<section id="H38C423A2DFBA4217992CEEDC6808E655" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hookah Clarification Act of 2025</short-title></quote>.</text></section>
<section id="HE93ACDF6178342A785C092892C985E72"><enum>2.</enum><header>Waterpipe tobacco tax</header> 
<subsection id="HE05A31FCF1544CB69A7E43A80F369F04"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/5701">Section 5701(f)</external-xref> of the Internal Revenue Code of 1986 is amended to read as follows:</text> <quoted-block id="HFA989EB871494C40A6F93522E3BA4B66" style="OLC"> <subsection id="H44C485F9E278443CB696142AC4A8070F"><enum>(f)</enum><header>Pipe tobacco</header> <paragraph id="H94DED953E8B54ACEB1ADADF664177959"><enum>(1)</enum><header>In general</header><text>On pipe tobacco, manufactured in or imported into the United States, which is not waterpipe tobacco, there shall be imposed a tax of $2.8311 per pound (and a proportionate tax at the like rate on all fractional parts of a pound).</text></paragraph> 
<paragraph id="H60EF21FBF2EC4D78BB993E477A0C758E"><enum>(2)</enum><header>Waterpipe tobacco</header><text>On waterpipe tobacco, manufactured in or imported into the United States, there shall be imposed a tax of $0.5662 per pound and (a proportionate tax at the like rate on all fractional parts of a pound).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H8DC1B6C610A84944A5C647D8E5F2B7DE"><enum>(b)</enum><header>Conforming amendments</header><text>Section 5702 of such Code is amended by adding at the end the following new subsections:</text>

<subsection id="H124A95A95A7E4E6496F7D7B816AC0F00"><enum>(q)</enum><header>Waterpipe tobacco</header><text>The term <quote>waterpipe tobacco</quote> means a tobacco product consumed or intended to be consumed in a waterpipe, including hookah tobacco, shisha, maassel, narghile, and argileh.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HDAE0C03A3C76439E9C67EC807C3904BC"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to tobacco manufactured or imported after the date of the enactment of this Act.</text></subsection></section>
