which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of Agriculture to provide additional payments for producers that, in participating in the conservation stewardship program, agree to adopt or improve, manage, and maintain perennial production systems, and for other purposes.</official-title></form><legis-body id="HFB2122C6F23C44478860A001C41DA347" style="OLC"><section id="H0C54FE44C0F7435DA10C69EF59E160F2" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strong Farms, Strong Future Act</short-title></quote>.</text></section><section id="H30B455BAD46A4B15A725A3309DEA7A7E"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 1240I(2) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-21">16 U.S.C. 3839aa–21(2)</external-xref>) is amended—</text><paragraph id="H37F63FC1BB2044E4BDA510C440D6A8E7"><enum>(1)</enum><text>in subparagraph (A), by inserting <quote>enhancements,</quote> after <quote>practices,</quote>; and</text></paragraph><paragraph id="HEF794F15DFE0457A8508DA58DA4403C4"><enum>(2)</enum><text>in subparagraph (B)(v), by inserting <quote>climate change and</quote> after <quote>mitigate against,</quote>.</text></paragraph></section><section id="HF99C041404B04B01AC8F8BA3E30B298A" section-type="subsequent-section"><enum>3.</enum><header>Stewardship contracts</header><subsection id="H0DC551578CEA4711BD1EE25FC5D9B56C"><enum>(a)</enum><header>Evaluation of contract offers</header><text display-inline="yes-display-inline">Section 1240K(b)(1)(A) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-23">16 U.S.C. 3839aa–23(b)(1)(A)</external-xref>) is amended—</text><paragraph id="HE00D76B4C7144393A379181E3F4B4CB3"><enum>(1)</enum><text>in clause (ii), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph id="H8B2FC7CDA20F43F3857CAB4511FEC37B"><enum>(2)</enum><text>by redesignating clause (iii) as clause (iv); and</text></paragraph><paragraph id="HECA408E870974952900F173805F45B75"><enum>(3)</enum><text>by inserting after clause (ii) the following:</text><quoted-block style="OLC" id="H4BA79603C1D64FECAE5A566732E7D337" display-inline="no-display-inline"><clause id="H2A7ED4F2607A46E8B727EFE4520315DC"><enum>(iii)</enum><text display-inline="yes-display-inline">other criteria consistent with an equal weighting of the factors described in clauses (i) and (ii), as determined by the Secretary, including criteria the Secretary determines are necessary to ensure that—</text><subclause id="H7672B70959B0442F8FB9374115DE0E55"><enum>(I)</enum><text display-inline="yes-display-inline">the program effectively targets improvements to soil health, increases in carbon sequestration, and reductions in greenhouse gas emissions; and</text></subclause><subclause id="HAB8E51CE41C3448F811D336219F8B2F9"><enum>(II)</enum><text display-inline="yes-display-inline">other national, State, and local priority resource concerns are effectively addressed; and</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H6803869ECF9D49488FE7F3A89EAC3E35"><enum>(b)</enum><header>Contract renewal</header><text display-inline="yes-display-inline">Section 1240K(e) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-23">16 U.S.C. 3839aa–23(e)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="H62CC87BBC5584FABAB83D889A492A47F" display-inline="no-display-inline"><subsection id="HE81E01A6EEBA46E7AAE270B9AA1E9CBA"><enum>(e)</enum><header>Contract renewal</header><paragraph id="HC4D4F429982A46F2A73382D6669A373F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may provide the producer an opportunity to renew an existing contract in the first half of the fifth year of the contract period if the producer—</text><subparagraph id="H4A471042FC7049759B9FBC0004B27769"><enum>(A)</enum><text>demonstrates compliance with the terms of the existing contract;</text></subparagraph><subparagraph id="H8C10E4EAA73C4905B3EDDD0DF46FE25B"><enum>(B)</enum><text>agrees to adopt and continue to integrate new or improved conservation activities across the agricultural operation, demonstrating continued improvement during the additional 5-year period, as determined by the Secretary; and</text></subparagraph><subparagraph id="H62A4C9F0DB68474DB3BE925BDDD363B8"><enum>(C)</enum><text>agrees, by the end of the contract period, to meet the stewardship threshold of at least 1 additional priority resource concern on the agricultural operation, if applicable.</text></subparagraph></paragraph><paragraph id="H66FF2655E9DE4F7B805EA8C8141C1D2A"><enum>(2)</enum><header>Ranking and payments</header><text>In determining whether to renew an existing contract under paragraph (1), and in calculating payments for such existing contract, the Secretary shall consider the full conservation benefits across the entire agricultural operation on eligible land that is subject to such existing contract, including—</text><subparagraph id="HC464A3B617AD45E6B007B1799EE4E8F8"><enum>(A)</enum><text>the number of priority resource concerns for which the producer is expected to meet or exceed the stewardship threshold by the end of the contract period of the existing contract; and</text></subparagraph><subparagraph id="H6E65AB0C5D354E5D94F9F727C837D37A"><enum>(B)</enum><text>the active management and maintenance of ongoing conservation activities, including—</text><clause id="H3256B74E7BF84228992D36D07A26DF14"><enum>(i)</enum><text>the conservation activities adopted during the contract period of the existing contract; and</text></clause><clause id="H355E549871E04B0086B4A6989B0BA383"><enum>(ii)</enum><text>the new or improved conservation activities to be adopted if such existing contract is renewed.</text></clause></subparagraph></paragraph><paragraph id="H4F8FEE2AC4A8485884D3BD12CF0B06B9"><enum>(3)</enum><header>Perennial production systems</header><text>The Secretary may automatically renew an existing contract under paragraph (1) if—</text><subparagraph id="HAE999AEA25DA4441BEDE95B3A3A07FE1"><enum>(A)</enum><text>the conditions under paragraph (1) are met; and</text></subparagraph><subparagraph id="HC2CDE60FE7B943FB9D5025DD9AE3490E"><enum>(B)</enum><text>the producer installed or improved a perennial production system, as such term is defined in section 1240L(d)(1), during the contract period of the existing contract.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H9E872FE7AAC14101BD0FA8D748030B76"><enum>4.</enum><header>Duties of the Secretary</header><subsection id="H1554B35883CD47FDAE679E3E5F1C6B55"><enum>(a)</enum><header>Conservation stewardship payments</header><text display-inline="yes-display-inline">Section 1240L(c)(4) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-24">16 U.S.C. 3839aa–24(c)(4)</external-xref>) is amended—</text><paragraph id="HA7AE9951FBF94C149DADC1D9BC085065"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HC5A5FB3BFB4142759B4A126323626833"><enum>(2)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HC4A3F4031E544686B9FF392619EB6C63"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H96012BD027814D568411DBB12A54D436" display-inline="no-display-inline"><subparagraph id="HD24E3348CBE1432CAA0645D93883E5DE"><enum>(C)</enum><text display-inline="yes-display-inline">adjust planned annual payments to account for inflation associated with planning, design, materials, installation, labor, management, maintenance, or training incurred by the producer over the life of the contract.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H78B176EBB5C248DEB402E79A38A6F5B1" commented="no"><enum>(b)</enum><header>Supplemental payments for resource-Conserving crop rotations, perennial production systems, and advanced grazing management</header><text>Section 1240L(d) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-24">16 U.S.C. 3839aa–24(d)</external-xref>) is amended—</text><paragraph id="HEF3E83A343594E3A9A29EB3C161FE565" commented="no"><enum>(1)</enum><text>in the subsection heading, by inserting <quote><header-in-text level="subsection" style="OLC">, perennial production systems</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">resource-conserving crop rotations</header-in-text></quote>;</text></paragraph><paragraph id="HAACB21D3614E46A2B8FA51A72B51D392" commented="no"><enum>(2)</enum><text>in paragraph (1), by adding at the end the following:</text><quoted-block style="OLC" id="H17AB818DB0B14C3B9F3585006377EED9" display-inline="no-display-inline"><subparagraph id="H2102FE7A402E412288104186FA729F6C" commented="no"><enum>(D)</enum><header>Perennial production system</header><text display-inline="yes-display-inline">The term <term>perennial production system</term> means a system of agricultural production that produces perennial species (including agroforestry products, perennial grains and oilseeds, perennial forages, and other perennial crops, as determined by the Secretary), including alley cropping, multifunctional riparian buffers, windbreaks, shelterbelts, forest farming, silvopasture, and other related practices, as determined by the Secretary.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HFA3502B6A844477788B5537B342D9F92" commented="no"><enum>(3)</enum><text>in paragraph (2)—</text><subparagraph id="H071589B68879414CB98B6827DB429666" commented="no"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="HE399D78787EF447DA6FB6FF7F496D444" commented="no"><enum>(B)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="H4ACD46C33C0947478A87EFA9FDB90DAD" commented="no"><enum>(C)</enum><text>by inserting after subparagraph (B) the following:</text><quoted-block style="OLC" id="H36E0EE0A0A6F43EB963D491F6A69E357" display-inline="no-display-inline"><subparagraph id="HCAE740BD4CB9433F902CBEF1F9AD684E" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">a perennial production system.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HABB9791A293B492D8D593CB92C9BF12C" commented="no"><enum>(4)</enum><text>in paragraph (3), by striking <quote>or advanced grazing management</quote> and inserting <quote>, advanced grazing management, or a perennial production system</quote>.</text></paragraph></subsection><subsection id="H28A4C1E061FA47EC87D2B55D4CECE4CF"><enum>(c)</enum><header>Establishment of climate change mitigation bundles</header><text display-inline="yes-display-inline">Section 1240L of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-24">16 U.S.C. 3839aa–24</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H14B9D5D08F4C4D30BFB4D89D1F0BC8C7" display-inline="no-display-inline"><subsection id="H160AC115C40A4369BAF1F520A0594ED4" commented="no"><enum>(m)</enum><header>Establishment of climate change mitigation bundles</header><paragraph id="H0A45A4C40FDA447AB0A860E2382483DC" commented="no"><enum>(1)</enum><header>Climate change mitigation bundle defined</header><text>In this subsection, the term <term>climate change mitigation bundle</term> means a grouping of conservation activities, determined by the Secretary and based on the best available science, to achieve substantial progress, when carried out together, toward—</text><subparagraph id="H3279D841335C4A1B96044F75CBB9DC7C" commented="no"><enum>(A)</enum><text>providing a net reduction of greenhouse gas emissions; or</text></subparagraph><subparagraph id="HAEFC3EE6FBFB43A6A7D099D7140FDF81" commented="no"><enum>(B)</enum><text>increasing carbon sequestration and improving soil health.</text></subparagraph></paragraph><paragraph id="HACC1F9063EAB4A36B2513B3F177903CD" commented="no"><enum>(2)</enum><header>Availability</header><text>In entering into a contract with a producer under the program, the Secretary shall make available State- or region-specific climate change mitigation bundles to such a producer, including climate change mitigation bundles for cropland, pastureland, rangeland, and forest land.</text></paragraph><paragraph id="H6480FE1133CF4B38BD88BC5AB2775818" commented="no"><enum>(3)</enum><header>Flexibility</header><text>The Secretary shall, to the maximum extent practicable, design climate change mitigation bundles that allow a producer to select conservation activities that meet the requirements of paragraph (1)(A) in order to tailor a climate change mitigation bundle to the site-specific needs of such a producer.</text></paragraph><paragraph id="H0A2953F63D9C405A83C65502FB3DB296" commented="no"><enum>(4)</enum><header>Minimum bundles offered</header><text>The Secretary shall make available at least 1 climate change mitigation bundle for each of the following:</text><subparagraph id="HD9CF8FAE7E9A4F708A60AAF32370C916" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">Perennial production systems, as defined in subsection (d)(1).</text></subparagraph><subparagraph id="HDEBFCBE415AD483194E0A31B8B61825F" commented="no"><enum>(B)</enum><text>Soil health management systems, as defined in such subsection.</text></subparagraph><subparagraph id="H8C6D05F9E02645BF9B53CBB3DBDEF169" commented="no"><enum>(C)</enum><text>Advanced grazing management, as defined in such subsection.</text></subparagraph><subparagraph id="H483010B985CA485AAB5633CA97D0B98C" commented="no"><enum>(D)</enum><text>Specialty crops.</text></subparagraph></paragraph><paragraph id="H639EF6EA1F4F40BEA781FD8C77898CBC" commented="no"><enum>(5)</enum><header>Applicability to organic production</header><text>Climate change mitigation bundles made available under paragraph (2) shall be equally accessible to organic and conventional producers, or separate additional bundles designed for organic producers shall be offered.</text></paragraph><paragraph id="H3CF9DF6B696F40B49A747532F9F27F99" commented="no"><enum>(6)</enum><header>Promotion</header><text>Each year, to the greatest extent practicable, the Secretary shall conduct targeted outreach and promotion regarding the availability of, and any changes to, climate change mitigation bundles to eligible producers.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA13D270CD54F4F8D8155597A0AD5D008" commented="no"><enum>(d)</enum><header>Report</header><paragraph id="H405BAD3825E740E6AB692C3B1D978100" commented="no"><enum>(1)</enum><header>General</header><text>Not later than 2 years after the date on which the Secretary of Agriculture makes available to producers the climate change mitigation bundles under section 1240L(m) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-24">16 U.S.C. 3839aa–24</external-xref>) (as added by subsection (c)), the Secretary shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report on the activities carried out under such section.</text></paragraph><paragraph id="H847EC1BBFDEA43E4BBD21BF06D07CC41" commented="no"><enum>(2)</enum><header>Contents</header><text>The Secretary shall include in the report under paragraph (1)—</text><subparagraph id="HD87D0364E8BD4FE485E1FE7C0E56DE01" commented="no"><enum>(A)</enum><text>a summary of feedback from producers that have adopted climate change mitigation bundles pursuant to section 1240L(m), regarding—</text><clause id="HB4E8CEEB5C674060B96D3290EDE4464A" commented="no"><enum>(i)</enum><text>barriers to adoption of such bundles;</text></clause><clause id="H3654BB13ED104656A31C90D1EE062CF9" commented="no"><enum>(ii)</enum><text>the makeup of such bundles;</text></clause><clause id="H693B7F22C9AE4B4EA432F50F489D69C6" commented="no"><enum>(iii)</enum><text>payment rates for such bundles;</text></clause><clause id="H51C890449E684DE98EE5DB0F78636336" commented="no"><enum>(iv)</enum><text>technical assistance relating to such bundles; and</text></clause><clause id="H8FC06F48004647E4B9DED1E3EB3DF514" commented="no"><enum>(v)</enum><text>other relevant information, as determined by the Secretary;</text></clause></subparagraph><subparagraph id="H6C884222375B4551877AC17BD4E8F842" commented="no"><enum>(B)</enum><text>data on such producers disaggregated by gender, race, age, and congressional district;</text></subparagraph><subparagraph id="H111B360486F04CD8BB25DD81327B4F49" commented="no"><enum>(C)</enum><text>an assessment of barriers, as identified by the Secretary, to the adoption of climate change mitigation bundles by producers;</text></subparagraph><subparagraph id="H42C1CEFC299845E68213C1DEEAC91F76" commented="no"><enum>(D)</enum><text>recommendations on steps to increase the adoption of climate change mitigation bundles by producers, including recommendations for any statutory changes necessary to implement such steps;</text></subparagraph><subparagraph id="HE9435199D54C4EF2AD8FB1BF4514CCF8" commented="no"><enum>(E)</enum><text>average per acre estimates of greenhouse gases mitigated and carbon sequestered for each climate change mitigation bundle offered; and</text></subparagraph><subparagraph id="H72DEDA9E54E34463A271547F8488CEBA" commented="no"><enum>(F)</enum><text>a summary of the outreach and promotional activities conducted by the Secretary to promote the availability of climate change mitigation bundles.</text></subparagraph></paragraph><paragraph id="HAE7AC17172594DE79D9BBB430A6DC340" commented="no"><enum>(3)</enum><header>Climate change mitigation bundle defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>climate change mitigation bundle</term> has the meaning given such term in section 1240L(m)(1) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-24">16 U.S.C. 3839aa–24</external-xref>) (as added by subsection (c)).</text></paragraph></subsection></section></legis-body></bill>
