<section id="H5DCCFB3E57C843499A77673A0F560A0A" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Furthering American Security by Tempering Environmental Regulations Act</short-title></quote> or the <quote><short-title>FASTER Act</short-title></quote>.</text></section> 
<section id="HDED2CFE8673A4680BBF7B75730225E95"><enum>2.</enum><header>Biennial survey of tactical infrastructure along the southern border</header> 
<subsection id="HBBCB28DF0EE64986B8765AC7FDF73D3F"><enum>(a)</enum><header>Biennial surveys</header> 
<paragraph id="HB3391B9CF9A1448DA58A9A2ECD625063"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act and biennially thereafter, the Secretary of Homeland Security shall conduct a survey of existing tactical infrastructure along the southern border. Each such survey shall include the following:</text> <subparagraph id="H5A992212ADD74F3A91759C855B4E5C5B"><enum>(A)</enum><text display-inline="yes-display-inline">A measurement of the number of miles of the southern border that are without tactical infrastructure.</text></subparagraph> 
<subparagraph id="H044DBEB4E172474AA849750CE1BFE02B"><enum>(B)</enum><text display-inline="yes-display-inline">A description of any deficiencies in the structure of existing tactical infrastructure along the southern border.</text></subparagraph> <subparagraph id="H7A8F77FEBA014241A813B6D05BADDBB9"><enum>(C)</enum><text>A description of any deficiencies in technology along the southern border.</text></subparagraph></paragraph> 
<paragraph id="H3847245ABA4C44C2A53A5CAF8D7D06CF"><enum>(2)</enum><header>Reports</header> 
<subparagraph id="H32A8FCD790B7486EAD37CACC61E15D87"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the conclusion of each survey under paragraph (1), the Secretary of Homeland Security shall submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report containing the findings and results of such survey.</text></subparagraph> <subparagraph id="H0BFABBD281B743FA870DFE3CC5501439"><enum>(B)</enum><header>Form</header><text>Each report under subparagraph (A) shall be submitted in unclassified format but may include a classified annex if the Secretary of Homeland Security determines such is appropriate.</text></subparagraph></paragraph></subsection> 
<subsection id="H8F925617DA8E4A538CBD7BE2C784522F"><enum>(b)</enum><header>Implementation of certain authority</header><text display-inline="yes-display-inline">If the Secretary of Homeland Security determines, pursuant to a survey under subsection (a), that there is a deficiency described paragraph (1) of such subsection, the Secretary shall take such actions as may be necessary, including exercising the authority provided pursuant to paragraph (1) of section 102(c) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1103">8 U.S.C. 1103</external-xref> note), to waive all legal requirements to correct in an expedited manner such a deficiency.</text></subsection> <subsection id="HF221BE4479474BC78621E1CCC5238896"><enum>(c)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <quote>deficiency</quote>, when used with respect to tactical infrastructure or technology, means that any such tactical infrastructure or technology, as the case may be—</text> 
<paragraph id="H41661D34BE9446E3B94DE2F33DD432CE"><enum>(1)</enum><text>is not operational; or</text></paragraph> <paragraph id="H1641D53C21B1447AAD9192EC5A178687"><enum>(2)</enum><text>cannot serve the intended function or purpose as a result of—</text> 
<subparagraph id="H691205F9C8E44D008D54E024F78B3A55"><enum>(A)</enum><text>damage;</text></subparagraph> <subparagraph id="HF271024B275646E585BFD21C44482083"><enum>(B)</enum><text>deterioration; or</text></subparagraph> 
<subparagraph id="HA0695B3182FB425FA821A3B3F05D4AFA"><enum>(C)</enum><text>unmet maintenance or repair.</text></subparagraph></paragraph></subsection> </section> </legis-body></bill>
