<section section-type="section-one" id="HA6FE654ACE004F0C95D09D8D6F63139A"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Constitutional Citizenship Clarification Act of 2025</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="H2B197C77331B4669BC702122C65203CE"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H1C8256480259456DA220DAEF0F411C48">
        <enum>(1)</enum>
 <text display-inline="yes-display-inline">the right of birthright citizenship, established by section 1 of the 14th Amendment to the Constitution of the United States, is rooted in the common law doctrine of jus soli and limited by the principle that it is not <quote>the soil, but ligeantia and obedientia that make the subject born</quote> a citizen;</text>
      </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HEEECFFFA3A1A45D0B1541D0D392AB969"><enum>(2)</enum><text>the Supreme Court of the United States has long recognized that, under the principle of allegiance and obedience, the children of foreign diplomats or enemy troops born on United States soil are not entitled to birthright citizenship; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H5AAC653FD445474B882913C085D7DE5D"><enum>(3)</enum><text display-inline="yes-display-inline">under that same principle, the children of foreign spies, saboteurs, terrorists, or other hostile actors, as well as the children of illegal aliens, should not be entitled to birthright citizenship.</text></paragraph></section> 
<section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H28DF21B82BF040808EBDA5CCE027DF98"><enum>3.</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="no-display-inline">The purposes of this Act are—</text> <paragraph commented="no" display-inline="no-display-inline" id="HCE540F91FE14436F8B2F400AA74C2852"><enum>(1)</enum><text display-inline="yes-display-inline">to codify the common law exception to birthright citizenship for ambassadors and invaders; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H00D10B4213C043AE804915B1A2EDE196"><enum>(2)</enum><text display-inline="yes-display-inline">to clarify that other categories of disloyal or disobedient aliens are also subject to such exception.</text></paragraph></section> <section id="H701313507432468DA8CB4ADABBC83D6E"><enum>4.</enum><header>Citizenship at birth exclusions for certain persons born in the United States</header><text display-inline="no-display-inline">Section 301(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1401">8 U.S.C. 1401(a)</external-xref>) is amended by striking the semicolon at the end and inserting the following:</text> 
<quoted-block style="traditional" id="H1BC474421BD04D6787E3C29AF9B6E0D0" display-inline="yes-display-inline"><text display-inline="yes-display-inline">: <italic>Provided</italic>, That a person born in the United States shall not be considered subject to the jurisdiction of the United States if the person is born of alien parents who are—</text> <paragraph id="H0AC39CF1F4194FF58C15CFA233A4A58C"><enum>(1)</enum><text>unlawfully present in the United States;</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HC122E05207F04920994778D9A357D33B"><enum>(2)</enum><text>present in the United States for diplomatic purposes; or</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HD211932A4817455ABBDF13CBB64E33B8"><enum>(3)</enum><text>engaged in a hostile occupation of, or a hostile operation in, the United States;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </section>
