which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Administrator of the Federal Emergency Management Agency to conduct a study to evaluate the effectiveness, long-term cost savings, and strategic impact of Federal Emergency Management Agency-funded hazard mitigation activities across the United States, and for other purposes.</official-title></form><legis-body id="H6B6BEADD6F704B4A8671BF66A80B7905" style="OLC"><section id="HA5AFB49310BF49DB91F46162EA617654" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Studying Mitigation And Reporting Transparently Act</short-title></quote> or the <quote><short-title>SMART Act</short-title></quote>.</text></section><section id="H3BD7B5443FE34E60B7B9E0F353A91812"><enum>2.</enum><header>Study and report on mitigation benefits</header><subsection id="HACCA89E8BFC143D1BAAAA7167A69E5C0"><enum>(a)</enum><header>In general</header><text>The Administrator of the Federal Emergency Management Agency shall conduct a comprehensive study to evaluate the effectiveness, long-term cost savings, and strategic impact of Federal Emergency Management Agency-funded hazard mitigation activities across the United States.</text></subsection><subsection id="H98C71B22D2844086ABE2232907B05284"><enum>(b)</enum><header>Objectives</header><text>In conducting the study required under subsection (a), the Administrator shall assess how the mitigation programs of the Federal Emergency Management Agency—</text><paragraph id="H89C49A10690C4DF2AC402556DDD75BEC"><enum>(1)</enum><text>reduce Federal and non-Federal expenditures for disaster response and recovery;</text></paragraph><paragraph id="H5223093E023646D7BF34B45CD1A71B5F"><enum>(2)</enum><text>enhance community preparedness for natural hazards;</text></paragraph><paragraph id="HD534728862DF40EEB6FB05B657546C4D"><enum>(3)</enum><text>improve the availability and affordability of hazard-related insurance;</text></paragraph><paragraph id="HA02A895358054B6B99663A206F563DDD"><enum>(4)</enum><text>support continuity of operations for critical services and infrastructure; and</text></paragraph><paragraph id="HC3B6BBA8EB3A495EAFA811F067645CA9"><enum>(5)</enum><text>generate long-term cost savings and measurable returns on investment.</text></paragraph></subsection><subsection id="H65B8B3BA60EC41BFAD41F433E262271B"><enum>(c)</enum><header>Methodology</header><text>The study under subsection (a) shall include—</text><paragraph id="HB5156C1C727841F188CAD52D3380D80C"><enum>(1)</enum><text>quantitative and qualitative analysis of avoided losses;</text></paragraph><paragraph id="HDE2A1A03FE7C4C17966E27FA21D0DA08"><enum>(2)</enum><text>evaluations of the effect of hazard mitigation on community-level risk ratings, actuarial assessments, and insurance penetration;</text></paragraph><paragraph id="H8C58A87A25294130A800ADD10883A80C"><enum>(3)</enum><text>case studies from diverse geographic regions and hazard types; and</text></paragraph><paragraph id="H87354B034FB34BC8B4AF978FB4D95DD1"><enum>(4)</enum><text>examinations of the role of mitigation activities in reducing Federal disaster response and recovery costs.</text></paragraph></subsection><subsection id="H96257262F7FC42C29D936AA30E5199B9"><enum>(d)</enum><header>Data sources</header><text>In carrying out the study under subsection (a), the Administrator shall use data from—</text><paragraph id="H8D41A13A742348CE92E17E164B27E5DD"><enum>(1)</enum><text>Federal, State, local, and Tribal agencies;</text></paragraph><paragraph id="H9B758F39E13F49989A9C980737E8F63C"><enum>(2)</enum><text>independent third-party assessments and academic studies; and</text></paragraph><paragraph id="HC0E942787C074FC78E905658F07488B3"><enum>(3)</enum><text>internal program evaluations and disaster recovery records.</text></paragraph></subsection><subsection id="HFBD0FBA15C5A437799D6AF9B2A04EAA8"><enum>(e)</enum><header>Consultation</header><text>In conducting the study under subsection (a), the Administrator may consult with—</text><paragraph id="H81FC503A922A4988B43D402BC4A50778"><enum>(1)</enum><text>the Government Accountability Office;</text></paragraph><paragraph id="H1ADA990194034B46A8B52899AAF62D50"><enum>(2)</enum><text>the National Institute of Standards and Technology;</text></paragraph><paragraph id="H37E1C4DBB7084D6297F404EE17BF5F95"><enum>(3)</enum><text>State, local, Tribal, and territorial governments; and</text></paragraph><paragraph id="H5FBCF900BDE949CA99463B14CB17947E"><enum>(4)</enum><text>relevant academic and research institutions.</text></paragraph></subsection><subsection id="HFF372F08F49D4405844F960730E55E77"><enum>(f)</enum><header>Report to Congress</header><text>Not later than 18 months after the date of enactment of this Act and annually thereafter, the Administrator shall submit to the Committee on Transportation and Infrastructure and the Committee on Appropriations of the House of Representatives and the Committee on Homeland Security and Governmental Affairs and the Committee on Appropriations of the Senate a report detailing—</text><paragraph id="H9276A02B083344EA8A4CBF91B2DE0AE0"><enum>(1)</enum><text>the findings of the study;</text></paragraph><paragraph id="H1DE205C849D644CE9B959F1E6561E649"><enum>(2)</enum><text>recommendations for improving program design, targeting, and oversight; and</text></paragraph><paragraph id="HFCBFCECDB6E84405B7E6686E602F7775"><enum>(3)</enum><text>recommendations for legislative and administrative actions.</text></paragraph></subsection></section><section id="HB378D4EF62214A0EA78C078C76E1F088"><enum>3.</enum><header>Public availability and ongoing review</header><subsection id="H405C1186222B44CE9D500F9BABD3B5A8"><enum>(a)</enum><header>Public access</header><text>Not later than 2 years after the date of enactment of this Act, the Administrator shall make the results of the initial study required under section 2 publicly available in a searchable, user-friendly format on the website of the Federal Emergency Management Agency.</text></subsection><subsection id="H5D08A42DECBA473CA8D319D8961B31BC"><enum>(b)</enum><header>Contents</header><text>The published data under subsection (a) shall include—</text><paragraph id="H0AEADCAE52704EDEAB284F8029830B83"><enum>(1)</enum><text>summarized findings and datasets, excluding any information that would compromise national security or privacy;</text></paragraph><paragraph id="H068734BDC9C74507999782BDD5E14066"><enum>(2)</enum><text>visualizations and geographic mappings of mitigation outcomes; and</text></paragraph><paragraph id="H480D6E9C29174929B0EBE80321F84F52"><enum>(3)</enum><text>clear explanations of methodology, data sources, and limitations.</text></paragraph></subsection><subsection id="H44762416437E4CF2A10E129505CA8D4E"><enum>(c)</enum><header>Annual updates</header><text>The Administrator shall conduct the study described in section 2 on an annual basis, incorporating the most recent available data, updates to methodology, and stakeholder feedback.</text></subsection><subsection id="H0EC31712B36C4AAF9C269E9485E393ED"><enum>(d)</enum><header>Availability</header><text>Each annual report under section 2(e) shall be made publicly available on the website of the Federal Emergency Management Agency not later than 60 days after the submission of such report to Congress.</text></subsection></section></legis-body></bill>
