<section id="HD223DB3FD8744B15926FE17D3711DF62" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Federal Employee Rights to Personnel Files Act of 2025</short-title></quote>.</text></section> 
<section id="HADA29CF706B3449280EE182A5B9875F7"><enum>2.</enum><header>Requirement to provide official personnel record files to employees and former employees</header> 
<subsection id="H476C7936220A4AD3A1B64F10DE83FB35"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/5/3330f">section 3330f</external-xref> the following:</text> <quoted-block style="USC" id="H47E26A3EBFD94A07877B2599B1E9F2B8" display-inline="no-display-inline"> <section id="H8A480D77086A4E8195BD119DCB1D7D36"><enum>3330g.</enum><header>Requirement to provide official personnel record files to employees and former employees</header> <subsection id="H0E8032F47E904DD8825EDCCE66C0A19A"><enum>(a)</enum><header>Current employees</header><text display-inline="yes-display-inline">Not later than seven days after the date an employee of an agency requests a copy of the employee’s official personnel record file, the head of such agency shall provide to such employee, in electronic and physical form, a copy of such file.</text></subsection> 
<subsection id="HE1551C03B9A841E08FBF6FAD0ABFC086"><enum>(b)</enum><header>Former employees</header> 
<paragraph id="H8336332E3E8C464EA69169A03C59B2E5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to any employee separating from an agency on or after the date of the enactment of this section, not later than seven days after the date of such separation, the head of such agency shall provide to such employee, in electronic and physical form, a copy of the employee’s official personnel record file.</text></paragraph> <paragraph id="H4D5D591DB9F540E8955EF1EE416C68E2"><enum>(2)</enum><header>Previously separated employees</header><text display-inline="yes-display-inline">With respect to any individual who separated from an agency before the date of the enactment of this section, not later than 21 days after the date such an individual requests a copy of the employee’s official personnel record file from the Director of the Office of Personnel Management, the Director shall provide, in electronic and physical form, a copy of such file to the individual.</text></paragraph></subsection> 
<subsection id="HF01AD67494FC40E09E5589C872C1E344"><enum>(c)</enum><header>Agency defined</header><text>In this section, the term <quote>agency</quote> has the meaning given that term in section 551.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H4DC29522B15742B3A44342739417386C"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for such subchapter is amended by inserting after the item relating to section 3330f the following:</text>
