<section id="H845B9A0FE4CC462D8CDBA5016CB17C02" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>ePermit Act</short-title></quote>.</text></section> <section id="H5754359F9BBC4E3D9739293392DEC99C" commented="no"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds that—</text> 
<paragraph id="H12DC6642A3884A64A0D48C160C01DF63" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">coordination between Federal, State, and local agencies and project sponsors is critical to ensuring the timely and effective completion of environmental reviews and authorizations, including through the sharing of relevant information, alignment of environmental review timelines, and integration of authorizations, while maintaining compliance with applicable statutory and regulatory requirements;</text></paragraph> <paragraph id="H0843A586D21F40A4BF98092591277D75" commented="no"><enum>(2)</enum><text>digital strategies for environmental reviews have proven to make the community engagement process more accessible, available, and transparent to all stakeholders, especially the communities in which new projects are built;</text></paragraph> 
<paragraph id="HE810B29C7D494ADDAAE137A981535254" commented="no"><enum>(3)</enum><text>establishing robust data architectures will ensure data integrity, improve transparency, reduce costs, and enhance the ability of the Federal Government to serve the public;</text></paragraph> <paragraph id="H8D6737691D84438ABFB841CDBF8ED9F4" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text>Federal agency use of modern software that can track the full lifecycle of environmental reviews and authorizations is critical for—</text> 
<subparagraph id="HE81A1958D75A44EEA8490F1F23672B8B"><enum>(A)</enum><text>effective project management and process improvement;</text> </subparagraph> <subparagraph id="H32843F405949474DA048B475C3737FEC"><enum>(B)</enum><text>enabling workflow automation, transparency, and tracking; and</text></subparagraph> 
<subparagraph id="HE513C0D507B04BE88C5E11C9D715EFB1"><enum>(C)</enum><text>simplifying reporting requirements;</text></subparagraph></paragraph> <paragraph id="H2422E2D9C73444A3AA3E115ED3C28811" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">modern business process management systems that track Federal agency workflows and produce interoperable event, task, and other milestone data that can be shared with other Federal agency systems can reduce costs and improve performance for Federal agencies responsible for environmental reviews and authorizations;</text> </paragraph> 
<paragraph id="H18351D66878D42E799AB9C1317080F98" commented="no"><enum>(6)</enum><text>case management systems—</text> <subparagraph id="H2B607ED090074923B70A735475DC9B8A"><enum>(A)</enum><text>are essential tools for managing the tasks and activities associated with environmental reviews and authorizations; and</text></subparagraph> 
<subparagraph id="H4A252485D45549DBB2FBA2D8E4D71EDC"><enum>(B)</enum><text>provide Federal agencies more data and insight into such environmental reviews and authorizations;</text></subparagraph></paragraph> <paragraph id="H3A71545AB04C489EBC2DEEC5D219091B" commented="no"><enum>(7)</enum><text display-inline="yes-display-inline">well-defined business rules can enable process automation that allows Federal agencies responsible for environmental reviews or authorizations to expedite routine tasks and workflows, and improve transparency and accuracy of project timeline estimates, which in turn can help project sponsors better plan for application preparation and project delivery milestones;</text></paragraph> 
<paragraph id="H3F24FE9C47A44E4BB05D0B6D0FF50BC6" commented="no"><enum>(8)</enum><text display-inline="yes-display-inline">taking a standardized, digital-first perspective to environmental reviews and authorizations at Federal agencies responsible for environmental reviews or authorizations will improve document quality, lead to more concise reports, enable the reuse and accessibility of the data underpinning Federal agency analyses and decisions, and enable objective, technology-assisted evaluation of environmental impacts, analysis, and documentation, and accelerate future environmental reviews and authorizations;</text></paragraph> <paragraph id="H7514810DF4AB422F8775AE9124E50A13" commented="no"><enum>(9)</enum><text display-inline="yes-display-inline">Federal agencies responsible for environmental reviews or authorizations, project sponsors, and the public should have access to up-to-date information on accurate timelines and the status of environmental reviews and authorizations; and</text></paragraph> 
<paragraph id="H65F52C298CCD44C99C78B612124B579A"><enum>(10)</enum><text>allowing for seamless information exchange among Federal agencies and between Federal agencies and project sponsors will increase predictability and efficiency of environmental review and authorization schedules for project sponsors.</text></paragraph> </section> <section id="HC87F2EA36E1E4A84BA55892CFA71F63B" commented="no"><enum>3.</enum><header>Establishment of data standards</header> <subsection id="H53117ADE07284A9BA50B20C2C38790A3" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Chair of the Council on Environmental Quality, in consultation with the Federal Permitting Improvement Steering Council, the Chief Information Officers Council, the Office of Management and Budget, and other relevant stakeholders and Federal agencies, shall develop, publish, and iteratively update data standards for the collection and curation of authorization data by Federal agencies, which shall be used to—</text> 
<paragraph id="H8241F7D5E8054263B52D116DC8A5E711" commented="no"><enum>(1)</enum><text>assist with environmental reviews and authorizations;</text></paragraph> <paragraph id="H7DF9F39E95EB43709AB93E0C628FD6F4"><enum>(2)</enum><text display-inline="yes-display-inline">organize, define, and standardize various concepts, formats, and protocols that are included in environmental reviews and authorizations; and</text></paragraph> 
<paragraph id="H87B666A2E9004DD0B55BFFE008232691" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">reduce the need for redundant environmental reviews by creating a shared vocabulary and software systems that will support data interoperability and automatic data exchange between Federal agencies.</text></paragraph></subsection> <subsection id="HC8C9FC1F68EB43F086478818311ED003" commented="no"><enum>(b)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The data standards developed, published, and iteratively updated under subsection (a) shall include the following:</text> 
<paragraph id="H35E8C41F5DED44448EB6FAEE2A328E23" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">A standardized taxonomy that allows Federal agencies to identify and track data types, relationships, and values.</text></paragraph> <paragraph id="H7537140AD7804BEBB56321E789F24C4B"><enum>(2)</enum><text>Comprehensive categories for data, such as—</text> 
<subparagraph id="H477A90A625C94B2B9A5502D9C81B0762"><enum>(A)</enum><text>projects;</text></subparagraph> <subparagraph id="H4B2B9D4374154AF3AE6F3A55CE2C5BCE"><enum>(B)</enum><text>processes;</text></subparagraph> 
<subparagraph id="H8696D92E54B944049C5540804C36A2A0"><enum>(C)</enum><text>environmental documents;</text></subparagraph> <subparagraph id="H80A40933F49540C5849A0E12E00850E1"><enum>(D)</enum><text>public comments;</text></subparagraph> 
<subparagraph id="HF9E1DF65DAFC4B459BD2E1698F8908C0"><enum>(E)</enum><text>geospatial information;</text></subparagraph> <subparagraph id="H50B8B67B0DF74FC1AD4C049DE4464F6A"><enum>(F)</enum><text>public engagement events, as applicable by process or Federal agency;</text></subparagraph> 
<subparagraph id="H7E3F2B76E0444FCD857AAE50A325CB0E"><enum>(G)</enum><text>case events; and</text></subparagraph> <subparagraph id="H82BF3608D9A8455FAE811FBBBA1360AD"><enum>(H)</enum><text>milestones to ensure clarity and uniformity.</text></subparagraph></paragraph> </subsection> </section> 
<section id="H322188E577FC4415A5BF45214CE632EF"><enum>4.</enum><header>Development of prototype tools</header><text display-inline="no-display-inline">The Chair of the Council on Environmental Quality, in consultation with the Administrator of General Services, the Federal Permitting Improvement Steering Council, the Chief Information Officers Council, the Director of the Office of Management and Budget, and other relevant stakeholders and Federal agencies, shall design, test, and build prototype tools for environmental reviews and authorizations that will assist Federal agencies in implementing the minimum functional requirements described in section 5. The Chair of the Council on Environmental Quality shall prioritize designing, testing, and building tools under this section that—</text> <paragraph id="HF791DE19F67D486FAA02057A03AD6445" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">support authorization case management systems that manage tasks, milestones, and activities associated with environmental reviews and authorizations, and provide Federal agencies more data and insight into such reviews and authorizations;</text></paragraph> 
<paragraph id="H9B096776F21B4BD6ADA7F6ED037A7698" commented="no"><enum>(2)</enum><text>enable application submission and tracking portals used by project sponsors, enabling greater transparency;</text></paragraph> <paragraph id="H92C70B2F2BA946F2ACD3B011CFB666C8" commented="no"><enum>(3)</enum><text>facilitate automated applications, environmental reviews. and authorizations;</text></paragraph> 
<paragraph id="HB9DE3C0000374AD89072E1238D5CDD2D" commented="no"><enum>(4)</enum><text>allow data exchange between Federal agency systems; and</text></paragraph> <paragraph id="H7BEFC81D95174C3195BCB231AF42D7B5" commented="no"><enum>(5)</enum><text>accelerate complex environmental reviews.</text></paragraph></section> 
<section id="H5F06FFB036BA493EBCCFD9B9A25A8846" commented="no"><enum>5.</enum><header>Publication of guidance for implementation of data standards and minimum functional requirements</header> 
<subsection id="H3DE5F8E2084A4B28A4F85FE8DFA95093" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header>Publication</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, the Chair of the Council on Environmental Quality shall publish guidance for how each Federal agency responsible for environmental reviews or authorizations implements—</text> <paragraph id="H13D36209F43447E68BCAD29E9748CB02" commented="no"><enum>(1)</enum><text>the data standards published under section 3; and</text></paragraph> 
<paragraph id="H1B682B60B6A54FD0A8C2A0EE14B1A515"><enum>(2)</enum><text>the following minimum functional requirements:</text> <subparagraph id="HE0F71789DD364E4AAC1779990537605D" commented="no"><enum>(A)</enum><text>Application data sharing that enables automated transfer of relevant environmental review and authorization data among Federal agencies.</text></subparagraph> 
<subparagraph id="H0FE373B639E94F638B9C5AA8C4CADA63" commented="no"><enum>(B)</enum><text>Automated project screening to assist frontline staff with reviewing project sponsor provided information for completeness and accuracy and determining if a categorical exclusion or other general authorization applies to an action. Automated project screening may not be used by the Council on Environmental Quality or a Federal agency to unlawfully restrict any activities on Federal lands.</text></subparagraph> <subparagraph id="HC636B6F52C2441DD9822F54A7CAB972E" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">Public availability of screening criteria and related decision models.</text></subparagraph> 
<subparagraph id="HB4CB68ED321942E9867C1DAF7A016CAA" commented="no"><enum>(D)</enum><text>Automated case management tools which include a repository of relevant data and metadata that enable advanced tracking, reporting, and optimization to aid workflows.</text></subparagraph> <subparagraph id="H97D46F17261646F8B2CA33CE6FCB0E21" commented="no"><enum>(E)</enum><text>Integrated geographic information system analysis tools which incorporate geospatial data layers and models for each resource analyzed as part of an environmental review or authorization for a given study area.</text></subparagraph> 
<subparagraph id="H751D876921F84F16A63431CE40965DD8" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">Document management tools that preserve metadata associated with geospatial analysis, modeling, and other analytic processes conducted during an environmental review or authorization, to support future reviews and enable Artificial Intelligence-assisted analysis of past decisions.</text></subparagraph> <subparagraph id="HBA6F02AD3ECF461B8E0B8C275FC7391A" commented="no"><enum>(G)</enum><text>Automated comment compilation and analysis tools, including services for comment categorization and response that handle the lifecycle of comment submission, analysis, categorization and response with Artificial Intelligence support where appropriate.</text></subparagraph> 
<subparagraph id="H9EB057B3B13940369D89C1E90B6DEB07" commented="no"><enum>(H)</enum><text display-inline="yes-display-inline">Administrative record management tools that maintain both portable document formats and data-rich repositories accessible to both machine and human users.</text></subparagraph> <subparagraph id="HFBC140F20A1A467295502F5E65175D3C" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">Common or interoperable Federal agency services that integrate shared services, shared applications, and common user experiences for Federal agency staff, project sponsors, and the public.</text></subparagraph></paragraph> </subsection> 
<subsection id="HF4731C7B9C564F63B51898C250FDFB1B" commented="no"><enum>(b)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The guidance published under this section shall include the following:</text> <paragraph id="HA1EB9B6DE61D472DA400D6F2E75FB940" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Guidelines for cloud-based storage, data sharing protocols, and application programming interfaces to enable the Council on Environmental Quality to work with Federal agencies to use authorization data to aid Federal agencies in modernizing their environmental reviews and authorizations and for iterative development of the authorization portal.</text></paragraph> 
<paragraph id="H82B636DEA58F4E2B9ACDFF97837AF22E" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">Provisions that support scalability and adaptability of the minimum requirements to emerging technologies.</text></paragraph></subsection> </section> <section id="HEF43DB30D3B348F19D33220CF42CFB28" commented="no"><enum>6.</enum><header>Implementation of data standards and minimum functional requirements</header> <subsection id="H545668EBC616484EB86A5C5559E71D64" commented="no"><enum>(a)</enum><header>Implementation</header><text display-inline="yes-display-inline">The head of each Federal agency responsible for environmental reviews or authorizations shall—</text> 
<paragraph id="H0342CBB0AB1747B5AD08E8AC0A21674C"><enum>(1)</enum><text>not later than 90 days after the date of enactment of this Act—</text> <subparagraph id="H9846E551C62E4A15BA0CDBC387B46E60" commented="no"><enum>(A)</enum><text>compare existing Federal agency systems for environmental reviews and authorizations with the data standards published under section 3 and the minimum functional requirements described in section 5(a)(2) and report findings from such comparison to the Council on Environmental Quality;</text></subparagraph> 
<subparagraph id="HC9195C4A4E524998894EFB8EAC9776BA" commented="no"><enum>(B)</enum><text>assess whether existing Federal agency technological capabilities are consistent with the data standards published under section 3 and the minimum functional requirements described in section 5(a)(2);</text></subparagraph> <subparagraph id="HCC0EDB29C3E2429C82CB8EA3710DB4E1" commented="no"><enum>(C)</enum><text>submit to the Council on Environmental Quality a report that estimates the completion dates for implementing the data standards published under section 3 and the minimum functional requirements described in section 5(a)(2); and</text></subparagraph> 
<subparagraph id="H04B09D215484407782C6E36D36723DE9" commented="no"><enum>(D)</enum><text>submit to the Council on Environmental Quality, in consultation with the Council on Environmental Quality, an implementation plan that—</text> <clause id="H8B5A989BF07F416B842E440A616A2D34" commented="no"><enum>(i)</enum><text>describes how the Federal agency will implement the data standards published under section 3 and the minimum functional requirements described in section 5(a)(2); and</text></clause> 
<clause id="H274FA903F7234309B3B24977FB5B6802" commented="no"><enum>(ii)</enum><text>describes how, to the extent the Federal agency determines necessary to meet relevant statutory requirements, the Federal agency will adopt or implement the prototype tools tested, designed, and built under section 4; and</text></clause></subparagraph></paragraph> <paragraph id="HA3B5A1BF11CF48AA90A257782B0650AD"><enum>(2)</enum><text>not later than 180 days after the date of enactment of this Act, begin implementing the data standards published under section 3 and the minimum functional requirements described in section 5(a)(2).</text></paragraph></subsection> 
<subsection id="H15B95230435C449CAE13056435001B64" commented="no"><enum>(b)</enum><header>Report</header><text>Not less frequently than twice each year, the Chief Information Officer of each Federal agency, in consultation with the Chief Environmental Review and Permitting Officer of each Federal agency, shall submit to the Council on Environmental Quality and the Director of the Office of Management and Budget a report on the progress of the Federal agency towards meeting the requirements of subsection (a).</text> </subsection></section> <section id="H395377E642F04001BB94061454D1900B" commented="no"><enum>7.</enum><header>Unified interagency data system</header> <subsection id="H01D15EE4D2C5425187105976B6CB7805" commented="no"><enum>(a)</enum><header>In general</header> <paragraph id="H1EF020FE76984591914D91588F1C329D"><enum>(1)</enum><header>Unified interagency data system</header><text display-inline="yes-display-inline">To the maximum extent practicable, the Chair of the Council of Environmental Quality and the head of each Federal agency responsible for environmental reviews or authorizations shall iteratively develop and maintain a unified interagency data system consisting of interconnected Federal agency systems and shared services for environmental reviews and authorizations.</text> </paragraph> 
<paragraph id="H356B732606814A938343801882CCF64E" commented="no"><enum>(2)</enum><header>Authorization portal</header> 
<subparagraph id="H4A66C0D565194C6AB4E429C7EDFEE8F4"><enum>(A)</enum><header>In general</header><text>The shared services developed and maintained under paragraph (1) shall include a common interactive, digital, cloud-based authorization portal, which shall—</text> <clause id="HE16187915CF14C23B28650F9695C354D" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">be designed in a manner consistent with—</text> 
<subclause id="HC41CB5E4A0394C168E46BB09AF2C27C7" commented="no"><enum>(I)</enum><text>the recommendations of the Council on Environmental Quality included in the study submitted pursuant to section 110 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4336d">42 U.S.C. 4336d</external-xref>) titled <quote>Council on Environmental Quality Report to Congress on the Potential for Online and Digital Technologies to Address Delays in Reviews and Improve Public Accessibility and Transparency under <external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref></quote>; and</text></subclause> <subclause id="HF425C4520ABB420A941BE7AFCE673199" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">the minimum functional requirements described in section 5(a)(2);</text></subclause></clause> 
<clause id="H8DCCA27F378B4D54966DB12ABB2B6D60" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">serve as a centralized platform for tracking and displaying real-time data on environmental reviews and authorizations made available through application programming interfaces or other reporting mechanisms from Federal agency systems that are compliant with the data standards and data architecture described in this Act;</text></clause> <clause id="H850C8D9821F24997ADC3CB463E06DE10" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">include a mechanism for the dissemination of relevant information (such as a notice of intent for public comment, public meetings, project statuses, or a notice of intent to begin an environmental review) to local communities, as applicable;</text> </clause> 
<clause id="HA7D59A5C8D2C47268275C1B6BD44262F" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">allow a project sponsor to submit all necessary documentation for environmental reviews and authorizations in one unified and secure portal;</text> </clause> <clause id="H4DE0C26B2D214A8F84D6D55DC28F38C7" commented="no"><enum>(v)</enum><text display-inline="yes-display-inline">support interactive, digital, and cloud-based tools enabling applicants to edit documents and collaborate with relevant Federal agencies in real time;</text></clause> 
<clause id="H49C47D0B26A54980A3D44A6B1C44FBCA" commented="no"><enum>(vi)</enum><text>support visual features, including video, animation, geographic information system displays, interactive maps, and three-dimensional renderings;</text></clause> <clause id="H4858A707EB864F04B5BEC90BB9D2E6ED" commented="no"><enum>(vii)</enum><text display-inline="yes-display-inline">provide for the exchange of information to and from Federal agency data systems via an application programming interface or another reporting mechanisms;</text></clause> 
<clause id="HD05D68255607415AB5EEF73FEC86A61A" commented="no"><enum>(viii)</enum><text>allow for the submission of geospatial data associated with project location, footprint, and impact;</text></clause> <clause id="H98BEAE1B8DA947E4A7B7F969BAB2764B" commented="no"><enum>(ix)</enum><text>support automatic documentation of submission and process timelines; and</text></clause> 
<clause id="H006480E53D1949579ECFAD604131A872" commented="no"><enum>(x)</enum><text>allow the following metrics to be tracked over time—</text> <subclause id="HC86A452EDB6F45D787E11E3B6E7EB5FE" commented="no"><enum>(I)</enum><text>estimates of achieved efficiencies, such as reductions in the time between receipt of applications and final authorization decisions;</text></subclause> 
<subclause id="HCA1A06CC1AD34753A8067F05A6DB6C3D" commented="no"><enum>(II)</enum><text>comparisons of authorization timelines before and after the implementation of this Act;</text></subclause> <subclause id="H3F03EFA0BF2D4218A08CDEC031225083" commented="no"><enum>(III)</enum><text>usage of the authorization portal and other statistics from the Digital Analytics Program;</text></subclause> 
<subclause id="H31B447BFC0B44AAD884D823901FAF3D0" commented="no"><enum>(IV)</enum><text display-inline="yes-display-inline">metrics on the number of public comments received, responses provided, and community meetings held;</text></subclause> <subclause id="H6A16170E1EE741238EF0640FF295C222" commented="no"><enum>(V)</enum><text display-inline="yes-display-inline">the number of projects subject to litigation based on authorization deficiencies or inefficiencies;</text></subclause> 
<subclause id="H529180F824F04B4E89551D7B2CCCD267" commented="no"><enum>(VI)</enum><text display-inline="yes-display-inline">a list of Federal agencies that are not yet fully compliant with the data standards published under section 3 and the minimum functional requirements described in section 5(a)(2), along with their progress toward compliance; and</text></subclause> <subclause id="H200B75E15E3942C698709AD9C5835CA8" commented="no"><enum>(VII)</enum><text display-inline="yes-display-inline">examples or repositories of Federal agency-developed digital workflows enabled by the implementation of this Act, including visualizations of data sharing, authorizations and decision logic, and environmental reviews.</text></subclause></clause></subparagraph> 
<subparagraph id="H806174AE55C74F5EA08C527C10BBB002" commented="no"><enum>(B)</enum><header>Administrative support</header><text display-inline="yes-display-inline">The Administrator of General Services shall host the authorization portal as a shared service for Congress, Federal agencies, and the public.</text> </subparagraph> <subparagraph id="HE0314046A9644CBAB1BFCFDEFD1C1922" commented="no"><enum>(C)</enum><header>Accessability</header><text display-inline="yes-display-inline">The authorization portal shall be accessible to Congress, Federal agencies, and the public, with appropriate safeguards to protect sensitive or classified information and information restricted by user type as appropriate.</text></subparagraph> 
<subparagraph id="H54DFFC4C5E4C42D096D3939C6BA25888" commented="no" display-inline="no-display-inline"><enum>(D)</enum><header>Public accessibility</header><text display-inline="yes-display-inline">To the extent practicable and consistent with other law, the authorization portal shall provide public access to non-sensitive data, including authorization timelines, location, project type, environmental reviews, and mitigation measures.</text></subparagraph> <subparagraph id="HDD127754CE2D416480E9E1C89C762EFB" commented="no"><enum>(E)</enum><header>Congressional access and oversight</header> <clause id="HB24A1C13A3D7419CB8C6D440F3D095A8" commented="no"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The authorization portal shall provide Congress with direct access to aggregated performance data and other analytics to enable real-time oversight of Federal agencies.</text> </clause> 
<clause id="H0C328800B1CD43C3A4AAC215906AF75A" commented="no"><enum>(ii)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">The Council on Environmental Quality shall provide to Congress technical assistance upon request to ensure effective use of the authorization portal for oversight purposes.</text></clause></subparagraph></paragraph> <paragraph id="H216E31A846C24FC8AADD3B10C6F57E1C" commented="no" display-inline="no-display-inline"> <enum>(3)</enum> <header>Cybersecurity and compliance considerations</header> <text display-inline="yes-display-inline">The authorization portal shall be designed to promote interoperability, reduce redundancy, and ensure compliance and coordination with other laws, including—</text>
          <subparagraph id="H3EFDAC4AACD74C889163E9E740380248" commented="no">
            <enum>(A)</enum>
 <text display-inline="yes-display-inline">section 552a of title 5, United States Code (commonly referred to as the Privacy Act of 1974), and subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code;</text>
          </subparagraph>
          <subparagraph id="HC104C73EB67F419E9652D2871C9722F3" commented="no">
            <enum>(B)</enum>
 <text display-inline="yes-display-inline">the Federal Risk and Authorization Management Program established under section 3608 of title 44, United States Code; and</text>
          </subparagraph>
          <subparagraph id="H47F4CDB8F8DB418F9B0121CFB56CF6EB" commented="no">
            <enum>(C)</enum>
 <text display-inline="yes-display-inline">the Cybersecurity and Infrastructure Security Agency of the Department of Homeland Security, for a case in which the project is in coordination with a Federal agency with stringent security requirements.</text>
          </subparagraph>
        </paragraph> </subsection> 
<subsection id="H835B9DD301DD4B71A9EC581B24E9F769" commented="no"><enum>(b)</enum><header>Deadlines</header> 
<paragraph id="H32F88316C9B74F248AF7F437C773A8DC" commented="no"><enum>(1)</enum><header>Shared services pilot</header><text display-inline="yes-display-inline">Not later than one year after the date of enactment of this Act, the Council on Environmental Quality shall oversee piloting of shared services for environmental reviews and authorizations, including the authorization portal under subsection (a)(2).</text></paragraph> <paragraph id="HF7D69EC4605949A59F1736F9AEC44A58" commented="no"><enum>(2)</enum><header>Unified system development and implementation</header><text display-inline="yes-display-inline">To the maximum extent practicable, not later than December 1, 2027, the Chair of the Council on Environmental Quality shall develop and implement the unified interagency data system required under subsection (a)(1).</text> </paragraph></subsection> 
<subsection id="H960274E2DC9949F78510827244C36A95" commented="no"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not less frequently than annually, the Chair of the Council on Environmental Quality, in consultation with the Federal Permitting Improvement Steering Council, the Chief Information Officers Council, and other relevant stakeholders and Federal agencies, shall submit to the Committee on Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate a report on the Council on Environmental Quality’s progress on developing a unified interagency data system under subsection (a).</text></subsection> <subsection id="H4A4AAC3C2BA24F7498A1B854EE4E4ACB" commented="no"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $1,000,000 for each of fiscal years 2026 through 2032, to remain available until expended.</text> </subsection></section> 
<section id="H25204B3C0F46408BA2E77A6839713E4C" commented="no"><enum>8.</enum><header>Authority to enter into contracts</header><text display-inline="no-display-inline">The Council on Environmental Quality may enter into contracts and other arrangements for analyses, services, and products with Federal agencies, private organizations, and businesses, and make such payments as determined necessary by the Council on Environmental Quality to carry out the provisions of this Act.</text> </section> <section id="HFAD8EDBE347C45A7B068EC92241A1112" commented="no"><enum>9.</enum><header>Clarifying rulemaking authority</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to authorize the Council on Environmental Quality or a Federal agency to impose additional regulatory processes or requirements beyond those expressly stipulated under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) or any other law.</text> </section> 
<section id="HF5B2323FF46A4CD8953495BFEA24EFD4" commented="no"><enum>10.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="HE978AB5E29D8402BB45EA970010FFD22" commented="no"><enum>(1)</enum><header>Authorization</header><text>The term <term>authorization</term> means any license, permit, approval, finding, determination, or other administrative decision issued by an agency and any interagency consultation that is required or authorized under Federal law in order to site, construct, reconstruct, or commence operations of a project administered by a Federal agency.</text> </paragraph> 
<paragraph id="H346CFDC7715E49ECB09C3BE208073B1F" commented="no"><enum>(2)</enum><header>Authorization data</header><text>The term <term>authorization data</term> means—</text> <subparagraph id="H2B85D6980D05428294B3EBB10DB3B9D7" commented="no"><enum>(A)</enum><text>any data relevant for a Federal agency to—</text> 
<clause id="H73E3884E0FC04916AE4D305763BB90BF" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">determine the effect on the environment of an action for which an authorization is required by the Federal agency; and</text> </clause> <clause id="H8E01DBC6A7F84F33B42292B7C294D251" commented="no"><enum>(ii)</enum><text>determine whether to issue such authorization; and</text></clause></subparagraph> 
<subparagraph id="H5C7BB1D2FC254F679CEF443A15BBA28A" commented="no"><enum>(B)</enum><text>any community input or public comment on such determinations.</text> </subparagraph></paragraph> <paragraph id="H90B9F0F0791E42278B0B67AF3CF000AC" commented="no"><enum>(3)</enum><header>Data architecture</header><text>The term <term>data architecture</term> means the design and organization of data systems, including frameworks for data storage, processing, and exchange.</text> </paragraph> 
<paragraph id="H36BACA3F688848C1B5296786191D7E55" commented="no"><enum>(4)</enum><header>Data standards</header><text>The term <term>data standards</term> means agreed-upon specifications for data formats, structures, and definitions to ensure consistency and interoperability.</text></paragraph> <paragraph id="H98C5192514A943EAB1FE2AB2C95CB95B" commented="no"><enum>(5)</enum><header>Environmental review</header><text display-inline="yes-display-inline">The term <term>environmental review</term> means any Federal agency procedures or processes for—</text> 
<subparagraph id="H73E3AC6245284625A32A49B43359180F" commented="no"><enum>(A)</enum><text>applying a categorical exclusion; or</text></subparagraph> <subparagraph id="H2B910381BCB447BDB1EFE264E96A203E" commented="no"><enum>(B)</enum><text>preparing an environmental assessment, an environmental impact statement, or another document required under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></subparagraph></paragraph> 
<paragraph id="HF56C9418A4A04F6595C89C161BC59E60" commented="no"><enum>(6)</enum><header>Federal agency</header><text display-inline="yes-display-inline">The term <term>Federal agency</term> has the meaning given the term <term>agency</term> in section 551 of title 5, United States Code.</text> </paragraph> <paragraph id="H8BD90073CC0D42DE89593AE500BBCD77" commented="no"><enum>(7)</enum><header>Federal Permitting Improvement Steering Council</header><text display-inline="yes-display-inline">The term <term>Federal Permitting Improvement Steering Council</term> has the meaning given the term <term>Council</term> in section 41001 of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m">42 U.S.C. 4370m</external-xref>).</text></paragraph> </section>
