R. 466</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250115">January 15, 2025</action-date><action-desc><sponsor name-id="T000468">Ms. Titus</sponsor> (for herself, <cosponsor name-id="H001066">Mr. Horsford</cosponsor>, and <cosponsor name-id="L000590">Ms. Lee of Nevada</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of Energy to obtain the consent of affected State and local governments before making an expenditure from the Nuclear Waste Fund for a nuclear waste repository, and for other purposes.</official-title></form><legis-body id="HE82A415875774C8183D31C1F2B398498" style="OLC"><section section-type="section-one" id="H36BD6A13064E439F84BA7E3F8F94D424"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nuclear Waste Informed Consent Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="H13649127EB31428B9C96B08834DC32A6"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the terms <term>affected Indian tribe</term>, <term>affected unit of local government</term>, <term>high-level radioactive waste</term>, <term>repository</term>, <term>Secretary</term>, <term>spent nuclear fuel</term>, and <term>unit of general local government</term> have the meanings given the terms in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>).</text></section><section id="H5812DF83519E41B89E41D6FD1C0A932D"><enum>3.</enum><header>Consent-based approval</header><subsection id="H86AC179758B742EB81CD6787E91EF5F4"><enum>(a)</enum><header>In general</header><text>The Secretary may not make an expenditure from the Nuclear Waste Fund established under section 302(c) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(c)</external-xref>) for the costs of the activities described in paragraphs (4) and (5) of section 302(d) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(d)</external-xref>) unless the Secretary has entered into an agreement for a repository with—</text><paragraph id="H8CA8B9F78557404B8041DDD9385F4311"><enum>(1)</enum><text>the Governor of the State in which the repository is proposed to be located;</text></paragraph><paragraph id="H6C13DC19B9364687897CD28AC9F3BB00"><enum>(2)</enum><text>each affected unit of local government;</text></paragraph><paragraph id="H33D218A3EB0B427E9FF82C2A81826F96"><enum>(3)</enum><text>any unit of general local government contiguous to the affected unit of local government if spent nuclear fuel or high-level radioactive waste will be transported through that unit of general local government for disposal at the repository; and</text></paragraph><paragraph id="HB4971D4727374C91A55F5BF2FD228B1C"><enum>(4)</enum><text>each affected Indian tribe.</text></paragraph></subsection><subsection id="HDD3B2B3CB2994A4CA6B82974D5191A34"><enum>(b)</enum><header>Conditions on agreement</header><text>Any agreement for a repository under this Act—</text><paragraph id="H5CDD783772904C32A01EA52FA2489678"><enum>(1)</enum><text>shall be in writing and signed by all parties;</text></paragraph><paragraph id="H07F9711DF16C44CDB7798F7FE8551649"><enum>(2)</enum><text>shall be binding on the parties; and</text></paragraph><paragraph id="H8AE49156527241E986130B08B3237A29"><enum>(3)</enum><text>shall not be amended or revoked except by mutual agreement of the parties.</text></paragraph></subsection></section></legis-body></bill>
