committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to establish a recycling property investment credit, and for other purposes.</official-title></form><legis-body id="H742D10F4BAC04AF9A415928F8602FE15" style="OLC"><section id="H29F64E9A179C4C03BB7A088642DECD22" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cultivating Investment in Recycling and Circular Local Economies Act of 2025</short-title></quote> or the <quote><short-title>CIRCLE Act</short-title></quote>.</text></section><section id="H27BEFAD9778A439B9D493EDA9B2194C9"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="HC9227DABD1D54650B60D98D507C25FAD"><enum>(1)</enum><text display-inline="yes-display-inline">The national recycling goal set by the Environmental Protection Agency is 50 percent by 2030.</text></paragraph><paragraph id="H80AAB30850154BFC834A61FF84349857"><enum>(2)</enum><text display-inline="yes-display-inline">America’s recycling rate hovers around 30 percent.</text></paragraph><paragraph id="H63E4B7462FFB4D78BB16F03D237D40C7"><enum>(3)</enum><text display-inline="yes-display-inline">The establishment of a tax credit for investment in existing and new recycling infrastructure would promote recycling by facilitating modernized and upgraded recycling operations and increasing supply of domestically recycled materials.</text></paragraph><paragraph id="H1428832338634D94A3C9F65F06390E86"><enum>(4)</enum><text display-inline="yes-display-inline">New recycling infrastructure would support responsible end markets by helping to meet significant demand for domestically sourced recycled material.</text></paragraph><paragraph id="HDC4B0BF0B55B494AAAC2D0EFCB8B1489"><enum>(5)</enum><text display-inline="yes-display-inline">Domestic markets face increased competition from international actors who may dump virgin materials or not-verifiably-recycled content in United States markets, undercutting the domestic recycling economy.</text></paragraph><paragraph id="H6B574A97B19B456B93C17D9A3EBE7A8B"><enum>(6)</enum><text display-inline="yes-display-inline">It is in the best interests of the United States to fully develop our recycling capacities.</text></paragraph></section><section id="H4798182F8C5E4B519828150A4BB3D573"><enum>3.</enum><header>Recycling property investment credit</header><subsection id="HB1C0E3ABA75745B1B0027B7A517F26BB" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subpart E of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after section 48E the following new section:</text><quoted-block style="OLC" id="HBEB0E2035616455DB787D57A3BA0661C" display-inline="no-display-inline"><section id="H4710B3C4DDC64C4A8048FC87AFB6234A" commented="no"><enum>48F.</enum><header>Recycling property investment credit</header><subsection id="HE49D7FD379FA4B10A193215D4AEAB7A1" commented="no"><enum>(a)</enum><header>In general</header><text>For purposes of section 46, the recycling property investment credit for any taxable year is an amount equal to 30 percent of the qualified investment for such taxable year.</text></subsection><subsection id="HDC131C40CEAE487083AA07527CAE9DE0" commented="no"><enum>(b)</enum><header>Qualified investment</header><paragraph id="H0933A7B7A3CC4B468A38F0228EA06D44" commented="no"><enum>(1)</enum><header>In general</header><text>For purposes of subsection (a), the qualified investment for any taxable year is the basis of any eligible property placed in service by the taxpayer during such taxable year.</text></paragraph><paragraph id="HE14EF2360E5B4339AD7FD76BD48890B3"><enum>(2)</enum><header>Eligible property</header><text>For purposes of this section, the term <term>eligible property</term> means property—</text><subparagraph id="HD778011A8FDD446491FD2013AED29E60"><enum>(A)</enum><text>which is qualified recycling property,</text></subparagraph><subparagraph id="H586E23DD6A5B417A85EC0CC87AB528D8"><enum>(B)</enum><text>with respect to which depreciation (or amortization in lieu of depreciation) is allowable, and</text></subparagraph><subparagraph id="H50DD90D60EC04223AC9FF958275BEB01"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="H6A03C6D40470440D8E2753EEE783F7E7"><enum>(i)</enum><text>the construction, reconstruction, addition, or erection of which is completed by the taxpayer, or</text></clause><clause id="H7BFE031407884A17984B32470B56E8AF" indent="up1"><enum>(ii)</enum><text>which is acquired by the taxpayer if the original use of such property commences with the taxpayer.</text></clause></subparagraph></paragraph></subsection><subsection id="HBB738ACDF7D24E4CAA60357691E8BB55" commented="no"><enum>(c)</enum><header>Special rules</header><text display-inline="yes-display-inline">For purposes of this section—</text><paragraph id="HF1C149EC1C754E3AA5B67B7BA3FBE3C0" commented="no"><enum>(1)</enum><header>Certain progress expenditure rules made applicable</header><text>Rules similar to the rules of subsections (c)(4) and (d) of section 46 (as in effect on the day before the date of the enactment of the Revenue Reconciliation Act of 1990) shall apply.</text></paragraph><paragraph id="HD1309EDCAF494E9F859DB9DC588F94D8" commented="no"><enum>(2)</enum><header>Special rule for certain subsidized property</header><text>Rules similar to section 45(b)(3) shall apply.</text></paragraph><paragraph id="H94645323B6BD4CDEA9E7B5B5F9F59EEA" commented="no"><enum>(3)</enum><header>Domestic content bonus credit amount</header><subparagraph id="HE78D5F710E224558B3CC2D76DEA0279B" commented="no"><enum>(A)</enum><header>In general</header><text>In the case of any qualified investment which satisfies the requirement under subparagraph (B), the amount of the credit determined under subsection (a) (determined without regard to this paragraph before the application of subsection (d) and after the application of any other provision of this section) shall be increased by an amount equal to 10 percentage points of the amount so determined.</text></subparagraph><subparagraph id="H80200E78F6A04AB883B3E007AE968F28" commented="no"><enum>(B)</enum><header>Requirement</header><text>Rules similar to the rules of section 45(b)(9)(B) shall apply.</text></subparagraph></paragraph><paragraph id="H1A53823899E246D5A145B47A644F2ECB" commented="no"><enum>(4)</enum><header>Phaseout for elective payment</header><text>In the case of a taxpayer making an election under section 6417 with respect to a credit under this section, rules similar to the rules of section 45(b)(10) shall apply.</text></paragraph></subsection><subsection id="H9B4F6C01720246F888FBB0EE5CB8A837" commented="no"><enum>(d)</enum><header>Credit phase-Out</header><paragraph id="HF3192ED050034B88B2A62A869D6EA652" commented="no"><enum>(1)</enum><header>In general</header><text>The amount of the credit determined under subsection (a) with respect to any qualified investment shall be equal to the product of—</text><subparagraph id="H443ED866D4DA4A44B053332335487239" commented="no"><enum>(A)</enum><text>the amount of the credit determined under subsection (a) without regard to this subsection, multiplied by</text></subparagraph><subparagraph id="HD7569BF2A7C94500840497D0FA6B91E7" commented="no"><enum>(B)</enum><text>the phase-out percentage under paragraph (2).</text></subparagraph></paragraph><paragraph id="HE44EDB730B2A4A94B18F81E6C8104D63" commented="no"><enum>(2)</enum><header>Phase-out percentage</header><text>The phase-out percentage under this paragraph is equal to—</text><subparagraph id="H291546ABC02E407591D8D0F2DD4BE9EE" commented="no"><enum>(A)</enum><text>in the case of any eligible property with a determination date beginning on or after January 1, 2026, and before December 31, 2032, 100 percent,</text></subparagraph><subparagraph id="HF1F12BC6EB63437E8D6D9DB9A69E2091" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of any eligible property with a determination date beginning on or after January 1, 2033, and before December 31, 2033, 80 percent,</text></subparagraph><subparagraph id="H31BC255FCAEC41658DFBDB8018E6C7F0" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of any eligible property with a determination date beginning on or after January 1, 2034, and before December 31, 2034, 60 percent,</text></subparagraph><subparagraph id="H3739D47850B9419A8BFD41EEABE2C6E6" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">in the case of any eligible property with a determination date beginning on or after January 1, 2035, and before December 31, 2035, 40 percent,</text></subparagraph><subparagraph id="H559D3652E1B243D7B1CEC10D93EBC76D" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">in the case of any eligible property with a determination date beginning on or after January 1, 2036, and before December 31, 2036, 20 percent, and</text></subparagraph><subparagraph id="H6390148CAD744FB6AA127657A51A499B" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">in the case of any eligible property with a determination date beginning on or after January 1, 2037, 0 percent.</text></subparagraph></paragraph><paragraph id="H57B02D34C0474EE2B32BF3F48CE890D5" commented="no"><enum>(3)</enum><header>Determination date</header><text>For purposes of paragraph (2), the determination date of an eligible property is—</text><subparagraph id="HB248947C711B418D942D2B49274F36DE"><enum>(A)</enum><text display-inline="yes-display-inline">in the case such property is described in subsection (b)(2)(C)(i), the date on which the construction, reconstruction, addition, or erection of such property begins, and</text></subparagraph><subparagraph id="H8CD52548C5A04F6AA84D637B2F1026AE"><enum>(B)</enum><text>in any other case, the date on which such property is placed in service.</text></subparagraph></paragraph></subsection><subsection id="H1877225DBBAB49E2A381EE29307CFB16"><enum>(e)</enum><header>Denial of double benefit</header><text display-inline="yes-display-inline">In the case of any eligible property with respect to which credit is allowed under subsection (a)—</text><paragraph id="HD27E54B52563450095C8F51B86B5F26F"><enum>(1)</enum><text>no other credit or deduction shall be allowed for, or by reason of, such property to the extent of the amount of such credit, and</text></paragraph><paragraph id="H09D4CF4B7FE74D419A63D1884466189B"><enum>(2)</enum><text>the basis of such property shall be reduced by the amount of such credit.</text></paragraph></subsection><subsection id="HAFAEBCD10174428B8DA00C72A9E92E9D" commented="no"><enum>(f)</enum><header>Regulations and guidance</header><text>The Secretary shall issue such regulations or other guidance as the Secretary determines necessary to carry out the purposes of this section, including regulations or other guidance which provides for requirements for recordkeeping or information reporting for purposes of administering the requirements of this section.</text></subsection><subsection id="HF96D9B615A2E47508F82D241CDEFA600" commented="no"><enum>(g)</enum><header>Definitions</header><text>For purposes of this section—</text><paragraph id="HFE3B237D6A8A4E6B8D6481D834DD2594" commented="no"><enum>(1)</enum><header>Qualified recycling property</header><text display-inline="yes-display-inline">The term <term>qualified recycling property</term> has the meaning given the term <term>reuse and recycling property</term> in section 168(m)(3)(A).</text></paragraph><paragraph id="H68148C6EC2C04F21B104B9BA34268754" commented="no"><enum>(2)</enum><header>Qualified reuse and recyclable materials</header><text display-inline="yes-display-inline">The term <term>qualified reuse and recyclable materials</term> has the meaning given such term in section 168(m)(3)(B), except that for purposes of this section such term includes any video display device and any computer device (including computer peripherals, such as keyboards, mice, speakers, cables, printers, and scanners).</text></paragraph><paragraph id="H2940B29CEB1742D18DA0741EBD0F3D6F" commented="no"><enum>(3)</enum><header>Recycle</header><text>The term <term>recycle</term> has the meaning given such term in section 168(m)(3)(C), except that for purposes of this section such term does not include—</text><subparagraph id="H9119F4EF99FD44CEA46035588DCA252D" commented="no"><enum>(A)</enum><text>any method of sorting, processing, and aggregating materials from solid waste that—</text><clause id="H5EAADCB6FEA84A2D9DFFE5B624B90E47" commented="no"><enum>(i)</enum><text>does not preserve the original quality of such materials, and</text></clause><clause id="HCA57CC8C277447F58F58A81BA09D9CAB" commented="no"><enum>(ii)</enum><text>results in the aggregated material not being usable—</text><subclause id="H55967F73AF094C8AA45BEC4CFB5ABCF0" commented="no"><enum>(I)</enum><text>for the initial purpose (or a substantially similar purpose) of such materials, or</text></subclause><subclause id="HF86C6AFF233247A79EDABF2C6C3050E7" commented="no"><enum>(II)</enum><text>as feedstock in lieu of virgin feedstock in the production of specification grade commodities, or</text></subclause></clause></subparagraph><subparagraph id="H752D57FB8D55409290F563A175B8E696" commented="no"><enum>(B)</enum><text>the primary use of waste or qualified reuse and recyclable materials—</text><clause id="HA6129E651FD34FEBB50E99D41CB3CE7C" commented="no"><enum>(i)</enum><text>as a fuel or fuel substitute;</text></clause><clause id="HDA0A4DA8642B4158AFCC67CA72FCB531" commented="no"><enum>(ii)</enum><text>for the production or generation of energy (including heat and electricity);</text></clause><clause id="H43DB676222BD4DC59B6BEBF32AE4E939" commented="no"><enum>(iii)</enum><text>for incineration;</text></clause><clause id="H7F0F14CF1415439C8C5BF2DA39B247A0" commented="no"><enum>(iv)</enum><text>for alternate operating cover; or</text></clause><clause id="H129BF20FE36D4EA8AC07B6CA508CC99E" commented="no"><enum>(v)</enum><text>within the footprint of a landfill.</text></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H1A5EF49CCD3343C4A51AFD4EE7508C1E" commented="no"><enum>(b)</enum><header>Credit made part of investment credit</header><text>Section 46 of such Code is amended by striking <quote>and</quote> at the end of paragraph (6), by striking the period at the end of paragraph (7) and inserting <quote>, and</quote>, and by adding at the end the following new paragraph:</text><quoted-block id="H2EC19EADDAE2404A8EB31CE3EBD730A3" style="OLC"><paragraph id="HF7D9A77DDEAC4CC291F2B46997514757" commented="no"><enum>(8)</enum><text>the recycling property investment credit.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H72745E6067B84926B87561D8B6BD9F53" commented="no"><enum>(c)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for subpart E of part IV of subchapter A of chapter 1 of such Code is amended by inserting after the item relating to section 48E the following new item:</text><quoted-block style="OLC" id="HC3FC65CAC2D2405D94C3DCC57FFB4F9D" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">48F. Recycling property investment credit.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB6D7269FA42146DBBAF3FC66D340B38B" commented="no"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to—</text><paragraph id="H058A72132CB5451B8962277E8C08A870"><enum>(1)</enum><text display-inline="yes-display-inline">in the case of property described in <external-xref legal-doc="usc" parsable-cite="usc/26/48F">section 48F(b)(2)(C)(i)</external-xref> of the Internal Revenue Code of 1986 (as added by subsection (a)), property which is constructed, reconstructed, added, or erected after December 31, 2025, and</text></paragraph><paragraph id="H6749A9AA0034438E960F17C46A10764B"><enum>(2)</enum><text>in any other case, property which is placed in service after December 31, 2025.</text></paragraph></subsection></section></legis-body></bill>
