<section id="H5EF04DDBC9E3459A9CEAE4ABB230E1D5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Newborn Screening Saves Lives Reauthorization Act of 2025</short-title></quote>.</text></section> <section id="H44CF3BEA89884D2DA8CCF82286832BB1"><enum>2.</enum><header>Improved newborn and child screening and follow-up for heritable disorders</header> <subsection id="HD274673C0B514C0CB8F1229B70686782"><enum>(a)</enum><header>Purposes</header><text display-inline="yes-display-inline">Section 1109(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300b-8">42 U.S.C. 300b–8(a)</external-xref>) is amended—</text> 
<paragraph id="HF9D696B7A1C24B9B9317039A672A95DA"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>enhance, improve or</quote> and inserting <quote>facilitate, enhance, improve, or</quote>;</text></paragraph> <paragraph id="H98CCD789C9994E94BE09BBEA9CDF721B"><enum>(2)</enum><text>by amending paragraph (3) to read as follows:</text> 
<quoted-block style="OLC" id="HD5AF80503CBC4C78986E88728067854E" display-inline="no-display-inline"> 
<paragraph id="HC631EF304C1D42D9A446C11C9305CD90"><enum>(3)</enum><text display-inline="yes-display-inline">to develop, and deliver to parents, families, and patient advocacy and support groups, educational programs that—</text> <subparagraph id="HC0EB0739A2A24BDAB82D7A491B8DA559"><enum>(A)</enum><text>address newborn screening counseling, testing (including newborn screening pilot studies), follow-up, treatment, specialty services, and long-term care;</text></subparagraph> 
<subparagraph id="H93FEEA48EA1E4C878105CF7447C0F6B8"><enum>(B)</enum><text>assess the target audience’s current knowledge, incorporate health communications strategies, and measure impact; and</text></subparagraph> <subparagraph id="HDE741C77C81C4DFF8C9750E2D74D5B00"><enum>(C)</enum><text>are at appropriate literacy levels;</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H56F097C4D4E241439625B7B7B5A68DBC"><enum>(3)</enum><text>in paragraph (4)—</text> <subparagraph id="HC8073B963200438D86C7787B4F2B0331"><enum>(A)</enum><text>by striking <quote>followup</quote> and inserting <quote>follow-up</quote>; and</text></subparagraph> 
<subparagraph id="HB30EA8D5CED24B66B391C2C659AB0C42"><enum>(B)</enum><text>by inserting before the semicolon at the end the following: <quote>, including re-engaging patients who have not received recommended follow-up services and supports</quote>.</text></subparagraph></paragraph></subsection> <subsection id="HBFDFAC859E1E4EFCA69D9ADE72E1880C"><enum>(b)</enum><header>Approval factors</header><text display-inline="yes-display-inline">Section 1109(c) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300b-8">42 U.S.C. 300b–8(c)</external-xref>) is amended—</text> 
<paragraph id="HC58049B67A894B6B9E2DC79DB600B4FE"><enum>(1)</enum><text>by striking <quote>or will use</quote> and inserting <quote>will use</quote>; and</text></paragraph> <paragraph id="H1E707E5C29BC453CA616C44BC1CF738E"><enum>(2)</enum><text>by inserting <quote>, or will use amounts received under such grant to enhance capacity and infrastructure to facilitate the adoption of,</quote> before <quote>the guidelines and recommendations</quote>.</text></paragraph></subsection></section> 
<section id="HFF97120866E44997A8BDA4A3AF7D574A"><enum>3.</enum><header>Advisory committee on heritable disorders in newborns and children</header><text display-inline="no-display-inline">Section 1111 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300b-10">42 U.S.C. 300b–10</external-xref>) is amended—</text> <paragraph id="H7582B6D8F1554A5FB500D5C92F3D7C07"><enum>(1)</enum><text>in subsection (b)—</text> 
<subparagraph id="HD58BAE177AF544D8B085281611192F90"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (5), by inserting <quote>and adopt process improvements</quote> after <quote>take appropriate steps</quote>;</text></subparagraph> <subparagraph id="H9730836352FB4ED19A9A087DD49D2F6B"><enum>(B)</enum><text>in paragraph (7) by striking <quote>and</quote> at the end;</text></subparagraph> 
<subparagraph id="HCDC9DE4C975D4C8590344BB4ABE24C37"><enum>(C)</enum><text>by redesignating paragraph (8) as paragraph (9);</text></subparagraph> <subparagraph id="H2A288640DA494C1F8AF8B2B666E27E6A"><enum>(D)</enum><text>by inserting after paragraph (7) the following:</text>

<paragraph id="HC45E46BE03D94820A68B3A11C7227340"><enum>(8)</enum><text display-inline="yes-display-inline">develop, maintain, and publish on a publicly accessible website consumer-friendly materials detailing—</text> <subparagraph id="H496A44C137C34523975581D0060CFD98"><enum>(A)</enum><text>the uniform screening panel nomination process, including data requirements, standards, and the use of international data in nomination submissions; and</text></subparagraph> 
<subparagraph id="HC3EDCA58A77C42EF8863819FE51E34F3"><enum>(B)</enum><text>the process for obtaining technical assistance for submitting nominations to the uniform screening panel and detailing the instances in which the provision of technical assistance would introduce a conflict of interest for members of the Advisory Committee; and</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H341CF379BC09412E86D7D126E68DFA1A"><enum>(E)</enum><text display-inline="yes-display-inline">in paragraph (9), as redesignated—</text> 
<clause id="H76F377D18B33479EAD11289449E47F2E"><enum>(i)</enum><text>by redesignating subparagraphs (K) and (L) as subparagraphs (L) and (M), respectively; and</text></clause> <clause id="H861D037AFC8B47A0BBCBA2D3D5BCABB5"><enum>(ii)</enum><text>by inserting after subparagraph (J) the following:</text>

<subparagraph id="H02CCF802CAEC4512AA6059C25BA6591F"><enum>(A)</enum><text>in paragraph (1) by striking <quote>2019</quote> and inserting <quote>2030</quote>; and</text></subparagraph> <subparagraph id="HA87166047C8D4DBD893F94367FB9DA0A"><enum>(B)</enum><text>in paragraph (2) by striking <quote>2019</quote> and inserting <quote>2030</quote>.</text></subparagraph></paragraph></section> 
<section id="H5A334548291142EA80EDD57220115276"><enum>4.</enum><header>Clearinghouse of newborn screening information</header><text display-inline="no-display-inline">Section 1112(c) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300b-11">42 U.S.C. 300b–11(c)</external-xref>) is amended by striking <quote>and supplement, not supplant, existing information sharing efforts</quote> and inserting <quote>and complement other Federal newborn screening information sharing activities</quote>.</text></section> <section id="H0DD3B2C84FCB4B34A48A1C7EFD9C6CF8"><enum>5.</enum><header>Laboratory quality and surveillance</header><text display-inline="no-display-inline">Section 1113 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300b-12">42 U.S.C. 300b–12</external-xref>) is amended—</text> 
<paragraph id="H9DAA767D01D84A3E9B6B2A077E6B87CE"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="H9EE7C65323454F7BAB79700CC438D9B2"><enum>(A)</enum><text>in paragraph (1)—</text> 
<clause id="HC132BB12B3ED488EA0E92B92E5547738"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>performance evaluation services,</quote> and inserting <quote>development of new screening tests,</quote>; and</text></clause> <clause id="HFB0C369072F740D8BC67FB75DA4D02AE"><enum>(ii)</enum><text>by striking <quote>and</quote> at the end;</text></clause></subparagraph> 
<subparagraph id="HF3F3031FCD4848DFA40CF716E7539AD9"><enum>(B)</enum><text>in paragraph (2)—</text> <clause id="H0AA840DD64634893A28AA4E74933D817"><enum>(i)</enum><text>by striking <quote>performance test materials</quote> and inserting <quote>test performance materials</quote>; and</text></clause> 
<clause id="HF1C66D0223A04C308940C174CD8A9C1C"><enum>(ii)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></clause></subparagraph> <subparagraph id="H43DF1063469842658C9B4F345D8B93C6"><enum>(C)</enum><text>by adding at the end the following:</text>

<paragraph id="HB92360D6A19148F8A4C787E2236AD575"><enum>(3)</enum><text display-inline="yes-display-inline">performance evaluation services to enhance disease detection, including the development of tools, resources, and infrastructure to improve data analysis, test result interpretation, data harmonization, and dissemination of laboratory best practices.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H94DD10A03F3744CF9E324C077BD4A9AC"><enum>(2)</enum><text>in subsection (b) to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H14A021F604B34D27BBD76CFBF1C2B769" style="OLC"> 
<subsection id="H3CC97D5C13284D46843B53228DE123EE"><enum>(b)</enum><header>Surveillance activities</header><text display-inline="yes-display-inline">The Secretary, acting through the Director of the Centers for Disease Control and Prevention, and taking into consideration the expertise of the Advisory Committee on Heritable Disorders in Newborns and Children established under section 1111, shall provide for the coordination of national surveillance activities, including—</text> <paragraph id="H4717C7D5A2DA4B0ABED83C5E238130A8"><enum>(1)</enum><text>standardizing data collection and reporting through the use of electronic and other forms of health records to achieve real-time data for tracking and monitoring the newborn screening system, from the initial positive screen through diagnosis and long-term care management; and</text></paragraph> 
<paragraph id="H851290883D9844529C384BF3BBC327AA"><enum>(2)</enum><text>by promoting data sharing linkages between State newborn screening programs and State-based birth defects and developmental disabilities surveillance programs to help families connect with services to assist in evaluating long-term outcomes.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H53A655C664944CBC9CB1E2373F4DAE34"><enum>6.</enum><header>Hunter Kelly research program</header><text display-inline="no-display-inline">Section 1116 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300b-15">42 U.S.C. 300b–15</external-xref>) is amended—</text> 
<paragraph id="H391F31B48215417FA12233262DF7851F"><enum>(1)</enum><text>in subsection (a)(1)—</text> <subparagraph id="HB6A334C542314DB89DD6E6F373142D7A"><enum>(A)</enum><text>by striking <quote>may</quote> and inserting <quote>shall</quote>; and</text></subparagraph> 
<subparagraph display-inline="no-display-inline" id="HE38C1CB67F63446093AA1DF1F3CB2BCA"><enum>(B)</enum><text>in subparagraph (D)—</text> <clause id="HDF04E2487B26459ABB6ABE67D04D0586"><enum>(i)</enum><text>by inserting <quote>, or with a high probability of being recommended by,</quote> after <quote>recommended by</quote>; and</text></clause> 
<clause id="H7C60A82FF4234577A45FAD4F597753C6"><enum>(ii)</enum><text>by striking <quote>that screenings are ready for nationwide implementation</quote> and inserting <quote>that reliable newborn screening technologies are piloted and ready for use</quote>; and</text></clause></subparagraph></paragraph> <paragraph id="H16464C7024BB42B982DB313C54CBEA42"><enum>(2)</enum><text>in subsection (b) to read as follows:</text>

<subsection id="HE29096CD9E174FA592D734DDDBAB01D4"><enum>(b)</enum><header>Funding</header><text display-inline="yes-display-inline">In carrying out the research program under this section, the Secretary and the Director shall ensure that entities receiving funding through the program will provide assurances, as practicable, that such entities will work in consultation with State departments of health, as appropriate.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="HAD38A43A3DEF4479A78171419D01062B"><enum>7.</enum><header>Authorization of appropriations for newborn screening programs and activities</header><text display-inline="no-display-inline">Section 1117 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300b-16">42 U.S.C. 300b–16</external-xref>) is amended—</text> 
<paragraph id="H134C622B7FB7418895419FC953ED8C22"><enum>(1)</enum><text>in paragraph (1)—</text> <subparagraph id="H2392E79336D743F6AC29911DBB51FE3C"><enum>(A)</enum><text>by striking <quote>$11,900,000</quote> and inserting <quote>$20,883,000</quote>;</text></subparagraph>

<section id="H2ADF1080E9D647A7B27365048C35B11C"><enum>8.</enum><header>Institutional review boards; ethics guidance program</header><text display-inline="no-display-inline">Section 12 of the Newborn Screening Saves Lives Reauthorization Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/42/289">42 U.S.C. 289</external-xref> note) is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H2E7F02EEC3AC45AAB6EAAE6CF69727FE" style="OLC"> <section id="H3E83843DC07C44748A95571179BD1FF8"><enum>12.</enum><header>Institutional review boards; ethics guidance program</header><text display-inline="no-display-inline">Research on nonidentified newborn dried blood spots shall be considered secondary research (as that term is defined in section 46.104(d)(4) of title 45, Code of Federal Regulations (or successor regulations)) with nonidentified biospecimens for purposes of federally funded research conducted pursuant to the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/200">42 U.S.C. 200 et seq.</external-xref>).</text></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
