R. 455</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250115">January 15, 2025</action-date><action-desc><sponsor name-id="S001214">Mr. Steube</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Higher Education Act of 1965 to prohibit the awarding of Federal funds to institutions of higher education that employ instructors funded by the Chinese Communist Party, and for other purposes.</official-title></form><legis-body id="H581F14737DB340FEB15F170A0D09F51C" style="OLC"><section id="HBF4F16E89A144D50AB061BC7A4A5CA3C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Higher Education from Foreign Threats Act</short-title></quote>. </text></section><section id="HE93BB12F04CB431A92EC7E737DEBE4F9"><enum>2.</enum><header>Prohibition on employment of instructors funded by the Chinese Communist Party</header><text display-inline="no-display-inline">Title I of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001 et seq.</external-xref>) is amended by inserting after section 117 the following:</text><quoted-block style="OLC" id="H4E841FF45458447EA9E4004EF8731F55" display-inline="no-display-inline"><section id="H6B7C8F27151B486BA1DEA57687CD2B02"><enum>117a.</enum><header>Prohibition on employment of instructors funded by the Chinese Communist Party</header><subsection id="H7373E70508D745118502668C6CCD327F"><enum>(a)</enum><header>Restriction on eligibility</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, no institution of higher education shall be eligible to receive funds or any other form of financial assistance under any Federal program for an award year in which the institution employs an CCP-funded instructor.</text></subsection><subsection id="H2C97832A426B4174BB93A232E63F0CB9"><enum>(b)</enum><header>Resumption of eligibility</header><text display-inline="yes-display-inline">An institution of higher education that loses eligibility to receive funds for an award year as described in subsection (a) may regain eligibility to receive such funds in a subsequent award year by demonstrating, to the satisfaction of the Secretary, that the institution no longer employs a CCP-funded instructor.</text></subsection><subsection id="H516FE949B4EB47BE88EF779EFD63947B"><enum>(c)</enum><header>CCP-Funded instructor defined</header><text>In this section, the term <term>CCP-funded instructor</term> means a professor, teacher, or any other individual who—</text><paragraph id="H1C189D247FBC421FA1ACB890E224F397"><enum>(1)</enum><text>provides instruction directly to the students of an institution of higher education; and</text></paragraph><paragraph id="H495C0522349C4A6EBD5D47DDFBEFEF12"><enum>(2)</enum><text display-inline="yes-display-inline">received funds, directly or indirectly, from the Chinese Communist Party while employed by such institution.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HBE2FD3B0FED449CBA2FF8451EEA5FA97"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendment made by section 2 shall take effect 180 days after the date of the enactment of this Act.</text></section></legis-body></bill>
