<section id="H59B782B9FE3D4B3BB67F5A1076453F13" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fit for Duty Act</short-title></quote>.</text> </section> <section id="HEA7132C358D340E888FAC63258EFDF23"><enum>2.</enum><header>Military fitness bonus pay</header> <subsection id="H831013F9FA964DD2AA03FF783394A5A2"><enum>(a)</enum><header>Findings; Sense of Congress</header> <paragraph id="H68FE52AD1307493CAEAC351C34B8716A"><enum>(1)</enum><header>Findings</header><text>Congress finds the following:</text> 
<subparagraph id="H4EF9F3D34ACA40BBB817AAE698099E0E"><enum>(A)</enum><text display-inline="yes-display-inline">Physical fitness is a critical component of military readiness, ensuring that members of the Armed Forces can meet the physical demands of their duties in both training and combat environments.</text></subparagraph> <subparagraph id="H535D80F479444B9D84E42F789C423420"><enum>(B)</enum><text>According to the Department of Defense, musculoskeletal injuries related to poor physical fitness are among the leading causes of non-deployability and medical discharge in the Armed Forces, costing the military billions in healthcare expenses annually.</text></subparagraph> 
<subparagraph id="H50EB4F9C6CC241F6859D397616E1E509"><enum>(C)</enum><text>A 2022 Department of Defense report found that approximately 77 percent of young Americans are ineligible for military service, with obesity being one of the primary disqualifying factors.</text></subparagraph> <subparagraph id="H1C5E4C7179204081831A7BBB37E91458"><enum>(D)</enum><text>Data from the Army Public Health Center indicates that excess body fat and poor cardiovascular fitness are linked to lower performance in physically demanding tasks, increased risk of injury, and higher attrition rates in basic training and beyond.</text></subparagraph> 
<subparagraph id="HDE26E243764B45D899A964343892AC64"><enum>(E)</enum><text>According to the Centers for Disease Control and Prevention, the prevalence of obesity among active-duty members of the Armed Forces increased from 10.4 percent in 2012 to 17.4 percent in 2022, negatively affecting overall force readiness and deployability.</text></subparagraph> <subparagraph id="H95F06F17A468441BB5918BEC9DAF74A0"><enum>(F)</enum><text>The United States Armed Forces lose an estimated $1,500,000,000 annually due to obesity-related health issues, including lost workdays, medical costs, and early separations from service.</text></subparagraph> 
<subparagraph id="H36A85383106242978447245043B3DAC3"><enum>(G)</enum><text>The implementation of incentive-based fitness programs have been shown to enhance motivation and readiness and reduce long-term healthcare expenditures within military populations.</text></subparagraph></paragraph> <paragraph id="HA65F646E78DF48868E7E8ACA5282C663"><enum>(2)</enum><header>Sense of Congress</header><text>It is the sense of Congress that fostering a culture of physical excellence among members of the Armed Forces strengthens individual and unit readiness and reinforces the ability of the United States to project power and defend freedom across the globe as the premier military force in the world.</text></paragraph></subsection> 
<subsection id="H6BDD399F994741F982A623F35A90B65C"><enum>(b)</enum><header>Establishment of Bonus</header><text display-inline="yes-display-inline">Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/37/5">chapter 5</external-xref> of title 37, United States Code, is amended by adding at the end the following new section:</text> <quoted-block style="USC" id="HDB979361928F4FA89D219C7A6D4221A3" display-inline="no-display-inline"> <section id="HB91AD92BD44A4014AA5A74C74163DE29"><enum>358.</enum><header>Military fitness bonus pay</header> <subsection id="H60F93C6093944318B6E11D02D608A808"><enum>(a)</enum><header>Availability of Bonus</header> <paragraph id="H7971ADA0900543CDB82AB6D839D67DB2"> <enum>(1)</enum> <header>In general</header> <text>The Secretary concerned shall pay a fitness bonus to each member of the Armed Forces who—</text>
                <subparagraph id="H469A3B4A78E2408D8C777A2E1BE45502">
                  <enum>(A)</enum>
 <text>is entitled to basic pay under section 204 of this title; and</text> </subparagraph> <subparagraph id="HBD5D0C17AD2F446C93691D17640EB695"> <enum>(B)</enum> <text>achieves a score of 90 percent or higher on a physical fitness test, as determined by the Secretary concerned.</text>
                </subparagraph>
              </paragraph> 
<paragraph id="HDA5EDD3DADD2448F9B0AA4CBA49F3A0A">
                <enum>(2)</enum>
                <header>Recurring availability</header>
 <text>A bonus under this section shall be available for each physical fitness test the Secretary concerned requires a member of the Armed Forces to complete.</text>
              </paragraph> </subsection> 
<subsection id="HE0561647E9A04C8187ACC9CF9D28E3E0"><enum>(b)</enum><header>Amount of Bonus</header><text>The amount of a bonus paid under this section shall be—</text> <paragraph id="H6C34E3DD7A3343F59EA553A47A7FE37B"> <enum>(1)</enum> <text>$1,000 with respect to a member of the Armed Forces who achieves a perfect score on a physical fitness test; and</text>
              </paragraph> 
<paragraph id="H17E4078D87774472A595181F04886359">
                <enum>(2)</enum>
 <text>$500 with respect to a member of the Armed Forces who—</text> <subparagraph id="H8187649BCCBD4D0997021E53CFD97534"> <enum>(A)</enum> <text>does not achieve a perfect score on a physical fitness test; and</text>
                </subparagraph>
                <subparagraph id="H9478ABDCE9C3458C8E826C2BFACF8387">
                  <enum>(B)</enum>
 <text>achieves a score of 90 percent or higher on such physical fitness test.</text>
                </subparagraph>
              </paragraph></subsection> 
<subsection id="H6A58B1593B50456CA699506A0EAF887F"><enum>(c)</enum><header>Annual Report</header><text>Not later than December 31 of each year, each Secretary concerned shall submit to the congressional defense committees a report that includes, with respect to the preceding fiscal year—</text> <paragraph id="HAECFCC89BB2D4A0881DC631E3D0C0B3B"><enum>(1)</enum><text>the total number of bonuses awarded under this section by the Secretary concerned;</text></paragraph> 
<paragraph id="HB2FF9B5BEC9C4A7BB37289534934275E"><enum>(2)</enum><text>the number of bonuses awarded under this section by the Secretary concerned for a perfect score on a physical fitness test;</text></paragraph> <paragraph id="HAA7A876D19D34879A2E896B190F7DD7B"><enum>(3)</enum><text>the number of bonuses awarded under this section by the Secretary concerned for a non-perfect score of 90 percent or higher on a physical fitness test;</text></paragraph>

                <enum>(4)</enum>
 <text>the number of members of the Armed Forces to whom the Secretary concerned awarded a bonus under this section;</text>
              </paragraph> 
<paragraph id="H8DF21BFEF8F940159C29CD6EECB87BEA">
                <enum>(5)</enum>
 <text>the total cost of carrying out this section for members of the Armed Forces under the jurisdiction of the Secretary concerned; and</text>
              </paragraph> 
<paragraph id="HE30FE9D6048D4FD58B4454F992534C45">
                <enum>(6)</enum>
 <text>a description of the impact of this section, if any, on the military readiness of the members of the Armed Forces under the jurisdiction of the Secretary concerned.</text>
              </paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HB61653A56EA64F0C9108C56C8A280974"><enum>(c)</enum><header>Exclusion from Income Tax</header> 
<paragraph id="H16A045C2D95B4B5BAC620DC4756A2E0C"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/134">Section 134(b)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text> <quoted-block style="OLC" id="HEF7FE46F2EE64CF9AB8C8697903050B2" display-inline="no-display-inline"> <paragraph id="H28D8A4931828473494CA57F70D8ED9D7"><enum>(7)</enum><header>Certain bonus payments for military fitness</header><text display-inline="yes-display-inline">The term <quote>qualified military benefit</quote> includes any bonus awarded under section 358 of title 37, United States Code.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H86B7D595E0744FD589572189D5D81F40"><enum>(2)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall apply to taxable years ending after the date of the enactment of this Act.</text></paragraph></subsection></section> </legis-body></bill>
