R. 4554</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250721">July 21, 2025</action-date><action-desc><sponsor name-id="S001214">Mr. Steube</sponsor> (for himself, <cosponsor name-id="M000194">Ms. Mace</cosponsor>, <cosponsor name-id="M001212">Mr. Moore of Alabama</cosponsor>, and <cosponsor name-id="M001240">Mr. McDowell</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title VII of the Civil Rights Act of 1964 to prohibit discrimination against employees on the basis of expression that describes, asserts, or reinforces the binary or biological nature of sex.</official-title></form><legis-body id="H867B42D254954847AB2E7C6C367A8912" style="OLC"><section id="H901CD5BFA3E34C0EA8892B13227CE93A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restoring Biological Truth to the Workplace Act</short-title></quote>.</text></section><section id="HB68D37797DBE461B85EF82F8B3696FC0"><enum>2.</enum><header>Prohibited unlawful employment action</header><text display-inline="no-display-inline">Section 703 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-2">42 U.S.C. 2000e–2</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD004A1869EF44B26B837B26C81C28E74"><subsection id="HD3EAD9F8F9714D388BAF7450276F42F6"><enum>(o)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H380DDA31457E4574941DF0447DE9BACA"><enum>(1)</enum><text>It shall be an unlawful employment practice for an employer to take an action described in subsection (a) because an employee engages in covered expression, that describes, asserts, or reinforces the binary or biological nature of sex. For purposes of this paragraph, the term <quote>covered expression</quote> means expression, inside or outside of a workplace, through means including speech, writing, or a depiction, or owning or using an item that contains speech, writing, or a depiction, and includes the use of pronouns. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE87489DF7C344DAFB89BD3C17EF42CCC" indent="up1"><enum>(2)</enum><text>It shall be an unlawful employment practice for an employer to take an action described in subsection (a) because an employee requests or uses a single-sex area that is a bathroom, changing area, or other area where physical privacy is desirable.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7564B64D56FF482D9C10DE933CE6EB95" indent="up1"><enum>(3)</enum><text>It shall not be a defense to the use of a practice described in paragraph (1) or (2) that use of the practice is job related for the position in question or consistent with business necessity.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H685658F317F54D19A67F8010D5C6A4F0"><enum>3.</enum><header>Prohibited retaliation</header><text display-inline="no-display-inline">Section 704(a) of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-3">42 U.S.C. 2000e–3(a)</external-xref>) is amended by inserting <quote>, including an unlawful employment practice prohibited under section 703(o)</quote> after <quote>by this title</quote>.</text></section></legis-body></bill>
