<section id="H51B390C054694D0EBFDF4E00669830BF" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Measuring Adverse Market Disruption And National Impact Act</short-title></quote> or the <quote><short-title>MAMDANI Act</short-title></quote>.</text></section> 
<section id="HDA3E36317E514C028188BC24CEDA56C0"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> <paragraph id="HFB6A3A6D26E04EACAEC1507AD3518A73"><enum>(1)</enum><text display-inline="yes-display-inline">The retail grocery sector is a critical component of the food supply chain and economy of the United States.</text></paragraph> 
<paragraph id="H251E5BC461444F009712CF7E3F1B4A52"><enum>(2)</enum><text>Recent proposals in various municipalities have advocated for public grocery stores.</text></paragraph> <paragraph id="H620B045B6ECB430C8703A24A51831E4A"><enum>(3)</enum><text>Such proposals raise questions about—</text> 
<subparagraph id="HA9D47E9471B5459CB53597809411C7F8"><enum>(A)</enum><text>the competitive dynamics between public and private grocery stores with respect to pricing, market access, and consumer choice;</text></subparagraph> <subparagraph id="H0D0B8C5B5FAF44FEAF32779F2EDCDB13"><enum>(B)</enum><text>impacts on farmers and food banks; and</text></subparagraph> 
<subparagraph id="H5ECA5A0EFE344EB794D864DEB8222FA4"><enum>(C)</enum><text>long-term sustainability.</text></subparagraph></paragraph> <paragraph id="HBEFC389F7688430C89DB502090E41C2B"><enum>(4)</enum><text>The Federal Trade Commission has expertise in analyzing competitive practices with respect to retail markets and is well positioned to assess the effects of government entry into consumer markets.</text></paragraph></section> 
<section id="H98B0FA265518496191A03375E716A9F0"><enum>3.</enum><header>Study on impacts of public grocery stores</header> 
<subsection id="H52F3D88EDB294EFA83492C3E0981D94F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Commission, in consultation with the Administrator of the Agricultural Marketing Service and the Administrator of the Food and Nutrition Service of the Department of Agriculture, shall conduct a study on the impacts of public grocery stores that includes an analysis of the following:</text> <paragraph id="H4A7B075F655D4578B88E9E4C2EFB4FD3"><enum>(1)</enum><text>The competitive impacts of such stores on the following:</text> 
<subparagraph id="H84F0686EB7144A4981A5A2989A53034D"><enum>(A)</enum><text>Small, medium, and large private grocery stores.</text></subparagraph> <subparagraph id="H75BD13B42EE548C48E4E460094077AE5"><enum>(B)</enum><text>Farmers.</text></subparagraph> 
<subparagraph id="HA21FAB168347497CA3C61A94F7278981"><enum>(C)</enum><text>Food banks and other charitable organizations.</text></subparagraph> <subparagraph id="HE92FC98A7D38445399A49F0AFC6F6CDA" commented="no"><enum>(D)</enum><text>Wholesale food prices and food supply chains, including impacts with respect to purchasing power, market share shifts, and local and regional food distribution networks.</text></subparagraph> 
<subparagraph id="H143DE9227B1C413EBBE4048260D68A12"><enum>(E)</enum><text>The retail grocery sector generally.</text></subparagraph> </paragraph> <paragraph id="HF9295F9CAEB8458990B7EDB91131BA4D"><enum>(2)</enum><text>The impacts of public grocery stores on consumer access, choice, and prices, including with respect to food deserts.</text> </paragraph> 
<paragraph id="HAB94F8A95EDD455990E88F19962813A0" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">Whether public grocery stores would receive subsidies, tax exemptions, or regulatory advantages that may alter competition.</text></paragraph> <paragraph id="H301FC05D0E6240109C287A949E3FA961" commented="no"><enum>(4)</enum><text>How public grocery stores may affect local, regional, and national agriculture, including prices received by producers.</text></paragraph> 
<paragraph id="HD7FCFD52BF7649218C11B485FFE24D04"><enum>(5)</enum><text display-inline="yes-display-inline">Long-term market impacts with respect to the retail grocery sector, including barriers for private entities to enter and exit such sector.</text></paragraph> <paragraph id="H8F75A5E22E674468928659086B711B96" commented="no"><enum>(6)</enum><text>Concerns with respect to unfair competition or market distortion.</text></paragraph></subsection> 
<subsection id="H7AFC6CA231344332992D9A1D066D6CD9"><enum>(b)</enum><header>Use of existing data</header><text display-inline="yes-display-inline">In conducting the study under subsection (a), the Commission shall use available data of the Commission, the Department of Agriculture, and other relevant sources, including State and local economic development records, industry reports, and public procurement disclosures.</text> </subsection> <subsection id="HF0597E37482749E49E413724C8B0E944"><enum>(c)</enum><header>Report</header><text>Not later than 1 year after the date of the completion of the study required under subsection (a), and annually thereafter, the Commission shall submit to Congress a report that includes information relating to the following:</text> 
<paragraph id="HDC4474E00B0C41888D2E66A7745A760D"><enum>(1)</enum><text>The results of such study.</text></paragraph> <paragraph id="H160212AE25B346D4A5B4FDACABA052AC"><enum>(2)</enum><text>Recommendations for administrative and legislative action with respect to any concerns identified in such study.</text></paragraph></subsection> 
<subsection id="H4E3B57FF850B4190B3312717A6BE846B"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H9CB826BB660D44C5B97A74C5A97BDF29"><enum>(1)</enum><header>Commission</header><text>The term <quote>Commission</quote> means the Federal Trade Commission.</text></paragraph> 
<paragraph id="H2C24796C5DDD4B1BBE5916CA9C7EE0B7" commented="no"><enum>(2)</enum><header>Food bank</header><text>The term <quote>food bank</quote> means a nonprofit organization that collects, warehouses, and distributes donated or purchased food.</text> </paragraph> <paragraph id="H406AE988C653484F83A99B0CF75965FC" commented="no"><enum>(3)</enum><header>Food desert</header><text>The term <quote>food desert</quote> means a census tract that has a poverty rate of 20 percent or higher and has at least 500 residents that live more than 1 mile from a supermarket or large grocery store.</text></paragraph> 
<paragraph id="H22B19D6E5B834745B24054F41A026A83"><enum>(4)</enum><header>Private grocery store</header><text>The term <quote>private grocery store</quote> means a business that—</text> <subparagraph id="H8797DC06902D44FD8CC2BBB2B6371EBC"><enum>(A)</enum><text>is not owned by a Federal, State, or local government entity; and</text></subparagraph> 
<subparagraph id="H4FD3D015558F44A396FE2EA0616EE29B"><enum>(B)</enum><text>sells general food products.</text> </subparagraph></paragraph> <paragraph id="H10A8283322034E65BF9B33D7C7BDA81D"><enum>(5)</enum><header>Public grocery store</header><text>The term <quote>public grocery store</quote> means a business that—</text> 
<subparagraph id="HD6091EAE0E514B5A862D95125A5ECFEC"><enum>(A)</enum><text>is directly owned or operated by a Federal, State, or local government entity; and</text></subparagraph> <subparagraph id="H8858E57769654946BF1FDAB59CE6B9B2"><enum>(B)</enum><text>sells general food products.</text></subparagraph></paragraph> </subsection></section>
