which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To impose requirements with respect to monitoring the operational use of sales, exports, and transfers of defense articles and services, and for other purposes.</official-title></form><legis-body id="HCBEFAE5F1D3B498D8A401FA9C474B8F2" style="OLC"><section id="H2AF675CE9FFF471283B24A70A4292F92" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Silver Shield Operational End Use Monitoring Act of 2025</short-title></quote> or the <quote><short-title>Silver Shield Act of 2025</short-title></quote>.</text></section><section id="H9CAD2E24CF014EB1A0898D820C3C57E4"><enum>2.</enum><header>Establishment of silver shield operational end-use monitoring program</header><subsection id="HC5E55E2F78AF4113A50A78EA502EF5EF"><enum>(a)</enum><header>Establishment of operational end-Use monitoring program</header><paragraph id="H0324D43C451E4337804CE735C90FDCEC"><enum>(1)</enum><header>In general</header><text>In order to improve accountability with respect to defense articles and defense services sold, leased, transferred, or exported under the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2751">22 U.S.C. 2751 et seq.</external-xref>) or the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151">22 U.S.C. 2151 et seq.</external-xref>), not later than 1 year after the date of the enactment of this Act, the President shall establish a program, to be known as the <quote>Silver Shield</quote> program, to provide for operational end-use monitoring of such articles and services.</text></paragraph><paragraph id="HE8E655705D934308BFE21E77EA7AE190"><enum>(2)</enum><header>Requirements of program</header><text>The Silver Shield program shall—</text><subparagraph id="HBFCC07080527467B9674F07193922AE4"><enum>(A)</enum><text display-inline="yes-display-inline">be designed to monitor whether there is credible information that a recipient used defense articles or defense services from the United States to inflict civilian harm, violate international humanitarian law, or violate international human rights law;</text></subparagraph><subparagraph id="H46963C7CEB8745C6A304765B3883BC5A"><enum>(B)</enum><text display-inline="yes-display-inline">determine through operational end-use monitoring whether defense articles or defense services from the United States were used to commit—</text><clause id="HE51A9394768547F8A2553B887B43ACF6"><enum>(i)</enum><text>genocide;</text></clause><clause id="HD3F0CF3B054349CB9C28166A96E3A7F8"><enum>(ii)</enum><text>crimes against humanity;</text></clause><clause id="H41C830E628414FE18B8E27393AA4912F"><enum>(iii)</enum><text>grave breaches of the Geneva Conventions of 1949; or</text></clause><clause id="HC18FAC455D214A4A99A9DC3A6ED0403F"><enum>(iv)</enum><text>other serious violations of international humanitarian or human rights law;</text></clause></subparagraph><subparagraph id="HB3EEBB7DEF604C0F9C264B5C41F1CF71"><enum>(C)</enum><text>require a determination of ineligibility, pursuant to section 3 of the Arms Export Control Act, should a determination described in subparagraph (B) be affirmative, including a timeline of 180 days to complete such determinations on such allegations of violation;</text></subparagraph><subparagraph id="H34C7E541A7E040A29E66CCD3975F11CA"><enum>(D)</enum><text>incorporate data, best practices, and lessons learned from the implementation of—</text><clause id="H5B98B4D4E2384BC88E5FFC4909517D8F"><enum>(i)</enum><text>the Civilian Harm Incident Response Guidance;</text></clause><clause id="H71487CD241704EB4B941DDF1DFE1D54E"><enum>(ii)</enum><text>programs to carry out the requirements of section 362 of title 10, United States Code and section 620M of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2378d">22 U.S.C. 2378d</external-xref>) (collectively referred to as the <quote>Leahy Laws</quote>);</text></clause><clause id="HBD9DDEFF40C14B5D83DF213B6B02938D"><enum>(iii)</enum><text>National Security Memorandum 20;</text></clause><clause id="HF225113663CD49CA81E9A7AD3A2DA681"><enum>(iv)</enum><text>the Golden Sentry End-Use Monitoring Program; and</text></clause><clause id="HF06563667BD74CE991A05CA7ACC13E2A"><enum>(v)</enum><text>the Blue Lantern program; and</text></clause></subparagraph><subparagraph id="H1C8847D0113F4776932E98B2ADBE9585"><enum>(E)</enum><text>incorporates sources of information for monitoring including—</text><clause id="H6BB7ABB2D14E46229B87C7FD56134DAE"><enum>(i)</enum><text>reports submitted by United States Government personnel, including United States embassy, Defense Security Cooperation Agency, or combatant command personnel;</text></clause><clause id="HD8254BE19D9942DD8BE8B25CB73C23EC"><enum>(ii)</enum><text>eyewitness interviews;</text></clause><clause id="H760D28B9698D4AAE9DDEEEBA23B5B74F"><enum>(iii)</enum><text>publicly available photographic and video evidence;</text></clause><clause id="H07D18E56CA4743FBBD78E62E87192411"><enum>(iv)</enum><text>satellite imagery;</text></clause><clause id="H4512E13FE2604593A303039EC6F8548F"><enum>(v)</enum><text>credible reports by non-governmental organizations and media;</text></clause><clause id="H9EADD09DC7AA4903B69C43FD606EAA1E"><enum>(vi)</enum><text>intelligence information;</text></clause><clause id="H03D141DF0105464E8936C30C67310265" commented="no"><enum>(vii)</enum><text>information submitted through a publicly available online portal to be integrated with the Human Rights Reporting Gateway;</text></clause><clause id="HFA136CA05C6E4FF8B10CE81608F0B47E"><enum>(viii)</enum><text>relevant forensic investigations;</text></clause><clause id="HB3D7477EDF19423D834FFBCE8FD0203F"><enum>(ix)</enum><text>site visits by United States Government personnel; and</text></clause><clause id="H831E041FC89A48B89A99119EC92DD319"><enum>(x)</enum><text>any other credible sources of information regarding the use of United States origin defense articles or defense services in inflicting civilian harm or to commit a violation of international humanitarian law or international human rights law.</text></clause></subparagraph></paragraph><paragraph id="HEE47A59B2FD647EEBED6128F786D1372"><enum>(3)</enum><header>Coordination</header><text>The Silver Shield program shall be established in the Department of State and shall be implemented through coordination between the following:</text><subparagraph id="H45BA8BCFCE6B42E9AFF9482487B91F31"><enum>(A)</enum><text>The Bureau of Democracy, Human Rights, and Labor, which shall in coordination with the Bureau of Political-Military Affairs of the Department of State be responsible for directing and managing the implementation of the program.</text></subparagraph><subparagraph id="HBDE5BB2358084F90B3BD614FFFC13ECE"><enum>(B)</enum><text>The Office of the Secretary, the Defense Security Cooperation Agency, and the Civilian Protection Center of Excellence of the Department of Defense.</text></subparagraph><subparagraph id="H58DBAD705FAF482D9A878149B20EE8E0"><enum>(C)</enum><text>Any other Federal department or agency the President determines relevant to the establishment or implementation of the Silver Shield program.</text></subparagraph></paragraph><paragraph id="H4EE93E64E6BF43909E4EAD991CA91250"><enum>(4)</enum><header>Consultation</header><text>The Silver Shield program shall take such steps as may be necessary to consult as appropriate with relevant experts affiliated with federally funded research and development corporations, non-governmental organizations, and academic institutions.</text></paragraph></subsection><subsection id="HB95FD04C3FB547AB84949F15B1AD231A"><enum>(b)</enum><header>External advisory board</header><text>The President shall establish an external advisory board comprising recognized academic and non-governmental experts in investigations regarding the monitoring of the usage of defense articles or services in civilian harm or violations of international law. The heads of the agencies listed in subsection (a)(3) shall periodically consult with the external advisory board with respect to—</text><paragraph id="HEF0FDE1077364BC981FE1C438428ED6F"><enum>(1)</enum><text>research methodology;</text></paragraph><paragraph id="H0129CFADC78E4B2F8B777772CEB4B5FB"><enum>(2)</enum><text>information sources;</text></paragraph><paragraph id="H0AD63F6053DA41F6821FEB90CEDFBE9F"><enum>(3)</enum><text>investigative best practices; and</text></paragraph><paragraph id="HD4A447A2EE414E8C97F6C7E1CD4868A7"><enum>(4)</enum><text>any other such information within the expertise of the advisory board and relevant to implementation of this Act.</text></paragraph></subsection></section><section id="HD7C7E1926ECB4E22A8119775AD8B12B9"><enum>3.</enum><header>Amendments to the Arms Export Control Act</header><subsection id="HB75BDEB756BF4086BB1FD686529B4106"><enum>(a)</enum><header>Arms export control act</header><text>Section 3 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2753">22 U.S.C. 2753</external-xref>) is amended by adding at the end of the section the following—</text><quoted-block style="OLC" id="H7F1D5EDF5CBB4E4E915C6A9F7429F50B" display-inline="no-display-inline"><subsection id="H90E9810860354FCCAAE2E8D9AF533491"><enum>(h)</enum><header>Agreement relating to use of defense articles and services</header><text>In addition to any other requirements under this Act, the President shall take such steps as may be necessary to ensure that—</text><paragraph id="HA7F181B237234FEF8E6CC59FA7366AD6"><enum>(1)</enum><text display-inline="yes-display-inline">prior to authorizing or licensing the sale, export, or transfer of any defense article or defense service to a foreign country or international organization, the Secretary of State shall enter into a written agreement with the appropriate counterparts providing that the government of such country or that such international organization will not use any defense article or defense service of United States origin—</text><subparagraph id="H17391A9A978A4D148F79EAF3CA0E69C5"><enum>(A)</enum><text>to commit or facilitate a violation of international humanitarian law or international human rights law; or</text></subparagraph><subparagraph id="H0408FE2C43444708B5D88CEF4AC60855"><enum>(B)</enum><text>in an action that would render the government or organization ineligible to receive United States assistance or arms transfers as a matter of United States law; and</text></subparagraph></paragraph><paragraph id="H39605498074A4F25B7A0B10869BE12D1"><enum>(2)</enum><text display-inline="yes-display-inline">if defense articles are sold, exported, or transferred to a foreign country pursuant to an agreement otherwise in accordance with the requirements of this Act in which the intended end-user has not been identified at the unit level for purposes of the vetting required by section 362 of title 10, United States Code or section 620M of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2378d">22 U.S.C. 2378d</external-xref>), the written agreement required by paragraph (1) for such sale, export, or transfer shall instead include a list of units ineligible to receive such articles, consistent with applicable provisions of United States law.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H05900DBA182E413B987BADBD75503396"><enum>(b)</enum><header>Eligibility for defense articles or services</header><paragraph id="H43CA82D04B574C18BEC449749C004A15"><enum>(1)</enum><header>Arms Export Control Act</header><text>Section 3(a) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2753">22 U.S.C. 2753(a)</external-xref>) is amended—</text><subparagraph id="HE94AB50C9DF34282A37472E666E5DF2D"><enum>(A)</enum><text>in paragraph (1), by striking <quote>and promote world peace</quote> and inserting <quote>, will promote world peace and the safety of civilians,</quote>;</text></subparagraph><subparagraph id="HB790CB67F1294AB581353C9EECB44F28"><enum>(B)</enum><text>in paragraph (3), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="H861F6A10263649D8B584EA8957391C9A"><enum>(C)</enum><text>by redesignating paragraph (4) as paragraph (5); and</text></subparagraph><subparagraph id="H0BE39686EEE74D6A93AF1943C05621EB"><enum>(D)</enum><text>by inserting after paragraph (3) the following new paragraph:</text><quoted-block id="HC71E2F538F374BBCA2802AF28C6E00F0" style="OLC"><paragraph id="H6339C7B56E964B2CBFFAB97AF1700090"><enum>(4)</enum><text>the country or international organization shall have agreed not to use such article or service to commit or facilitate a serious violation of international humanitarian law or international human rights law; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HAFE78C83D9084FBD9E5EEC50C3FD90BD"><enum>(2)</enum><header>Foreign Assistance Act of 1961</header><text>Section 505 of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2314">22 U.S.C. 2314</external-xref>) is amended—</text><subparagraph id="HE80EC262054F4C788386AECA97ED6A2C"><enum>(A)</enum><text>in subsection (a)—</text><clause id="H9211E6F947294E4593F420FFC63652F3"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>(a) <header-in-text level="subsection" style="traditional">Conditions of eligibility</header-in-text></quote> and all that follows through the matter preceding paragraph (1) and inserting the following:</text><quoted-block style="OLC" id="H62774202812C48398944A0A378B5BF6B" display-inline="no-display-inline"><subsection id="H31D8845E8A444A36BFE0B91F8848B584"><enum>(a)</enum><header>Conditions of eligibility</header><text display-inline="yes-display-inline">In addition to such other provisions as the President may require, no defense articles or related training or other defense service shall be furnished to any country or international organization on a grant basis unless it shall have agreed that—</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="H5105F45B1A4F42FCB3B89B9290DF3927"><enum>(ii)</enum><text>in paragraph (3), by striking <quote>; and</quote> and inserting a semicolon;</text></clause><clause id="HCCB3656BEF66453AB7298B1711203E3B"><enum>(iii)</enum><text>by redesignating paragraph (4) as paragraph (5); and</text></clause><clause id="HAE29F21AB9B340A0A8CA3CC32D543F26"><enum>(iv)</enum><text>by inserting after paragraph (3) the following new paragraph:</text><quoted-block id="H8B952DF3C99044D8B2A968A79EDE228E" style="OLC"><paragraph id="H0EE6CDD4A0A44609A4C770D084C8CCF9"><enum>(4)</enum><text>it will not use such articles or services to commit or facilitate a serious violation of international humanitarian law or international human rights law; and</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H91A3332839F9421681CB6AF19CAA7269"><enum>(B)</enum><text>in subsection (e), by striking <quote>subsection (a)(1) or (a)(4)</quote> each place it appears and inserting <quote>subsection (a)(1) or (a)(5)</quote>.</text></subparagraph></paragraph></subsection><subsection id="H3707647E05CA4AFAB7D3B075AE497030"><enum>(c)</enum><header>Authorized purpose for military sales</header><text>Section 4 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2754">22 U.S.C. 2754</external-xref>) is amended—</text><paragraph id="H428673C94BEE482DAEC71B3E705DEFC7"><enum>(1)</enum><text>by inserting <quote>legitimate</quote> before <quote>internal security</quote>; and</text></paragraph><paragraph id="HE883401361514503BDD5F19E0A4444A5"><enum>(2)</enum><text>by inserting <quote>, to the extent that such defense articles and defense services will not be used in the commission of a serious violation of international humanitarian law or international human rights law. The violation of international humanitarian law or international human rights law may not be construed to be an authorized purpose for military sales or leases by the United States.</quote> after <quote>such friendly countries</quote>.</text></paragraph></subsection><subsection id="HFFFC6D6B24AC483FB119CC171E4796DE"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall take effect 1 year after the date of the enactment of this Act.</text></subsection><subsection id="HE5E3FD36A97D49349C007CA8B820A919"><enum>(e)</enum><header>Updates to existing policy</header><paragraph id="HB32CECD333D44377951C2E03BE100B24"><enum>(1)</enum><header>Secretary of State</header><text>The Secretary of State shall—</text><subparagraph id="HCC6B7ECEB85647B7A426DBB6D38EF27D"><enum>(A)</enum><text>subsume the Civilian Harm Incident Response Guidance into the requirements of this Act to carry out the Department’s operational end-use monitoring responsibilities; and</text></subparagraph><subparagraph id="H0864ABDECDFE409299607C5178732AFF"><enum>(B)</enum><text>review other relevant policy and doctrine and, as necessary, amend any such policy or doctrine to ensure consistency with such amendments and to carry out such responsibilities.</text></subparagraph></paragraph><paragraph id="HAD89BF3605B24A268573C499DA603322"><enum>(2)</enum><header>Secretary of Defense</header><text>The Secretary of Defense shall—</text><subparagraph id="H192CDCF53BB842F9B4830F0B6D76651B"><enum>(A)</enum><text display-inline="yes-display-inline">reissue Department of Defense Instruction 4140.66 to ensure consistency with the amendments made by this Act to carry out the Department’s operational end-use monitoring responsibilities; and</text></subparagraph><subparagraph id="HF493364E56194AD9A0F4A7CB1460ECC0"><enum>(B)</enum><text display-inline="yes-display-inline">review other relevant policy and doctrine and, as necessary, amend any such policy or doctrine to ensure consistency with such amendments and to carry out such responsibilities.</text></subparagraph></paragraph></subsection></section><section id="H1931B3ACF5DB4184A3ADB3C2324FFF01"><enum>4.</enum><header>Authorization of appropriations</header><subsection id="HFACBDA978F4C4A83A229E49A416A1899"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">There is authorized to be appropriated such sums as may be necessary to implement the Silver Shield program described in section 2.</text></subsection><subsection id="H8AC8822BEF9D4C87B459D050CB3E7C00"><enum>(b)</enum><header>Application of foreign military sales administrative surcharge</header><text>The Silver Shield program shall be considered an administrative service of the administration of sales made pursuant to section 21(e)(1) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2761">22 U.S.C. 2761</external-xref>).</text></subsection><subsection id="HDD1DD1B90F17494D88D790E1106114D1"><enum>(c)</enum><header>Application of foreign military financing administrative funds</header><text>The Silver Shield program shall be considered an administrative and operational cost of the Department of State related to military assistance and sales pursuant to funds authorized to carry out title IV of the annual Acts making appropriations for the State Department, Foreign Operations, and Related programs (relating to the heading Foreign Military Financing program).</text></subsection></section><section id="H866E8BAECE74471B8429274E30B44573"><enum>5.</enum><header>Reports</header><subsection id="HB75DE834289D4AB5B0AB7721B20120AA"><enum>(a)</enum><header>Report on required resources</header><text display-inline="yes-display-inline">Not later than 180 days after the enactment of this Act, the Secretary of State shall submit to the appropriate congressional committees a report on the necessary resources, staffing, and authorities to implement the Silver Shield program and requirements described in section 2(a).</text></subsection><subsection id="HA47AEC98F975412D957A678200426688"><enum>(b)</enum><header>Annual implementation report</header><text>Not later than 1 year after the establishment of the program required by section 2, and annually thereafter as a part of the annual congressional presentation documents submitted under section 634 of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2394">22 U.S.C. 2394</external-xref>), the President shall submit to the appropriate congressional committees a report describing the actions taken to implement this Act and the amendments made by this Act, including the following:</text><paragraph id="H5564FF6695154E338D3097C1682A07B1"><enum>(1)</enum><text>A detailed accounting of the costs and number of personnel associated with the Silver Shield program.</text></paragraph><paragraph id="H746D733909464806BFDBFC2C7E24078E"><enum>(2)</enum><text>Resource constraints associated with the implementation of the program, including staffing, funding, and authorities.</text></paragraph><paragraph id="HD035C426734D4B6BA4B6B200B4D2F972"><enum>(3)</enum><text>The numbers and range of operational end-use monitoring of United States arms transfers.</text></paragraph><paragraph id="HD6942E42BF734258AA49FB7F9739A30C"><enum>(4)</enum><text>The number of identified incidents for which investigations have not yet been initiated.</text></paragraph><paragraph id="HE00B0703926642F2B18ACDDD66BCF954"><enum>(5)</enum><text>The number and status of ongoing investigations, including the stage they are in, how long such incidents have remained in such stage, and if any have remained in such stage for more than 1 year.</text></paragraph></subsection></section><section id="H8BC5DE7744694EA29263746DA25DBF41"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><subsection id="H547D47A9DF914D4A8FEAEADF18E5945F"><enum>(a)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><paragraph id="H63D3D4C6B5DA4CBF8E8A7E579F0360ED"><enum>(1)</enum><text>the Committee on Foreign Affairs, the Committee on Armed Services, and the Committee on Appropriations of the House of Representatives; and</text></paragraph><paragraph id="HCB6914E9ACA04E03AB501300E20272B3"><enum>(2)</enum><text>the Committee on Foreign Relations, the Committee on Armed Services, and the Committee on Appropriations of the Senate.</text></paragraph></subsection><subsection id="H30C85BE1F97A4EEFBB9226B3292E757B"><enum>(b)</enum><header>Civilian harm</header><text>The term <term>civilian harm</term> means civilian casualties, damage to or destruction of civilian objects, and significant adverse effects on the civilian population and the personnel, organizations, resources, infrastructure, essential services, and systems on which civilian life depends resulting from military operations.</text></subsection><subsection id="H0A9099A4178D458DA572EE9264039A48"><enum>(c)</enum><header>Defense article;
