<section id="HE01266A38EEF457585573113A680B2EA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keep Kids Covered Act</short-title></quote>.</text></section> <section id="H84A491EB85EF46E3B7AD124FCD980FA9"> <enum>2.</enum> <header>Requiring States to provide for continuous eligibility for children under Medicaid and CHIP</header> <subsection id="HF937A9F60C614EBF835FB9177ADE332F"> <enum>(a)</enum> <header>Continuous eligibility for deemed newborns until age 6</header> <paragraph id="HD4179A57F9A04CEAB8DD1E0527C7DAAB"> <enum>(1)</enum> <header>Medicaid</header> <text display-inline="yes-display-inline">Section 1902(e)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(e)(4)</external-xref>) is amended by striking <quote>one year</quote> and inserting <quote>6 years</quote>.</text> </paragraph> 
<paragraph id="H21EAF1D1367249A9ABE75337A877558E"> <enum>(2)</enum> <header>CHIP</header> <text display-inline="yes-display-inline">Section 2112(e) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397ll">42 U.S.C. 1397ll(e)</external-xref>) is amended by striking <quote>1 year of age</quote> and inserting <quote>6 years of age (except that such a child who is enrolled under the State child health plan or waiver may be transferred to the Medicaid program under title XIX for the remaining duration of the 6-year continuous eligibility period, if the child becomes eligible for full benefits under title XIX during such period)</quote>.</text> </paragraph> </subsection> <subsection id="H44044E86169C498A910ABDDBB3F5A1A1"> <enum>(b)</enum> <header>Continuous eligibility for children under age 19 and former foster youth</header> <paragraph id="H66CFC4E8A2484AA3A851892797F4FF53"> <enum>(1)</enum> <header>Medicaid</header> <text display-inline="yes-display-inline">Section 1902(e)(12) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(e)(12)</external-xref>) is amended—</text> 
<subparagraph id="H48240C9601E64FD4BA72C5C11E21556C"> <enum>(A)</enum> <text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">1 year of continuous</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Continuous</header-in-text></quote>;</text> </subparagraph> <subparagraph commented="no" id="H0BDF69EF3E0047DC97D8EC71455F5DF0"> <enum>(B)</enum> <text>in the text preceding subparagraph (A), by inserting <quote>has attained the age of 6 and</quote> after <quote>an individual who</quote>;</text> </subparagraph> 
<subparagraph id="H0BE8D85C40664BAEB6243333E8603012"> <enum>(C)</enum> <text>in subparagraph (A), by striking <quote>the 12-month period</quote> and inserting <quote>the 24-month period</quote>;</text> </subparagraph> <subparagraph id="H23CB6591215D40E29B44940EC8D9EB26"> <enum>(D)</enum> <text>by redesignating subparagraphs (A) through (C) as clauses (i) through (iii), respectively, and adjusting the margins accordingly;</text> </subparagraph> 
<subparagraph id="HDFE33F55292840A0890F83578CF8F386"> <enum>(E)</enum> <text>by striking <quote>The State plan</quote> and inserting:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H0570748C0A2B424CA832DFF6D9C5D55C"> <subparagraph id="H1BFEFEEBFCF8420899C320FCA6A1BFC4"> <enum>(A)</enum> <header>Children under age 6</header> <text display-inline="yes-display-inline">The State plan (or waiver of such State plan) shall provide that an individual who is under the age of 6 and who is determined to be eligible for benefits under a State plan (or waiver of such plan) approved under this title under subsection (a)(10)(A) shall remain eligible for such benefits until the earlier of—</text> 
<clause commented="no" id="H918ADF3BB0174959BF98B6B8D9E49F92"> <enum>(i)</enum> <text>the time that such individual attains the age of 6; or</text> </clause> <clause id="H32B682855735497AB65023AFD4C77B7D"> <enum>(ii)</enum> <text>the date that such individual ceases to be a resident of such State.</text> </clause> </subparagraph> 
<subparagraph id="H21D68C0B751F4C968178D50AFF337A90"> <enum>(B)</enum> <header>Children ages 6 through 18</header> <text>The State plan</text> </subparagraph> <after-quoted-block>; and</after-quoted-block> </quoted-block> </subparagraph> <subparagraph id="H0C136E6F2ED640F0BD063C3F93BD2283"> <enum>(F)</enum> <text>by adding at the end the following new subparagraph:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H56C4488B5FDE4124A0C39AA1B39BA195"> 
<subparagraph commented="no" id="H7C4D5D0D101044ABAD3E3C51677C3BBC"> <enum>(C)</enum> <header>Former foster youth</header> <text display-inline="yes-display-inline">The State plan (or waiver of such State plan) shall provide that an individual who is determined to be eligible for benefits under a State plan (or waiver of such plan) approved under this title under subsection (a)(10)(A)(i)(IX) shall remain eligible for such benefits until the earlier of—</text> <clause commented="no" id="H4BC95C21EA4D450F96CF02BC543C6E9B"> <enum>(i)</enum> <text>the time that such individual attains the age of 26; or</text> </clause> 
<clause commented="no" id="HF516B1E7484C43299FCC6CBC0FD2BFAA"> <enum>(ii)</enum> <text>the date that such individual ceases to be a resident of such State.</text> </clause> </subparagraph> <after-quoted-block>.</after-quoted-block> </quoted-block> </subparagraph> </paragraph> <paragraph id="H0F2995BF16484C1387C765972D9E0F1D"> <enum>(2)</enum> <header>CHIP</header> <text display-inline="yes-display-inline">Section 2107(e)(1)(L) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397gg">42 U.S.C. 1397gg(e)(1)(L)</external-xref>), as redesignated by section 71103(b)(1) of <external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref>, is amended—</text> 
<subparagraph id="H7EC031717FFD4345BABFBBDE5998DE12"> <enum>(A)</enum> <text>by striking <quote>1 year of</quote>; and</text> </subparagraph> <subparagraph id="HD8B72CC7D64B4B8A9A8EB0312500AF6D"> <enum>(B)</enum> <text>by striking <quote>12-month</quote> and inserting <quote>applicable</quote>.</text> </subparagraph> </paragraph> </subsection> 
<subsection commented="no" id="H178C984EFF4B45A58D3C52D439730854"> <enum>(c)</enum> <header>Updating contact information during continuous eligibility period</header> 
<paragraph commented="no" id="H5C18F4F2CA9D44BAB1D778F04D8E6B27"> <enum>(1)</enum> <header>Medicaid</header> <text>Section 1902(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)</external-xref>), as amended by sections 71103(a)(1) and 71104 of <external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref>, is amended—</text> <subparagraph commented="no" id="H6E79405D64AF4AE2B5893F274F0040BB"> <enum>(A)</enum> <text>in paragraph (88), by striking <quote>and</quote> at the end;</text> </subparagraph> 
<subparagraph commented="no" id="H0E57E4550A0642669DCFADE6DCAFC0CB"> <enum>(B)</enum> <text>in paragraph (89), by striking the period at the end and inserting <quote>; and</quote>; and</text> </subparagraph> <subparagraph commented="no" id="HB343ECACB5884DF5AFB52C0A2D11B81F"> <enum>(C)</enum> <text>by inserting after paragraph (89) the following new paragraph:</text>

<paragraph commented="no" id="H4EAD9CA700E84DC8B11D1247F9D59E86"> <enum>(90)</enum> <text display-inline="yes-display-inline">provide for a process—</text> <subparagraph id="H24A5CE8EAE6F41608DDFBD263E7B73BF"> <enum>(A)</enum> <text>to obtain, not less frequently than annually, the up-to-date contact information for individuals enrolled under such plan (or a waiver of such plan) who have been so enrolled for a period of longer than 12 months pursuant to a continuous eligibility provision under this title; and</text> </subparagraph> 
<subparagraph id="H36572D591F214AD18F06065402417D6F"> <enum>(B)</enum> <text>to inform each such individual of their enrollment under such plan (or waiver) pursuant to such continuous eligibility provision and of the remaining duration of the applicable period of continuous eligibility.</text> </subparagraph> </paragraph> <after-quoted-block>.</after-quoted-block> </quoted-block> </subparagraph> </paragraph> <paragraph commented="no" id="H9B9E7767B82942F5B633C4FAB914818A"> <enum>(2)</enum> <header>CHIP</header> <text display-inline="yes-display-inline">Section 2107(e)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397gg">42 U.S.C. 1397gg(e)(1)</external-xref>), as amended by sections 71103(b)(1) and 71109(b) of <external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref>, is amended—</text> 
<subparagraph commented="no" id="HDCCECEBD068A4CDB939925F5912AF7A1"> <enum>(A)</enum> <text>by redesignating subparagraphs (I) through (W) as subparagraphs (J) through (X), respectively; and</text> </subparagraph> <subparagraph commented="no" id="H01512DF5702540B4A6A99703470F52B3"> <enum>(B)</enum> <text>by inserting after subparagraph (H) the following new subparagraph:</text>

<subparagraph commented="no" id="H953AA6A7C5E34581B696114FE1806D3C"> <enum>(I)</enum> <text display-inline="yes-display-inline">Section 1902(a)(90) (relating to the verification of contact information and provision of information regarding enrollment during a period of continuous eligibility).</text> </subparagraph> <after-quoted-block>.</after-quoted-block> </quoted-block> </subparagraph> </paragraph> </subsection> <subsection id="HE41C0DA10C5A445FB73C450F75FB671C"> <enum>(d)</enum> <header>Effective date</header> <text display-inline="yes-display-inline">The amendments made by this section shall take effect on the date that is 1 year after the date of the enactment of this section.</text> </subsection> </section> 
<section id="H99B89AB8C03543389735C82053CAC00D"> <enum>3.</enum> <header>Adjusting application of provision providing coverage continuity for former foster children up to age 26 under Medicaid</header> <text display-inline="no-display-inline">Section 1002(a)(2) of the SUPPORT for Patients and Communities Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref> note) is amended by striking <quote>shall take effect with respect to</quote> and all that follows through the period at the end and inserting the following:</text> <quoted-block style="OLC" display-inline="yes-display-inline" id="HD7044C946599487BBB3E5D147BFFC0AA"> <text>shall apply—</text> 
<subparagraph id="HBFC81DAB563349C18C41799C6449E574"> <enum>(A)</enum> <text display-inline="yes-display-inline">beginning January 1, 2023, with respect to foster youth who attain 18 years of age on or after such date; and</text> </subparagraph> <subparagraph id="H8221CE7D55444119BF325D9A9EDBEC85"> <enum>(B)</enum> <text>beginning on the date that is 180 days after the date of enactment of the Keep Kids Covered Act, with respect to foster youth not described in subparagraph (A).</text> </subparagraph> <after-quoted-block>.</after-quoted-block> </quoted-block> </section>
