<section id="H811005BF5F40411A977EC0004B48F869" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>United States-Israel Bilateral Innovation for Research and Development in Health Act of 2025</short-title></quote> or the <quote><short-title>BIRD Health Act of 2025</short-title></quote>.</text></section> <section id="HA2D03911A88E4A09ACE3FB908331D7F8"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="HC758156942FA433287A57A96C409D121"><enum>(1)</enum><text>The Binational Industrial Research and Development Foundation (in this Act referred to as the <quote>BIRD Foundation</quote>) was established in 1977 as a joint initiative between the United States and Israel and has become a model for successful bilateral research and development collaboration.</text></paragraph> <paragraph id="H1CF7A105C01547358DD563ECFDA63C53"><enum>(2)</enum><text>Since its inception, the BIRD Foundation has approved over 1,000 projects with a total investment exceeding $500 million, generating over $10 billion in sales.</text></paragraph> 
<paragraph id="H13B0F05195C1458185F6398696644B7D"><enum>(3)</enum><text>In the past decade, approximately 30 percent of the projects approved by the BIRD Foundation have been related to health, biotechnology, life sciences, medical devices, diagnostics, and telemedicine.</text></paragraph> <paragraph id="HFC55AE3CD2A943DCABF9B00DAF975D5F"><enum>(4)</enum><text>The United States and Israel have successfully expanded the activities of the Bird Foundation into dedicated programs targeting specific industrial needs, including energy, cyber, and homeland security.</text></paragraph> 
<paragraph id="H935E1C7CA4244FB48AEA2563DA31F1ED"><enum>(5)</enum><text>The United States and Israel signed a health, medical, and scientific cooperation agreement on January 4, 2016, which is designed to foster collaboration in various health-related areas.</text></paragraph> <paragraph id="H16D0E04B59F243749790F1ECF9511B57"><enum>(6)</enum><text>In 2020, Congress allocated $2 million to establish a bilateral collaboration program with the Israel for the development of health-related technologies.</text></paragraph></section> 
<section id="H54FE401E006B4DE9886B4FE71F69EC0A"><enum>3.</enum><header>Establishment of BIRD Health Program</header> 
<subsection id="H07327F7CF44B4C08BCD3FD25241261A5"><enum>(a)</enum><header>Establishment</header>
<paragraph id="H1FA8F85F247F4C0EA130B194BE3FD25A"><enum>(1)</enum><header>In general</header><text>The Secretary of Health and Human Services shall enter into a cooperative agreement to establish a bilateral research and innovation program (in this Act referred to as the <quote>BIRD Health Program</quote>) to facilitate and coordinate efforts between the United States and Israel to expand and enhance collaboration on—</text> <subparagraph id="H89982A60EB764BC1A45C751E47DDC312"><enum>(A)</enum><text>the development of healthcare products and services; and</text></subparagraph>
<subparagraph id="HFEC225796CD74A73A585CEFA80149E54"><enum>(B)</enum><text>the delivery of such products and services to individuals in need.</text></subparagraph></paragraph> <paragraph id="HE9789EBDFB824D83B2ED71F47D4ED8E9"><enum>(2)</enum><header>Coordination</header><text>The Secretary of Health and Human Services shall carry out this subsection in coordination with the Secretary of Commerce and the Executive Director of the BIRD Foundation.</text></paragraph>
<paragraph id="HF5F8FD98A8C143CBA37A77A2D4E2036C"><enum>(3)</enum><header>Applicability of requirements</header><text>The authority provided by this subsection shall be subject to any applicable requirements of law and any applicable agreements or understandings between the United States and Israel.</text> </paragraph></subsection> <subsection id="H8429AD2E38EB40D6B3553F5F676A4C78" commented="no"><enum>(b)</enum><header>Program administration, goals, and components</header><text display-inline="yes-display-inline">The cooperation agreement referred to in subsection (a) shall provide for the following:</text> 
<paragraph id="H0980E12FF2814FF3A5EEE3D5971ACE68" commented="no"><enum>(1)</enum><header>Implementation partner</header><text display-inline="yes-display-inline">The BIRD Health Program shall be administered by the BIRD Foundation, following the same model used for United States-Israel collaborations in energy, cyber, and homeland security.</text></paragraph> <paragraph id="H59F90563184544B099ED785FF9AA88DC" commented="no"> <enum>(2)</enum> <header>Governance</header> <text>The program shall be jointly governed by representatives from the Department of Health and Human Services and the Ministry of Health of Israel, who shall actively participate in defining focus areas and selecting projects to receive funding.</text>
                </paragraph> 
<paragraph id="H5F2C14BE19314B958CAC0F97422B4737"><enum>(3)</enum><header>Program goals</header><text display-inline="yes-display-inline">The goals of the BIRD Health Program shall be—</text> <subparagraph id="H436086B3C5974D62973FD3E253B3AC9A"><enum>(A)</enum><text display-inline="yes-display-inline">to facilitate joint research and development projects between United States and Israeli institutions, companies, and academic organizations in the field of health technologies;</text></subparagraph> 
<subparagraph id="H4CD34D210E93476D8825CC36AE6F7454"><enum>(B)</enum><text display-inline="yes-display-inline">to support the commercialization and deployment of innovative healthcare products and services, including—</text> <clause id="HD306D9CC154F4AFA95B2888266B531FB"><enum>(i)</enum><text>medical devices and diagnostics;</text></clause> 
<clause id="H55F5BD508AEE404EA875AE67D5713E5E"><enum>(ii)</enum><text>pharmaceuticals and biological products;</text></clause> <clause id="HB08E62237FF84DCE8E434E3FEF172ED2"><enum>(iii)</enum><text>genomics and personalized medicine;</text></clause> 
<clause id="H3193E354875E478F880F33C17DD3261F"><enum>(iv)</enum><text>telemedicine and digital health technologies;</text></clause> <clause id="HABA3215D4ED741528F9B79C5D6EE0515"><enum>(v)</enum><text>artificial intelligence for healthcare applications;</text></clause> 
<clause id="H3E4BF34A6B434A1E8DDC01E4DE2AE659"><enum>(vi)</enum><text>infectious disease prevention;</text></clause> <clause id="HEFAF0A870E884C6EB2D0B2DE68AEAEE0"><enum>(vii)</enum><text>vaccine development; and</text></clause> 
<clause id="H1148718DF828476B8699EBE3F3A9AA5D"><enum>(viii)</enum><text>epidemiological research; and</text></clause></subparagraph> <subparagraph id="H6C3D0850A7F4446D8E551C7AD528E5AD"><enum>(C)</enum><text display-inline="yes-display-inline">to strengthen health-related ecosystems by fostering United States-Israel partnerships in healthcare technology development.</text></subparagraph></paragraph> 
<paragraph id="HBD38CCE9695F4731A37CA0E6CA69DA93"><enum>(4)</enum><header>Program components</header> 
<subparagraph id="HC082E117055F4460877F678D880C463D"><enum>(A)</enum><header>In general</header><text>The BIRD Health Program shall provide funding for the following:</text> <clause id="H2BFDC8D2A52946A9B922B8EA4D2A3B51"><enum>(i)</enum><header>Research and development</header><text display-inline="yes-display-inline">Programs and activities for research and development, including—</text> 
<subclause id="H9D22729F71D24D309748CFEFF4C2C665"><enum>(I)</enum><text display-inline="yes-display-inline">joint research projects between United States and Israeli institutions and companies;</text></subclause> <subclause id="HD2D4FAA36E924CF187D47B83B373941C"><enum>(II)</enum><text>promoting collaboration in areas such as medical device technology, pharmaceuticals (including biological products, genomics, and innovative digital health care solutions) and health care systems management (including a special focus on early-stage clinical trials);</text></subclause> 
<subclause id="HC95A06CC4AC44485ABA96A925D4EDA68"><enum>(III)</enum><text>with respect to biological products, supporting—</text> <item id="H1D5522D7CD0A4F7FA21F073E3B1E5CB9"><enum>(aa)</enum><text>innovation;</text></item> 
<item id="HB7109B94F22B4E6F9F2812FA210027C8"><enum>(bb)</enum><text>process optimization; and</text></item> <item id="H5EA2FA92C87F4B508387B3ECF43822DB"><enum>(cc)</enum><text>the development of advanced manufacturing techniques that can enhance productivity, reduce costs, and improve product quality; and</text></item></subclause> 
<subclause id="HA7E55EB06F884269AC89316AD3156CA9"><enum>(IV)</enum><text>work toward developing a framework for sharing health data for research purposes with the Ministry of Health of Israel.</text></subclause></clause> <clause id="H939657A29C194EF892E0A1952B5AF6E3"><enum>(ii)</enum><header>Innovation and startup ecosystem</header><text display-inline="yes-display-inline">Programs and activities for health-related ecosystems, including—</text> 
<subclause id="H38BF7BF60A2B48A7A7BE65F5E84DFAF1"><enum>(I)</enum><text display-inline="yes-display-inline">fostering collaboration between United States and Israeli startup companies and other companies in the healthcare sector;</text></subclause> <subclause id="HCC0358789CC947B1B6F69E56AC503F1E"><enum>(II)</enum><text>facilitating innovative technology acceptance by the marketplace;</text></subclause> 
<subclause id="H7A16AE00753C4A989A69E6F4062FCB93"><enum>(III)</enum><text>facilitating mechanisms for technology transfer and joint venture opportunities; and</text></subclause> <subclause id="H94099BBE8B564E9F96E682B5E4CD5BEF"><enum>(IV)</enum><text display-inline="yes-display-inline">supporting innovation hubs to accelerate the development and commercialization of United States healthcare technologies in the Israeli market, including encouraging cybersecurity standards for sharing data, promoting patient privacy, and encouraging research.</text></subclause></clause> 
<clause id="H0944E237A212483B93DB25C61AFDAB73"><enum>(iii)</enum><header>Health care system strengthening</header><text display-inline="yes-display-inline">Programs and activities for health care system strengthening, including facilitating sharing best practices, knowledge, and skills in areas such as clinical care and health care management.</text></clause></subparagraph> <subparagraph id="H9A80E9D6FA6E41D2A3EC3969458A602E"><enum>(B)</enum><header>Telemedicine and digital health cooperation</header><text display-inline="yes-display-inline">The BIRD Health Program shall provide funding for programs and activities for telemedicine and digital health cooperation for establishing initiatives—</text> 
<clause id="H72612408410B4131B691D1DED3EB03DA"><enum>(i)</enum><text>to enhance telemedicine infrastructure;</text></clause> <clause id="H52E1A2A9FB3B4D80B2B0CE70F2018270"><enum>(ii)</enum><text>to promote interoperability between United States and Israeli health care systems; and</text></clause> 
<clause id="H5EB124F22A4846ABA92E78A7323282D7"><enum>(iii)</enum><text>to facilitate collaboration on digital health technologies, data analytics, and cybersecurity.</text></clause></subparagraph> <subparagraph id="H5D207D48018D480E855459EE76F489BC"><enum>(C)</enum><header>Disease prevention initiatives</header><text display-inline="yes-display-inline">The BIRD Health Program shall provide funding for collaborating in disease prevention, including joint efforts to combat infectious diseases, develop vaccines, and share epidemiological data.</text></subparagraph> 
<subparagraph id="H3B031E1DC34D46BFBDDFB732E64BFA35"><enum>(D)</enum><header>Biological product manufacturing</header><text display-inline="yes-display-inline">The BIRD Health Program shall provide funding for—</text> <clause id="H6FD5878A9D0C48B28CB4C7F5564C75A1"><enum>(i)</enum><text>promoting biological product manufacturing;</text></clause> 
<clause id="H1DFABD8580634DD599AF40FE1A4963EC"><enum>(ii)</enum><text>establishing joint manufacturing facilities for biological products in facilities in the United States that leverage the strengths and expertise of both countries;</text></clause> <clause id="H2BC3117E109541819A1FCB5E9CE6570D"><enum>(iii)</enum><text>pursuing accelerated development of life-saving treatments and new sources of nutrition that are both healthier and more available at an affordable cost; and</text></clause> 
<clause id="H84DAAB7D4B1745F6B2CF987E80E660D8"><enum>(iv)</enum><text>supply chain resilience through strategic collaboration to identify and develop contingency plans to mitigate biological product supply disruptions.</text></clause></subparagraph></paragraph> <paragraph id="HA958FD7122F148EA92F322A68B67B6D2"><enum>(5)</enum><header>Project selection criteria</header><text>Projects selected for funding under the BIRD Health program shall be evaluated based on—</text> 
<subparagraph id="H8CD24D077D90415DA2A5CFD18D84A22B"><enum>(A)</enum><text>technical merit and innovation;</text></subparagraph> <subparagraph id="H86C2257C9CDF48DFAE4B662A3D0E7191"><enum>(B)</enum><text>commercial potential and economic impact;</text></subparagraph> 
<subparagraph id="HD0319BDACCB5405FAFB97ED46DD6AE3D"><enum>(C)</enum><text>relevance to health priorities identified by both governments;</text></subparagraph> <subparagraph id="H8EE7FDDC8B394BCEA75D1000A538ABD9"><enum>(D)</enum><text>strength of the United States-Israel partnership; and</text></subparagraph> 
<subparagraph id="HF17E2A199E134F45BE483A2270511826"><enum>(E)</enum><text>potential to address unmet medical needs.</text></subparagraph></paragraph></subsection> </section> <section id="H80F2851AA3B54B78962929462BE51075"><enum>4.</enum><header>Funding and implementation</header> <subsection id="H83129997041F466FAF5B503DCFBF5360"><enum>(a)</enum><header>Funding</header> <paragraph id="H1CCD51D156C048899FE925F3CBD3EB4B"><enum>(1)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary of Health and Human Services to carry out this Act $10,000,000 for each of fiscal years 2026 through 2032.</text></paragraph> 
<paragraph id="HD51D0131AFF9411B96102285E9429023" commented="no"><enum>(2)</enum><header>Administration of funds</header><text display-inline="yes-display-inline">Subject to the terms and conditions of the cooperative agreement referred to in section 3(a)(1), funds made available under this section shall be administered through the BIRD Foundation, with oversight from Secretary of Health and Human Services and the Secretary of Commerce.</text> </paragraph></subsection> <subsection id="H7A8A36666E7E49869D3B74C7831B3D02" commented="no"><enum>(b)</enum><header>Implementation timeline</header> <paragraph id="H5FA895FCA94944F6A0C836F7BA8B12EB" commented="no"><enum>(1)</enum><header>Program framework</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Health and Human Services shall submit to Congress a report on the progress made in establishing the program framework.</text></paragraph> 
<paragraph id="H353A820F8D4D40CAB49B91A37E4064D5" commented="no"><enum>(2)</enum><header>Proposals</header><text display-inline="yes-display-inline">Not later than one year after the date of establishment of the program framework, the BIRD Health Program shall begin accepting proposals and allocating funds for eligible projects.</text> </paragraph></subsection></section> <section id="H0EC6B026A8A44BABB9C8B8376F9E30F3"><enum>5.</enum><header>Reporting and evaluation</header> <subsection id="H15309AD01F4D430092DE9CFA5396708B"><enum>(a)</enum><header>Annual report to Congress</header><text display-inline="yes-display-inline">Not later than one year after the date of enactment of this Act, and annually thereafter, the Secretary of Health and Human Services shall submit to Congress an annual report detailing the establishment and implementation of the BIRD Health Program, including—</text> 
<paragraph id="H25D945879B604CECAD0FA4A73C73B3BD"><enum>(1)</enum><text>the progress of funded projects and their impact on healthcare innovation;</text></paragraph> <paragraph id="HB63D14F0BD1043E3872E9BBDD82B6236"><enum>(2)</enum><text>the economic and scientific benefits resulting from United States-Israel collaborations; and</text></paragraph> 
<paragraph id="H759DECFE6A9441AA829288D9F3B36C32"><enum>(3)</enum><text display-inline="yes-display-inline">any policy recommendations to enhance the effectiveness of the BIRD Health Program.</text></paragraph></subsection> <subsection id="H7216F6A8F0EE49FBBA4D2877D26808DC"><enum>(b)</enum><header>Program Review</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall conduct, and submit to Congress, a comprehensive review of the success of the BIRD Health Program every three years, with recommendations for renewal or expansion.</text></subsection></section> 
<section id="H524A9444240C4B5A81EBC30867812F15"><enum>6.</enum><header>Health technology defined</header><text display-inline="no-display-inline">In this Act, the term <quote>health technology</quote> includes a medical device, pharmaceutical, digital health solution, diagnostic driven by artificial intelligence, and biologic.</text></section> </legis-body></bill>
