which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 49, United States Code, to authorize state of good repair grants to be used for public transportation resilience improvement, and for other purposes.</official-title></form><legis-body id="HDCA7EFDA9506419CA79306DAB9672576" style="OLC"><section section-type="section-one" id="H8ADF61C0567146E9BEF7A39DB22DCE74"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Resilient Transit Act of 2025</short-title></quote>.</text></section><section id="HBC074D4C369B47AD9015147789062A60"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 5302 of title 49, United States Code, is amended—</text><paragraph id="HFD6F08EB4E4842048354089921360CF7"><enum>(1)</enum><text>by redesignating paragraphs (17) through (25) as paragraphs (18) through (26), respectively; and</text></paragraph><paragraph id="H4E36C124BDCB471381ACF7433DC36F89"><enum>(2)</enum><text>by inserting after paragraph (16) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3E3D1568CD034EE7B686F59425B467DA"><paragraph id="HE1F7E74CA7974850B83BA062677184AF"><enum>(17)</enum><header>Resilience improvement</header><text>The term <term>resilience improvement</term> has the meaning given the term in section 176(a) of title 23.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H3745C744BCFB4076AE134A7659CE62CB"><enum>3.</enum><header>State of good repair grants for public transportation resilience improvement</header><subsection id="H2988E3837AC24A02B6B82B0216476047"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 5337 of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H946C091BE7684A67BCDE1FFD939F5340"><subsection id="H7B08829E52C6443AB1D81A202736214C"><enum>(g)</enum><header>Public transportation resilience improvement grants</header><paragraph commented="no" display-inline="no-display-inline" id="H2CBEBB5DC7E845ECAF6C9E9B462D9819"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><subparagraph id="H0DE044965C244FDEBAFBE5ADF8DB26EC"><enum>(A)</enum><header>Environmental justice community</header><text>The term <term>environmental justice community</term> means a community with significant representation of communities of color, low-income communities, or Tribal and indigenous communities, that experiences or is at risk of experiencing higher or more adverse human health or environmental effects.</text></subparagraph><subparagraph id="H8C2938D3953C4DBD93B78B5F96E8C4E9"><enum>(B)</enum><header>EJSCREEN</header><text>The term <term>EJSCREEN</term> means the environmental justice mapping and screening tool created by the Environmental Protection Agency.</text></subparagraph><subparagraph id="H07E129161A754303873C652F128E7EFB"><enum>(C)</enum><header>EJ Index</header><text>The term <term>EJ Index</term> means the Environmental Justice Indexes in EJSCREEN.</text></subparagraph><subparagraph id="H749DAADACBD04ECAB00DC4BC622315CD"><enum>(D)</enum><header>Medically underserved community</header><text>The term <term>medically underserved community</term> has the meaning given the term in section 799B of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/295p">42 U.S.C. 295p</external-xref>).</text></subparagraph><subparagraph id="H712B2A491A1D4A16B6EFB102B0DA826D"><enum>(E)</enum><header>Underserved community</header><text>The term <term>underserved community</term> means—</text><clause id="HB3A8DC62BABB457DB9F54FF0B5702AD3"><enum>(i)</enum><text>a community located within a ZIP Code or census tract that is identified by the Secretary as—</text><subclause id="H9C5369FBD11D4CAF82E95486CD5A1E23"><enum>(I)</enum><text>a low-income community;</text></subclause><subclause id="H564AC53257384FF6BEA052A13895DB18"><enum>(II)</enum><text>a community of color; or</text></subclause><subclause id="HA1EE7422E8E840ACBF5499EAC9435EA9"><enum>(III)</enum><text>a Tribal community; or</text></subclause></clause><clause id="H3A60436B5E174FA1B0E77F295247AE0A"><enum>(ii)</enum><text>any other community that the Secretary determines is disproportionately vulnerable to, or bares a disproportionate burden of, any combination of economic, social, environmental, or climate stressors.</text></clause></subparagraph></paragraph><paragraph id="H2825513243A84078B3616F9F1C453498"><enum>(2)</enum><header>Grants</header><text>The Secretary may make grants under this subsection to assist State and local government authorities in financing 1 or more eligible activities described in paragraph (3).</text></paragraph><paragraph id="H97A9F122A8A04E8F882CAA7084F7A1B6"><enum>(3)</enum><header>Eligible activities</header><subparagraph id="H3FC162D2DBCC48F69A3FE82BE5DF5082"><enum>(A)</enum><header>In general</header><text>A recipient of a grant under this subsection may use grant amounts for public transportation resilience improvements that increase the resilience of public transportation systems from the impacts of climate change, such as sea level rise, flooding, wildfires, extreme weather events, and other natural disasters.</text></subparagraph><subparagraph id="HED07EB685A104438A6153A6BB2DDBF87"><enum>(B)</enum><header>Inclusions</header><text>Activities eligible to be carried out using grant amounts under this subsection include—</text><clause id="H5CF52961CF7B429D9334571903230BA6"><enum>(i)</enum><text>the installation of mitigation measures that prevent the intrusion of floodwaters;</text></clause><clause id="H6FA97D5C0A82443C9B0CBB27FE4F6549"><enum>(ii)</enum><text>the installation of equipment to detect the occurrence of a flood event;</text></clause><clause id="H6A856EE3C3D14046B587E60F7A75F53F"><enum>(iii)</enum><text>the replacement of equipment or facilities that are currently prone to flood events or will be in the future;</text></clause><clause id="H49A712388C954EA6AB8D3F9EEC928FA1"><enum>(iv)</enum><text>the purchase of new equipment to support regular maintenance of drainage and pumping infrastructure;</text></clause><clause id="HF7FCC812B14245F98D9B7C44EA28A76C"><enum>(v)</enum><text>the replacement of equipment stressed during extreme temperature events;</text></clause><clause id="H8D1386AF91884DB1AF13B4C0253FB7CA"><enum>(vi)</enum><text>the installation of equipment to regulate temperatures and sensors to monitor extreme temperatures;</text></clause><clause id="HC78723E0B19141DEB226518FCD3D8FC5"><enum>(vii)</enum><text>the development of backup systems to provide redundancy during the outage of a primary power source;</text></clause><clause id="H39A2726D575048D8964570D77123FBFD"><enum>(viii)</enum><text>the assessment of system vulnerabilities to current and future weather events, natural disasters, and climate change, including sea level rise;</text></clause><clause id="HB7477AE0345A4F51B2A10C45AA0C3FE4"><enum>(ix)</enum><text>the planning of system improvements and emergency response strategies to address identified vulnerabilities; and</text></clause><clause id="H6098E6CA948144E4A5CA204563B9E0B2"><enum>(x)</enum><text>any other activity for resilience improvement, as determined by the Secretary.</text></clause></subparagraph></paragraph><paragraph id="HC98C77251D134637B71A280E4B203C1F"><enum>(4)</enum><header>Types of projects</header><text>Grants under this subsection may be used to finance—</text><subparagraph id="H810B1C193E3E4C2DBE10F1C7B6BDF928"><enum>(A)</enum><text>standalone projects; and</text></subparagraph><subparagraph id="H8AEA9BCD45534D3A945FFC8AB72A46CB"><enum>(B)</enum><text>components of projects carried out under subsection (b)(1).</text></subparagraph></paragraph><paragraph commented="no" id="H9087ABEA50894D61AEB72BE28011FC6E"><enum>(5)</enum><header>Public transportation resilience improvement formula</header><text>Of the amounts made available under section 5338(a)(2)(L) to carry out this subsection—</text><subparagraph commented="no" id="H4F46C09CE23B49EC904649EDBCA39FF7"><enum>(A)</enum><text>97.15 percent shall be apportioned to recipients in accordance with subsection (c); and</text></subparagraph><subparagraph commented="no" id="H155C0352A5A04EE2817B6B70F90F7B40"><enum>(B)</enum><text>2.85 percent shall be apportioned to recipients in accordance with subsection (d).</text></subparagraph></paragraph><paragraph id="HE10D3D875B5D4B52BDA8A82C3674A5FC"><enum>(6)</enum><header>Annual reports to Congress</header><text>Not later than 1 year after the date of enactment of this subsection, and annually thereafter, the Secretary shall submit to the Committee on Banking, Housing, and Urban Affairs of the Senate, the Committee on Appropriations of the Senate, the Committee on Transportation and Infrastructure of the House of Representatives, and the Committee on Appropriations of the House of Representatives, and publish on the website of the Department of Transportation, a report that describes the implementation of this subsection during the preceding calendar year, including—</text><subparagraph id="H02761E0FB0CF498BBB8CBBE102F41DDF"><enum>(A)</enum><text>a detailed description of the activities carried out under the grants provided under this subsection;</text></subparagraph><subparagraph id="HB6D723FEA7E643A6A6C33E47953662E1"><enum>(B)</enum><text>a summary of each project financed in whole or in part by a grant provided under this subsection that benefits or is located in—</text><clause id="HA2A1C1AED5BD4F91992E3039A5E0D2DA"><enum>(i)</enum><text>a neighborhood with poverty and unemployment rates that exceed the average in the United States;</text></clause><clause id="HDF8E6D86B7914AB3B22022ED36B9E301"><enum>(ii)</enum><text>a neighborhood where 30 percent or more of households receive benefits under—</text><subclause id="HE16DCEFE869041CFA23A73D7387E316F"><enum>(I)</enum><text>the supplemental nutrition assistance program under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/7011">7 U.S.C. 7011 et seq.</external-xref>); or</text></subclause><subclause id="H4143943B7F594944B2FB6F556FE61E17"><enum>(II)</enum><text>a mandatory spending program of the Federal Government for which, as determined by the Secretary, eligibility for the program’s benefits, or the amount of such benefits, is determined on the basis of income or resources of the individual or family seeking the benefit;</text></subclause></clause><clause id="HCB2D478F54EB4FF5AAA01B86D88BC44E"><enum>(iii)</enum><text>an underserved community or a medically underserved community;</text></clause><clause id="HF62833C1ED0549C583E1C9408B41B2B5"><enum>(iv)</enum><text>an EPA region where the EJ Index is above the national average, as determined by EJSCREEN; or</text></clause><clause id="HCE83E82C181348D1AF219C3D16221926"><enum>(v)</enum><text>an environmental justice community, as documented by federally recognized environmental justice mapping and equity screening tools; and</text></clause></subparagraph><subparagraph id="HD376173C057A479C9A28253D98055967"><enum>(C)</enum><text>recommendations to improve the administration of this subsection.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF202A19D083C42B3A168CFDD487A6A41"><enum>(b)</enum><header>Conforming amendments</header><text>Section 5337 of title 49, United States Code, is amended by striking <quote>section 5338(a)(2)(K)</quote> each place it appears and inserting <quote>section 5338(a)(2)(L)</quote>.</text></subsection></section><section id="H6F67462A667C4466A3B98F603D569DA7"><enum>4.</enum><header>Authorizations</header><text display-inline="no-display-inline">Section 5338(a) of title 49, United States Code, is amended—</text><paragraph id="H3A5FBDCF479D4BECB718C8031CFEA3C7"><enum>(1)</enum><text>in paragraph (1)(E), by striking <quote>$14,642,000,000</quote> and inserting <quote>$14,942,000,000</quote>; and</text></paragraph><paragraph id="H46918784063D40A3A0DE7F406F5125D8"><enum>(2)</enum><text>in paragraph (2)(L)—</text><subparagraph id="HBB879614E62D49E388E2E4BF5EC0F4E9"><enum>(A)</enum><text>by striking <quote>$3,850,496,668</quote> and inserting <quote>$4,150,496,668</quote>; and</text></subparagraph><subparagraph id="HE5C48BBB986A4A30859785F9A1B285DA"><enum>(B)</enum><text>by inserting <quote>and $300,000,000 for fiscal year 2026 shall be available to carry out section 5337(g)</quote> after <quote>section 5337(f)</quote>.</text></subparagraph></paragraph></section></legis-body></bill>
