<section id="HC4790CEC08184EB1B1F4ECD2A17AF74A" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Freedom from Improper Regulation and Enforcement Act</short-title></quote> or <quote><short-title>FIRE Act</short-title></quote>.</text></section> 
<section id="H5A23656EF1D14561B86C5EB1A29695C0"><enum>2.</enum><header>Prohibitions relating to capacity-based restrictions on firearm magazines</header> 
<subsection id="HB024F585665C42689A706DC162EF3101"><enum>(a)</enum><header>Federal restrictions</header><text>Section 926 of title 18, United States Code, is amended by adding at the end the following:</text> <quoted-block style="OLC" id="H68FA0ACDA08E4D1484DEECA7105A04E0" display-inline="no-display-inline"> <subsection id="H4211857FA2704067AB4F827ECDA3F226"><enum>(d)</enum><text display-inline="yes-display-inline">An officer or employee of the Federal Government may not prescribe or enforce any regulation that imposes any limitation or prohibition in relation to a firearm magazine based on the capacity of the magazine.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HDCC306BF9EE24EBF8429EBF6D91F070D"><enum>(b)</enum><header>State and local restrictions</header><text>Section 927 of such title is amended—</text> <paragraph id="H86ABD21E732C41DE9A126B79107C57C1"><enum>(1)</enum><text>by inserting <quote>(a)</quote> before <quote>No</quote>; and</text></paragraph> 
<paragraph id="H94EF012A772844FF9F3638D5AFFEBE57"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H99BC3EE702294D008ECDE0343C7D0CB1"> <subsection id="HA80282338D0F4AA2959195B92C95F98A"><enum>(b)</enum><text display-inline="yes-display-inline">A State or local law that imposes any limitation, prohibition, or penalty in relation to a firearm magazine based on the capacity of the magazine shall have no force or effect.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H6F4BC738BCE1446BA64E943E9BDACD0E"><enum>(c)</enum><header>Firearm magazine defined</header><text>Section 921(a) of such title is amended by adding at the end the following:</text> <quoted-block style="OLC" id="HF596E37C10234AB490F6F3F0A5FF0EF4" display-inline="no-display-inline"> <paragraph id="HF01D1D4F4F9344379B82103FE1188890" indent="up1"><enum>(39)</enum><text display-inline="yes-display-inline">The term <term>firearm magazine</term> means a fixed or detachable device used to store and feed ammunition into a firearm. The term <term>capacity</term> means, with respect to a firearm magazine, the number of rounds of ammunition that can be stored in the magazine.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF322BCE931574F8BA7B7EC207DB1D5DF"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to conduct engaged in 30 or more days after the date of the enactment of this Act.</text></subsection> </section> </legis-body></bill>
