<section id="HB878307B27604D1FA157B4632862F49E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Freedom to Move Act</short-title></quote>.</text></section> <section id="H9E3A667406984AC8AD5E245FD6E4BDA9"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
<paragraph id="H1B406C306EE4499E9894FECC87B39FB1"><enum>(1)</enum><text>to invest in State, county, and local municipalities efforts to provide fare-free public transportation; and</text></paragraph> <paragraph id="H9D3C1A6E41134585B92D9F874703DDC3"><enum>(2)</enum><text>to support State, county, and local municipalities in improving and expanding access to safe, accessible, and reliable mass transit systems in order to improve the livability of communities.</text></paragraph></section>
<section id="H1DA7E3651A964EC0953BF8EB9F4323D4"><enum>3.</enum><header>Grants to support fare-free transit</header>
<subsection id="H93940C34F9BE49E88FF4DBC1160F351A"><enum>(a)</enum><header>In general</header><text>Not later than 360 days after the date of enactment of this Act, the Secretary shall award grants (which shall be known as <quote>Freedom to Move Grants</quote>) to eligible entities, on a competitive basis, to cover the lost fare revenue for fare-free public transportation and improve public transportation.</text></subsection> <subsection id="HD2E984540F2845CEA63228490B887BA1"><enum>(b)</enum><header>Application</header><text>To be eligible to receive a grant under this section, an eligible entity shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including, at a minimum, the following:</text>
<paragraph id="H52BB6EA89138421D95638FDC06140766"><enum>(1)</enum><text>A description of how the eligible entity plans to implement fare free transit access.</text></paragraph> <paragraph id="HFBF56A3F5AA34CAD9770E3B97012B71C"><enum>(2)</enum><text>A description of how the entity will work to expand and improve bus service, which may include—</text>
<subparagraph id="H1BEA32F8F11A45598447266648415C6E"><enum>(A)</enum><text>a bus network redesign;</text></subparagraph> <subparagraph id="HFA97B81239B64D4790C9124E57DA38B3"><enum>(B)</enum><text>how such redesign will prioritize consistent and reliable service for low-income and historically underserved communities;</text></subparagraph>
<subparagraph id="H9C1B4075504F444DBC9CE7E629F4AE03"><enum>(C)</enum><text>how such redesign will prioritize connectivity to critical services and improve community livability; and</text></subparagraph> <subparagraph id="H1262654F04894478BCD15744B112E574"><enum>(D)</enum><text>how the eligible entity will meaningfully consult with community, community leaders, local stakeholders and advocates, including transit advocates and disability advocates, local education agencies and institutions of higher education, community developers, labor unions, public housing agencies and workforce development boards, while facilitating such redesign.</text></subparagraph></paragraph>
<paragraph id="H7C92A697E8734761AF8DFCAD2CF3B919"><enum>(3)</enum><text>A description of how the eligible entity will meaningfully partner and collaborate with community, community leaders, local stakeholders and advocates, including transit advocates and disability advocates, local education agencies and institutions of higher education, community developers, labor unions, public housing agencies and workforce development boards to support outreach efforts to increase awareness of fare-free bus and transit programs.</text></paragraph> <paragraph id="HE3DA3B3ADC8742C9ACB7E0430AE31FCE"><enum>(4)</enum><text>A description of the eligible entity’s equity evaluation examining any transit and mobility gaps within the current transit system and how the eligible entity plans to significantly improve these gaps, including—</text>
<subparagraph id="H03D6F9368D0A4E10AF81592B1138A568"><enum>(A)</enum><text>the average commute times for driver commuters and non-driver commuters;</text></subparagraph> <subparagraph id="H38A8271F1DD94AC990710ADF93E5C0FB"><enum>(B)</enum><text>public transit ridership rates disaggregated by mode of transportation and demographic group (youth (including youth involved in the foster care system), seniors, individuals with disabilities, and low-income status); and</text></subparagraph>
<subparagraph id="H264F237278A9407EBC601511726BE0C1"><enum>(C)</enum><text>average length of bus routes and average delay times.</text></subparagraph></paragraph> <paragraph id="HB57AE0A8133C4DC5953F328426C496B5"><enum>(5)</enum><text>A description of the eligible entity’s current fare evasion enforcement policies, including—</text>
<subparagraph id="H3E8FED22C77C42E7A27EF4BC880E3FC7"><enum>(A)</enum><text>the cost of the fine and whether the infraction is considered a civil offense or a criminal offense punishable by imprisonment;</text></subparagraph> <subparagraph id="H6E93745CE84F422280E0DBC731ABCFF5"><enum>(B)</enum><text>the number of individuals charged with violating a fare evasion policy, disaggregated by age, race, gender, and disability status; and</text></subparagraph>
<subparagraph id="H878873FD772141209FB98D6380F314FF"><enum>(C)</enum><text>how the eligible entity plans to eliminate fare evasion policies and end the criminalization of individuals evading fares.</text></subparagraph></paragraph> <paragraph id="H577318E791104DA0BE0E7BED287DC8D5"><enum>(6)</enum><text display-inline="yes-display-inline">An estimate of additional costs as a result of increased ridership, including—</text>
<subparagraph id="HF9B5C5AA34864859AD8E78F840A124EB"><enum>(A)</enum><text>fuel;</text></subparagraph> <subparagraph id="HF949317DA61B447689E96FD2E12D389F"><enum>(B)</enum><text>personnel;</text></subparagraph>
<subparagraph id="H5FE7386C6A024413A1B766B0BA0A81EB"><enum>(C)</enum><text>maintenance; and</text></subparagraph> <subparagraph id="H66C6F0E1B0A0452DAA75C7CB5487FD62"><enum>(D)</enum><text>other operational costs.</text></subparagraph></paragraph>
<paragraph id="H8B2358C6BCBB42B88DECA8A843FF3F3D"><enum>(7)</enum><text>Information and statistics on assaults on transit employees and a description of trainings and policies to protect employees, which may include de-escalation training.</text></paragraph></subsection> <subsection id="H40109E9C025D49B5A5DD3DB181C62DE8"><enum>(c)</enum><header>Duration</header><text>Grants awarded under this section shall be for a 5-year period.</text></subsection>
<subsection id="H0C6CF974189742F28C8B9CB88FA6E3FF"><enum>(d)</enum><header>Selection of eligible entities</header><text>In carrying out the program under this section, the Secretary shall award grants to eligible entities located in both rural and urbanized areas.</text></subsection> <subsection id="H3C4D0F8250E04355BE28678C63BD2C7C"><enum>(e)</enum><header>Uses of funds</header><text>An eligible entity that receives a grant under this section shall use such grant to support—</text>
<paragraph id="HA7B221931509457A9C15ABAE5938A05F"><enum>(1)</enum><text>implementing a fare-free transit program; and</text></paragraph> <paragraph id="H14A1EAB7EA914BEE928C3518088C50D1"><enum>(2)</enum><text>efforts to improve public transportation, particularly in underserved communities, including costs associated with efforts to provide more safe, frequent, and reliable bus service, including—</text>
<subparagraph id="HF8A4411C28BF4A8ABE5F33936B6162FD"><enum>(A)</enum><text>bus stop safety and accessibility improvements;</text></subparagraph> <subparagraph id="HD19AF72E5642450198FBFB9C53F67A60"><enum>(B)</enum><text>pedestrian and bike shelters;</text></subparagraph>
<subparagraph id="H8CD94479D29543EC917E61E591C77B2C"><enum>(C)</enum><text>signage;</text></subparagraph> <subparagraph id="H00785A2388CA4D26AA141328BB5036E1"><enum>(D)</enum><text>painted bus lanes;</text></subparagraph>
<subparagraph id="HCA93B56B73904F5F8ABF8BA439D1C203"><enum>(E)</enum><text>signal priority systems;</text></subparagraph> <subparagraph id="HE480136B1F8047348658D4D4327F2E4F"><enum>(F)</enum><text>street redesign;</text></subparagraph>
<subparagraph id="HDD0F9C6B21814DA48E55257D4CE7902A"><enum>(G)</enum><text>operational costs to meet demands of increased ridership, including hiring and training of personnel; and</text></subparagraph> <subparagraph id="H0F29F42D442045C78817F0B4565F3D9D"><enum>(H)</enum><text>conducting a bus network redesign.</text></subparagraph></paragraph></subsection>
<subsection id="H3667D27CC57F42ABB9FEBB61122474B2"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H64D04D81B14147A59438CA566AC6F2A8"><enum>(1)</enum><header>Eligible entities</header><text>In this section, the term <term>eligible entity</term> means—</text>
<subparagraph id="H4DF2E30F5071407C9C61FE9AEC6980F9"><enum>(A)</enum><text>a State, county, local municipality;</text></subparagraph> <subparagraph id="H1BFFFABE8D7C42ADB27558F79EB30999"><enum>(B)</enum><text>a transit agency;</text></subparagraph>
<subparagraph id="H4372BADFA6914DABB18B42C3E8A5D702"><enum>(C)</enum><text>a private nonprofit organization engaged in public transportation in rural areas; or</text></subparagraph> <subparagraph id="HEDF4C8E96E9546CFA36576EA6433FEBF"><enum>(D)</enum><text>a partnership between entities described in subparagraphs (A) through (C).</text></subparagraph></paragraph>
<paragraph id="H48458A486F9945C6A39F52C763B7854D"><enum>(2)</enum><header>Underserved community</header><text>The term <term>underserved community</term> means—</text> <subparagraph id="H47A33ACD3D1F45409CD21E3CB24B8FF1"><enum>(A)</enum><text>a community not served by existing bus routes or infrequent service; and</text></subparagraph>
<subparagraph id="H9D80EA2459E94882998A39898315440C"><enum>(B)</enum><text>a community located in an area within a census tract that is identified as—</text> <clause id="HB27348606DFB4E2D855ACE5ADBA6DB11"><enum>(i)</enum><text>a low-income community; and</text></clause>
<clause id="HB09EE6042C354517B1D5185D97617DC9"><enum>(ii)</enum><text>a community of color.</text></clause></subparagraph></paragraph> <paragraph id="HF4BDAA999A764BB38B3799E3044F3522"><enum>(3)</enum><header>Low-income individuals</header><text>The term <term>low-income individuals</term> means an individual whose family income is at or below 150 percent of the poverty line (as that term is defined in section 673(2) of the Community Service Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9902">42 U.S.C. 9902(2)</external-xref>), including any revision required by that section) for a family of the size involved.</text></paragraph>
<paragraph id="HE22F3B4C8FF84CC388F2F85E52B56A20"><enum>(4)</enum><header>Foster care youth</header><text>The term <term>foster care youth</term>—</text> <subparagraph id="H1EE4A1BCB2B840A6B60AA028D910D171"><enum>(A)</enum><text>means children and youth whose care and placement are the responsibility of the State or Tribal agency that administers a State or Tribal plan under part B or E of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/621">42 U.S.C. 621 et seq.</external-xref> and 670 et seq.), without regard to whether foster care maintenance payments are made under section 472 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/672">42 U.S.C. 672</external-xref>) on behalf of such children and youth; and</text></subparagraph>
<subparagraph id="HD3F71D0FA492447088A2C0688BB775B9"><enum>(B)</enum><text>includes individuals who were age 13 or older when their care and placement were the responsibility of a State or Tribal agency that administered a State or Tribal plan under part B or E of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/621">42 U.S.C. 621 et seq.</external-xref> and 670 et seq.) and who are no longer under the care and responsibility of such a State or Tribal agency, without regard to any such individual’s subsequent adoption, guardianship arrangement, or other form of permanency outcome.</text></subparagraph></paragraph> <paragraph id="H529344E62B9B4489A7BFF158EDBDBDFB"><enum>(5)</enum><header>Public transportation</header><text>The term <term>public transportation</term>—</text>
<subparagraph id="HD6FD12BD6C4A4EDFB87C9D7FC9E8EA6A"><enum>(A)</enum><text display-inline="yes-display-inline">means regular, continuing shared-ride surface transportation services that are open to the general public or open to a segment of the general public defined by age, disability, or low income; and</text></subparagraph> <subparagraph id="H5C8F971929F043F5B4325FCAFB74A1F4"><enum>(B)</enum><text>does not include—</text>
<clause id="H02EF7298E8AD49A499384F95B85F7DF1">
              <enum>(i)</enum>
 <text display-inline="yes-display-inline">intercity passenger rail transportation provided by the entity described in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/243">chapter 243</external-xref> of title 49, United States Code (or a successor to such entity);</text>
            </clause>
<clause id="HCB6B0D1D6D45487CB04803AD14A75BC0"><enum>(ii)</enum><text>intercity bus service;</text></clause> <clause id="H5256974E1E184C8390BBE940A6EB4892"><enum>(iii)</enum><text>charter bus service;</text></clause>
<clause id="HC2B4C1F65B434DFBB5F06D8541F8B22C"><enum>(iv)</enum><text>school bus service;</text></clause> <clause id="HAA7C3A56E55745D49F66E655D08AFA6F"><enum>(v)</enum><text>sightseeing service;</text></clause>
<clause id="HE0380BF75E1B48E7B57A94FF239F25E9"><enum>(vi)</enum><text>courtesy shuttle service for patrons of one or more specific establishments; or</text></clause> <clause id="HF586026D165C4B1882A06F792684792C"><enum>(vii)</enum><text>intra-terminal or intra-facility shuttle services.</text></clause></subparagraph></paragraph></subsection>
<subsection id="H601458876DE440FA9D0BB7031E0B1E7D"><enum>(g)</enum><header>Report</header>
<paragraph id="HBFB232D5766942B4B27101DFCF87A4FC"><enum>(1)</enum><header>In general</header><text>Not later than 3 years after the date on which funds are made available to carry out this section, the Secretary shall collect data from eligible entities receiving a grant under this section on the progress of meeting the targets described in the application of such entity.</text></paragraph> <paragraph id="H07BC867A6BCB4A7389A99F77B9B78F50"><enum>(2)</enum><header>Requirements</header><text>The report required under paragraph (1) shall—</text>
<subparagraph id="H7067B1E683264ACA92BB0BDC333DEA44"><enum>(A)</enum><text>collect data on demographics of communities served under this Act, disaggregated and cross-tabulated by—</text> <clause id="H1202465F0B454E629B90787F3EA38164"><enum>(i)</enum><text>race;</text></clause>
<clause id="H757FF530A321453396BF97B7DF256605"><enum>(ii)</enum><text>ethnicity;</text></clause> <clause id="H9CA4BF78808A42EC944238322CE209CF"><enum>(iii)</enum><text>sex; and</text></clause>
<clause id="HE59E3FAAF8FE4DB2BB1FAA9823B79CF0"><enum>(iv)</enum><text>household median income; and</text></clause></subparagraph> <subparagraph id="H7BC990EC5FE94E6AB56CD9FA7CE0E99F"><enum>(B)</enum><text>progress towards significantly closing transit equity gaps as described in subsection (b)(4).</text></subparagraph></paragraph></subsection>
<subsection id="H443B53821CD24C72BC2ABC4E5E7C0953"><enum>(h)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $5,000,000,000 for each of fiscal years 2026 through 2030.</text></subsection></section> </legis-body></bill>
