<section id="HE9530C3CEA5B4034BC5DF18629F1BCED" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Dillon’s Law</short-title></quote>.</text></section> <section id="HCA86648B26F74E51ADC471221DCE572F"><enum>2.</enum><header>Preference for States that allow trained individuals to administer epinephrine at schools</header> <subsection id="H46AAE50EA941409582CF67AFBDF23587"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 399L(d) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280g">42 U.S.C. 280g(d)</external-xref>) is amended—</text> 
<paragraph id="H51E57CAB354D4B278BD8F6E748BBB3F2"><enum>(1)</enum><text>in paragraph (1)(F)—</text> <subparagraph id="H7D7B022D835546E9950D4B960ADDCACE"><enum>(A)</enum><text display-inline="yes-display-inline">in the subparagraph heading, by striking <quote><header-in-text level="subparagraph" style="OLC">School personnel</header-in-text></quote> and inserting <quote><header-in-text level="subparagraph" style="OLC">Trained personnel</header-in-text></quote>;</text></subparagraph> 
<subparagraph id="H6AFD1F9A88D14CE899273068491ABA06" display-inline="no-display-inline"><enum>(B)</enum><text>in the heading for clause (ii), by striking <quote><header-in-text level="clause" style="OLC">school</header-in-text></quote> and inserting <quote><header-in-text level="clause" style="OLC">trained</header-in-text></quote>; and</text></subparagraph> <subparagraph id="H381B4DF6C2C64D85BB1D54340374828B"><enum>(C)</enum><text>by adding at the end the following:</text>

<clause id="H2EF16CF2A2324954B0DAB548F7C7BFF5"><enum>(iv)</enum><header>Special rule</header><text display-inline="yes-display-inline">For purposes of this subparagraph, an elementary school or secondary school in a State may treat an individual who is not an employee of the school as being part of the trained personnel of the school if—</text> <subclause id="HB8A61AFBD0494E7DB2D4C819ECD2243B"><enum>(I)</enum><text display-inline="yes-display-inline">the individual meets the requirements of paragraph (3)(E); and</text></subclause> 
<subclause id="HC792C08C04FF4A23A5B79956A1A52C6B"><enum>(II)</enum><text display-inline="yes-display-inline">the State attorney general reaffirms the certification of the State under subparagraph (G), taking into account the treatment of individuals authorized by this clause.</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph></paragraph> <paragraph id="H4ABB7E5A0AB24F79AAE118395FD0E0C3"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3)(E), in the matter preceding clause (i), by striking <quote>, such as the school nurse</quote>.</text></paragraph></subsection> 
<subsection id="H7139C52B8E554F498F14D0B1DAE1825C"><enum>(b)</enum><header>Epinephrine delivery systems</header><text display-inline="yes-display-inline">Section 399L(d)(3)(C) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280g">42 U.S.C. 280g(d)(3)(C)</external-xref>) is amended by striking <quote>auto-injectable epinephrine</quote> and inserting <quote>epinephrine delivery systems</quote>.</text> </subsection> <subsection id="H0CDC4060319B46A88377FEA516E5B38D"><enum>(c)</enum><header>Correction</header><text display-inline="yes-display-inline">Section 399L(d)(1)(F)(i) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280g">42 U.S.C. 280g(d)(1)(F)(i)</external-xref>) is amended by striking <quote>schoolin</quote> and inserting <quote>school in</quote>.</text> </subsection></section>
