<section id="HDB2F5FF323794E34879D44F4AC910945" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Toxic-Free Beauty Act of 2025</short-title></quote>.</text></section> <section id="H7906F6279E0C48E89F403653F46BE33A"><enum>2.</enum><header>Ban on certain substances in cosmetic products</header> <subsection id="HC3CEFB5866914C50BD642EC190C523D0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 601 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/361">21 U.S.C. 361</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H9DA347A8F1EF46CEB787B32516F7D540"><enum>(h)</enum><text display-inline="yes-display-inline">If it contains as an ingredient, any intentionally added ortho-phthalate or formaldehyde-releasing preservative.</text></subsection> <subsection id="HABACB28DEF0E452D886AB84AD8094BE5"><enum>(i)</enum><text>If it contains any of the following intentionally added ingredients:</text> 
<paragraph id="HC96B70AA0E9D4B8DBC6D6DE046E9AF3E"><enum>(1)</enum><text display-inline="yes-display-inline">Formaldehyde (CAS No. 50–00–0).</text></paragraph> <paragraph id="H6C7157B23C7340A79BC9211D17398C3D"><enum>(2)</enum><text>Methylene glycol (CAS No. 463–57–0).</text></paragraph> 
<paragraph id="HC382EFFC611341329200E7B72D53CB87"><enum>(3)</enum><text>Mercury and mercury compounds (CAS No. 7439–97–6).</text></paragraph> <paragraph id="H003CACE0286E409CBE7057D14B738F17"><enum>(4)</enum><text>Isobutylparaben (CAS No. 4247–02–3).</text></paragraph>

<subsection id="H293304D843874CD19A11CF3A03CE2C66"><enum>(j)</enum><text display-inline="yes-display-inline">If it contains any of the following contaminants:</text> <paragraph id="H0CAFA13E4BAD48A3AC4CF45CACCE1EDA"><enum>(1)</enum><text>1,4 dioxane (CAS No. 14807–96–6) present at or above 2 parts per million (referred to in this paragraph as <quote>ppm</quote>).</text></paragraph> 
<paragraph id="H10103DBB2CFC462384E343DDF9AEB7D1"><enum>(2)</enum><text>Lead and lead compounds (CAS No. 7439–92–1) present at or above 2 ppm for color cosmetics or 5 ppm for general cosmetics.</text></paragraph> <paragraph id="H4CD5EED0019544A398047665DBB92D47"><enum>(3)</enum><text>Asbestos or asbestos containing compounds, including asbestos-contaminated talc (present at the lowest possible limit of detection).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H8351DD6251F3427A9CE8DA9C6D46BF85"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 604 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/364">21 U.S.C. 364</external-xref>) is amended—</text> <paragraph id="H2C87BEC694B04613914D09C1E0E93F4D"><enum>(1)</enum><text>by redesignating paragraphs (4) and (5) as paragraphs (11) and (12), respectively; and</text></paragraph> 
<paragraph id="H7DF9767B8C864AE0892A9E779F7505D4"><enum>(2)</enum><text>by inserting after paragraph (3) the following:</text> <quoted-block style="OLC" id="H1F2259F5776E4E69BB9DD6A4FC3C05EA" display-inline="no-display-inline"> <paragraph id="H8881A0C4857C46A093CE7E3596A711C6"><enum>(4)</enum><header>Color cosmetic</header><text display-inline="yes-display-inline">The term <term>color cosmetic</term> means a cosmetic that either enhances or conceals natural pigment of an individual’s skin by applying color, including eyeshadow, eyeliner, blush, lipstick, and foundation.</text></paragraph> 
<paragraph id="H9C29DB7A352C479DB61925EDCAFD5400"><enum>(5)</enum><header>Contaminant</header><text display-inline="yes-display-inline">The term <term>contaminant</term> means a chemical that was not intentionally added to a cosmetic and is incidental to the manufacturing process and serves no intended function in the finished cosmetic.</text></paragraph> <paragraph id="H29D071BC180C4EE08133D2EEAC04E1E7"><enum>(6)</enum><header>Formaldehyde-releasing preservative</header><text display-inline="yes-display-inline">The term <term>formaldehyde-releasing preservative</term> means a chemical that releases formaldehyde, to preserve the cosmetic.</text> </paragraph> 
<paragraph id="H25EC69F0D30648F490149598051634FE"><enum>(7)</enum><header>General cosmetic</header><text display-inline="yes-display-inline">The term <term>general cosmetic</term> means a cosmetic that is not primarily intended to provide color, including a product that cleanses, protects, moisturizes, provides fragrance, or enhances appearance without imparting color.</text></paragraph> <paragraph id="H919A6BC3B8214443B4162B38FDC007F0"><enum>(8)</enum><header>Ingredient</header><text display-inline="yes-display-inline">The term <term>ingredient</term> means any single chemical entity or mixture used as a component in the manufacture of a cosmetic.</text></paragraph> 
<paragraph id="HA78BB62E84CE44BEBCB7710A48555C41"><enum>(9)</enum><header>Intentionally added</header><text display-inline="yes-display-inline">The term <term>intentionally added</term> means, with respect to a cosmetic, the addition of a chemical to a cosmetic that serves an intended function in the cosmetic.</text></paragraph> <paragraph id="HD4E8D00FBD5142AAAA402A32A98DB7B6"><enum>(10)</enum><header>Ortho-phthalate</header><text display-inline="yes-display-inline">The term <term>ortho-phthalate</term> means any member of the class of organic chemicals that are esters of phthalic acid containing two carbon chains located in the ortho position.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>

        <enum>(c)</enum>
        <header>Non-Preemption</header>
 <text display-inline="yes-display-inline">Section 614(b) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/364j">21 U.S.C. 364j(b)</external-xref>) is amended to read as follows:</text>

            <enum>(b)</enum>
            <header>Limitations</header>
            <paragraph id="H15E4EAC8AC184C988920BAE58A9DC3F9">
              <enum>(1)</enum>
              <header>In general</header>
 <text display-inline="yes-display-inline">Notwithstanding subsection (a), nothing in this section shall be construed to prevent any State (or a political subdivision thereof) from—</text>
              <subparagraph id="H837F4C34A6CB4BD5AAAB83CC177B1019">
                <enum>(A)</enum>
 <text>prohibiting the use or limiting the amount of an ingredient in a cosmetic product;</text>
              </subparagraph>
              <subparagraph id="H987AA99DADDC4BD1BDC6B25BE68DEE91">
                <enum>(B)</enum>
 <text display-inline="yes-display-inline">continuing to implement a requirement of such State (or a political subdivision thereof) that is in effect at the time of enactment of the Modernization of Cosmetics Regulation Act of 2022 for the reporting to the State (or a political subdivision thereof) of an ingredient in a cosmetic product; or</text>
              </subparagraph>
              <subparagraph id="H3D4B4495DA5D43EFB2B7AB85B2CCDBEC">
                <enum>(C)</enum>
 <text display-inline="yes-display-inline">implementing a requirement of such State (or a political subdivision thereof) that prohibits or limits the use (or the amount of such use) of an ingredient or contaminant specified in paragraph (h), (i), or (j) of section 601 in a cosmetic product (or continuing to implement any such requirement that is in effect as of the date of the enactment of the <short-title>Toxic-Free Beauty Act of 2025</short-title>).</text>
              </subparagraph>
            </paragraph>
            <paragraph id="H2972F95F7B0C4453BD00EBB575127E5C">
              <enum>(2)</enum>
              <header>Modernization of Cosmetics Regulation Act of 2022</header>
 <text display-inline="yes-display-inline">Nothing in the amendments to this Act made by the Modernization of Cosmetics Regulation Act of 2022 shall be construed to preempt any State statute, public initiative, referendum, regulation, or other State action, except as expressly provided in subsection (a).</text>
            </paragraph>
          </subsection>

<subsection id="H8B6E518AF6334B2C8E468B77932A7889"><enum>(d)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply with respect to cosmetics introduced or delivered into introduction into interstate commerce beginning on January 1, 2027.</text></subsection></section> </legis-body></bill>
