R. 4438</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250716">July 16, 2025</action-date><action-desc><sponsor name-id="A000148">Mr. Auchincloss</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the Board of Governors of the Federal Reserve and the Secretary of the Treasury from issuing a central bank digital currency, and for other purposes.</official-title></form><legis-body id="H9E1BB585C51D4AC484A8F6521DA5C45D" style="OLC"><section id="HB5C7144A3E9949C18EE21E3D6E8834E2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Power of the Mint Act</short-title></quote>.</text></section><section id="HA12E4C6E9BA346C5AFB32F6921004ED9"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text><paragraph id="HFC2954C0EC9D486E90F8E0209DADB8DD"><enum>(1)</enum><text display-inline="yes-display-inline">The article I, section 8 of the Constitution states that only Congress has the authority to coin money and regulate the value of such money.</text></paragraph><paragraph id="H0589B9F5A92C4F219005DB6B9238B4A4"><enum>(2)</enum><text>The Federal Reserve Act of 1913 provides that the Federal Reserve banks shall act as the fiscal agents of the United States and depositories when required to do so by the Secretary of the Treasury.</text></paragraph></section><section id="H8F47CBD39A3F458B9699470B2A051BE8"><enum>3.</enum><header>Central bank digital currency</header><subsection id="H1BCFB51461D44FAB8DC2EEF7F1F6C337"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Federal Reserve Act (<external-xref legal-doc="usc" parsable-cite="usc/12/221">12 U.S.C. 221 et seq.</external-xref>) is amended by inserting after section 16 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC8B3DFB6054D4C2DB35FE77F607308BC"><section id="H7372E3BE18D14790B859D43CAC5EC1D1"><enum>16A.</enum><header>Central bank digital currency</header><subsection id="H6E357CAB306E4EF9B018A12F151E0943"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Board of Governors of the Federal Reserve may not, absent Congressional authorization, issue a central bank digital currency.</text></subsection><subsection id="H828D8499639C44C28E14AA9995626D3C"><enum>(b)</enum><header>Central bank digital currency defined</header><text display-inline="yes-display-inline">In this section, the term <term>central bank digital currency</term> means a form of digital money or monetary value, denominated in the national unit of account, that is a direct liability of the Federal Reserve.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H64649AC887524A4690DC3ED91A226E4A"><enum>(b)</enum><header>Treasury</header><text>Chapter 3 of subtitle I of title 31 of the United States Code is amended by inserting after section 316 the following:</text><quoted-block style="OLC" id="H8DECFBCC2BC342A988E57BA85EB3D280" display-inline="no-display-inline"><section id="HC20EC7AE9738459F966D116C31DB52D6"><enum>317.</enum><header>Central bank digital currency</header><subsection id="H7BCEA87DCC62446A82238B40BD724F1E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the Treasury may not, absent Congressional authorization, direct the Board of Governors of the Federal Reserve to issue a central bank digital currency.</text></subsection><subsection id="HF04134AA704D42048710911E75FC16FE"><enum>(b)</enum><header>Central Bank Digital Currency defined</header><text display-inline="yes-display-inline">In this section, the term <term>central bank digital currency</term> means a form of digital money or monetary value, denominated in the national unit of account, that is a direct liability of the central bank.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
