraph id="H4AC528158D2843FDBAE132829043B5F0">
          <enum>(3)</enum>
 <text>in subsection (d), by striking <quote>action.</quote> and inserting <quote>action. Where applicable, the statement of purpose and need shall meet the goals of the applicant.</quote>; and</text>
        </paragraph>
        <paragraph id="H7A1DFB641C754045AC20DF52D76B683E">
          <enum>(4)</enum>
 <text>in subsection (g)—</text> <subparagraph id="H3005956A16AC4F118532E8455C52F511"> <enum>(A)</enum> <text>in paragraph (2), by striking <quote>, in consultation with the applicant, to</quote> and inserting <quote>if the applicant approves such extension. If the applicant approves such extension, the lead agency shall</quote>;</text>
          </subparagraph>
          <subparagraph id="H2E1ACF0432A84C6A9580F87D33AA2DC6">
            <enum>(B)</enum>
 <text>in paragraph (3)(A), by striking <quote>A project sponsor may</quote> and inserting <quote>Except as provided in subparagraph (C), a project sponsor may</quote>; and</text>
          </subparagraph>
          <subparagraph id="H592D777C7033499DBB7B7706E3A8A37C">
            <enum>(C)</enum>
 <text>by adding at the end the following:</text> <quoted-block id="HC34C7725E97241CFB726CD8F4A462C94" style="OLC"> <subparagraph id="HDAECDB9D07B749E38ECD41024AADF63D"> <enum>(C)</enum> <header>Exception</header> <text>A project sponsor that approved an extension of a deadline under paragraph (2) may not obtain review of a failure to act in accordance with such deadline under subparagraph (A) unless the lead agency fails to meet the new deadline or is delaying for reasons other than those necessary to complete its review.</text>
              </subparagraph>
              <after-quoted-block>.</after-quoted-block>
            </quoted-block>
          </subparagraph>
        </paragraph>
      </subsection> 
<subsection id="H0683E367529C409DB75282AA404F4901"><enum>(d)</enum><header>Programmatic environmental documents</header><text>Section 108 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4336b">42 U.S.C. 4336b</external-xref>) is amended—</text> <paragraph id="H6B7DA1C150A34B849E67DC46851D10A1"><enum>(1)</enum><text>in paragraph (1), by striking <quote>5</quote> and inserting <quote>10</quote>; and</text></paragraph> 
<paragraph id="HB38387AE40CD4CF3BAC33D45B2920797"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>5</quote> and inserting <quote>10</quote>.</text></paragraph></subsection> <subsection id="HD8AD47F5DC404FCEA69A2F1F1CD8B0D0"><enum>(e)</enum><header>Adoption of categorical exclusions</header><text>Section 109 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4336c">42 U.S.C. 4336c</external-xref>) is amended—</text> 
<paragraph id="H6B8FF363F47B4F2A9988FB55306B735C"><enum>(1)</enum><text>in the text preceding paragraph (1), by inserting <quote>, or that was legislatively enacted by Congress,</quote> after <quote>procedures</quote>; and</text></paragraph> <paragraph id="H5A38721211AC48449F04C521F596EA74"><enum>(2)</enum><text>in paragraph (2), by inserting <quote>, if applicable,</quote> after <quote>established the categorical exclusion</quote>.</text></paragraph></subsection> 
<subsection id="H857A10D1CF384DDCA9303EF72B21ECE7"><enum>(f)</enum><header>Definitions</header><text>Section 111 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4336e">42 U.S.C. 4336e</external-xref>) is amended—</text> <paragraph id="H5B0C13120BF14481A4DE0246DD2BD3C5" commented="no"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>, or Congress deems by statute,</quote> after <quote>Federal agency has determined</quote>;</text> </paragraph> 
<paragraph id="H5298DB46CCE447A0A2F7BA21F212C8E1"><enum>(2)</enum><text>in paragraph (10)—</text> <subparagraph id="H8821932630F74B708B70DC5312D8CFCD"><enum>(A)</enum><text>in subparagraph (B)—</text> 
<clause id="H08472BE4A3954DFCB5EA0806A92B0963"><enum>(i)</enum><text>in clause (iii)—</text> <subclause id="H8D8567B628824F85A1EAE9C6D1386E4E"><enum>(I)</enum><text>by inserting <quote>, grants</quote> after <quote>loan guarantees</quote>;</text></subclause>

<clause id="H4B0349018B3D4E3084AC604D0F333F3D"><enum>(iv)</enum><text>farm ownership loans and operating loan guarantees by the Farm Service Agency pursuant to sections 305 and 311 through 319 of the Consolidated Farm and Rural Development Act;</text></clause> <clause id="H5C77FA652C154D8B8A88D1059F86C30A"><enum>(v)</enum><text display-inline="yes-display-inline">the issuance of a permit or other authorization by an agency where the proposal under consideration is otherwise being evaluated or was previously evaluated by the lead agency in compliance with this Act;</text></clause> <after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> 
<subparagraph id="HEBC1EE4E1B2A484B998099C35EDEB1D8"><enum>(B)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="HE7F495AA58F642A7B049DF4CDDE51C84" display-inline="no-display-inline"> <subparagraph id="H8ED747C9D62549A6A57D08621D8EF5A3"><enum>(C)</enum><header>Additional exclusions</header><text display-inline="yes-display-inline">An agency action may not be determined to be a major Federal action solely on the basis of the provision of Federal funds, including a grant, loan, loan guarantee, and funding assistance.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H5D70A39A62DC452AB3351D42E5288118"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block id="HA5B8D52852DE4A1A9AF8240F903E3CF9" style="OLC"> <paragraph id="H968222B93D754A4EAFB028CFE4698A2B" commented="no"><enum>(14)</enum><header>Reasonably foreseeable</header><text>The term <term>reasonably foreseeable</term>, with respect to environmental effects of a proposed agency action—</text> 
<subparagraph id="HBE6C118AAAA64AD69E69B9E3C105E4AC"><enum>(A)</enum><text>means effects that share a reasonably close causal relationship to, and are proximately caused by, the immediate project or action under consideration; and</text></subparagraph> <subparagraph id="H50940BD20E4541CD972C0EFE2B1F6B1A"><enum>(B)</enum><text>does not include effects that are—</text> 
<clause id="H7E3EC52FA5C8454CB6D3EC3B3B9A01CB" commented="no"><enum>(i)</enum><text>speculative;</text></clause> <clause id="HBCB0DF93CBB34C60B8FDC852EC98890F" commented="no"><enum>(ii)</enum><text>attenuated from the proposed agency action;</text></clause> 
<clause id="H10F608BF170E407CB6475BC115894C39" commented="no"><enum>(iii)</enum><text>separate in time or place from the proposed agency action; or</text></clause> <clause id="H350A06CDEE2C479DA98B64BB3FD4448A" commented="no"><enum>(iv)</enum><text>in relation to separate existing or potential future projects.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H97F96CAB4818416D870436CED4108569"><enum>(g)</enum><header>Duties</header><text>Section 204 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4344">42 U.S.C. 4344</external-xref>) is amended in paragraph (4) by inserting <quote>energy,</quote> after <quote>health,</quote>.</text></subsection></section> <section id="H5908A8B498A242C2BF072225743FE3F3"><enum>3.</enum><header>Judicial review</header><text display-inline="no-display-inline">Title I of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4331">42 U.S.C. 4331 et seq.</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block id="H9480D243DD4142F9AFAB1D7B2B95B44C" style="OLC"> 
<section id="H3E5D0BD8C5BD484D9694FBF89ED9CEB3" commented="no"><enum>113.</enum><header>Judicial review</header> 
<subsection id="HE25FC60945E74B8E85051E021402750B" commented="no"><enum>(a)</enum><header>Standard of review</header><text display-inline="yes-display-inline">Notwithstanding <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">chapter 7</external-xref> of title 5, United States Code, in reviewing a claim of whether a final agency action complies with the procedural requirements of this Act, a court may only hold that the final agency action does not comply with the procedural requirements of this Act if the court determines—</text> <paragraph id="HC1E30273804247AB8362719110034A21" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">the agency abused its substantial discretion in complying with the procedural requirements of this Act; and</text></paragraph> 
<paragraph id="HEAD49BA2B0DD4324B337D64232AB0B43" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">the agency would have reached a different result with respect to the final agency action absent such abuse of substantial discretion.</text></paragraph></subsection> <subsection id="H039ABC493463415681E967C93060578E" commented="no"><enum>(b)</enum><header>Role of the court</header><text display-inline="yes-display-inline">A court reviewing a claim described in subsection (a) may not substitute its judgment for that of the agency regarding the environmental effects of a proposed agency action.</text></subsection> 
<subsection id="H01F14A782312449CB894EB045A129195" commented="no"><enum>(c)</enum><header>Remand</header> 
<paragraph id="H591B20C8DD3C47CC816E5AA0C6C42117" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If a court holds that a final agency action does not comply with the procedural requirements of this Act, the court may only remand the final agency action to the agency with—</text> <subparagraph id="HC1B08EDC4C414B7A97B1C0F675CDD464" commented="no"><enum>(A)</enum><text>specific instruction to correct the errors or deficiencies in compliance; and</text></subparagraph> 
<subparagraph id="H1AEBFC6204094D4FAE5E8B58AF1E382F" commented="no"><enum>(B)</enum><text>a reasonable schedule and deadline, which such deadline may not exceed—</text> <clause id="HEC20BB1D043B4866B9ACD225DB024308" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">with regard to an order entered on or after the date of enactment of this section, the date that is 180 days after the date on which the order was entered; and</text></clause> 
<clause id="H20A0447E0885410380332F1DAE443B58" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">with regard to an order entered before the date of enactment of this section, the date that is 180 days after the date of enactment of this section.</text></clause></subparagraph></paragraph> <paragraph id="HD642CCB5E7844B2D94570629FAD400BF" commented="no"><enum>(2)</enum><header>Continued effect of final agency action</header><text display-inline="yes-display-inline">A final agency action remanded under paragraph (1) shall remain in effect while the Federal agency corrects any errors or deficiencies specified by the court.</text></paragraph></subsection> 
<subsection id="H4D3363D899AC4FBAA4D3F7F8FE934D0F" commented="no"><enum>(d)</enum><header>Limitations on claims</header> 
<paragraph id="H29959992A60C4B60934BBF60D96ACE49" commented="no"><enum>(1)</enum><header>In general</header><text>Notwithstanding <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">chapter 7</external-xref> of title 5, United States Code, a claim described in subsection (a) shall be barred unless—</text> <subparagraph id="H453FA00B88254D9D8B871E02555F0773" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">such claim is filed not later than 150 days after the final agency action is made public, unless a shorter timeline is specified under Federal law;</text></subparagraph> 
<subparagraph id="H4FCDD0AAC6724EF382F3B3DAEA0CC6B8" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a final agency action for which there was a public comment period on an environmental document, such claim—</text> <clause id="HE3C9F23BE37B4F1194518CF760F81AC9" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">is filed by a party that submitted a substantive and unique comment during such public comment period by the noticed comment deadline for the environmental document and such comment was sufficiently detailed to put the applicable Federal agency on notice of the issue upon which the party seeks review and shows that the party would suffer direct harm if its comments were not addressed; and</text></clause> 
<clause id="H1534BD9FBD084E858A764047679EF8FE" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">concerns the same subject matter raised in the comment submitted during the public comment period; and</text></clause></subparagraph> <subparagraph id="H1A846A0A39434C35A9FA6D19D0F710F5" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">such claim does not challenge the establishment of a categorical exclusion.</text></subparagraph></paragraph> 
<paragraph id="HEC84C4C19DB04D0A89F1155EB38B95D2" commented="no"><enum>(2)</enum><header>Supplemental environmental documents</header><text display-inline="yes-display-inline">If an agency issues a supplemental environmental document in response to a court order remanding a final agency action, the deadline described in paragraph (1)(A) shall be the date on which the agency makes public the agency action for which the supplemental environmental document is prepared. A claim for review of such final agency action shall be limited to information contained in the final supplemental environmental document that was not contained in a previous environmental document for the final agency action.</text></paragraph></subsection> <subsection id="HFF92CAF70A95445DB878B7AC62AA5AAF" commented="no"><enum>(e)</enum><header>Deadline for resolution</header> <paragraph id="H563EAEEA69914E8C8DC43AB6B068C366" commented="no"><enum>(1)</enum><header>In general</header><text>A court shall issue a final judgment on a claim described in subsection (a)—</text> 
<subparagraph id="HC046A64E4CD448D0A6D88586554D9F64" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">as expeditiously as practicable; and</text></subparagraph> <subparagraph id="HCEA9A479EE4F43DCA54F42C2EB219D99" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">unless a shorter timeline is specified under Federal law, not later than the date that is 180 days after the date on which the agency record for the review is filed with the reviewing court, which shall not be more than 30 days from the filing of the claim.</text></subparagraph></paragraph> 
<paragraph id="HA5EBAFA0F7B74D63A75370DCBF9DFCE6" commented="no"><enum>(2)</enum><header>Accelerated deadlines</header><text>Nothing in this subsection may be construed to prevent a court form further expediting review of a claim described in subsection (a).</text></paragraph> <paragraph id="H8CF9104D65B04F07BE80C5F969FFC331" commented="no"><enum>(3)</enum><header>Appeals</header> <subparagraph id="HADDBDEA344AA4FC48CFFB7F81CB883A7" commented="no"><enum>(A)</enum><header>Filing</header><text display-inline="yes-display-inline">A notice of appeal of a final judgment described in this subsection shall be filed not later than 60 days after such final judgment is issued.</text></subparagraph> 
<subparagraph id="H938B9CA8CA1940A3BA2C23A9C1338624" commented="no"><enum>(B)</enum><header>Deadline for review</header><text display-inline="yes-display-inline">A court shall issue a final decision on an appeal filed under subparagraph (A)—</text> <clause id="HBC9BB897A328402C8B4BABC4FA3937F9" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">as expeditiously as practicable; and</text></clause> 
<clause id="H4914DB63FC614438BA41400F02137AC4" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">not later than the date that is 180 days after the date on which the appeal is filed.</text></clause></subparagraph></paragraph></subsection> <subsection id="H6DA820A22A9B4B64AF75EE052B6D70F7" commented="no"><enum>(f)</enum><header>Final agency actions</header> <paragraph id="H3087A8D4BC594A7684D9D29F9428C9F2" commented="no"><enum>(1)</enum><header>In general</header><text>The completion of an environmental assessment, an environmental impact statement, or a finding of no significant impact, or a determination to categorically exclude an action, shall not be considered a final agency action under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">chapter 7</external-xref> of title 5, United States Code.</text></paragraph> 
<paragraph id="H1BC178A4FED7426293A800C4D79C4436" commented="no"><enum>(2)</enum><header>Agency action defined</header><text display-inline="yes-display-inline">In this section, the term <term>agency action</term> has the meaning given such term in section 551 of title 5, United States Code.</text></paragraph></subsection> <subsection id="HD61542D1C6CF428D90539BDC62869D2C" commented="no"><enum>(g)</enum><header>No effect on review of compliance with other deadlines</header><text display-inline="yes-display-inline">This section shall not affect the right to obtain review under section 107(g)(3).</text></subsection></section> <after-quoted-block>.</after-quoted-block></quoted-block></section>
