<section id="H04901CE0F017447BB8FC17976F2F8D88" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Defending American Property Abroad Act of 2025</short-title></quote>.</text></section> <section id="HC3A9A51FD7514918A8AEDD89B2577045"><enum>2.</enum><header>Identification and prohibitions with respect to property nationalized or expropriated by certain foreign governments</header> <subsection id="HC713F3B3080B49288D8E937C39C4A628"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H9D0A35D7A4AA432CBA5934B497845ABA"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text> <subparagraph id="HD9CC2F869F8A4655AB44F5A234CC8542"><enum>(A)</enum><text>the Committee on Homeland Security and Governmental Affairs, the Committee on Foreign Relations, the Committee on Finance, and the Select Committee on Intelligence of the Senate; and</text></subparagraph> 
<subparagraph id="HDF8DE03D016144808B7120CEF0897029"><enum>(B)</enum><text>the Committee on Homeland Security, the Committee on Foreign Affairs, the Committee on Ways and Means, and the Permanent Select Committee on Intelligence of the House of Representatives.</text></subparagraph></paragraph> <paragraph id="H8BF7B8554E7A416D920AA222C888A897"><enum>(2)</enum><header>Covered foreign trade partner</header><text>The term <term>covered foreign trade partner</term> means a country in the Western Hemisphere that has in effect a free trade agreement with the United States.</text></paragraph> 
<paragraph id="H6D06E07CC4104725A7C21B06B96B0FF9"><enum>(3)</enum><header>Passenger vessel</header><text>The term <term>passenger vessel</term> means a vessel that—</text> <subparagraph id="HC48E667FF9B841B1AA918523CB2B37C2"><enum>(A)</enum><text>is authorized to carry 149 or more passengers;</text></subparagraph> 
<subparagraph id="H9EAD6E0602FB4DD895A16500B20E4292"><enum>(B)</enum><text>has onboard sleeping facilities for each passenger;</text></subparagraph> <subparagraph id="H175A274AD81E4DD5A5A57EE1CACD88A6"><enum>(C)</enum><text>is on a voyage that embarks or disembarks passengers; and</text></subparagraph> 
<subparagraph id="H51420C42B42A42DF8221F9B0E4053F71"><enum>(D)</enum><text>is not engaged in a coastwise voyage subject to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/105">chapter 105</external-xref> of title 46, United States Code.</text></subparagraph></paragraph> <paragraph id="H23C3B0C722FF4D23B564B7167C94A960"><enum>(4)</enum><header>Prohibited property</header><text display-inline="yes-display-inline">The term <term>prohibited property</term> means any port, harbor, or marine terminal, including any relevant port infrastructure—</text> 
<subparagraph id="H6184AE3E782942D6A1B48C476E62F71F"><enum>(A)</enum><text>that is located within the territory of a covered foreign trade partner;</text></subparagraph> <subparagraph id="H6F40F362C5DC406085D94B306A5A537A"><enum>(B)</enum><text>that is accessible only through land that is owned, held, or controlled, directly or indirectly, by a United States person; and</text></subparagraph> 
<subparagraph id="HDF5763BEB70041B689022397E191EDEF"><enum>(C)</enum><text>if an agency or official of the government of the covered foreign trade partner has, on or after January 1, 2024—</text> <clause id="H946D31E777644F29820E4CA91FBB834E"><enum>(i)</enum><text display-inline="yes-display-inline">nationalized, forcibly limited, or expropriated the land described in subparagraph (B);</text></clause> 
<clause id="H63813376754549588354C9A50B8743C8"><enum>(ii)</enum><text>repudiated or nullified any contract, permit, concession, easement, or similar authorization with a United States person related to that land; or</text></clause> <clause id="H6521757162AF43CAA20F29D912D48DE5"><enum>(iii)</enum><text display-inline="yes-display-inline">taken any other action that has the effect of seizing ownership or control of that land.</text></clause></subparagraph></paragraph> 
<paragraph id="H59FA9801A1704C8E8EE4CAB0AC010B68" commented="no"><enum>(5)</enum><header>Relevant port infrastructure</header><text>The term <term>relevant port infrastructure</term> means the following infrastructure at a port or harbor:</text> <subparagraph id="H01E0C8F4F7C94BD49FC088ADC5F95F05" commented="no"><enum>(A)</enum><text>Conveyors and other equipment used to load or unload freight or passenger vessels.</text></subparagraph> 
<subparagraph id="H43E8A556130A46D584492BE2A33CBAF9" commented="no"><enum>(B)</enum><text>Roads and pathways used to load or unload freight or passenger vessels.</text></subparagraph> <subparagraph id="HA30056E283AC471294E78D280BF74059" commented="no"><enum>(C)</enum><text>Docks and piers used to load or unload freight or passenger vessels.</text></subparagraph> 
<subparagraph id="H17EB24C94A854FD9B911649F0D0EBEE2" commented="no"><enum>(D)</enum><text>Moorings, dolphins, or other structures used for anchoring freight or passenger vessels.</text></subparagraph> <subparagraph id="H149CB4A3599742E5B9F83CDCC4CFEC11" commented="no"><enum>(E)</enum><text>Silos, domes, or other structures used for the storage of any good, ware, article, merchandise, or other freight.</text></subparagraph> 
<subparagraph id="H700A47825C9A4D9A95C76C7B69E5F67C" commented="no"><enum>(F)</enum><text>Offices, facilities, and other buildings used for the administration and security of the port or harbor.</text> </subparagraph></paragraph> <paragraph id="HB0C9D3D215EA4459A5DBB496541CADC1"><enum>(6)</enum><header>United states</header><text>The term <term>United States</term> includes the 50 States, the District of Columbia, and any territory or possession of the United States.</text></paragraph> 
<paragraph id="H22C1FC5C924F4DBEAADBFEC342EDFA9A"><enum>(7)</enum><header>United states person</header><text>The term <term>United States person</term> means—</text> <subparagraph id="H37CD55380CC64A918C2085E02FEC23D0"><enum>(A)</enum><text>a United States citizen or an alien lawfully admitted for permanent residence to the United States; or</text></subparagraph> 
<subparagraph id="H8361E1B85EE241019537C707FD53A5FA"><enum>(B)</enum><text>an entity not less than 50 percent of the ownership interest in which is owned by United States citizens.</text></subparagraph></paragraph></subsection> <subsection id="HC2C931565DBA44E5A19E7D59734BF04D"><enum>(b)</enum><header>Designation of prohibited property</header><text>Not later than 60 days after the date of the enactment of this Act, the Secretary of Homeland Security, in consultation with and with the concurrence of the Secretary of the Treasury and the Secretary of State, shall—</text> 
<paragraph id="HA6253F4FA14E4D2CA04ACF729F0559E0"><enum>(1)</enum><text>identify and designate all prohibited property;</text></paragraph> <paragraph id="H08CBABC88C1245C1A1720BD004F7E0DD"><enum>(2)</enum><text>provide a list of all prohibited property designated under paragraph (1) to—</text> 
<subparagraph id="H9E29D12B0B644EC09A491BA8A99E984B"><enum>(A)</enum><text>the agencies and officials within the Department of Homeland Security, the Department of the Treasury, and the Department of State responsible for the implementation of subsection (c); and</text></subparagraph> <subparagraph id="HA7BBCB4209FA42359D2100A83E10CED3"><enum>(B)</enum><text>the appropriate congressional committees; and</text></subparagraph></paragraph> 
<paragraph id="H8EE70EE3ED1C43D2BF756E3F9FBED08B"><enum>(3)</enum><text>publish the list required under paragraph (2) in the Federal Register.</text></paragraph></subsection> <subsection id="HF45229E7159B423CBA5488C4712B109E"><enum>(c)</enum><header>Prohibitions on use of prohibited property</header><text display-inline="yes-display-inline">The President shall prohibit any vessel loaded or previously held at a port, harbor, or marine terminal that is designated as prohibited property under subsection (b)(1) from—</text> 
<paragraph id="H504DC96EFC29467C9A097BABE66B2501"><enum>(1)</enum><text>importing into the United States any good;</text></paragraph> <paragraph id="H82E850A779CA487EB192F4868AEBBAB9"><enum>(2)</enum><text>releasing into the United States any good;</text></paragraph> 
<paragraph id="HC731148E933941E995A5B5C8C0396E8B"><enum>(3)</enum><text>docking any passenger vessel in the United States;</text></paragraph> <paragraph id="H718C9CCF8E604B72A9A21FEB1AC1DE9B"><enum>(4)</enum><text>releasing into the United States any passenger from a passenger vessel; or</text></paragraph> 
<paragraph id="H4FE5F60D60D1446A89E63C97ABBCA079"><enum>(5)</enum><text>dry docking, completing repair work, refurbishing, victualing, refueling, or conducting any other servicing or maintenance-related activities.</text></paragraph></subsection></section> <section id="HF2140B9B3B814BAE84443C5689CA8819"><enum>3.</enum><header>Expansion of acts, policies, and practices that are unreasonable or discriminatory under title iii of the trade act of 1974</header><text display-inline="no-display-inline">Section 301(d)(3)(B) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2411">19 U.S.C. 2411(d)(3)(B)</external-xref>) is amended—</text> 
<paragraph id="HE75AA408DF924D969727D1C0E1D45C13"><enum>(1)</enum><text>in clause (iii)(V), by striking <quote>, or</quote> and inserting a comma;</text></paragraph> <paragraph id="H695F526B74E1463FA22736EF73F5BC5A"><enum>(2)</enum><text>by moving clause (iv) 2 ems to the left;</text></paragraph> 
<paragraph id="HE4512737B61B49D3A724349B3ED04B6D"><enum>(3)</enum><text>in clause (iv), by striking the period at the end and inserting <quote>, or</quote>; and</text></paragraph> <paragraph id="HE62B53985DC7434B9E9FC071CAB09BD8"><enum>(4)</enum><text>by adding at the end the following:</text> 
<quoted-block id="HBA47CB9654C7468E8A8A9C242C9AC545" style="OLC"> 
<clause id="H49F31E8D08A6400B85262F9183A13CE6"><enum>(v)</enum><text>constitutes, with respect to the assets of a United States person—</text> <subclause id="H3814B9F91DF64A48AA742A835E99B88B"><enum>(I)</enum><text>direct or indirect expropriation or nationalization,</text></subclause> 
<subclause id="H50C4679ECAB14C15BFB37D1A681D0718"><enum>(II)</enum><text>arbitrary or capricious treatment,</text></subclause> <subclause id="HEBAE5E73F5EB45EBA4BF5CAB47B794B9"><enum>(III)</enum><text>denial of due process, or</text></subclause> 
<subclause id="H155345A59FA44F5287DA86E449E6B378"><enum>(IV)</enum><text>discrimination on the basis of nationality.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> </legis-body></bill>
