determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XXVII of the Public Health Service Act, the Employee Retirement Income Security Act of 1974, the Internal Revenue Code of 1986, and the Patient Protection and Affordable Care Act to require coverage of hearing devices and systems in certain private health insurance plans, and for other purposes.</official-title></form><legis-body id="H4A241BB589114D228F3564359E9D7BC2" style="OLC"><section id="HC40CF7D1DFCE434C950385EE96AC84A1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ally’s Act</short-title></quote>.</text></section><section id="HAB64541C19E5491482E9BEC9A09911A7"><enum>2.</enum><header>Coverage of hearing devices and systems in certain private health insurance plans</header><subsection id="H1B2F4CD4ADC84D2B92EAE8E9587A51A5"><enum>(a)</enum><header>PHSA</header><text display-inline="yes-display-inline">Part D of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-111">42 U.S.C. 300gg–111 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="H25ECF09EE2E3404684CFC97E84EACF13" style="OLC"><section id="H3AF1D41DD76E43CCA2E97C941FDEE99F"><enum>2799A–11.</enum><header>Coverage of hearing devices and systems</header><subsection display-inline="no-display-inline" id="HE6CB897F40FD4825AF82B060E2B90386"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A group health plan and a health insurance issuer offering group or individual health insurance coverage shall at a minimum provide coverage for the following items and services furnished to a qualifying individual (as defined in subsection (d)):</text><paragraph id="H6C20951520AE4435BFA5A629727AF99C"><enum>(1)</enum><text display-inline="yes-display-inline">Auditory implant devices (including auditory osseointegrated (bone conduction) implants and cochlear implants) and external sound processors.</text></paragraph><paragraph id="H5FAB7BC594AA4312B1CB134AFFC0E717"><enum>(2)</enum><text display-inline="yes-display-inline">The maintenance of auditory implant devices and external sound processors described in paragraph (1).</text></paragraph><paragraph id="H779180E917144E5484EAC4FC3E92100E"><enum>(3)</enum><text display-inline="yes-display-inline">Every 5 years, the upgrade (or replacement if an upgrade is not available) of auditory implant devices and external sound processors described in paragraph (1).</text></paragraph><paragraph id="HD6118AE9FA514274A0498962A7562DAC"><enum>(4)</enum><text display-inline="yes-display-inline">Adhesive adapters and softband headbands.</text></paragraph><paragraph id="H07B5F4901D5441229D78475DC3390AEB"><enum>(5)</enum><text display-inline="yes-display-inline">The repair of auditory implant devices and external sound processors described in paragraph (1).</text></paragraph><paragraph id="H9361CF7804A54F41A8F187EECCB10924"><enum>(6)</enum><text display-inline="yes-display-inline">A comprehensive hearing assessment.</text></paragraph><paragraph id="HED9A024020F944A7B68A178B16E204C0"><enum>(7)</enum><text>A preoperative medical assessment.</text></paragraph><paragraph id="H2A6A8799200A456AADB0944A9D009385"><enum>(8)</enum><text>Surgery relating to the furnishing of such devices and processors (as determined necessary by a physician or qualified audiologist (as such terms are defined for purposes of subsection (d)) treating such individual).</text></paragraph><paragraph id="HA620FFB2128C42A5B85E01F4C98BBCE1"><enum>(9)</enum><text>Postoperative medical visits for purposes of ensuring appropriate recovery from such surgery.</text></paragraph><paragraph id="HD88F8988D7BB4DFE86E298488D8E8301"><enum>(10)</enum><text display-inline="yes-display-inline">Postoperative audiological visits for activation and fitting of such devices and processors.</text></paragraph><paragraph id="HA070B0884C7B4F53A3CA2DADC3009873"><enum>(11)</enum><text>Aural rehabilitation and treatment services (as so determined necessary).</text></paragraph></subsection><subsection id="H49BFB98929DD404682BB416D06635950"><enum>(b)</enum><header>Coverage requirements</header><text display-inline="yes-display-inline">In the case of an item or service described in subsection (a) furnished to a qualifying individual under a group health plan or group or individual health insurance coverage, such plan or coverage shall ensure that—</text><paragraph id="HC094E7813C404BE0A16DEB507B470209"><enum>(1)</enum><text display-inline="yes-display-inline">the financial requirements (as defined in section 2726(a)(3)) applicable to such item or service are no more restrictive than the predominant financial requirements applied to substantially all medical and surgical benefits covered by the plan or coverage (as applicable), and that there are no separate cost sharing requirements that are applicable only with respect to such item or service; and</text></paragraph><paragraph id="H5820A5158E6E40609C2F7BFD31BC7F2C"><enum>(2)</enum><text display-inline="yes-display-inline">the treatment limitations (as defined in such section) applicable to such item or service are no more restrictive than the predominant treatment limitations applied to substantially all medical and surgical benefits covered by the plan or coverage (as applicable), and that there are no separate treatment limitations that are applicable only with respect to such item or service.</text></paragraph></subsection><subsection id="H8717531D1EC84352A6F2AEC6D9A6491E"><enum>(c)</enum><header>Prohibition on review of medical necessity</header><text display-inline="yes-display-inline">A group health plan and a health insurance issuer offering group or individual health insurance coverage may not deny or otherwise limit coverage of any item or service described in subsection (a) where such item or service has been determined to be medically necessary by a physician or qualified audiologist (as such terms are defined in subsection (d)).</text></subsection><subsection id="H9E4BA18BA0E74A208B13AC1E9AF34F8D"><enum>(d)</enum><header>Qualifying individual defined</header><text display-inline="yes-display-inline">For purposes of this section, the term <quote>qualifying individual</quote> means an individual that a physician (as defined in section 1861(r) of the Social Security Act) or qualified audiologist (as defined in section 1861(ll)(4)(B) of such Act) determines meets an indication (including unilateral or bilateral hearing loss) for an auditory implant device and external sound processor described in subsection (a)(1).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H60303F8125124CD299D6FF564FABF866" display-inline="no-display-inline"><enum>(b)</enum><header>ERISA</header><paragraph id="H71398270F80A483AA7099C9A11763F0D"><enum>(1)</enum><header>In general</header><text>Subpart B of part 7 of subtitle B of title I of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1185">29 U.S.C. 1185 et seq.</external-xref>) by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="HE1942075931A4EDBB13D05C327289514" style="OLC"><section id="H77C93D0EE9C34DC585747FE56A52DBE2"><enum>726.</enum><header>Coverage of hearing devices and systems</header><subsection display-inline="no-display-inline" id="H4F53050ECAD64AC9B43A668D23779437"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A group health plan and a health insurance issuer offering group health insurance coverage shall at a minimum provide coverage for the following items and services furnished to a qualifying individual (as defined in subsection (d)):</text><paragraph id="H50A666DFC14846D48DFB8905DFFAC4D0"><enum>(1)</enum><text display-inline="yes-display-inline">Auditory implant devices (including auditory osseointegrated (bone conduction) implants and cochlear implants) and external sound processors.</text></paragraph><paragraph id="HF72115C852AD45CF962ADC91E48DD862"><enum>(2)</enum><text display-inline="yes-display-inline">The maintenance of auditory (1).</text></paragraph><paragraph id="H1BD237BFDB7F4363882B54CD5388A394"><enum>(4)</enum><text display-inline="yes-display-inline">Adhesive adapters and softband id="H79A395D13A344292A82A78BF7FC48C2F"><enum>(8)</enum><text display-inline="yes-display-inline">Surgery relating to the furnishing of such devices and processors (as determined necessary by a physician or qualified audiologist (as such terms are defined for purposes of subsection (d)) treating such individual).</text></paragraph><paragraph id="H6DD4E5A5FE80439081C55B1BA4FBF197"><enum>(9)</enum><text>Postoperative medical visits for purposes of ensuring appropriate recovery from such surgery.</text></paragraph><paragraph id="H6554AE917A404758827380F51CEEE37D"><enum>(10)</enum><text display-inline="yes-display-inline">Postoperative audiological visits for activation and fitting of such devices and processors.</text></paragraph><paragraph id="HD2FE083ADA1A42FAA047C14CA2214A4B"><enum>(11)</enum><text>Aural rehabilitation and treatment services (as so determined necessary).</text></paragraph></subsection><subsection id="H78D9270BBAF84FAEBCF736282DA45957"><enum>(b)</enum><header>Coverage requirements</header><text display-inline="yes-display-inline">In the case of an item or service described in subsection (a) furnished to a qualifying individual under a group health plan or group health insurance coverage, such plan or coverage shall ensure that—</text><paragraph id="H00FB26C7FA394A0B86AD078096923BD5"><enum>(1)</enum><text display-inline="yes-display-inline">the financial requirements (as defined in section 2726(a)(3) of the Public Health Service Act) applicable to such item or service are no more restrictive than the predominant financial requirements applied to substantially all medical and surgical benefits covered by the plan or coverage (as applicable), and that there are no separate cost sharing requirements that are applicable only with respect to such item or service; and</text></paragraph><paragraph id="H5343BCFB5BAA4F1E8AE35DB71FDD7718"><enum>(2)</enum><text display-inline="yes-display-inline">the treatment limitations (as defined in such section) applicable to such item or service are no more restrictive than the predominant treatment limitations applied to substantially all medical and surgical benefits covered by the plan or coverage (as applicable), and that there are no separate treatment limitations that are applicable only with respect to such item or service.</text></paragraph></subsection><subsection id="H60660866FF354EC4B96B7098151B94C0"><enum>(c)</enum><header>Prohibition on review of medical necessity</header><text display-inline="yes-display-inline">A group health plan and a health insurance issuer offering group health insurance coverage may not deny or otherwise limit coverage of any item or service described in subsection (a) where such item or service has been determined to be medically necessary by a physician or qualified audiologist (as such terms are defined in subsection (d)). </text></subsection><subsection id="HA0FA8A20D2D742719A5149BA932E4E8F"><enum>(d)</enum><header>Qualifying individual defined</header><text display-inline="yes-display-inline">For purposes of this section, the term <quote>qualifying individual</quote> means an individual that a physician (as defined in section 1861(r) of the Social Security Act) or qualified audiologist (as defined in section 1861(ll)(4)(B) of such Act) determines meets an indication (including unilateral or bilateral hearing loss) for an auditory implant device and external sound processor described in subsection (a)(1).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H1BCB6A3EEC9948F6B6B4B89EFAA69F4E"><enum>(2)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents in section 1 of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1001">29 U.S.C. 1001 et seq.</external-xref>) is amended by inserting after the item relating to section 725 the following new item:</text><quoted-block style="OLC" id="H0BCB8840EF404288B88FC0BD8456A999" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 726. Coverage of hearing devices and systems.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H283BE69C6BA14FC1ABDF3D08388983D8" display-inline="no-display-inline"><enum>(c)</enum><header>IRC</header><paragraph id="H148881B2939B45599B54268CFAD9D234"><enum>(1)</enum><header>In general</header><text>Subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/100">chapter 100</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="HCFFBB92AA34941D3BEA3AD4C80AF77C3" style="OLC"><section id="H0443A2C5B7AA449288FD6D1DC7059BF8"><enum>9826.</enum><header>Coverage of hearing devices and systems</header><subsection display-inline="no-display-inline" id="H75ED19B9168E46149E52593E5F7E307B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A group health plan shall at a minimum provide coverage for the following items and services furnished to a qualifying individual (as defined in subsection (d)):</text><paragraph id="HED2D5A66D37F41F48CDE8EA0E16E9251"><enum>(1)</enum><text display-inline="yes-display-inline">Auditory implant devices (including auditory osseointegrated (bone conduction) implants and cochlear implants) and external sound processors.</text></paragraph><paragraph id="HB90B2A8ABCC64E63BFDF15F48D7934F8"><enum>(2)</enum><text display-inline="yes-display-inline">The maintenance of auditory implant devices and external sound processors described in paragraph (1).</text></paragraph><paragraph id="H3643F91D1C3F46EDB99AD530C39B85BC"><enum>(3)</enum><text display-inline="yes-display-inline">Every 5 years, the upgrade (or replacement if an upgrade is not available) of auditory implant devices and external sound processors described in paragraph (1).</text></paragraph><paragraph id="H7EB4400C392943CC93EC7CC6477ECCD5"><enum>(4)</enum><text display-inline="yes-display-inline">Adhesive adapters and softband headbands.</text></paragraph><paragraph id="H3D9EB24B3024409A846C1EC96A04E076"><enum>(5)</enum><text display-inline="yes-display-inline">The repair of auditory implant devices and external sound processors described in paragraph (1).</text></paragraph><paragraph id="HABDE7131FF9F485A8A47B0036F333F08"><enum>(6)</enum><text display-inline="yes-display-inline">A comprehensive hearing assessment.</text></paragraph><paragraph id="H271184EC9C8843D69C7651AFA6BFD654"><enum>(7)</enum><text>A preoperative medical assessment.</text></paragraph><paragraph id="HB750D47E35B8416CA4E3A21A85F685F2"><enum>(8)</enum><text display-inline="yes-display-inline">Surgery relating to the furnishing of such devices and processors (as determined necessary by a physician or qualified audiologist (as such terms are defined for purposes of subsection (d)) treating such individual).</text></paragraph><paragraph id="HC4F111EFF09B47FCAFE23577AE44940E"><enum>(9)</enum><text>Postoperative medical visits for purposes of ensuring appropriate recovery from such surgery.</text></paragraph><paragraph id="H6D95A30C0733423BA4649DDC6FE5D4D8"><enum>(10)</enum><text display-inline="yes-display-inline">Postoperative audiological visits for activation and fitting of such devices and processors.</text></paragraph><paragraph id="HD2BFA6001D17497AA187F6BBEFCD328B"><enum>(11)</enum><text>Aural rehabilitation and treatment services (as so determined necessary).</text></paragraph></subsection><subsection id="H0D5308D1BC964F7D8EF500EEBB74A5FA"><enum>(b)</enum><header>Coverage requirements</header><text display-inline="yes-display-inline">In the case of an item or service described in subsection (a) furnished to a qualifying individual under a group health plan, such plan shall ensure that—</text><paragraph id="H53F56BB84415401E9599E9BBE0994626"><enum>(1)</enum><text display-inline="yes-display-inline">the financial requirements (as defined in section 2726(a)(3) of the Public Health Service Act) applicable to such item or service are no more restrictive than the predominant financial requirements applied to substantially all medical and surgical benefits covered by the plan, and that there are no separate cost sharing requirements that are applicable only with respect to such item or service; and</text></paragraph><paragraph id="H2C3537CFAA8D4D15BEF02DB0953947EA"><enum>(2)</enum><text display-inline="yes-display-inline">the treatment limitations (as defined in such section) applicable to such item or service are no more restrictive than the predominant treatment limitations applied to substantially all medical and surgical benefits covered by the plan, and that there are no separate treatment limitations that are applicable only with respect to such item or service.</text></paragraph></subsection><subsection id="H6447CF9771AD4A57AD7DEAA94559E3A7"><enum>(c)</enum><header>Prohibition on review of medical necessity</header><text display-inline="yes-display-inline">A group health plan may not deny or otherwise limit coverage of any item or service described in subsection (a) where such item or service has been determined to be medically necessary by a physician or qualified audiologist (as such terms are defined in subsection (d)).</text></subsection><subsection id="HC2C9C7F38B1B40BB978BAB002116EC2F"><enum>(d)</enum><header>Qualifying individual defined</header><text display-inline="yes-display-inline">For purposes of this section, the term <quote>qualifying individual</quote> means an individual that a physician (as defined in section 1861(r) of the Social Security Act) or qualified audiologist (as defined in section 1861(ll)(4)(B) of such Act) determines meets an indication (including unilateral or bilateral hearing loss) for an auditory implant device and external sound processor described in subsection (a)(1).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HE5BE90A6195140DFB049D4EDE12A2796"><enum>(2)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/100">chapter 100</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after the item relating to section 9825 the following new item:</text><quoted-block style="OLC" id="HF961938B0D8D44ADA78BE216EF603EE4" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section" bold="off">Sec. 9286. Coverage of hearing devices and systems.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H745279623AAF4421A6E93A9EFFF3CFCE"><enum>(d)</enum><header>Application to grandfathered health plans</header><text display-inline="yes-display-inline">Section 1251(a)(4)(A) of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18011">42 U.S.C. 18011(a)(4)(A)</external-xref>) is amended—</text><paragraph id="H1DA30A537A744A5CB7D68914394976AF"><enum>(1)</enum><text>by striking <quote>title</quote> and inserting <quote>title, or as added after the date of the enactment of this Act)</quote>; and</text></paragraph><paragraph id="H89FE8677873D4817A3B406A0EDADB8D6"><enum>(2)</enum><text>by adding at the end the following new clause:</text><quoted-block display-inline="no-display-inline" id="H1D5B284334FA41DE9F487BA33894DF12" style="OLC"><clause commented="no" id="HB5E7A733D7574511B01ADF43198D3E34"><enum>(v)</enum><text display-inline="yes-display-inline">Section 2799A–11 (relating to hearing devices and systems).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H7F432E05AAF647DD94DC50BBA47E2EC3"><enum>(3)</enum><header>Effective date</header><text>The amendments made by this subsection shall apply with respect to plan years beginning on or after January 1, 2026.</text></paragraph></subsection></section></legis-body></bill>
