            to ensure the supply chain transparency needed for companies to make safe cosmetics, and
            for other purposes.</official-title>

            <enum>1.</enum>
            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cosmetic Supply Chain Transparency Act of 2025</short-title></quote>.</text>
        </section>
        <section id="HFF525BB2E1DE49E5965D3419FAB49F7A">
            <enum>2.</enum>
            <header>Cosmetic regulation</header>
 <text display-inline="no-display-inline">Chapter VI of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/361">21 U.S.C. 361 et seq.</external-xref>) is amended—</text>
            <paragraph id="HCD24B2CF09E54CBDBAEFA2BD51F798AD">
                <enum>(1)</enum>
 <text>by inserting before section 601 the following:</text> <quoted-block style="OLC" id="H5379D099765A40A2B3025791946BC9DE" display-inline="no-display-inline"> <subchapter id="HB8C3060246884B4A8871C23D6B38254F"> <enum>A</enum> <header>Adulterated and Misbranded Cosmetics</header> </subchapter> <after-quoted-block>;</after-quoted-block> </quoted-block> <continuation-text continuation-text-level="paragraph"> </continuation-text> </paragraph> <paragraph id="HBF9312809FA7462987EA099A45374CE4"> <enum>(2)</enum> <text>in section 614, by amending subsection (b) to read as follows:</text>

                        <enum>(b)</enum>
                        <header>Limitations</header>
                        <paragraph id="H00FD12674D5C4565ACF0A09FBCA9BEEB">
                            <enum>(1)</enum>
                            <header>In general</header>
 <text display-inline="yes-display-inline">Notwithstanding subsection (a), nothing in this section shall be construed to prevent any State (or a political subdivision thereof) from—</text>
                            <subparagraph id="H292C5967F5E84D8E96E72628AE7784D2">
                                <enum>(A)</enum>
 <text>prohibiting the use or limiting the amount of an ingredient in a cosmetic product;</text>
                            </subparagraph>
                            <subparagraph id="HD4DB082EE99941E0A50472DD6E2A78EC">
                                <enum>(B)</enum>
 <text display-inline="yes-display-inline">continuing to implement a requirement of such State (or a political subdivision thereof) that is in effect at the time of enactment of the Modernization of Cosmetics Regulation Act of 2022 for the reporting to the State (or a political subdivision thereof) of an ingredient in a cosmetic product; and</text>
                            </subparagraph>
                            <subparagraph id="H4ECB05A68DC344BE9AF6D0895738D11E">
                                <enum>(C)</enum>
 <text display-inline="yes-display-inline">implementing a requirement of such State (or a political subdivision thereof), or continuing to implement a requirement that is in effect at the time of enactment of the <short-title>Cosmetic Supply Chain Transparency Act of 2025</short-title>, that provides greater transparency, disclosure, or protection than the amendments made by such Act, with respect to—</text>
                                <clause id="H9EC4DEA83C9E418882F84A7DBC8B6D8B">
                                    <enum>(i)</enum>
 <text>cosmetic ingredients;</text> </clause> <clause id="H580671CB2A394B4398C74F46B3B10374"> <enum>(ii)</enum> <text>the practices used in the manufacture of cosmetics (and the ingredients thereof); or</text>
                                </clause>
                                <clause id="HBE0951C4A80442FE8772A6EDCA2D334B">
                                    <enum>(iii)</enum>
 <text>the disclosure of information with respect to such ingredients or such practices.</text>
                                </clause>
                            </subparagraph>
                        </paragraph>
                        <paragraph id="H54C95CD40E8F44E5BA9E9A88E5E822BC">
                            <enum>(2)</enum>
                            <header>Modernization of Cosmetics Regulation Act of 2022</header>
 <text display-inline="yes-display-inline">Nothing in the amendments to this Act made by the Modernization of Cosmetics Regulation Act of 2022 shall be construed to preempt any State statute, public initiative, referendum, regulation, or other State action, except as expressly provided in subsection (a). </text>
                        </paragraph>
                    </subsection>

                <enum>(3)</enum>
 <text>by adding at the end the following:</text> <quoted-block id="HFD533636F8424133B8BFC499CD230A5C" style="OLC"> <subchapter id="H9984D0E0827046738971C7CF7BAD36C5"> <enum>B</enum> <header>Supply Chain Transparency</header> <section id="H3BC22E188FA54650AB22C37B66136DAC"> <enum>621.</enum> <header>Definitions</header> <text display-inline="no-display-inline">In this subchapter:</text>
                            <paragraph id="HD6F51761759A440C9FF4E22D329887B7">
                                <enum>(1)</enum>
                                <header>Brand owner</header>
 <text>The term <term>brand owner</term> means the entity responsible for bringing a cosmetic to market.</text>
                            </paragraph>
                            <paragraph id="H9B091E1B74D04697B199CD108A0FCF32">
                                <enum>(2)</enum>
                                <header>Flavor or fragrance company</header>
 <text display-inline="yes-display-inline">The term <term>flavor or fragrance company</term> means an entity that makes or supplies fragrance or flavor ingredients or fragrance or flavor formulations.</text>
                            </paragraph>
                            <paragraph id="H553004C7E49D488E8DE2121484015015">
                                <enum>(3)</enum>
                                <header>Formulating laboratory</header>
 <text display-inline="yes-display-inline">The term <term>formulating laboratory</term> means an entity that supplies a finished cosmetic product to a retailer or cosmetic company to sell under the retailer or cosmetic company’s brand name.</text>
                            </paragraph>
                            <paragraph id="H40B2E6BF01E04D2C97ED871717173A19" commented="no">
                                <enum>(4)</enum>
                                <header>Harmful to human health or the environment</header>
 <text display-inline="yes-display-inline">The phrase <quote>harmful to human health or the environment</quote> means, with respect to a nonfunctional constituent—</text>
                                <subparagraph id="HAF92BC7EF2EC4CDAABE9B4AC26218B60" commented="no">
                                    <enum>(A)</enum>
 <text display-inline="yes-display-inline">being—</text> <clause id="HEAF1BB539E864222B859EC88A5663655"> <enum>(i)</enum> <text>a reproductive or developmental toxicant;</text>
                                    </clause>
                                    <clause id="H531E1BDB5F68462F8539D6B079AD12FA" commented="no">
                                        <enum>(ii)</enum>
 <text>persistent, bioaccumulative, and toxic;</text> </clause> <clause id="H2703574DCA514B358F4C4FFF030FBC35" commented="no"> <enum>(iii)</enum> <text>an allergen; or</text>
                                    </clause>
                                    <clause id="HDCD7655F48B04DC3BDBDE2E16E956D2F" commented="no">
                                        <enum>(iv)</enum>
 <text>an endocrine disruptor, carcinogen, or mutagen; and</text>
                                    </clause>
                                </subparagraph>
                                <subparagraph id="H695AF99C8B2D45E7B5B6ACFFD3EDA5D3">
                                    <enum>(B)</enum>
 <text display-inline="yes-display-inline">present on the most recent version in effect of any of the following lists:</text>
                                    <clause id="H315111D2A19B40C6ABE491870155221D">
                                        <enum>(i)</enum>
 <text display-inline="yes-display-inline">Chapter 6.6 of the California Safe Drinking Water and Toxic Enforcement Act of 1986 (sections 25249.5 through 25249.14 of the California Health and Safety Code), List of Reproductive and Developmental Toxicants and Carcinogens.</text>
                                    </clause>
                                    <clause id="H32922F25B3EF41DAAB923DEEEB82C123">
                                        <enum>(ii)</enum>
 <text>Chemicals classified as <quote>Persistent, Bioaccumulative and Toxic</quote> by the Toxics Release Inventory published by the Environmental Protection Agency pursuant to section 313 of the Emergency Planning and Community Right-to-Know Act of 1986.</text>
                                    </clause>
                                    <clause id="HF6A716E594EC4797B490A37C05E7ACCF">
                                        <enum>(iii)</enum>
 <text>European Union Regulation 1223/2009/EC on Cosmetic Products, as amended by Regulation (EU) 2020/1683, Annex II–Prohibited Substances.</text>
                                    </clause>
                                    <clause id="HF1CC2B709AB04FCB902F597F7F7FFA10">
                                        <enum>(iv)</enum>
 <text>Annex III of European Union Cosmetics Regulation No. 1223/2009, as required to be disclosed pursuant to European Union Detergents Regulation No. 21648/2004.</text>
                                    </clause>
                                    <clause id="H042BA8E4F8244B1BBD75A676E02537E0">
                                        <enum>(v)</enum>
 <text>Chemicals included in the European Union Candidate List of Substances of Very High Concern in accordance with Article 59 of the REACH Regulation (EC) No. 1907/2006 on the basis of fulfilling the criteria defined in Article 57(f) for endocrine-disrupting properties.</text>
                                    </clause>
                                    <clause id="HE57B134160914FE8BE53A983AFB0846F">
                                        <enum>(vi)</enum>
 <text>Substances classified as carcinogens, mutagens, or reproductive toxicants in Appendices 1–6 of Annex XVII to Regulation (EC) No. 1907/2006 of the European Union’s Registration, Evaluation, Authorisation, and Restriction of Chemicals (REACH) law, as revised by the Commission Regulation (EU) 2020/2096 of December 15, 2020.</text>
                                    </clause>
                                    <clause id="H599BB218961E4868953CA07BC5F97623">
                                        <enum>(vii)</enum>
 <text>Group 1, 2A, or 2B carcinogens identified by the International Agency for Research on Cancer of the World Health Organization.</text>
                                    </clause>
                                    <clause id="H17B0492D845F43B0BA93F1E30A347FAC">
                                        <enum>(viii)</enum>
 <text display-inline="yes-display-inline">Any other list the Secretary determines appropriate for purposes of this subchapter.</text>
                                    </clause>
                                </subparagraph>
                            </paragraph>
                            <paragraph id="H623257C1A6134293AD2EACB9D72CCEC7">
                                <enum>(5)</enum>
                                <header>Ingredient</header>
 <text>The term <term>ingredient</term> means an intentionally added chemical in a cosmetic that has a technical or functional effect, including—</text>
                                <subparagraph id="H9718B30060CA46E8BC0DA97199C9776C">
                                    <enum>(A)</enum>
 <text>the breakdown products of an intentionally added chemical that also have a functional or technical effect in the cosmetic;</text>
                                </subparagraph>
                                <subparagraph id="H30703F7364364F69843F4D74816AE5A6">
                                    <enum>(B)</enum>
 <text>a fragrance, flavor, preservative, or colorant (and the components thereof); and</text>
                                </subparagraph>
                                <subparagraph id="H674410FDAD04457D812D8F2E2BB06FE2">
                                    <enum>(C)</enum>
 <text>any individual component that the Secretary deems to be an ingredient for purposes of this subchapter.</text>
                                </subparagraph>
                            </paragraph>
                            <paragraph id="H9807FF67E92843FCBC624BA021CF7BF7">
                                <enum>(6)</enum>
                                <header>Incidental component</header>
 <text>The term <term>incidental component</term> means—</text> <subparagraph id="H501C20245D5747DF95AAA811557E5B52"> <enum>(A)</enum> <text>a chemical added during the manufacturing process at any point in a cosmetic’s, or an ingredient’s, supply chain, but which has no functional or technical effect in the finished cosmetic; or</text>
                                </subparagraph>
                                <subparagraph id="HDE166892A9EB42A082CB8DEC4BB39C9E">
                                    <enum>(B)</enum>
 <text>a chemical present in the environment which was introduced into a cosmetic, or into an ingredient, at any point in the supply chain for the cosmetic or ingredient.</text>
                                </subparagraph>
                            </paragraph>
                            <paragraph id="H5E0E85554C2C4ED3A29526B2113171F0">
                                <enum>(7)</enum>
                                <header>Manufacturer</header>
 <text>The term <term>manufacturer</term> means any entity that—</text>
                                <subparagraph id="HBF6E4C8B768742029ED6AB909C4499AD">
                                    <enum>(A)</enum>
 <text>produces an ingredient; or</text> </subparagraph> <subparagraph id="HB1D6CB00E1BC4C3EABBE382F391EEFF9"> <enum>(B)</enum> <text>combines one or more ingredients to produce a cosmetic.</text>
                                </subparagraph>
                            </paragraph>
                            <paragraph id="H732D9B8B6F0648769D08ECF73862F485">
                                <enum>(8)</enum>
                                <header>Nonfunctional constituent</header>
 <text display-inline="yes-display-inline">The term <term>nonfunctional constituent</term> means a chemical that has no functional or technical effect on the product or ingredient and is present—</text>
                                <subparagraph id="H39533A301F0F4AD5BFE7FF9796E6507B">
                                    <enum>(A)</enum>
 <text>as an incidental component of an intentionally added ingredient;</text>
                                </subparagraph>
                                <subparagraph id="H30653BBDB3A84A87B42C66BD050E0089">
                                    <enum>(B)</enum>
 <text>as a breakdown product of an intentionally added ingredient;</text>
                                </subparagraph>
                                <subparagraph id="HF83B17AB34A54D6BB93639AF05E88526">
                                    <enum>(C)</enum>
 <text>as a byproduct of the manufacturing process;</text> </subparagraph> <subparagraph id="H14B0480D086C494D8CB4C2BB6782E837"> <enum>(D)</enum> <text>due to storage of primary substances; or</text>
                                </subparagraph>
                                <subparagraph id="H7BACDFA7EC7F4DA7B56282C079F4A429">
                                    <enum>(E)</enum>
 <text>due to instability of the packaging.</text> </subparagraph> </paragraph> <paragraph id="H397B145ADF1A4BD690A50E53D0AFCE02"> <enum>(9)</enum> <header>Raw material</header> <text display-inline="yes-display-inline">The term <term>raw material</term> means a substance or mixture of substances that—</text>
                                <subparagraph id="HD64E18BFD631431E9A13DBD55E220AD4">
                                    <enum>(A)</enum>
 <text>is used in the manufacture of a cosmetic for commercial distribution; and</text>
                                </subparagraph>
                                <subparagraph id="HEC88334630A74142B7F1824AB3812FAF">
                                    <enum>(B)</enum>
 <text>is supplied to a cosmetic manufacturer, packer, or distributor by a cosmetic raw material manufacturer or supplier.</text>
                                </subparagraph>
                            </paragraph>
                            <paragraph id="HF2813971D9D9481A892CE2F813A1E020">
                                <enum>(10)</enum>
                                <header>Supplier</header>
 <text display-inline="yes-display-inline">The term <term>supplier</term>—</text>
                                <subparagraph id="HF259B41F987941CC85AA7369C73BE5D0">
                                    <enum>(A)</enum>
 <text>means an entity that supplies a cosmetic, cosmetic packaging, or an ingredient or raw material of a cosmetic or cosmetic packaging; and</text>
                                </subparagraph>
                                <subparagraph id="H4EB7826E565A40E38AAC6ED440DA6825">
                                    <enum>(B)</enum>
 <text>includes any such entity that is a manufacturer, a formulating laboratory, or a fragrance or flavor company.</text>
                                </subparagraph>
                            </paragraph>
                        </section>
                        <section id="HD22975EF2026465BB03C81B3EBA26E88">
                            <enum>622.</enum>
                            <header>Cosmetic and ingredient safety information</header>
 <text display-inline="no-display-inline">At the request of a brand owner of a cosmetic, a supplier of the cosmetic or any ingredient therein shall, not later than 90 days after receipt of such request, provide to the brand owner, with respect to the cosmetic or ingredient, any of the following information:</text>

                                <subparagraph commented="no" display-inline="yes-display-inline"

                                    <enum>(A)</enum>
 <text>Functions and uses.</text> </subparagraph> <subparagraph id="HBE95226AD88A4B79A4E1A196BD7AFF07" indent="up1"> <enum>(B)</enum> <text display-inline="yes-display-inline">The human health and environmental hazards.</text>
                                </subparagraph>
                                <subparagraph id="H9E554A6E5E004D5BA4EE34F4B0E52B68" indent="up1">
                                    <enum>(C)</enum>
 <text display-inline="yes-display-inline">The physical and chemical properties.</text>
                                </subparagraph>
                                <subparagraph id="H663F62E322014695A01BCD9E3B68C9F0" indent="up1">
                                    <enum>(D)</enum>
 <text>The Chemical Abstracts Services Registry number of any such ingredient.</text>
                                </subparagraph>
                                <subparagraph id="H730E1D088B394F9298EC522A7A773897" indent="up1">
                                    <enum>(E)</enum>
 <text display-inline="yes-display-inline">Environmental exposure and fate information.</text>
                                </subparagraph>

                                    <enum>(F)</enum>
 <text>Heavy metal testing results.</text> </subparagraph> <subparagraph id="HD043968A0F444622B1A0C7FEBEC229C2" indent="up1"> <enum>(G)</enum> <text>Safety data sheets.</text>
                                </subparagraph>
                                <subparagraph id="HC978E87000D54D06A814E7D6032E4C55" indent="up1">
                                    <enum>(H)</enum>
 <text>Manufacturing flow charts.</text> </subparagraph> <subparagraph id="H8C49A7EDA43E4BBEBAF33ABC539E7B9E" indent="up1"> <enum>(I)</enum> <text>Composition statement.</text>
                                </subparagraph>
                                <subparagraph id="HAC98EBEFC8F1416EA92735FB1CD9F42F" indent="up1">
                                    <enum>(J)</enum>
 <text display-inline="yes-display-inline">Fragrance allergen statement.</text>
                                </subparagraph>
                                <subparagraph id="HF4A65370DFEE4D1D839BBE5C7693067B" indent="up1">
                                    <enum>(K)</enum>
 <text display-inline="yes-display-inline">International Fragrance Association (IFRA) standards conformity certificate.</text>
                                </subparagraph>
                                <subparagraph id="HF0A9EB34D14B4A168142EAB0DA90C750" indent="up1">
                                    <enum>(L)</enum>
 <text display-inline="yes-display-inline">Any other information used to substantiate the safety of such ingredient.</text>
                                </subparagraph>
                            </paragraph>
                            <paragraph id="H5640689F0A7740CFB70351E5A0D356C3">
                                <enum>(2)</enum>
 <text display-inline="yes-display-inline">A full and complete listing of ingredients in fragrance or flavor formulations, preservative systems, or other ingredient formulations, including the presence of any allergens.</text>
                            </paragraph>
                            <paragraph id="H76A09DDCD1B845B394770D0EF6EAE7C6">
                                <enum>(3)</enum>
 <text display-inline="yes-display-inline">A full and complete listing of ingredients in a finished cosmetic presented in descending order of predominance by weight, except that ingredients present in amounts of 1 percent or less by weight can be placed in any order at the end of the ingredient statement.</text>
                            </paragraph>
                            <paragraph id="H66BCE318341241E3821520E2D1EF84B3">
                                <enum>(4)</enum>
 <text display-inline="yes-display-inline">A certificate of analysis for the ingredient.</text>
                            </paragraph>
                        </section>
                        <section id="HA0DFA7DA8A6D4186A752AD19EA3B81F0">
                            <enum>623.</enum>
                            <header>Process for establishing an FDA list of nonfunctional
                                constituents known or reasonably expected to be present in cosmetics
                                and ingredients</header>
                            <subsection id="H3FD3C5B6FCDD4B7DBC4BFEDF539A08C1">
                                <enum>(a)</enum>
                                <header>In general</header>
 <text display-inline="yes-display-inline">The Secretary shall create and maintain a list of nonfunctional constituents to guide testing under this subchapter conducted by suppliers of cosmetics and ingredients.</text>
                            </subsection>
                            <subsection id="H547B14ABCAA64DB9AD4F1A682A0D9D3B">
                                <enum>(b)</enum>
                                <header>Contents</header>
 <text>The list under subsection (a) shall consist of nonfunctional constituents that are—</text>
                                <paragraph id="HEB53C3DD51CA4E858AFCC68088E55A5F">
                                    <enum>(1)</enum>
 <text>known or reasonably expected to be present in cosmetics or ingredients; and</text>
                                </paragraph>
                                <paragraph id="H9A3CD84F24BA427096F56D4ACC985D84">
                                    <enum>(2)</enum>
 <text>subject to subsection (e)(2), harmful to human health or the environment.</text>
                                </paragraph>
                            </subsection>
                            <subsection id="H7CD5172847804FCF926E20140F143C40">
                                <enum>(c)</enum>
                                <header>Identification of ingredients and cosmetics</header>
 <text display-inline="yes-display-inline">For each nonfunctional constituent on the list under subsection (a), the Secretary shall identify the specific ingredient or cosmetic, or category of ingredients or cosmetics, in which the nonfunctional constituent is known or reasonably expected to be present.</text>
                            </subsection>
                            <subsection id="H7EC949F365914E9E9A551F17CF1D54AB">
                                <enum>(d)</enum>
                                <header>Initial list</header>
                                <paragraph id="HC0B4BEFB62144F9084517659733095BE">
                                    <enum>(1)</enum>
                                    <header>In general</header>
 <text display-inline="yes-display-inline">In creating the initial list under subsection (a), the Secretary shall—</text>
                                    <subparagraph id="HD5CD6E4B106949A285FA2FE62ECD4BC1">
                                        <enum>(A)</enum>
 <text>publish a proposed list and provide an opportunity for public comment on such proposed list for a period of 60 days; and</text>
                                    </subparagraph>
                                    <subparagraph id="H0B04D2B0F8B542E4A9ECA5F2D062812D">
                                        <enum>(B)</enum>

                                    <subparagraph id="HBF09BBADDF7245E581FB7DFF837A3CD3">
                                        <enum>(A)</enum>
                                        <header>In general</header>
 <text display-inline="yes-display-inline">Not later than 9 months after the date of enactment of the <short-title>Cosmetic Supply Chain Transparency Act of 2025</short-title>, the Secretary shall convene an advisory committee to advise the Secretary on—</text>
                                        <clause id="H4C4C2683BECE493F82720539C25DA7A6">
                                            <enum>(i)</enum>
 <text>creating the initial list under subsection (a); and</text>
                                        </clause>
                                        <clause id="H2238AFD1A20F4005BBCF2E807D323D32">
                                            <enum>(ii)</enum>
 <text>best practices related to analytical testing for nonfunctional constituents in cosmetics and ingredients.</text>
                                        </clause>
                                    </subparagraph>
                                    <subparagraph id="H74525EFDE8504E7C816A8DAD5D62F079">
                                        <enum>(B)</enum>
                                        <header>Membership</header>
 <text display-inline="yes-display-inline">The membership of the advisory committee convened under subparagraph (A) shall consist of an equal number of—</text>
                                        <clause id="H704E670EC663475784379AEDF811128B">
                                            <enum>(i)</enum>
 <text>representatives from industry;</text> </clause> <clause id="HDC8DD56E324C49C0807BFC599031982D"> <enum>(ii)</enum> <text>representatives from the nonprofit community;</text>
                                        </clause>
                                        <clause id="H2630D108790B4E57BAA4B6372D8ADF19">
                                            <enum>(iii)</enum>
 <text>representatives from the scientific community; and</text>
                                        </clause>
                                        <clause id="H4F375F963E7C4DE08B61119A2D0F7EE4">
                                            <enum>(iv)</enum>
 <text display-inline="yes-display-inline" >representatives from the medical and public health community.</text>
                                        </clause>
                                    </subparagraph>
                                    <subparagraph id="H582D93657EB24D4B80C3EFA581AF791C">
                                        <enum>(C)</enum>
                                        <header>Termination</header>
 <text>The Secretary shall terminate the advisory committee convened under this paragraph upon the finalization of the initial list pursuant to paragraph (1).</text>
                                    </subparagraph>
                                </paragraph>
                            </subsection>
                            <subsection id="HEEEDD31BC4D344588CEA42168A7B8E12" commented="no">
                                <enum>(e)</enum>
                                <header>Updates</header>
 <text display-inline="yes-display-inline">Not less than annually after the finalization pursuant to subsection (d) of the initial list under subsection (a), and not less than annually thereafter, the Secretary shall—</text>

                                    <enum>(1)</enum>
 <text display-inline="yes-display-inline">review the list under subsection (a);</text>
                                </paragraph>
                                <paragraph id="H8BD0899297BD4340ADAB3A3BE02B4946">
                                    <enum>(2)</enum>
 <text display-inline="yes-display-inline">after providing a period of at least 30 days for public comment, update the list by adding nonfunctional constituents that are known or reasonably expected to be present in a cosmetic or ingredient as specified in subsection (b)(1) and—</text>
                                    <subparagraph id="H613CBB39B37E4372965C0753A5A9C43F">
                                        <enum>(A)</enum>
 <text display-inline="yes-display-inline">are determined by the Secretary to meet the standard specified in section 621(4)(A) based on existing and emerging science; or</text>
                                    </subparagraph>
                                    <subparagraph id="H7AF641D3BF7643C4BE6016160412A46F">
                                        <enum>(B)</enum>
 <text display-inline="yes-display-inline">have been added to one of the lists in section 621(4)(B); and</text>
                                    </subparagraph>
                                </paragraph>
                                <paragraph id="H2425A1C274F348C1A8D2426BEF946005">
                                    <enum>(3)</enum>
 <text>update the list by adding any nonfunctional constituent whose addition was approved pursuant to a petition under subsection (f).</text>
                                </paragraph>
                            </subsection>

                                <enum>(f)</enum>
                                <header>Petition process for adding nonfunctional constituents or
                                    new lists</header>
                                <paragraph id="HE41F151D90FC47DD88173B99F68302E7">
                                    <enum>(1)</enum>
                                    <header>In general</header>
 <text display-inline="yes-display-inline">Any person may petition, in accordance with paragraph (3), to add—</text>
                                    <subparagraph id="HFD3F3FCB15C2447986B64E0EB6F0EC0A">
                                        <enum>(A)</enum>
 <text>a nonfunctional constituent to the list under subsection (a); or</text>
                                    </subparagraph>
                                    <subparagraph id="H83E3C21E00204A229318A03A1045179A">
                                        <enum>(B)</enum>
 <text>a new list to the lists specified in section 621(4)(B).</text>
                                    </subparagraph>
                                </paragraph>
                                <paragraph id="HBF1A8DD7F8E340D09EAB8898BD227D8E">
                                    <enum>(2)</enum>
                                    <header>Development of process</header>
 <text display-inline="yes-display-inline">The Secretary—</text> <subparagraph id="HBAB3C74279094F8986AFC8C0D477524B"> <enum>(A)</enum> <text>not later than 24 months after the date of enactment of the <short-title>Cosmetic Supply Chain Transparency Act of 2025</short-title>, shall develop and publish the process for submitting a petition under this subsection; and</text>
                                    </subparagraph>
                                    <subparagraph id="H7EF6C0F00B474F76A6D909688E550A5D">
                                        <enum>(B)</enum>
 <text>may periodically review and update such process.</text>
                                    </subparagraph>
                                </paragraph>
                                <paragraph id="HC2FFB3E74DDB446496BE2DB3648CBBE3">
                                    <enum>(3)</enum>
                                    <header>Requirements for process</header>
 <text display-inline="yes-display-inline">The process developed and updated by the Secretary under paragraph (2) shall be consistent with the following:</text>
                                    <subparagraph id="HF19D064671ED4167A9EEC277E80DD6BE">
                                        <enum>(A)</enum>
 <text>Such process shall specify the necessary scientific justification that must be included in a petition.</text>
                                    </subparagraph>
                                    <subparagraph id="H6AE02E5AC5AD4BA8BB86F3338363B62C">
                                        <enum>(B)</enum>
 <text>The Secretary shall—</text> <clause id="H1743CED43E7742A09CCCEDD55A4C7519"> <enum>(i)</enum> <text>provide a 30-day period for public comment on a petition; and</text>
                                        </clause>
                                        <clause id="H89055558D8CB442799C104CAB8073978">
                                            <enum>(ii)</enum>
 <text display-inline="yes-display-inline">not later than 90 days after the close of such public comment period, approve or deny the petition.</text>
                                        </clause>
                                    </subparagraph>
                                    <subparagraph id="H9C21B5E920DB49F6AB5E0C185E249544">
                                        <enum>(C)</enum>
 <text>If the Secretary approves a petition, the Secretary shall provide notice in the Federal Register of each addition made pursuant to such approval.</text>
                                    </subparagraph>
                                    <subparagraph id="H70E9B9C3213A44C083772A502D768FA3">
                                        <enum>(D)</enum>
 <text>In denying a petition, the Secretary shall provide a written justification to the petitioner for the denial.</text>
                                    </subparagraph>
                                </paragraph>
                            </subsection>
                            <subsection id="HE30DF406E1704F4196FDB086257E8FD0">
                                <enum>(g)</enum>
                                <header>Guidance</header>
 <text display-inline="yes-display-inline">The Secretary—</text> <paragraph id="H655A3C5B22BC4B429334E1815286F968"> <enum>(1)</enum> <text display-inline="yes-display-inline">shall, concurrently with the publication of the initial list under subsection (a), and upon adding any nonfunctional constituent pursuant to subsection (e) or (f) to the list under subsection (a), issue guidance for industry on best practices related to—</text>
                                    <subparagraph id="H6F73FD78599F467F96A6BC6233A99D39">
                                        <enum>(A)</enum>
 <text>analytical testing for nonfunctional constituents in cosmetics and ingredients; and</text>
                                    </subparagraph>
                                    <subparagraph id="H143229677ABB4DDA9FD48C041CF107E7">
                                        <enum>(B)</enum>
 <text display-inline="yes-display-inline">detection limits; and</text>
                                    </subparagraph>
                                </paragraph>
                                <paragraph id="H65048F2F020C4CAAB11AB5EF0526EEC0">
                                    <enum>(2)</enum>
 <text>may periodically review and update such guidance.</text> </paragraph> </subsection> </section> <section id="H08E95F87D7B44D1EB148CD25AA0604A8"> <enum>624.</enum> <header>Treatment of nonfunctional constituents</header> <text display-inline="no-display-inline">A supplier of an ingredient or cosmetic shall—</text>
                            <paragraph id="H2B1E87AEAAB340118E7873752024EB36">
                                <enum>(1)</enum>
 <text display-inline="yes-display-inline">not later than 1 year after a nonfunctional constituent is added to the list under section 623(a) pursuant to subsection (d), (e), or (f) of section 623, conduct testing for such nonfunctional constituent; and</text>
                            </paragraph>
                            <paragraph id="H38A0076509D94023BC3508A1927CA9C4">
                                <enum>(2)</enum>
 <text display-inline="yes-display-inline">prior to the sale of the ingredient or cosmetic to the brand owner, provide the brand owner a certificate of analysis that includes—</text>
                                <subparagraph id="H083C7F62E5484E35AB525DDB93F72080">
                                    <enum>(A)</enum>
 <text>the levels of each such nonfunctional constituent present;</text>
                                </subparagraph>
                                <subparagraph id="H224A2A09510B4073BB18C64D5A0D1851">
                                    <enum>(B)</enum>
 <text display-inline="yes-display-inline">any analytical test used;</text>
                                </subparagraph>
                                <subparagraph id="H2F6D172DC65F46109095E440FFF51622">
                                    <enum>(C)</enum>
 <text display-inline="yes-display-inline">the detection limits of any analytical test used to detect each such nonfunctional constituent; and</text>
                                </subparagraph>
                                <subparagraph id="H94C5FB53D1454CB889599D28FC3F85E9">
                                    <enum>(D)</enum>
 <text>heavy metal testing results.</text> </subparagraph> </paragraph> </section> <section id="HB6AF7C4DED8C4AF18DA0876413A51CBA"> <enum>625.</enum> <header>Notification, nondistribution, and recall of adulterated or misbranded cosmetics</header> <subsection id="HA645AB07FE9C47158FCE34AD06900053"> <enum>(a)</enum> <header>Supply chain information</header> <text>In the case of a cosmetic that the Secretary has reason to believe is adulterated, misbranded, or otherwise in violation of this Act, the Secretary shall request that the brand owner named on the label of such cosmetic submit to the Secretary all of the following information:</text>
                                <paragraph id="HA576364A9CD7463E96D2E8F089A9980D">
                                    <enum>(1)</enum>
 <text>The name and place of business of the manufacturer of the cosmetic and any supplier of an ingredient or raw material used in the manufacture of the cosmetic.</text>
                                </paragraph>
                                <paragraph id="H9E4FD78D919743618D549EDE6BD02BB4">
                                    <enum>(2)</enum>
 <text>The name and place of business of any entity (including any retailer) to which the brand owner provided the cosmetic.</text>
                                </paragraph>
                            </subsection>
                            <subsection id="H154495518FBD4739B2677CD0050688C1">
                                <enum>(b)</enum>
                                <header>Collection of additional supply chain information</header>
 <text>In the case of a cosmetic that the Secretary has reason to believe is adulterated, misbranded, or otherwise in violation of this Act, to the extent necessary to protect the safety of the public, the Secretary may request that any entity in the supply chain of such cosmetic submit to the Secretary information that is similar to the information described in paragraphs (1) and (2) of subsection (a).</text>
                            </subsection>
                            <subsection id="H3C02C042B25140B992D138140B361B29" commented="no">
                                <enum>(c)</enum>
                                <header>Maintenance of records</header>
 <text>Any entity in the supply chain of a cosmetic (including the brand owner named on the label of a cosmetic) shall—</text>
                                <paragraph id="HABC39ACF190E436DAB45CD7021438D93" commented="no">
                                    <enum>(1)</enum>
 <text>maintain records sufficient to provide the information described in paragraphs (1) and (2) of subsection (a); and</text>
                                </paragraph>
                                <paragraph id="HAF29EF54D22744A3A691280B18E04687" commented="no">
                                    <enum>(2)</enum>
 <text>provide such information to the Secretary upon the request of the Secretary.</text>
                                </paragraph>
                            </subsection>
                        </section>
                        <section id="H439EF54374B74280A477426CFAEA7522">
                            <enum>626.</enum>
                            <header>Civil penalties</header>
 <text display-inline="no-display-inline">Any person that violates section 622, 624, or 625 shall be liable to the United States for a civil penalty in an amount up to $10,000 for each day on which such violation continues.</text>
                        </section>
